Question: Ayes: All Nayes: None -000- Resolution 78-81 authorizing the award of formal bid to Wallace Refrigera- tion for a three-year lease plan in the amount of $14 ,094. 00 with an option to purchase ice machines for use by the Public Works Department was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Resolution 78-82 authorizing the award of bid to Betts and Majors of Dallas for furnishing supplies for the Police Department "s breathalizer testing equipment in the amount of $1 , 020. 00 was approved on a motion made by Coun- cilman Evans and seconded by Councilman Cash. Question : Ayes: All Nayes : None -000 Ordinance No. 78-25 allocating and appropriating $2, 160,000 for the con- struction of the Irving Street Grade Separation Project and authorizing the award of bid to Trotti and Thomson in the amount of $3, 071 , 372 .27 was considered: ORDINANCE NO. 78-25 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1 , 1977, AND ENDING SEPTEMBER 30, 1978, BY ALLOCATING AND APPROPRIATING $2, 160, 000 TO THE IRVING STREET GRADE SEPARATION PROJECT NO. 071- 74-141 ; AWARDING A CONSTRUCTION CONTRACT FOR SAID PROJECT TO TROTTI AND THOMSON, INC. IN THE AMOUNT OF $3 , 071 , 372.27; AUTH- ORIZING THE CITY MANAGER TO EXECUTE A CONTRACT FOR SAID CONSTRUCTION PROJECT; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. Question : Ayes: All Nayes: None -000- Ordinance No. 78-27 appropriating $1 ,700 from Unappropriated Park Improvement Funds to be used for the replacement of the roof on the existing shelter at Carroll Street Park was considered: ORDINANCE NO. 78-27 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1 , 1977, AND ENDING SEPTEMBER 30, 1978, BY APPROPRIATING $1 ,700. 00 FROM THE UNAPPROPRIATED PARK IM- PROVEMENT FUNDS FOR USE IN THE REPLACEMENT OF THE ROOF OF THE EXISTING SHELTER AT CARROLL STREET PARK. The ordinance was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question : Ayes: All Naves: None March 7 , 1978 Resolution 78-84 appointing Joe Carlucci, Naaman Woodland, Bonnie Cokinos, Marsha Woody, Robert Scevers, Jodie Richards, Lynn Walker, Al Sacker, Don Kelly and Frank Skibba to the City Auditorium Renovation Advisory Committee was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question: Ayes : All Nayes : None -000- Ordinance No. 78-28 amending the ordinance calling a General Municipal Elec- tion (South Park Independent School District withdrew) was considered: ORDINANCE NO. 78-28 ENTITLED AN ORDINANCE AMENDING ORDINANCE NO. 78-17 TO REPEAL PROVISIONS PROVIDING FOR A JOINT ELECTION WITH THE SOUTH PARK INDEPENDENT SCHOOL DISTRICT AND PROVIDING FOR REPEAL. . The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question : Ayes : All Nayes: None -000- Ordinance No. 78-29 revising the speed limits on State Highway 105 was considered: ORDINANCE NO. 78-29 ENTITLED AN ORDINANCE AMENDING SECTION 37-58H(c) BY CHANGING THE SPEED LIMIT ON STATE HIGHWAY 105 WHEN SIGNS ARE ERECTED GIVING NOTICE THEREOF; PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question : Ayes: All Nayes : None -,000 Resolution 78-86 authorizing the settlement to the EEO claim of Sherman Cohen was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Fortney who served as Acting Health Director for two (2) months at a cost of $2 , 000. 00 was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None 000 Resolution 78-88 authorizing the execution of three (3) quitclaim deeds to Mel Shelander (Lot 10, Block 35, Calder Addition - $450. 00) , 0. B. Moore, Sr. (Lot 21 , Block 15, West Oakland Addition - $700.00) , and John L. and Kary Fallon (West twenty feet of Lot 32, Block 4, Gulf Terrace Addition - $50. 00) was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- March 7, 1978 Ordinance No. 78-30 approving the preliminary official statement for the bond sale was considered: ORDI - ORDINANCE NO. 78 30 ENTITLED AN ORDINANCE APPROVING THE PRELIM- INARY OFFICIAL STATEMENTS OF THE CITY OF BEAUMONT, DATED MARCH 2, 1978 , RELATING TO $7, 740, 000 PERMANENT IMPROVEMENT BONDS, SERIES 1978 , AND $1, 000, 000 WATERWORKS SYSTEM REVENUE BONDS, SERIES 1978-A; AUTH- ORIZING THE MAYOR TO EXECUTE A CERTIFICATE RELATING THERETO; AND RATIFYING ALL ACTS OF CITY OFFICERS AND AGENTS RELATING TO THE PUBLICATION AND DI'STRIBUTI'ON THEREOF. The ordinance was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- Mr . Robert Greenleaf , 4395 El Paso, addressed Council in opposition to special use permits to allow operation of children "s day care nursery centers in areas zoned R-1 to allow only single family dwelling. Mr. Ray Taylor, 1096 Oregon Street , addressed Council concerning the bad condition of some city streets and to also ask for more signs to be posted near street repair sites. He also suggested the need for a committee to study the parking needs (on the streets) around Lamar University. Mrs. Ettie Fazio, 1919 Sabine Pass, addressed Council to request City assist- ance with her gas bill with Ehtex for a garage apartment that burned down several months ago. Ms. Orine Green, member and co-founder of the Beaumont Progressive Cultural Society, said that her group is sponsoring the first Black Arts Festival in the State in Beaumont on March 31 , 1978 , and urged all interested citizens to attend. -000-, There being no further business, the meeting was recessed before continuing with the City Council Workshop Session. -000- I , Myrtle Corgey, City Clerk of the City of Beaumont , Texas, certify that the above is a true copy of the regular City Council session held March 7, 1978.
