The Pledge of Allegiance was led by Councilwoman McGinnis. -000- The Minutes of the regular City Council session held August 22 , 1978 , were approved on a motion made by Councilwoman McGinnis and seconded by Council- man Evans . Question: Ayes : All Nayes : None -000- Mayor Meyers issued the following proclamation : "Jerry Lewis Muscular Dystrophy Telethon Weekend in Beaumont" - September 3 & 4 , 1978 . (*Councilman Williams arrived here) Beaumont Association for Senior Citizens representatives, Mr . & Mrs . Richard Ramsey and Mr . Richard Evans, presented large "happy face" signature cards to the Mayor and Council and to the City Manager in appreciation of support for the Senior Citizen Center. -000- Presentation of retirement plaques and service award pins to employees was held : Retirement plaques were presented to Mr . Leon Burnett , Tax Collector Admin- istrator (23 years service) and to Mr. Anthony Marziana, Equipment Mechanic with Fleet Maintenance Division (20 years service) . ($21 , 171 . 95 for three 4-door sedans and one station wagon) and Myron Gray Chrysler Center ($12, 280. 00 for two police interceptors) for furnish- ing vehicles to various departments was approved on a motion made by Coun- cilman Evans and seconded by Councilwoman "McGinnis. Question : Ayes : All Nayes : None -000- Resolution 78-296 authorizing the award of bid to Norstok Steel Building Company for purchase of materials for construction of six project ( instruc- tor) classroom buildings for the Fire Department at a cost of $2 , 557 . 00 was approved on a motion made by Councilman Combs and seconded by Council- man Evans . Question : Ayes : All Nayes : None -000- Resolution 78-297 authorizing the award of bid to Neff Brothers Automotive Service to provide wrecker and twoing service for City fleet vehicles for a period of one year at a cost of $1 , 725. 00 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question: Ayes : All Nayes : None -000- Ordinance No. 78-91 authorizing a zoning change from R-2 to LR-1 for a 3 . 194 acre tract located on the southeast corner of the Gladys Avenue/Major Drive intersection was considered: ORDINANCE NO. 78-91 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CITY OF BEAUMONT, TEXAS, BY CHANGING A 3 . 194 ACRE TRACT OF LAND OUT OF THE H. WILLIAMS SURVEY IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED PRE- SENTLY ZONED "R-2" TO "LR-111 ; PROVIDING FOR SEVERABILITY AND PROVIDING A PENALTY. A motion to approve the ordinance was made by Councilman Evans and seconded by Councilman Combs . Councilman Combs told Council that he had received a request from property owners in the area for reconsideration and made a motion to table the ordi- nance for one week. -131- August 29, 1978 Mr. Harold J. Laine, Jr . , Attorney and resident of the area, addressed Council to object to the zoning change to allow a shopping center to be constructed on the subject property . Councilman Williams seconded the motion to table. After further discus- sion, Councilman Williams withdrew his second to the motion. The motion died for lack of second. Question was called for the original motion to approve the zoning change, Question : Ayes : All Nayes : None -000- An ordinance adopting the Planning and Zoning Commission ' s recommendation for the rezoning of an 85 acre tract in its entirety bounded by Corley Avenue, 11th Street , Washington Boulevard and Interstate 10 was considered : Councilman Williams read a prepared statement related to his opinion bn the need for continuity of Zoning in the City of Beaumont . Councilwoman McGinnis made a motion to deny the ordinance; it was seconded by Councilman Combs . Question : Ayes : All Nayes : None --000- Ordinance No. 78-92 rezoning part of an 85 acre tract as recommended by the Planning and Zoning Commission generally bounded by Corley Avenue, 11th Street , Washington Boulevard and Interstate 10 except for that por- tion fronting on Washington Boulevard was considered : ORDINANCE NO. 78-92 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CITY OF BEAUMONT, TEXAS , BY CHANGING A 16. 39 ACRE TRACT OF LAND OUT OF THE COLLEGE ACRES EXTENSION ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "I-1" TO "C-2" ; BY CHANGING A 14. 3 ACRE TRACT OF LAND OUT OF THE COLLEGE ACRES EXTENSION ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "i-1" TO "A-111 ; BY CHANGING A . 91 ACRE TRACT OF LAND OUT OF THE COLLEGE ACRES EXTENSION ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "I-1" TO 11C-2 11 ; PROVIDING FOR SEVERABILITY AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Resolution 78-298 setting a public hearing for September 19, 1978 , to con- sider the rezoning of a tract of land fronting on Washington Boulevard between llth Street and Interstate 10 was approved on a motion made by Coun- cilwoman McGinnis and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 78-299 authorizing Change Order No. 14 to Contract 77148 , H. A. Lott , Inc. (Civic Center Project ) in the amount of $19,429. 00 for electrical and data conduit wire and accessories for the marquee was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -132- August 29, 1978 Resolution 78-300 authorizing payment for Emergency Order #762-H issued to Browning-Ferris Industries for rental of three front loader trucks for garbage pickup on Saturday, July 29, 1978 , (Solid Waste Department ) at A COSt Of $1 , 197. 00 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 78-301 authorizing payment to Westinghouse Electric Corporation for emergency repairs to a pump in the Water Utilities Department at a cost of $3,462 . 00 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Williams. Question : Ayes : All Nayes : None -000 Mrs. Lila Williams, 2585 Gladys Street , addressed Council to say that she had filed a protest of zoning violation with the Planning Department against the Beaumont Art Museum, 1111 9th Street . Mr. Jack Farley, 2270 Gladys Street , invited all to attend the ribbon-cut- ting ceremony Wednesday, 10 : 00 a.m. , for the Crime Prevention "Ex-Offenders Job Support Center. Mr. Albert Koontz, 1620 Euclid, addressed Council to speak in favor of prudent and deliberate zoning in the city. Mrs. Delia Harrington, 815 Willow Street , addressed Council in favor of strict enforcement of litter ordinance. -000- Mayor Meyers called an Executive Session pursuant to Section 2 of the Texas Open Meetings Law. -000- There being no further business , the meeting was recessed before continu- ing with with City Council Workshop Session. -000 I , Myrtle Corgey, City Clerk of the City of Beaumont , Texas, certify that the above is a true copy of the regular City Council session held August 29, 1978.
