City Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk -000 The Invocation was given by Allen Ray, Minister of Youth of Calder Baptist Church. The Pledge of Allegiance was led by Councilman Combs . -000- Mayor Meyers reminded citizens about .the City Council Workshop Session to be held at 7 : 30 p.m. at Lucas Elementary School . -000- Mayor Meyers issued the following proclamation : "Spindletop Boom Days in Beaumont"-September 27 and 28 , 1980. -000- The following Consent Agenda, items were considered : Approval of the minutes of the regular City Council session held Septem- ber 16, 1980; Resolution 80-326 authorizing purchase of Lot 136 , Block 13 of the Herring Addition (Project 720-74-191) for relocation of a house for the Buford- Carroll Street Project ; Resolution 80-327 approving the operations of the Jefferson County Housing Finance Corporation within the corporate limits of the City of Beaumont ; Resolution 80-328 advertising for bids on the sale of property (Lots 13 , 14, 15, 17 , 18 , N-2 21, and 22) in Block 3 , LaSalle Addition acquired for the University Drive Project - CIP 11-ST-07 ; and Resolution 80-329 accepting the bid of Audio Intelligence Devices for fur- nishing electronic surveillance equipment for the Police Department at a cost of $3 , 793 . 00. The Consent Agenda was approved on a motion made by Councilman Combs and seconded by Councilman Turner . Question : Ayes : All Nayes : None -000- -177- September 23 , 1980 Ordinance No. 80-91 amending Chapter 24 of the Code of Ordinances by creating exemptions for lot splits was considered : ORDINANCE NO. 80-91 ENTITLED AN ORDINANCE AMENDING CHAPTER 24 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS , BY ADDING A NEW SECTION 24-11 TO CHAPTER 24 OF THE CODE RELATIVE TO THE DIVISION OF LOTS IN PLATTED SUBDIVI- SIONS ; PROVIDING FOR SEVERABILITY; PROVID- ING FOR REPEAL; AND PROVIDING FOR A PENALTY. The ordinance was approved on a motion made by Councilman Lord and secon- ded by Councilman Combs. Question : Ayes : All Nayes : None -000- An ordinance changing the zoning from R-3 to C-1 for Lots 1-24 , Block 10, Jarrett Addition , at 595 Interstate 10 North (requested by James McNicholas , attorney for Centennial Savings) was considered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZON- ING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 2. 5 ACRE TRACT OUT OF THE JARRETT ADDITION, BEAU- MONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-3 TO C-1 ; PROVID- ING FOR SEVERABILITY; AND PROVIDING A PENALTY. Mr. McNicholas addressed Council acknowledging that the bank building could be constructed under present zoning but that future expansion would be prohibited if new proposed zoning ordinance is adopted. Councilman Turner made a motion to deny the ordinance ; motion was seconded by Councilman Williams . Question: Ayes : All Nayes : None -000- Ordinance No. 80-92 changing the zoning from C-1 to R-1 for Lots 1-21 , Block 1 ; Lots 1-30, Block 2 , Lots 1-17 , Block 3 , Pine Glen Addition and a 340 by 840 foot-tract immediately west of and adjacent to Pine Glen Ad- dition .in the 7700-7800 Blocks of Tolivar Road was considered : ORDINANCE NO. 80-92 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZON- ING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 19. 35 ACRE TRACT OUT OF THE PINE GLEN ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREIN- AFTER DESCRIBED, PRESENTLY ZONED C-1 TO R-1 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Combs and secon- ded by Councilman Williams . Question: Ayes : All Nayes : None -000- -178- September 23 , 1980 An ordinance changing the zoning from R-2 to I-1 for Lot 68 , Block 6 , Crary Addition, at 1011 Orange Street (requested by Ken Jai) was con- sidered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,. AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A . 17 ACRE TRACT OUT OF THE CRARY ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRE- SENTLY ZONED R-2 TO I-1 ; PROVIDING FOR SEVERA- BILITY; AND PROVIDING A PENALTY. The ordinance was denied on a motion made by Councilman Williams ; motion seconded by Councilman Turner . Bigner Survey and Thomas Spear League at 6060, 6070 and 6080 Concord Road and', at 5420 Garner Road (re- quested by Richard Danna) was considered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 1 . 6 ACRE TRACT OUT OF THE F. BIGNER SURVEY AND THOMAS SPEAR LEAGUE, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-3 AND R-1 TO C-1 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. Question : Ayes : Mayor Meyers Nayes : Councilman Councilman Combs Turner Councilman Williams Abstained : Councilman Lord -000- Ordinance No. 80-93 abandoning a portion of Milam Street from Main Street northward to its terminus and Franklin Street from Main Street northward to its terminus was considered : ORDINANCE NO. 80-93 ENTITLED AN ORDINANCE VACATING AND ABANDON- ING A PORTION OF MILAM STREET FROM MAIN STREET NORTHEASTERLY TO ITS TERMINUS AND A PORTION OF FRANKLIN STREET FROM MAIN STREET NORTHEASTERLY TO ITS TERMINUS IN THE CITY OF BEAUMONT, JEF- FERSON COUNTY, TEXAS , AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman Lord and secon- ded by Councilman Turner. Question : Ayes : Mayor Meyers Nayes : Councilman Councilman Combs Williams Councilman Lord Councilman Turner -000- -179- September 23 , 1980 Resolution 80-330 dedicating the Multimax Village property (bounded by the Santa Fe Railroad right-of-way on the jest , Caldwell on the North, Gulf on the East and Interstate 10 on the South) as "Babe Didrikson Zaharias Park" was approved on a motion made by Councilman Williams and seconded by Coun- cilman Turner. Question : Ayes : All Nayes : None -000- Resolution 80-331 authorizing final payment of $19 ,695. 