Asst . to Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk -000- ?Mayor Ritter issued two proclamations : "Black History Month" February, 1978 and "National Vocational Education Week" February 12-18 , 1978. -000- The minutes of the regular City Council session held January 31 , 1978 , were approved on a motion made by Councilwoman McGinnis and seconded by Councilman Williams. Question : Ayes : All Nayes : None -000- Mr. Thompson announced that the request for zone change for property located at Braeburn and Major Drive had been dropped .. -000- Resolution 78-50 authorizing the advertising for bids for furnishing a ramp at the Fair Park Arena to allow access by handicapped was approved on a mo- tion made by Councilman Williams and seconded by Councilwoman McGinnis . Question: Ayes: All Nayes: None -000 Resolution 78-51 authorizing the award of bids and the execution of contracts with Allied Chemical Company ($137. 80 pet ton) , Jones Chemicals, Inc. ($182 . 00 per ton) , and Austin White Lime ($62 . 80 per ton) for furnishing chemicals for water treatment for the Water Production Plant was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Resolution 78-52 authorizing the award of informal bid to Triangle Equipment Ir_c. ($1 , 785. 00) for three (3) portable heating units for the Central Garage wa. approved on a motion made by Councilwoman McGinnis and seconded by Coun- cilman Evans . Question : Ayes: All Nayes : None -000- Resolution 78-53 authorizing the award of bids and the execution of contracts with Gulf Oil Corp. and Martin Matthews, Inc . (Union Oil) for furnishing petrol- eum products for the City' s fleet of vehicles and equipment was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question : Ayes : All Nayes: None -23- February 7 , 1978 Ordinance No. 78-13 adopting the 1978 National Electrical Code was considered : ORDINANCE NO. 78-13 ENTITLED AN ORDINANCE AMENDING CHAPTER 11 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS, BY AMENDING SECTION 11-35 (b) TO ADOPT THE 1978 NATIONAL ELECTRICAL CODE ; PROVIDING FOR REPEAL; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE . The ordinance was approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Williams. Question : Ayes : All Nayes : None -000- Ordinance No. 78-14 authorizing the execution of a boundary line agreement between the City of Beaumont and the Port of Beaumont and authorizing the execution of a deed to the Port of Beaumont and acceptance of certain util- ity easements was considered: ORDINANCE NO. 78-14 ENTITLED AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A BOUNDARY LINE AGREE- MENT WITH THE PORT OF BEAUMONT; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED TO THE PORT OF BEAUMONT; AUTHORIZING ACCEPTANCE FROM THE PORT OF BEAUMONT OF CERTAIN UTIL- ITY EASEMENTS AND STREET RIGHTS-OF-WAY; VACATING AND ABANDONING A PORTION OF EULA STREET FROM BUFORD STREET TO THE NECHES RIVER, IRVING STREET FROM BUFORD STREET TO FINIS STREET, FINIS STREET FROM EULA TO GREER STREET; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Cash. The ordinance was approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Evans . Question : Ayes : All Nayes : None 000 PUBLIC HEARING GULF STATES UTILITIES COMPANY REQUEST FOR RATE INCREASE Mr. Ward McCurtain, Manager, Beaumont Division of Gulf States Utilities Com- pany made a presentation for the rate increase. Discussion was held by Council . Mayor Ritter opened the hearing for citizen comments. Mr. J. C. Leggett , 1849 Washington Boulevard, addressed Council in opposition to the rate increase. Mr. Walter Swift , 1475 Avenue F, addressed Council in favor of the rate in- crease. Mr. Kenneth Wall , City Attorney, stated to Council and citizens that the rates would be set by the Utility Commission. The public hearing was closed. -000- PUBLIC HEARING ANNEXATION Mr. Jim Thompson, Administrative Assistant to the City Manager, gave a des- cription of five areas to be included in the annexation. In answer to a question from Councilman Evans as to why consideration was not given to taking in more property in this annexation, Attorney Kenneth Wall responded that these five areas were the only areas requested and that the City Council could, at any time, pass another ordinance to include additional property. Councilman Williams asked if we have a plan on annexation. Planning Director John Anderson answered that his department was not involved in the areas be- ing annexed today since the areas (schools, etc . ) requested to be annexed but that they will have a definitive recommendation in the near future; the plan is not ready yet . Councilwoman McGinnis stated that it is difficult to decide on areas to be annexed until a master plan is ready. Mr. Anderson told the Council that today' s annexation is 75 square miles, some not yet developed. -25- February 7, 1978 Mr. John Dunlap, 335 4th Street , with the Missouri Pacific Railroad, asked which property included in today' s ordinance effected the Railroad. Kenneth Wall told him theonly property involving the Railroad, to some small extent , was near Municipal Airport .
