City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend Doug Rathgeber, St . John ' s Lutheran Church. The Pledge of Allegiance was led by Councilman Combs. -000- The Minutes of the regular City Council session held May 23, 1978 , were approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Resolution 78-190 authorizing advertising for bids for signal equipment for 18 intersections (Washington and Sabine Pass , Washington and Avenue C , Highland and Woodrow, Doucette and Railroad, Doucette and Irving, Franklin and Avenue C, Calder and Magnolia, College and Langhan , Dowlen and West- gate, Dowlen and Gladys, Main and Franklin, Main and Milam, Main and Col- lege, Main and Bowie, Main and Forsythe, Main and Crockett , Main and Liberty, and Main and Calder - to be funded by Program 13 funds, Revenue Sharing and CAP) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs. (Cost estimates - $350, 000. 00) Question : Ayes : All Nayes : None -000- Resolution 78-191 authorizing the award of a formal bid to Horner Flooring Company for furnishing a portable basketball floor , backstops and storage carts for the Civic Center Complex at a cost of $35, 368 . 00 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . ),. Resolution 78-194 authorizing the award of a formal bid to Perey Manu- facturing Company for furnishing three (3) turnstiles and three (3) ticket receptacles for the Civic Center Complex at a cost of $3 , 030. 00 was approved on a motion made by Councilman Combs and seconded by Councilman Evans . Question: Ayes : All Nayes : None -000- Resolution 78-195 authorizing the award of a formal bid to Swab Wagon Com- pany, Inc . for furnishing three (3) animal rescue units (to be placed on trucks) at a cost of $9,450. 00 was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question : Ayes : All Nayes : None -000- Resolution 78-196 authorizing the award of bid of list price to Pak-Mor Manu- facturing Company for furnishing replacement parts for Packer Bodies was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question : Ayes : All Nayes : None -000- Resolution 78-197 authorizing the award of bid to Mabry Foundry for furnish- ing manhole covers and meter boxes for the Water Utilities Department at a cost of $27, 266 . 50 was approved on a motion made by Councilman Combs and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 78-198 authorizing the award of bid and the execution of lease agreements with Xerox Corporation for two (2) Xerox 4000 copiers for the Police Department at a cost of $255 . 00 per month plus $. 024 per copy .for each copy in excess of 6, 985 copies was approved on a motion made by Coun- cilwoman McGinnis and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- An ordinance authorizing a zoning change from R-2 to C-1 for a 0.48 acre tract located on the south side of Arabella Street between Brien and At lanta Avenues was considered: AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS', AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING A 0.48 ACRE TRACT OF LAND OUT OF THE O'BRIEN AND BORDAGES ADDITION AND THE GERTZ ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED PRESENTLY ZONED "R-2" TO 11C-111 ; PROVIDING FOR SEVER- ABILITY AND PROVIDING A PENALTY. Councilwoman McGinnis made a motion to deny the zone change; the motion was seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Ordinance No . 78-59 authorizing a zoning change from R-1 to R-2 for 18 . 6 acres and from R-1 to R-21,2 for 30.7 acres located approximately 400 feet west of the Manion Road/Major Drive intersection, on the north side, was considered : May 30, 1978 ORDINANCE NO. 78-59 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED ON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , BY CHANGING AN 18 . 646 ACRE TRACT OF LAND OUT OF THE A. HUSTON LEAGUE, ABSTRACT 33, BEAUMONT, JEFFERSON COUNTY, TEXAS , AS HEREINAFTER DES- CRIBED AS TRACT 1 , PRESENTLY ZONED "R-1" TO "R-21' ; AND BY CHANGING A 30. 