The Pledge of Allegiance was led by Councilman Evans. -000- Mayor Ritter issued the following proclamation : "National Engineers Week in Beaumont" - February 19-25, 1978 . -000- The Minutes of the regular City Council sessions held February 7 and 14, 1978 were approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis . Question: Ayes : All Nayes: None -000- Resolution 78-67 authorizing the award of bid and the execution of an annual contract with Kinsel Ford, Inc. for repairing wrecked City vehicles was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- Ordinance No. 78-19 transferring $6, 199 from the Unappropriated Balance of the General Fund to the General Fund (Fire Department ) Account 34-503 and authorizing the award of bid to Claude Wright and Associates (American LaFrance) for furnishing one (1) 100 ft . custom aerial fire truck with 100 ft . waterways and 1 , 000 G.P.M. Pump ('total cost $156, 199. 00) was considered : ORDINANCE NO. 78-19 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD BEGINNING OCTOBER 1 , 1977, AND ENDING SEPTEMBER 30, 1978 , BY TRANSFERRING $6, 199. 00 FROM THE UNAPPROPRIATED BALANCE OF GENERAL FUND ACCOUNT TO THE GENERAL FUND (-FIRE DEPARTMENT) ACCOUNT NO. 34-503 FOR AWARDING THE BID FOR FURNISHING ONE (1) 100 FT. CUSTOM AERIAL FIRE TRUCK WITH 100 FT. WATERWAYS AND 1 , 000 G.P.M. PUMP TO CLAUDE WRIGHT & ASSOCIATES (AMERICAN LAFRANCE) . February 21 , 1978 The ordinance was approved on a motion made by Councilman Williams and se- conded by Councilman Evans . Question: Ayes : All Nayes : None -000- Resolution 78-68 authorizing the award of bid to Becker Printing Company for furnishing five thousand (5, 000) handbooks for City employees at a cost of $1 , 107. 15 was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis . Question: Ayes : All Nayes : None -000 Ordinance No. 78-20 authorizing abandonment of a 15' x 426 ' alley located in Block 12B of the W. W. Chaison Addition and bounded by Lavaca, Irby, Brandon, and Lakner Streets and retaining a general utility easement was considered: ORDINANCE NO. 78-20 ENTITLED AN ORDINANCE VACATING AND ABAN- DONING A FIFTEEN FOOT (15 " ) ALLEY, PROVIDING THAT A GENERAL UTILITY EASEMENT IS RETAINED, IN THE W. W. CHAISON ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman Cash and seconded by Councilman Evans . Ordinance No. 78-21 authorizing abandonment of a 16 ", x 112 " utility easement located in Lot 15, Block 2 , Wescalder Estates Addition and retaining a 51' x 171 guy wire easement was considered: ORDINANCE NO. 78-21 ENTITLED AN ORDINANCE VACATING AND ABANDONING A SIXTEEN FOOT (16'' ) UTILITY EASEMENT OUT OF LOT 15, BLOCK 2 , WEST-- CALDER ESTATES ADDITION IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes: All Mayes : None *-.000 . Ordinance No. 78-22 correcting a typographical error in the caption of Ordi- nance 78-12 , passed by the City Council on January 31 , 1978 , which granted a zone change from R-2 to C-1 of a tract of land generally at the intersection of Highway 105 and Walker Road was considered : ORDINANCE NO. 78-22 ENTITLED AN ORDINANCE REPEALING ORDINANCE 78-12 AND CORRECTING SAID ORDINANCE BY AMEND- ING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUN- DARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CITY OF BEAUMONT, TEXAS, BY CHANGING A 7 . 88 ACRE TRACT LOCATED IN THE DAVID EASLEY SURVEY IN BEAUMONT, JEF_ FERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED 11R,-21,1' TO "C-114'; PROVIDING FOR SEVERABILITY AND PROVIDING A PENALTY. February 21 , 1978 The ordinance was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- Resolution 78-69 authorizing a name change from the Fair Park "Arena" to the Fair Park "Coliseum" was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question : Ayes: All Nayes : None -000 Resolution 78-70 authorizing final payment to Southwestern Laboratories for testing conducted in conjunction with Phase II improvements at Beaumont Municipal Airport at an,-.amount of $3 , 939. 37 was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Resolution 78-71 accepting additional securities in the amount of $2, 000,000 of U. S. Treasury Notes, which have been pledged to the City's Time and De- mand Deposits by the American National Bank was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes : None -000 Resolution 78-72 authorizing execution of an agreement with Gulf States Utilities Company for the undergrounding of distribution lines along Main Street at an estimated cost of $29, 822.83 was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question : Ayes : All Nayes : None -000 Ordinance No. 78-23 adopting the Affirmative Action Plan was considered: ORDINANCE NO. 78-23 ENTITLED AN ORDINANCE ADOPTING THE AFFIRMA- TIVE ACTION PLAN OF THE CITY OF BEAUMONT; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes: None 000 The first reading of the Annexation Ordinance was held : AN ORDINANCE ENTITLED AN ORDINANCE ANNEXING, THE HEREIN- AFTER DESCRIBED TERRITORY TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AND EX- TENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE THE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE CITY LIMITS, AND GRANTING TO SAID TERRITORY AND TO ALL FUTURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF SAID CITY. February 21 , 1978 Resolution 78-73 authorizing the award of bid to J. Garth, Inc. for the construction of a ramp for handicapped' at the Fair Park Coliseum at a cost of $9, 390. 00 was approved on a motion made by Councilman Cash and seconded by Councilman Evans.
