The Pledge of Allegiance was led by Councilman Turner. -000- Mayor Meyers issued the following proclamation : Telephone Company "Pioneers Day in Beaumont" - November 2 , 1980. -000- The Consent Agenda was considered : Approval of the minutes of the regular City Council session held Octo- ber 21 , 1980; Resolution 80-373 granting a permit to Mobil Oil Corporation for the construction of an 811 ethylene pipeline across Frint Drive , Sulphur Drive and a strip of unimproved street right-of-way in the same vicinity ; Resolution 80-374 authorizing the execution of a contract with A.M. In- ternational , Inc . for one-year maintenance of the print Shop copy system at a cost of $3 , 778. 90; Resolution 80-375 granting a 10-foot easement to Gulf States Utilities Company for underground electric service lines on Pine Street Park; Resolution 80-376 authorizing purchase of a copying machine from A. B. Dick Company for Tyrrell Historical Library at a cost of $1 ,667 . 60; Resolution 80-377 appointing Bessie Zecher to the Senior Citizens Advisory Commission for one-year term; Resolution 80-378 authorizing the release of $1 , 540, 000 in .securities pledged as collateral for City deposits in the American National Bank and accepting the pledge of $500, 000 in other securities (total pledged $34 , 305, 000) ; Resolution 80-379 authorizing purchase of fingerprint filing guide cards for the Police Identification Bureau from Law Enforcement Equipment Com- pany at $1 ,482. 00; and Resolution 80-380 authorizing purchase of 250, 000 water bill forms from the Rein Company at $1 ,422 . 50. The Consent Agenda was approved on a motion made by Councilman Combs and seconded by Councilman Turner. Bigner Survey at 4310 Singleton Road (requested by Bell Telephone Company) was considered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS AND IN PARTICULAR THE BOUNDARIES OF THE ZO"dING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 1 . 1 ACRE TRACT OUT OF THE F. BIGNER SURVEY, BEAUMONT, JEFFER- SON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED , PRESENTLY ZONED R-1 TO LR-1 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. The ordinance was denied on a motion made by Councilman Williams and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Ordinance No. 80-102 changing the zoning from R-3 and C-1 to I-2 for 15. 56 acres located generally at 5250 College (requested by Southern Iron and Metal Company) was considered : ORDINANCE NO. 80-102 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINAICES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 7 . 38 ACRE TRACT OUT OF THE CHARLES WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED PRESENTLY ZONED R-3 TO I-2 : BY CHANGING AN 8 . 1 ACRE TRACT OUT OF THE CHARLES WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED C-1 TO 1-2 ; PROVIDING FOR SEVERARILITY; AND PROVIDING A PENALTY. Councilman Williams made a motion to table the ordinance ; motion died for lack of second. Councilman Combs made a motion to approve the ordinance; motion was se- conded by Councilman Turner. Question : Ayes : Mayor Meyers Nayes : Councilman Lord Councilman Combs Councilman Williams Councilman Turner -000- Ordinance No. 80-103 changing the zoning from R-1 to C-2 for 0.672 of an acre tract 110 feet south line of West Highland and the Usan Street Ditch was considered: ORDINANCE NO. 80-103 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 0.672 ACRE TRACT OUT OF THE J. W. BULLOCK SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREIN- AFTER DESCRIBED, PRESENTLY ZONED R-1 TO C-2 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Turner and se- conded by Councilman Lord. Question : Ayes : All Nayes: None -199- October 28 , 1980 E An ordinance changing the zoning from R-lA to R-1 , from R-1A to R-2 , and from R-2 and C-1 to C-2 for property at the following location : beginning 340 feet west of Pine Glen Addition and extending generally west to Keith Road, south for a distance 0. 58 of a mile or 3069. 5 feet southeast of the LNVA Canal and a tract measuring 669.45 feet by 2106 feet on the south- West corner of Tolivar Road and Walker Road (FM 3120) having its princi- pal frontage on Walker Road was considered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 17. 11 ACRE TRACT OUT OF THE D. EASLEY LEAGUE , BEAUMONT, JEFFERSON COUNTY, TEXAS, HEREINAFTER DESCRIBED , PRESENTLY ZONED R-1A TO R-1 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. A motion to table this ordinance was made by Councilman Combs ; motion was seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Ordinance No. 80-104 abandoning a 10-foot utility easement in Lot 1 , Block 8, Delaware Place, Section II (requested by Bill Little for con- struction of a swimming pool) was considered : ORDINANCE NO. 80-104 ENTITLED AN ORDINANCE ABANDONING A 10-FOOT UTILITY EASEMENT IN DELAWARE PLACE , SECTION II ADDITION, TO THE CITY OF BEAUMONT , JEFFER- SON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED. The ordinance was approved on a motion grade by Councilman Combs and se- conded by Councilman Lord. Question : Ayes : All Nayes : None -000- Ordinance No . 