Burton Smith, St . Paul ' s United Methodist Church. The Pledge of Allegiance was led by Councilman Combs . -000- Mayor Meyers issued the following proclamation : "Official Minute of Prayer in Beaumont" for the American Hostages held in Iran , beginning at 10 : 00 a.m. on Friday, December 28 , 1979, and each Friday thereafter until the hostages are released. -000- An ordinance changing the zoning from R-1 to LR-1 for three lots located at 605, 625, and 645 N. 18th Street (requested by Lynn Walker , Edward Sherlock and Robert Sartain) was considered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A . 3 ACRE TRACT OUT OF THE JARRETT ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO LR-1 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. Councilman Evans made a motion to deny the zoning change ; Councilman Combs seconded the motion. Question : Ayes : All Nayes : None -000- Ordinance No . 79-99 changing the zoning from R-1 to LR-1 for a 1 . 0 acre tract , from R-1 to R-2 for a 3 . 0 acre tract and from R-1 to R-2M for a 1 . 68 acre tract , all located approximately 230 feet south of Highway 105 on the east side of Walker Road (requested by J. J. After a lengthy discussion , a motion to approve Ordinance No . 79-99 but eliminating the R-2M rezoning portion from it was made by Councilman Evans and seconded by Mayor Meyers . Question : Ayes : Mayor Meyers Nayes : Councilman Combs Councilman Williams Councilman Evans -000- Ordinance No . 79-100 changing the zoning from R-IA to R-2 for a 2 . 98 acre tract and from R-2 to R-IA for a 3 . 6 acre tract , located generally at the northwest corner of RFD Road and Highway 105 (requested by Don Streety) was considered : ORDINANCE NO. 79-100 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 2 . 98 ACRE TRACT OUT OF THE W. B. DYCHES SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED , PRESENTLY ZONED R-IA TO R-2 ; AND BY CHANGING A 3 . 6 ACRE TRACT OUT OF THE W. B. DYCHES SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-2 TO R-lA; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. City Staff recommended approval of the ordinance with the stipulation that the property be properly platted before the ordinance became effective . Counc.iima.n Combs made a motion to approve the ordinance with the platting stipulation; Councilman Evans seconded the motion . During discussion of the item, it was stated that the platting requirement had not been discussed with the property owner. Councilman Combs withdrew his motion to approve. Councilman Combs made a new motion to approve the ordinance eliminating the platting requirement ; the motion was seconded by Councilman Williams . Question : Ayes : All Nayes : None -000- -178- December 27 , 1979 Ordinance No . 79-101 changing the zoning from R-1 to C-1 for 13 . 5 acres , from R-1 to LR-1 for 8 . 6 acres , from R-1 to R-2 for 8 . 5 acres and 11 .6 acres , and from R-1 to R-2M for 13 . 4 acres , located in the 4800-5200 Blocks of Washington Boulevard and also at the southern end of Pacific Avenue (requested by Blom Engineering) was considered : ORDINANCE NO. 79-101 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS BY CHANGING A 13 . 5 ACRE TRACT OUT OF THE CHARLES WILLIAMS SURVEY, BEAUMONT, JEF- FERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED PRESENTLY ZONED R-1 TO LR-1 ; BY CHANGING A 8 . 8 ACRE TRACT AND AN 11 . 6 ACRE TRACT OUT OF THE CHARLES WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO R-2 ; BY CHANGING A 13 .4 ACRE TRACT OUT OF THE CHARLES WILLIAMS SURVEY, BEAUMONT , JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO R-2M; PROVIDING A PREREQUISITE TO BE COMPLETED PRIOR TO ZONE CHANGES BECOMING EFFECTIVE ; PROVIDING FOR SEVERABILITY; AND PRO- VIDING A PENALTY. The ordinance was approved on a motion made by Councilman Combs and se- conded by Councilman Evans . Question : Ayes : All Nayes : None -000- An ordinance changing the zoning from R-lA to LR-1 for a 4 . 36 acre tract located generally on the northwest corner of the L.N.V.A. Canal and Eastex Freeway (requested by Mark Merrill) was considered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 4 . 36 ACRE TRACT OUT OF THE W. B. DYCHES SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-lA TO LR-1 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. A discussion concerning the depth of the LR-1 zoning in relation to three residents near the property was held . It was decided that a set-back of 180 ' would be more compatible with the existing zoning . A motion to table the ordinance for an amendment of the description was made by Councilman Combs and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- -179- December 27 , 1979 Ordinance No. 79-102 abandoning a 20-foot alley located in Block 12 , Jarrett Addition (requested by Thomas J. Sibley) was considered: ORDINANCE NO. 79-102 ENTITLED AN ORDINANCE VACATING AND ABANDON- ING AN ALLEY LOCATED IN BLOCK 12 OF THE JARRETT ADDITION IN BEAUMONT, JEFFERSON COUNTY, TEXAS , AS DESCRIBED HEREIN; PROVID- ING THAT A PORTION OF SUCH ALLEY BE RE- TAINED AS A GENERAL UTILITY EASEMENT. The ordinance was approved on a motion made by Councilman Evans and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Ordinance No. 79-103 abandoning Oregon and Vermont Streets from Cheek Street to University Drive (requested by Ray Rice for Lamar University) was considered: ORDINANCE NO. 79-103 ENTITLED AN ORDINANCE VACATING AND ABANDON- ING A PORTION OF OREGON STREET AND VERMONT STREET FROM CHEEK STREET TO UNIVERSITY DRIVE, IN THE LAMAR ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman Combs and se- conded by Councilman Evans. Question : Ayes : All Nayes : None -000- Resolution 79-447 authorizing purchase of two (2) parcels of land for the Buford-Carroll Projects (#29/Buford @ $31 ,870. 