HomeMy WebLinkAboutMIN APR 08 1980 REGULAR SESSION CITY COUNCIL - CITY OF BEAUMONT HELD APRIL 8 , 1980 BE IT REMEMBERED that the City Council of the City of Beaumont , Texas , met in regular session this the 8th day of April , 1980, with the following present : HONORABLE : Maurice Meyers Mayor Tom Combs , Jr. Councilman , Ward I Vi McGinnis Councilwoman , Ward II Calvin Williams Councilman , Ward III Leroy Evans Councilman , Ward IV Ray Riley City Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend James Tolle , South Park Church of Christ . The Pledge of Allegiance was led by Councilwoman McGinnis and Councilman Evans . -000- Ordinance No . 80-31 canvassing the votes of the City General Election held on April 5 , 1980, was considered : ORDINANCE NO. 80-31 ENTITLED AN ORDINANCE CANVASSING THE RETURNS OF THE REGULAR CITY ELECTION WHICH WAS HELD ON THE 5TH DAY OF APRIL, 1980, TO DETERMINE WHO SHALL BE MAYOR, COUNCILMEN FOR WARDS I , II , III , AND IV; APPROVING OR REJECTING AN ORDINANCE AS SET FORTH HEREIN; AND PROVIDING FOR SEVERABILITY. The results of said election are : For Mayor - Maurice Meyers ; for Council- man, Ward 1 - Tom Combs , Jr. ; for Councilman, Ward II - Evelyn M. Lord; for Councilman , Ward III - Calvin Williams and for Councilman , Ward IV - G. W. "Wayne" Turner ; and approval of the ordinance providing for compulsory binding arbitration as a method to resolve collective bargaining impasses between the City and scuh association. The ordinance was approved on a motion made by Councilman Evans and seconded by Councilman Combs. Question : Ayes : All Nayes : '_None -000- Federal Judge Joe J. Fisher administered the Oath of Office to the City Council . Mr. Ben J. Rogers , 2310 Thomas Road, addressed Council to hope for contir_ued "love atmosphere" and to compliment the past Council and staff for the Pro gress being made. -000- The meeting was recessed for a workshop briefing session for Council . -000- -63- April 8 , 1980 The regular session of City Council was reconvened with the following pre- sent : HONORABLE : Alaurice Meyers Mayor Tom Combs , Jr . Lord Councilman , Ward II Calvin Williams Councilman , Ward III Wayne Turner Councilman , Ward IV Ray Riley City Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk -000- Mayor Meyers issued the following proclamation : "National Coin Week in Beaumont" - April 13-19, 1980. .-000- Ordinance No. 80-32 canvassing the votes of a special election on the issuance of $33 million in Street Improvement Bonds held on April 5 , 1080 , was considered: ORDINANCE NO. 80-32 ORDINANCE CANVASSING RETURNS AND DECLARING RESULTS OF ELECTION THE STATE OF TEXAS 0 COUNTY OF JEFFERSON CITY OF BEAUMONT WHEREAS , there was held in the City of Beaumont , Texas, on the 5th day of April , 1980, an election at which there was submitted to all duly qualified resident electors of said City for their action thereupon , ' the following proposition : the issuance of $33 , 000 ,000 street improvement bonds ; and WHEREAS, there was cast at said election : 14 , 351 votes , of which number there were cast : PROPOSITION FOR THE ISSUANCE OF $33 , 000, 000 STREET IMPROVEMENT BONDS 9 , 189 votes AGAINST THE ISSUANCE OF $33 , 000, 000 STREET IMPROVEMENT BONDS 2 , 742 votes as shown in the official election returns heretofore submitted to the City Council of said City and duly filed with the City Clerk of said City Council; and WHEREAS , said election was called and held in all respects under and in strict conformity with the Constitution and laws of the State of Texas and the United States of America; Now, Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS : Section 1 . That the election held in and throughout the City of Beaumont , Texas, on the 5th day of April , 1980, which election is more particularly described in the preamble of this ordinance , was duly called and notice thereof was given and said election was held under and in strict conformity with law; that only duly qualified resident electors of said City voted at said election ; that due returns of said electron have been made by the proper officers ; that said election has resulted favorably to the is- suance of the bonds mentioned in the preamble of this ordinance ; and that a majority of the qualified voters voting in said election have voted in favor of the issuance of such bonds and the levying of such taxes in payment thereof . -64- April 8 , 1980 Section 2 . That the City Council of said City is now authorized to issue all of the bonds described above , and that the City Council is authorized to do any and all things necessary and/or convenient in con- nection therewith. Question : Ayes : All Nayes : None -000- Resolution 80-112 authorizing the Legal Department to institute condemna- tion proceedings to acquire certain parcels of land for the Spur 380/Lamar Freeway project (Parcels #48 at $69, 500 . 00, #49 at $-8 ,750 . 00 , #50 at $772 . 00 - to be reimbursed by State) was approved on a motion made by Councilman Williams and seconded by Councilman Lord. Question : .Ayes : All Nayes : None -000- An ordinance changing the zoning from R-1A to R-2 for a 1 . 01 acre tract , located at 290 N. Major Drive (requested by Mark Dollinger) was considered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT , TEXAS AND IN PARTICULAR THE BOUNDARIES OF THE ZON- ING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 1 . 