73 to Jay Garth, Inc. on the contract for construction of the Municipal Airport Terminal building was approved on a motion made by Councilman Williams and seconded by Councilman Lord. Question : Ayes : All Nayes : None 000 Resolution 80-332 relating to bus route modifications for the Beaumont Transit System was approved on a motion made by Councilman Lord and secon- ded by Councilman Turner. Question : Ayes : All Nayes : None -000- Resolution 80-333 approving the 1980 tax assessment rolls (total taxable -- $799, 830,460. 00) was approved on a motion made by Councilman Williams and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Ordinance No. 80-94 setting the ad valorem tax �rate at $1 . 87 per $100 assessed valuation was considered : ORDINANCE NO. 80-94 j ENTITLED AN ORDINANCE PROVIDING FOR THE LEVYING, ASSESSING AND COLLECTING OF AD VALOREM TAXES FOR THE TAX YEAR 1880-1981 FOR THE PURPOSES OF PROVIDING A ENERAL FUND, AND A SINKING FUND TO MEET THE PAYMENT OF ALL BONDED INDEBTEDNESS OF THE CITY OF BEAUMONT AND THE PAYMENT OF ACCRUING INTEREST THEREON; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Lord and secon- ded by Councilman Turner. Question : Ayes : Mayor Meyers Nayes : Councilman Councilman Lord Combs Councilman Williams Councilman Turner -000- Ordinance No. 80-95 adopting the City of Beaumont Budgets for FY 81 , the General Revenue Sharing Budget and a five-year , Capital Improvements Bud- get was considered: ORDINANCE NO. 80-95 ENTITLED AN ORDINANCE REFERRED AS THE "ANNUAL APPROPRIATION ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FIS- CAL PERIOD BEGINNING OCTOBER 1 , 1980, AND ENDING SEPTEMBER 30, 1981 , AND ADOPTING A FIVE YEAR CAPITAL PROGRAM IN ACCORDANCE WITH THE CHARTER OF THE CITY OF BEAUMONT, APPORTIONING THE FUNDS OF THE CITY OF BEAUMONT; PROVIDING FOR LINE-ITEM TRANSFERS ; REPEALING ALL ORDI- NANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR SEVERABILITY. -180- September 23 , 1980 Ordinance No. 80-96 establishing positions and rates of pay in the Police and Fire Departments was considered : ORDINANCE NO. 80-96 ENTITLED AN ORDINANCE AMENDING CHAPTER 21 , SECTION 21-74 , AND 21-75 OF THE CODE OF OR- DINANCES OF THE CITY OF BEAUMONT, TO PROVIDE FOR GRADES, CLASSIFICATION, AND PAY SCALES IN THE POLICE AND FIRE DEPARTMENTS ; PROVID- ING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Lord and secon- ded by Councilman Combs . Question: Ayes : All Nayes : None -000- Ordinance No. 80-97 adopting a revised position Classification and Compen- sation Plan was considered : ORDINANCE NO. 80-97 ENTITLED AN ORDINANCE AMENDING CHAPTER 21 , SECTION 21-31, ADOPTING A CLASSIFICATION AND PAY PLAN; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Williams and seconded by Councilman Turner. Question: Ayes : All Nayes : None -000- Ordinance No . 80-98 revising the schedule of holidays (one additional day to celebrate employee's birthday) was considered: ORDINANCE NO. 80-98 ENTITLED AN ORDINANCE AMENDING CHAPTER 21 , SECTION 21-7, OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO PROVIDE AN ADDI- TIONAL HOLIDAY; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Williams and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Ordinance No. 80-99 providing for an increase in the City' s contribution to health care coverage for employees ' dependents was considered : ORDINANCE NO. 80-99 ENTITLED AN ORDINANCE PROVIDING THAT THE CITY SHALL CONTRIBUTE ONE HUNDRED (100%) PERCENT OF EMPLOYEE DEPENDENT HEALTH CARE INSURANCE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING AN EFFECTIVE DATE . The ordinance was approved on a motion made by Councilman Combs and secon- ded by Councilman Williams . Question : Ayes: All Nayes : None -000- -181- September 23 , 1980 Ordinance No. 80-100 readopting Updated Service Credits at a rate of 70 percent under the Texas Municipal Retirement System was considered : ORDINANCE NO. 80-100 ENTITLED AN ORDINANCE DETERMINING TO GRANT, PROVIDING FOR AND ALLOWING, UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL RETIREMENT SYSTEM, "UPDATED SERVICE CREDIT" IN SAID SYSTEM FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM IN THE EMPLOYMENT OF THE CITY OF BEAUMONT; ELECTING AND PRESCRIBING THE EFFECTIVE DATE OF SUCH UPDATED SERVICE CREDITS; AUTHORIZING AND PROVIDING FOR AL- LOWANCE OF INCREASES , AS HEREIN PROVIDED, IN MONTHLY BENEFITS PAYABLE BY TEXAS MUNICIPAL RETIREMENT SYSTEM AFTER THE EFFECTIVE DATE HEREIN SPECIFIED, TO RETIRED EMPLOYEES AND TO BENEFICIARIES OF DECEASED EMPLOYEES , UNDER CURRENT SERVICE ANNUITIES ARISING FROM SERVICE OF SUCH EMPLOYEES TO THIS CITY.
