Councilman , Ward I Vi McGinnis Councilwoman, Ward II Leroy Evans Councilman, Ward IV Absent : Calvin Williams Councilman , Ward III Ray Riley City Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend Max Dawson, Pinecrest Church of Christ . The Pledge of Allegiance was led by Councilman Evans . -000- The Minutes of the regular City Council session held August 21 , 1979, were approved on a motion made by Councilman Combs and seconded by Councilwoman 'JcGinnis . Question : Ayes : All Nayes : None -000- Mayor Meyers issued the following proclamation : "Beaumont to Waco Day" - September 8 , 1979. (Lamar Cardinals vs. Baylor Bears, Saturday , Septem- ber 8th. ) -000- Resolution 79-310 accepting the bid of Cajun Concrete Works , Inc . for the construction of a supplementary police parking lot on Pearl Street. at a cost of $27 , 528 . 30 was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Resolution 79.-311 accepting the Collier Road (from Berry Road to Drainage District 5) Assessment Paving Project as completed and authorizing final payment of $11 , 816. 80 to E. R. Dupuis Concrete Company, Inc . (total pro- ject $103 ,357 . 00) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question : Ayes : All Nayes : None 000 Resolution 79-312 accepting the bid of Olshan Demolishing Company, Inc . for demolition of Carver ($88,400. 00) and Charlton-Pollard ($129,400. 00) School buildings. was considered. Community Development Block Grant funds will be used for demolition with a lien fixed against sale of the property. Councilwoman McGinnis made a motion to approve the resolution; Councilman Evans seconded the motion. Mr. Ben Rogers, 2030 Thomas Road, addressed Council to express his concern for the demolition of these structures and the appraised value of the pro- perty after demolition . Question was called: Ayes : Mayor Meyers Nayes : Councilman Combs Councilwoman McGinnis Councilman Evans -122- August 28 , 1979 Resolution 79-313 accepting the bid of S & S Enterprises for construction of a Parks Maintenance Building (Civic Center Complex) at a cost of $21 , 988 . 00 was approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Evans . Question : Ayes : All Nayes : None -000- Resolution 79-314 authorizing advertisement for bids for street and water line improvements in Census Tract 20 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes: All Nayes : None -000- Resolution 79-315 accepting the bid from Harmon Precast Concrete Products for the purchase of seventy-seven (77) parking curbs for the southeast parking lot at a cost of $1 , 155. 00 was approved on a motion made by Coun- cilwoman McGinnis and seconded by Councilman Combs . Question : Ayes : All Nayes : None 000- Resolution 79-316 authorizing the purchase of eleven (11) additional pagers to be furnished by General Electric Company for use by the Planning and Zoning Department personnel was approved on a motion made by Councilman Combs and seconded by Councilman Evans . Question : Ayes : All Nayes: None -000- Resolution 79-317 accepting improvements to West Virginia Street between Fourth Street and Mercantile as completed and authorizing final payment of $16, 248. 20 to E. R. Dupuis Concrete Company , Inc . was approved on a motion made by Councilman Evans and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000 Resolution 79-318 declaring Beverly and Berkley Streets from LaSalle Street northward to Parry an assessment paving project and authorizing Public Works and Engineering to prepare plans, specifications and cost estimates for said project subject to prepayment by 3/4 of abutting property owners was ap- proved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Resolution 79-319 accepting the bid of American National Bank to serve as City Depository for the two-year period from October 1 , 1979 to September 30, 1981 was approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Resolution 79-320 authorizing Kansas City Southern Lines to make improvements to its track in Railroad Avenue by elevating the track and track bed and providing full-depth wood crossings at Doucette - Brien - Sabine Pass , Penn- sylvania, Park, Neches - Easy, Erma, Royal , Franklin and Blanchette and by installing a rubberized crossing where its track crosses Main Street was ap-, proved on a motion made by Councilwoman McGinnis and seconded by Council- man Evans . Question : Ayes : All Nayes : None -000- -123- August 28 , 1979 Resolution 79-321 authorizing steps necessary for acquisition of a site (two acres located north of and adjacent to Rogers Park and has approxi- mately 250 feet of frontage on the west side of Dowlen Road and approxi- mately 400 feet of depth) for the proposed neighborhood library endowed by the Randolph C. Miller Trust , including execution of an agreement with the trustees (American National Bank) was considered. Councilman Evans made a motion to approve the resolution; Councilwoman McGinnis seconded the motion. Mr. Ben Rogers , 2030 Thomas Road, addressed Council to again offer a site for the Library at Parkdale Mall . Question was called on the motion to approve the resolution. Ayes : All Nayes : None -000- Resolution 79-322 authorizing the emergency purchase of a trailer from Westview Mobil Homes Sales to be used as a temporary office for the Solid Waste Division (Solid Waste Office uninhabitable due to methane gas seepage) at a cost of $12 , 381 . 