The Pledge of Allegiance was led by Councilman Combs . -000- The Minutes of the regular City Council session held August 28 , 1979, were approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Mayor Meyers issued one proclamation ; "Fly Jefferson County Airport Month in Beaumont" - September , 1979. -000- Ordinance No . 79-64 changing the zoning from R-2 to LR-1 for an 8 . 936 acre tract located approximately 300 feet south of the intersection of Gladys Avenue and Major Drive (requested by Ken Ritter) was considered: ORDINANCE NO. 79-64 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 8 . 9 ACRE TRACT OUT OF THE H. WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-2 TO LR-1 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. Mayor Meyers recognized former Mayor , Ken Ritter , who was in attendance at the meeting. A brief discussion of the drainage problems in the area of the above listed property was held . The ordinance was approved on a motion made by Councilman Combs and secon- ded by Councilman Evans. Question : Ayes : All Nayes : None -000- -127- September 4 , 1979 Ordinance No . 79-65 changing the zoning from R-1 to R-2 for a 9.36 acre tract located approximately 0.68 miles west of Langham Road and 171 feet south of College Street (PRS Associates made the request ) was considered : ORDINANCE NO. 79-65 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 9. 36 ACRE TRACT OUT OF THE CHARLES WILLIAMS LEAGUE, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO R-2 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs. Question : Ayes : All Nayes : None -o00- An ordinance changing the zoning from R-1 to C-2 for a 0 . 55 acre lot located on the northwest corner of Hoover and Ninth Streets (requested by Don Belt Company) was considered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 0. 55 ACRE TRACT OUT OF THE PECAN GROVE ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO C-2 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. The ordinance was denied on a motion made by Councilwoman McGinnis and seconded by Councilman Combs . Question: Ayes : All Nayes : None -000- Ordinance No. 79-66 changing the zoning from R-1 to LR--1 for a 1 .85 acre tract located on the northeast corner of Fannett Road and Frint Road (re- quested by Paul Zoch) was considered : ORDINANCE NO. 79-66 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 1 .85 ACRE TRACT OUT OF THE BROOKLAND FARMS ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-1 TO LR-1 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Combs and se- conded by Councilman Evans. Question : Ayes : All Nayes : None -000- -128- September 4 , 1979 Ordinance No. 79-67 changing the zoning from R-2 to C-2 for lots 10 and 11 , Block 2, Hillside Addition (requested by Mobil Oil Federal Credit Union) was considered : ORDINANCE NO. 79-67 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING TWO LOTS OF THE HILLSIDE ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-2 TO C-2 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis. Question : Ayes : Mayor Meyers Abstained : Councilman Councilman Combs Evans Councilwoman McGinnis -000- Ordinance No. 79-68 issuing a specific use permit to build a 3-story apart- ment building on a 2 .48 acre tract located at 4335 Crow Road (PRS Develop- ment Corporation made the request ) was considered : ORDINANCE NO. 79-68 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A THREE-STORY HIGH RISE APARTMENT PROJECT FOR A 2 .48 ACRE TRACT HEREIN DESCRIBED; IN ACCORDANCE WITH A PLAN OF DEVELOPMENT; AND SUBJECT TO CERTAIN CONDITIONS ; AND PROVIDING FOR SEVERABILITY. Councilman Williams arrived during discussion of this item. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Ordinance No . 79-69 issuing a specific use permit to construct a Type "A" mobile home park on an 8 . 71 acre tract located on South 23rd Street (re- quested by Carl Kohler) was considered : ORDINANCE NO. 79-69 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A TYPE "A" TRAILER PARK ON A 8 .71 ACRE TRACT HEREIN DESCRIBED ; IN ACCORDANCE WITH A PLAN OF DEVELOPMENT; AND SUBJECT TO CERTAIN CONDITIONS ; AND PROVID- ING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Evans and secon- ded by Councilwoman McGinnis. Question : Ayes : All Nayes : None -000- Resolution 79-323 authorizing the purchase of Parcel #49 (879 square foot tract out of Lot 1 , Chollar Addition for Schwarner Street ) needed for the Community Development Block Grant Project (B-77-PAC-48-0003) at a cost of $1 , 585. 00 was approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Evans. Question : Ayes : All Nayes : None -129- September 4 , 1979 Resolution 79-324 accepting the bid of Donald D. Engle for an Oil and Gas Lease on Beaumont Municipal Airport property ($75. 00 per acre or $20,658 for one-year lease plus J royalty for any minerals discovered) was approved on a motion made by Councilman Evans and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 79-325 accepting the bid of the Xerox Corporation for furnish- ing a copier for one year at $365. 00 per month for use by the City Manager ' s Office was approved on a motion made by Councilman Combs and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Resolution 79-326 accepting as completed the work performed under a demoli- tion contract on Pearl , Highland and East Florida Streets with Olshan Demolishing Company, Inc . and authorizing final payment of $24 ,450 . 00 was approved on a motion made by Councilwoman McGinnis and seconded by Coun- cilman Evans . Question : Ayes : All Nayes : None -000- Resolution 79-327 authorizing advertisement for bids for the construction of a 5-million gallon ground storage tank at the site of Loeb Well No. 1 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- Resolution 79-328 accepting the bid of Glen D. Beard for the installation of a 20 ' x 115 ' aluminum parking canopy at the Traffic Operations Building at a cost of $4 , 213 .00 was approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None 000 A resolution authorizing execution of a lease agreement for the purpose of drilling an oil and/or gas well in an alley in Block 31 , Calder Addi- tion for six (6) months at $500. 00 per month was deferred one week for action. -000- Resolution 79-329 authorizing the City Manager to execute a street mainte- nance agreement with the Boise Southern Company for a logging operation using Charles Street , Bigner, and E. Lucas and providing the City with a Performance Bond in the amount of $250, 000 was approved on a motion made by Councilman Evans and seconded by Councilman Combs . Question: Ayes : All Nayes : None -000- Resolution 79-330 authorizing application for an Environmental Protection Agency Step II Federal Grant to provide 75% funding for engineering and design work for proposed improvements to the sanitary sewer system as set forth in the 201 Facilities Plan was approved on a motion made by Council- man Evans and seconded by Councilman Combs. (Total project estimated $32, 000, 000) Question : Ayes : All Nayes : None -000- Mayor Meyers introduced Mr. Joe DiBacco, new Manager for Liberty Cable TV. Mr. J. C.
