Councilman, Ward I Vi McGinnis Councilwoman, Ward II Calvin Williams Councilman, Ward III Leroy Evans Councilman, Ward IV Ray Riley City Manager Kenneth Wall City Attorney -000- The Invocation was given by the Reverend Cecil Pemberton, Woodland Baptist Church. The Pledge of Allegiance was led by Councilman Williams. -000- The following proclamations were issued : "Beta Sigma Phi Day in Beaumont" April 27, 1978 ; "Small Business Week in Beaumont" - May 1-6, 1978 ; "Sickle Cell Anemia Month in Beaumont May, 1978; "Secretaries ' Week in Beaumont" April 23-29, 1978 ; "'Clean Air Week in Beaumont" - May 1-7, 1978 ; and "Dance Weed in Beaumont" April 24-30, 1978 . -000- The Minutes of the regular City Council session held April 18, 1978 , were approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes : None -000- Resolution 78-143 authorizing the award of formal bid to Oil City Tractors for furnishing two (2) flail mowers for use by the Parks & Recreation De- partment at a cost of $3 , 290. 00 was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Resolution 78-144 authorizing the award of bid and the execution of a con- tract with Olivetti Corporation of America for furnishing a maintenance a.-reement for the City's IBM typewriters ($40. 16 each or an estimated total c 74 , 819. 20 -- contract period from April 25, 1978 through April 24, 1979) w•)s approved on a motion made by Councilman Evans and seconded by Council- McGinnis. Question: Ayes : Councilwoman McGinnis Councilman Williams Councilman Evans Nayes : Mayor Meyers Councilman Combs -000- resolution authorizing the award of bid and the execution of a five-year contract with S & S Food Distribution Corp. for furnishing a concession April 25, 1978 contract for City Parks, Harvest Club, YMBL Hall, Athletic . Complex and covered areas at Fair Park was considered. A motion to approve the resolu- tion was made by Councilwoman McGinnis; Councilman Evans seconded the motion. Question : Ayes: Councilwoman McGinnis Councilman Evans Nayes : Mayor Meyers Councilman Combs Councilman Williams Councilman Williams then made a motion to award the Concessionaire ' s con-, tract to Charlie' s Port-a-Rental ; motion was seconded by Councilman Combs . Question: Ayes : Mayor Meyers Nayes : Councilwoman McGinnis Councilman Combs Councilman Evans Councilman Williams -000- Resolution 78-145 authorizing Ray Riley, City Manager, to be the designated official to execute all documents concerning Environmental Protection Agency Grant #C-48-1254-01-0 for the construction of a Wastewater Treatment Works was approved on a motion made by Councilman Combs and seconded by Council- man Evans. Question : Ayes : All Nayes : None -000. Resolution 78-146 authorizing final payment to Jay Garth, Inc. for construc- tion of a ramp for the physically handicapped at the Fair Park Coliseum (final payment - $469. 50) was approved on a motion made by Councilman Evans and seconded by Councilman Williams. Question : Ayes : All Nayes: None --000- Resolution 78-147 authorizing the City Manager to execute Addendum No, 2 for engineering services for a 5 MGD water well and transmission line, 5 MG ground storage tank and increased high service pumping capacity (Hardin County) authorized by the 1971 CIP Water Works Improvements and funded from the $1 , 000, 000 Waterworks System Revenue Bonds sold March 14, 1978 was approved on a motion made by Councilwoman McGinnis and seconded by Council- man Williams. Question: Ayes ; All Nayes : None -000- Resolution 78-148 authorizing participation in the ICMA Retirement Program was approved on a motion made by Councilwoman McGinnis and seconded by Coun- cilman Williams. Question: Ayes : All Nayes : None -000- A00,ointment of Maurice Meyers and J. Leroy Evans to the South East Texas Regional Planning Commission Board, replacing Ken Ritter and Don Cash, was approved on a motion made by Councilwoman McGinnis and seconded by Council- man Combs. Question : Ayes : All Nayes : None -000- Appointment of Tom Combs, Jr. as ex-officio member to the Airport Advisory Committee, replacing Don Cash, was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- April 25, 1978 The second reading of an ordinance granting the Atchison, Topeka and Santa Fe Railway Company a renewal franchise for Track No. 87 which crosses Frank- lin Street between Trinity and Archie Streets was considered: AN ORDINANCE AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, ITS SUCCESSORS, ASSIGNS AND LESSEES, THE RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE AN INDUSTRY SPUR TRACT NO. 87 CROSSING FRANKLIN STREET BETWEEN TRINITY STREET AND ARCHIE AVENUE IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN ACCORD WITH EXHIBIT ATTACHED HERETO; PRO- VIDING THAT SAID TRACK SHALL BE USED ONLY FOR THE PURPOSE OF LOADING, UNLOADING AND SWITCHING TO INDUSTRIAL TRACT SERVING COMMERCIAL ENTERPRISE; PROVIDING REGULATIONS AND RESTRICTIONS FOR THE USE OF SAID SPUR TRACT; PROVIDING THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT CERTAIN MAIN- TENANCE WORK SHALL BE DONE AT THE DIRECTION OF THE CITY ENGINEER; PROVIDING FOR THE ACCEPTANCE AND FEE HEREUNDER; PROVIDING THAT THIS FRANCHISE IS SUBJECT TO THE CHARTER AND ORDINANCES OF THE CITY OF BEAUMONT AND PROVIDING FOR TERMINATION FOR FAILURE TO USE THE TRACK FRANCHISED HERE- UNDER; PROVIDING FOR TERMINATION OF THIS FRANCHISE ON FEBRUARY 24, 1983 AND THE RESTORATION OF SAID STREET WITHIN NINETY (90) DAYS THEREAFTER; AND PROVIDING FOR INDEMNIFICA- TION OF THE CITY OF BEAUMONT. The ordinance was passed to its third and final reading on a motion made by Councilwoman McGinnis and seconded by Councilman Combs. John Wasser, 5340 Landry Lane, member of the Beaumont Jaycees , addressed Council to say, that Sunday, April 30th, at 2 :00 p.m. in the Jefferson Thea- tre, the Beaumont Jaycees will present the "Miss Beaumont Scholarship Pageant . He said that 13 ladies are competing to represent Beaumont in the Miss Texas Pageant in Fort Worth in the fall .