00 and #38/Carroll @ $7 , 900. 00) was approved on a motion made by Councilman Combs and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- Resolution 79-448 authorizing Change Order No. 2 to the contract with Signal Engineering Company for the Computerized Traffic Signal System Pro- ject for the installation of 30 solid state controllers and to amend the specifications for traffic signal heads (contract decreased from $838 , 387 .62 to $836 , 038 . 62) was approved on a motion made by Councilman Combs and se- conded by Councilman Evans . Question : Ayes : All Nayes : None -000- Resolution 79-449 authorizing the American National Bank to release $85, 000. 00 in securities was approved on a motion made by Councilman Evans and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 79-450 authorizing final payment of $16 , 151 . 00 to Cleveland Steel Company for the construction of a metal garage building at the Fire Training Grounds was approved on a motion made by Councilman Combs and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- -180- December 27 , 1979 Resolution 79-451 accepting the improvements in the Fourth Street Widening Project , Phase II (Fourth from College to Calder) and authorizing final payment of $55, 544 . 34 to the contractor , Bella Company, was approved on a motion made by Councilman Evans and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 79-452 accepting bids for traffic signal equipment from Trans- Tronics , Inc. @ $19,470. 60; Minnesota Mining & Mfg. Company @ $2 ,913 . 00; Traffic Control Division, Automatic Signal @ $7 ,869. 00; G & M Sales , Com- pany, Inc. @ $884 . 27 ; VePed Traffic Controls , Inc. @^a $24 ,457. 32; Signal Engineering Company @ $6, 995. 00 and Valmont Ind. , Inc . @ $4 ,750.00 and re- jecting all bids received for steel lighting pole assemblies was approved on a motion made by Councilman Combs and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- Resolution 79-453 authorizing the purchase of repair parts (carrier 505 rear end) for a 1975 8-cubic yard dump truck from Beaumont Motor Company in ghe amount of $1 ,419. 00 was approved on a motion made by Councilman Evans and seconded by Councilman Combs. Question : Ayes: All Nayes : None -000- Resolution 79-454 authorizing execution of a quitclaim deed to Ronald Richardson in the sale of a lot in Block 24 of the Gulf Terrace Addition acquired for delinquent taxes (sale $2 , 000 —City portion $1 ,036. 39) was approved on a motion made by Councilman Combs and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- A resolution authorizing execution of an agreement with the State Depart- ment of Highways and Public Transportation and the Kansas City Southern regarding construction of the Spur 380 Extension, and division of respon- sibilities for maintenance and drainage was deferred for action. -000- Resolution 79-455 approving plans and specifications for preservation of Tyrrell Historical Library and authorizing advertisement for bids was approved on a motion made by Councilman Combs and seconded by Council- man Evans . Question : Ayes : All Nayes : None -000- Resolution 79-456 authorizing Change Orders nos . 1 , 2 & 3 to the contract with T. C. Gray for renovation work on the Central Park Activities Build- ing in the amount of $39, 535. 00 was approved on a motion made by Council- man Evans and seconded by Councilman Combs. !question : Ayes : All Nayes : None -000- Resolution 79-457 accepting a bid for furnishing public employee bonds from Reliance Insurance Company through Sol L. Weisenberg was approved on a motion made by Councilman Combs and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- A resolution accepting a bid for establishing a Redistribution Program for uniforms was deferred. -000- -181- December 27 , 1979 Resolution 79-458 accepting a transit operating assistance grant from the Urban Mass Transportation Administration in the amount of $190, 760.00 was approved on a motion made by Councilman Combs and seconded by Council- man Evans. Question : Ayes : All Nayes : None -000- Resolution 79-459 accepting the donation of an undivided one-fourth inter- est in a 64-acre tract designated as Morgan Park from Frank Lewis Bartlett was approved on a motion made by Councilman Combs and seconded by Council- man Evans. Question : Ayes : All Nayes : None -000- Resolution 79-460 accepting the bid of Glidden Coating & Resins Corpora- tion for furnishing latex exterior paint at $6. 52 a gallon and primer at $6. 92 per gallon for housing rehabilitation under the Community Develop- ment Block Grant Program was approved on a motion made by Councilman Combs and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Mr. J. C. Leggett , 1849 Washington Boulevard, addressed Council to com- plain about poor condition of Avenue C between Washington and Euclid. Mr. Manuel Holloway, 2355 South 9th Street , addressed Council to complain of methods used by Police Department personnel to check for outstanding traffic violations . Mr. Cotter H. Farris , 1839 Roberts, addressed Council to complain about drainage problems . Mrs. Delia Harrington, 815 Willow Street , addressed Council to speak for Mrs. Helen Kuhn of Beaumont Association for Senior Citizens and request $19, 100. 00 match money from the City for $87 , 000 to be received by the Association. Mr . Taalib-Din Sabir , 1252 Cottonwood, addressed Council to request favor- able consideration be given to changing the names of Sarah, Lavaca and E. Lavaca Streets to Martin Luther King Drive. -000- Mayor Meyers called an Executive Session pursuant to Section 2 of the Texas Open Meetings Law. -000- The meeting was reconvened.