712 ACRE TRACT OF LAND OUT OF THE A. HUSTON LEAGUE, ABSTRACT 33 , BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED AS TRACT 2 , PRESENTLY ZONED "R-1" TO "R-2M" ; PROVIDING FOR SEVER- ABILITY AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Evans and secon- ded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Ordinance No . 78-60 authorizing a zoning change from R-,1 to LR-1 of a 0.52 acre tract located in the 900 block of Avalon Avenue (request by Quick Pantry) was considered : ORDINANCE NO. 78-60 ENTITLED AN .ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING A 0. 52 ACRE TRACT OF LAND OUT OF THE MAYFAIR ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HERE- INAFTER DESCRIBED PRESENTLY ZONED ''R-1" TO "LR-111 ; PROVIDING FOR SEVERABILITY AND PRO- VIDING A PENALTY. The ordinance was approved on a motion made by Councilman Combs and secon- ded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Ordinance No . 78-61 revising the speed limit on a portion of Calder Ave- nue from 50 MPH to 40 MPH (from a point 150 ' west of the center line of the Caldwood Cut-off Ditch Bridge to a point 2, 800 ' west of the center lice of FM 364 (Major Drive) was considered: ORDINANCE NO. 78-61 ENTITLED AN ORDINANCE AMENDING CHAPTER 37, SECTION 37-58 . 2 TO CHANGE THE SPEED LIMIT ON A PORTION OF CALDER AVENUE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AIM PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis . Question : Ayes: All Nayes : None -000- May 30, 1978 Resolution 78-199 authorizing final payment to Mar-Len, Inc., Contractor, of $19, 928 . 60, and Kohler & Kohler, . Engineers, of $1 ,880. 19, for con- struction and engineering services for a sanitary sewer line along Dela- ware Street from Dowlen Road east , approximately 4,300 feet was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Resolution 78-200 authorizing the City Manager to execute an agreement with Milton Bell and D. Rex Goode for architectural and other professional services for the construction, restoration, alterations and additions to the Municipal Auditorium, Project #, 70-74-013 , fee not to exceed $136,607 , was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000-• Resolution 78-201 authorizing the acceptance for City maintenance the street , water and sewer improvements in Delaware Place (Littlefield, Ashdown , Annandale, Chadwick, Dunleith, Monticello, Elmhurst and Tara) was approved on made by Councilman Evans and seconded by Councilwoman McGinnis. Question : Ayes : All Nayes : None -000- Resolution 78-202 supporting the application of Southwest Airlines to provide service to Jefferson County Airport was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- The second reading of an ordinance granting the Atchison, Topeka and Santa Fe Railway Company a renewal franchise for Track No. 91 in Blanchette Street between Neches and Park Streets was held: AN ORDINANCE AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, ITS SUCCESSORS, ASSIGNS AND LESSEES, THE RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE AN INDUSTRY TRACK FROM A POINT IN BLANCHETTE STREET SOUTHEASTERLY OF BLOCK 69, OF THE OLD TOWN OF BEAUMONT CONNECTING WITH THE PARALLEL TO THE MAIN TRACK OF THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY NOW CONSTRUCTED IN SAID STREET AND RUNNING DOWN SAID BLANCHETTE STREET TO A POINT OPPOSITE LOT NO. 357 IN SAID BLOCK IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN ACCORD WITH EXHIBIT ATTACHED HERETO; PROVIDING THAT SAID TRACK SHALL BE USED ONLY FOR THE PURPOSE OF LOADING, UN- LOADING AND SWITCHING TO INDUSTRIAL TRACKS SERVING COMMERCIAL ENTERPRISES; PROVIDING REGULATIONS AND RESTRICTIONS FOR THE USE OF SAID TRACK; PROVIDING THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT CERTAIN MAINTENANCE WORK SHALL BE DONE AT THE DIRECTION OF THE CITY ENGINEER; PROVIDING FOR THE ACCEPTANCE AND FEE HEREUNDER; PROVIDING THAT THIS FRANCHISE IS SUBJECT TO THE CHARTER AND ORDINANCES OF THE CITY OF BEAUMONT AND PROVIDING FOR TERMINATION AND FAILURE TO USE THE TRACK FRANCHISED HEREUNDER; PROVIDING FOR TERMINATION OF THIS FRANCHISE ON JUNE 14 , 1979 AND THE RESTORATION OF SAID STREETS WITHIN NINETY (90) DAYS THEREAFTER; AND PROVIDING FOR IN- DEMNIFICATION OF THE CITY OF BEAUMONT.