01 ACRE TRACT OUT OF THE HEZEKIAH WILLIAMS SUR- VEY, BEAUMONT , JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-ILA TO R-2 ; PROVIDING FOR SEVERABILITY; AND PRO- VIDING A PENALTY. The ordinance was denied on a motion made by Councilman Williams and se- conded by Councilman Lord. Question : Ayes : Mayor Meyers Nayes : Councilman Combs Councilman Lord Councilman Williams Councilman Turner A motion directing the Planning staff to reinitiate t'Ihe request for zoning change to R-2M was made by Councilman Lord and seconded by Councilman Wil- liams. Question : Ayes : All Naves',: None -000- An ordinance issuing a specific use permit for a 3 . 95 acre tract mobile home park located at 5375 Fannett Road was deferred for correction of property description . -000- -65- April 8 , 1980 An ordinance amending Section 24-7 of the Code of Ordinances by establish- ing requirements for the granting of variances for subdivision plat approval was deferred and will be scheduled for a future Workshop Session . -000- Ordinance No. 80-33 abandoning Liberty Street from 23rd Street east for 500 feet was considered: ORDINANCE NO. 80-33 ENTITLED AN ORDINANCE VACATING AND ABANDON- ING A PORTION OF LIBERTY STREET IN THE LAUREL HEIGHTS ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS , AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman_ Combs and seconded by Councilman Turner . Question : Ayes : All Nayes : None -000- Resolution 80-113 authorizing an agreement with Central City Development Corporation concerning acquisition of Temperance Hall located at Pearl at Bowie (a part of the Beaumont Commercial Historic District as listed in the National Register of Historical Places - CCDC to purchase the building and grounds for demolition and operate as a parking lot ) was approved on a motion made by Councilman Combs and seconded by Councilman Williams . Question : Ayes : All Naves : None -000- Resolution 80-114 authorizing an agreement with D. W. Borniconcerning fixed base operations at Beaumont Municipal Airport was approved on a motion made by Councilman Combs and seconded by Councilman Williams . Question : Ayes : All Nayes : None -000- Resolution 80-115 appointing Mr . Earl L. Reed to the Parks and Recreation Advisory Committee for a one-year term was approved on a motion made by Councilman Turner and seconded by Councilman Williams . Question : Ayes : All Nayes : None -000- Resolution 80-116 authorizing an agreement with Kohler and Kohler , Consult- ing Engineers , for profession services for the development c-' dr ainage master plan at an estimated cost of $87 , 000 - study to take approximately 9 to 12 months for completion - was approved on a motion made by Councilman Combs and seconded by Councilman Turner . Question : Ayes : All Nayes : None -000- Resolution 80-117 authorizing an agreement with Charles R. Haile Associates, Inc . for professional services related to development of a site for the City ' s solid waste disposal was approved on a motion made by Councilman Combs and seconded by Councilman Williams . Question: Ayes : All Nayes : None -000- Resolution 80-118 authorizing payment to Overhead Door Company for mater- ials and labor for repair of a hangar door at Beaumont Municipal Airport at a cost of $3 , 908 . 00 was approved on a motion made by Councilman Lord and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 80-119 authorizing final payment of 5237 ,427 . 57 to Trotti and Thomson for Project I of the 1980 Street Maintenance Program (total cost -66- April 8 , 1980 of the project - ('- A , 570 .00) was approved on a motion made by Councilman Williams and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Resolution 80-120 accepting the bids of Beaumont Motor Company for furnish- ing 5 1-ton service trucks at $8 , 620.40 each and Kinsel Ford for 1 2-ton truck equipped with water tank and liftgate at a cost of $16 , 382 . 14 was ap- proved on a motion made by Councilman Combs and seconded by Councilman Lord . Question : Ayes : All Nayes : None -000 Resolution 80-121 accepting the bid of Evans Refrigeration Company for fur- nishing a boiler for the heating unit at the Water Utilities Building at a cost of $3682 . 00 was approved on a motion made by Councilman Turner and se- conded by Councilman Williams. Question : Ayes : All Nayes : None -000- Resolution 80-122 accepting the bids of Nunn Electric Company , Marine and Industrial Supply and Westinghouse Electric Company for furnishing luminaires used in replacement of street lighting fixtures was approved on a motion made by Councilman Williams and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 80-123 rejecting bids received on heaters and doors for the Beaumont Transit Building (both bids exceeded budgeted amount ) was approved on a motion made by Councilman Combs and seconded by Councilman Nord . Question : Ayes : All Nayes : None -000- Mr . J . C. Leggett , 1849 Washington Boulevard, addressed Council again to complain of drainage problems in his area. Mr. Mark Roberts , 1645 Tulane, addressed Council to make comments about the time taken by private contractor employees for road repairs; late ballot returns in the election; and stated that he was going to start a petition for single member districts. Mrs .
