The Pledge of Allegiance was led by Councilwoman McGinnis . -000- The Minutes of the regular City Council session held May 22, 1979, were approved on a motion made by Councilwoman McGinnis and seconded by Coun- cilman Evans . Question : Ayes: All Nayes : None -000- Mayor Meyers issued the following proclamation : "Big Thicket Walk Fest Days in Beaumont" - June 2 & 3 , 1979. -000- An ordinance authorizing a zoning change from R-3 to R-1 for Lots 1-14 , Block 19; Lots 1-13 , Block 30; Lots 1-13 , Block 42 ; and Lots 1-12 , Block 53 , located generally from the 2300 Block to the 2600 Block of Hazel Street was considered: AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING BLOCKS 19, 30, 42 , AND 53 OF THE AVERILL ADDITION, BEAUMONT, JEF- FERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-3 TO R-1 ; PROVIDING FOR SEVERABILITY; AND PRO- VIDING A PENALTY. *Councilman Williams arrived here. Councilwoman McGinnis made a motion to table action for one week; the motion was seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- Ordinance No. 79-40 authorizing a zoning change from R-1 and R-3 to C-1 for two (2) tracts totaling 3 . 089 acres, located in the 5300-5500 Blocks of Eastex Freeway service road was considered : -82- May 29, 1979 ORDINANCE NO. 79-40 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT , TEXAS, BY CHANGING A 3 . 089 ACRE TRACT OUT OF THE F. BIGNER SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DE- SCRIBED, PRESENTLY ZONED R-1 AND R-3 TO C-1 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs . The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Ordinance No. 79-42 abandoning a 1 . 5-foot portion of a 20-foot utility easement located in Lot 3 , Block 2 , Evangeline West Addition, Unit II (requested by Victor Marino) was considered : ORDINANCE NO. 79-42 ENTITLED AN ORDINANCE VACATING AND ABANDON- ING A PORTION OF A 20 FOOT UTILITY EASEMENT LOCATED ON LOT 3 , BLOCK 2 OF THE EVANGELINE WEST ADDITION, UNIT II , IN BEAUMONT, JEFFER- SON COUNTY, TEXAS , AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman Evans and se- conded by Councilman Combs . Question : Ayes : All Nayes : None -000- Ordinance No. 79-43 abandoning a 2863 . 5 square-foot portion of McLean Street right-of-way abutting Lots 16-18 , Block 10, Westfield Terrace Addition (requested by Barbara Griffin) was considered : ORDINANCE NO. 79-43 ENTITLED AN ORDINANCE VACATING AND ABANDON- ING A 2863. 5 SQUARE FOOT PORTION OF McLEAN STREET RIGHT-OF-WAY ABUTTING LOTS 16-18 , BLOCK 10, IN THE WESTFIELD TERRACE ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS , AS DESCRIBED HEREIN. -83- May 29, 1979 The ordinance was approved on a motion made by Councilman Combs and secon- ded by Councilwoman McGinnis. Kohler) was considered: ORDINANCE NO. 79-44 ENTITLED AN ORDINANCE VACATING AND ABAN- DONING A PORTION OF WOOTEN ROAD RIGHT-OF- WAY LOCATED SOUTH OF WASHINGTON BOULEVARD IN THE WESCALDER FIG ACRES TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS , AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman Evans and secon- ded by Councilwoman McGinnis. The ordinance was approved on a motion made by Councilman Evans and secon- ded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 79-196 authorizing the purchase of a parcel of land for the Florida/Highland Project (Parcel #4 at $6, 000. 00) was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Resolution 79--197 authorizing continuation of the Manpower Consortium Agreement between the City of Beaumont , Jefferson County, Hardin County, and Orange County for fiscal year 1980 (C. E.T.A. ) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- Ordinance No . 79-46 amending Chapter 21 , Section 21-74 of the Code of Ordi- nances establishing positions and rates of pay for police officers was considered : ORDINANCE NO. 79-46 ENTITLED AN ORDINANCE AMENDING CHAPTER 21 , SECTION 21-74 ESTABLISHING POSITIONS AND PAY GRADES IN THE POLICE DEPARTMENT; PRO- VIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. -84- May 29, 1979 The ordinance was approved on ,a motion made by Councilman Evans and secon- ded by Councilman Combs. Question: Ayes : All Nayes : None -000- Resolution 79-198 amending the Community Development Block Grant budget by $39, 822. 00 to provide funding for the renovation of the Senior Citizen ' s Center (old Naval Reserve Building on Fourth Street ) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes: All Nayes : None -000 Resolution 79-199 accepting the bid of T. C. Gray Construction for the renovation of the Senior Citizen 's Center at a cost of $118 ,322 . 00 was approved on a motion made by Councilman Combs and seconded by Council- woman McGinnis. Question : Ayes: All Nayes : None -000'r. Resolution 79-200 accepting the bid of J. R. Plake and Company for the re- location of three (3) residential structures (2955 Sabine Pass, 1385 and 1387 Schwarner) for use in temporary relocation assistance program at a cost of $7, 950. 00 was approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None mb00m Resolution 79-201 accepting the Library Supplementary Parking Lot Project and authorizing final payment of $11 ,470. 17 to Liberty Industrial Construc- tion, Inc . was approved on a motion made by Councilman Evans and seconded by Councilman Combs , Question: Ayes : All Nayes : None -000- Resolution 79-202 accepting the bid of Olshan Demolishing Company on demo- lition and site clearing for the police parking facility and the Florida- Highland Major Street Project at a cost of $24,450. 00 was approved on a motion made by Councilman Evans and seconded by Councilman Combs. Question : Ayes: All Nayes : None -000 Ordinance No. 79-47 providing for the appointment of Patricia Broussard to the Tax Equalization Board was considered: ORDINANCE NO. 79-47 ENTITLED AN ORDINANCE AUTHORIZING THE APPOINTMENT OF EMPLOYEES OF PUBLIC UTILITY COMPANIES TO THE BOARD OF EQUAL- IZATION; MAKING AN APPOINTMENT TO THE BOARD OF EQUALIZATION; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000 Resolution 79-203 authorizing the City Manager to execute several quit- claim deeds was approved on a motion made by Councilman Combs and seconded by Councilman Evans. Question : Ayes : All Nayes : None -85- May 29, 1979 Ordinance No . 79-48 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered : ORDINANCE NO. 79-48 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES - ' ORDERING REPAIR OR DEMOLITION FOR CER- TAIN STRUCTURES; ORDERING DEMOLITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLI- TION BY THE CITY UNDER CERTAIN CONDITIONS; PROVIDING FOR SEVERABILITY AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Mrs . W. C. Looney, 2700 Toccoa Road, owner of property located at Hazel Street at Eight Street , addressed Council in opposition to the proposed zoning change to R-1 for the 2300-2600 Blocks of Hazel Street .