00 was considered. Councilman Combs made a motion to approve the resolution ; Councilman Evans seconded the motion. Mr . Ben Rogers addressed Council to ask if a lease/purchase option had been considered before buying a trailer outright . He was told that had been con- sidered but was not considered feasible. Question was called. Ayes : All Nayes : None -000- Mr. Ben Rogers , 2030 Thomas Road, addressed Council to request that the City acquire the 20-acre tract on Delaware from the County (formerly the old T.B. Hospital} to be used as a park. -000- The, meeting was recessed before the public hearing for dilapidated struc- tures. -000- Mayor Meyers declared the public hearing on Dilapidated Structures open. PUBLIC HEARING DILAPIDATED STRUCTURES Mr. George Gardner , Urban Rehabilitation Administrator , stated that all fourteen (14) structures are in violation of Article III , Section 14-50 and 14-51 of the Dangerous Structures Ordinance of the City of Beaumont and that all notification procedures have been complied with. The following list of structures was considered : 1814 Park (rear garage) - Mr. Brynan Hendrex, , owner (11 violations) , re- commendation to raze within 30 days; 2445 Pine - V. W. Johnson & Willie Henry Johnson, owners (17 violations) , recommendation to raze within 30 days ; 1735 Church - Rudolf and Earline Hebert , owners (16 violations) , recommenda- tion to raze within 30 days; 2401 St . Helena- Julia & Earl Bodwin, owners (15 violations) , recommendation to raze within 30 days ; 905 E. Lucas - Sue Brewbaker and Marvin Sterling, Jr. , owners (fire damage - 25 violations) recommendation to raze within 30 days ; 2620 Linson (rear) - Wyatt E. Poe, owner (13 violations), recommendation to raze or repair within 30 days ; 144 Alabama - Fears, Goodhue and Coffin, owners ( 11 violations) , recommenda- tion to raze or repair within 30 days; 2155 Angeline (House & Garage) - Ernest D. Green & Henry Fracht , owners (14 violations) , raze within 30 days ; -124- August 28 , 1979 3139 W. Crockett - Bill Sims & Raymond Tyler , owners ( 17 violations) , recom- mendation to raze within 30 days ; 93 South 4th Street - A. L. Mazoch, owner (11 violations - fire damage) , recommendation to raze within 30 days ; 1600 North Street - Wayne Boswell , owner (24 violations) , recommendation to raze or repair within 30 days ; 1051 & 1053 Alabama - Ross Bennett , owner (13 vio- lations) , recommendation to raze within 30 days ; 2385 Monroe , Home & Garage Sara Daigle Estate, owner (22 violations) , recommendation for home is to raze or repair within 30 days and for garage is to raze within 30 days ; 1885 Franklin - L. J . Allen c/o Mrs . 0. Ebner , owner (12 violations - fire damage) , recommendation to raze within 30 days . (Councilman Williams arrived during the public hearing for dilapidated structures. ) A motion to approve the recommendations for the above listed structures was made by Councilman Combs and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None The public hearing was closed. -000- Mayor Meyers declared the public hearing on the proposed city budgets for FY 1980 including the General Fund budget document , the General Revenue Sharing Budget and the Capital Improvements Budget open for citizen comments . City Manager gave a summary of the budgets totaling $49, 133 ,400. 00 . Mr. J. C. Leggett , 1849 Washington Boulevard, addressed Council to comment on the size of the budget . Mr. Ben Rogers, 2030 Thomas Road, addressed Council in opposition to the continued use of CETA employees . Mrs. Delia Harrington, 815 Willow Street , addressed Council to request that employees of the City be required to live in the city. Mrs. Marie Broussard, 1185 Ivy Lane, addressed Council requesting additional school crossing guards, flashing lights and bike paths for school children safety. Mrs. Jane Dunatchik, 6860 Guess Road, addressed Council to request develop- ment of Riverfront Park and a north end park. Mr. Jim Mutch, 8290 Seagull , addressed Council to question the development of Gussman Park. He was told funds are included in the 1980 budget for equipment for this park. Mr . David Horn, 9550 Piney Point Lane, addressed Council to request ditch- ing in the northern section of the city. There being no further citizens wishing to address Council , the public hearing was closed. -000- Ordinance No . 79-63 for condemnation of dilapidated structures was consid- ered: ORDINANCE NO. 79-63 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES, ORDERING REPAIR OR DEMOLITION OF CERTAIN STRUCTURES ; ORDERING DEMOLITION OF CERTAIN STRUCTURES; ORDERING DEMOLITION BY THE CITY UNDER CER- TAIN CONDITIONS; AND PROVIDING A PENALTY; AND PROVID- ING FOR SEVERABILITY. -125- August 28 , 1979 The ordinance was approved on a motion made by Councilman Combs and secon- ded by Councilwoman McGinnis .