80-105 abandoning a 20-foot drainage easement in the 500 Block of Langham and on the northwest corner of the intersection of Langham Road and the Southern Pacific Railroad right-of-way was consid- ered: ORDINANCE NO. 80-105 ENTITLED AN ORDINANCE ABANDONING A 20-FOOT DRAINAGE EASEMENT IN THE T. H. LANGHAM ESTATE SUBDIVISION, TO THE CITY OF BEAUMONT, JEFFER- SON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED. The ordinance was approved on a motion made by Councilman Combs and se- conded by Councilman Turner . (question : Ayes : All Nayes : None -000- Resolution 80-381 accepting the bid of Hagan Fence Company for erection of 830' of 6-foot chain link fence at the Wiess Bluff Pumping Station site at a cost of $5,374 . 00 was approved on a motion made by Councilman Combs and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- -200- October 28 , 1980 Resolution 80-382 authorizing a contract with Fittz, Shipman and Asso- ciates , Inc . to provide engineering services for the Dowlen Road (Cal- der to College) T. I .P. Project at a fee not to $360,000 was approved on a motion made by Councilman Combs and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Resolution 80-383 authorizing a contract with Garrod and Associates to provide engineering services for the Sarah Street (4th to 11th) T. I .P. Project at a maximum' fee ' of $140, 000 was approved on a motion made by Councilman Turner and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Resolution 80-384 authorizing the City Manager to submit an application for grant assistance under the Urban Park and Recreation Recovery Pro- gram (federal grant - improvements planned for four (4) City parks -- Central Park for rehabilitation of the Community Center and Play areas and landscaping at an estimated $180, 000; Cottonwood Park for renova- tion of the hard-surfaced play areas, landscaping improvements at an estimated $42 ,500. 00; Liberia Park for replacement of the wading pool , renovation of the playground with landscaping improvements at an esti- mated cost of $102, 500. 00; and Roberts Park for renovation of the play- ground areas to include playground equipment and landscaping improvements at an estimated cost of $32 , 500. 00. The total project amount is $357 ,500 with Urban Park funds of $250, 250; State of $71 , 500 and City of $35 , 800) was approved on a motion made by Councilman Combs and seconded by Coun- cilman Turner . Question : Ayes : All Nayes : None -000- Resolution 80-385 authorizing a contract with Fittz , Crozier and Shipman for a topographic survey of the site for the proposed Riverfront Park at a fee not to exceed $2 , 500. 00 was approved on a motion made by Coun- cilman Williams and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- The public hearing for Dilapidated Structures was opened : Mr . George Gardner, Urban Rehabilitation Administrator , told Council that all the below-listed structures are in violation of Article III , Sections 14-50 and 14-51 of the Dangerous Structures Ordinance of the City of Beau- mont and that all notification procedures have been met : 6795 Bigner Road - Ms. Ada Chambers, owner (20 violations) , recommenda- tion to raze with 30 days; 565 - 567 Center (Duplex) - James Edward Savoy, owner (13 violations) , recommendation to raze or repair within 30 days; 3,065 Concord - George T. Normand, owner (13 violations) , recommendation to raze within 30 days; 1745 Cottonwood - Roy Doss estate, owner (20 vi- olations , recommendation to raze within 30 days ; 1699 Doucette - M. L. Glenwinkle, owner (19 violations) , recommendation to raze within 30 days ; 3137 Hollywood - Kattie Dragna, owner (13 violations) , recommendation to raze within 30 days; 1377 Lamar (5 violations) and 1385 Lamar (9 viola- tions) - Guy A. Jones, owner, recommendation for both structures is to raze within 30 days; 3395 Rivers - Ethelene Harris Butler, owner (8 vio- lations) , recommendation to raze within 30 days; and 3440 Roland Road (Rear) - Davis Whittington, owner (24 violations) , recommendation to raze within 30 days. Mr. Gardner further presented : The structures listed below have been condemned by the City Council and owners ordered to either repair or raze structures within specified time frames. Reinspections of these proper- ties have revealed noncompliance with the Council ' s orders . The Code Enforcement Department is requesting authorization from the City Council to demolish these structures in accordance with the City Codes and charge the property owners with the cost of this demolition. 1371 Lamar 720 Lee -201- October 28 , 1980 The above-listed recommendations were approved on a motion made by Coun- cilman Combs and seconded by Councilman Williams . Question : Ayes : All Nayes : None The public hearing was closed. Ordinance No. 80-106 declaring certain dilapidated structures to be pub- lic nuisances and requiring their repair or removal was considered : ORDINANCE NO. 80-106 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES, ORDERING REPAIR OR DEMOL- ITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION BY THE CITY UNDER CERTAIN CONDITIONS; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILIT.Y. The ordinance was approved on a motion made by Councilman Combs and se- conded by Councilman Lord. Question : Ayes : All Nayes : None -_000- Mrs. Grace M.
