HomeMy WebLinkAboutMIN AUG 30 1977 REGULAR SESSION CITY COUNCIL - CITY OF BEAUMONT HELD AUGUST 30, 1977 BE IT REMEMBERED that the City Council of the City of Beaumont , Texas, met in regular session this the 30th day of August , 1977 , with the following present : HONORABLE : Ken Ritter Mayor Don Cash Councilman , Ward I Vi McGinnis Councilwoman, ;yard II Leroy Evans Councilman, Ward IV Absent : Calvin Williams Councilman , Ward III Howard ?McDaniel City Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend Ray Morgan, Westgate Memorial Baptist Church. The Pledge of Allegiance was led by Councilman Cash. -000- Mmes . JoAnn Hathaway , Carol Nelson and Sissy Williams, members of the Beaumont Heritage Society, presented to the Council and staff 2-volume copies of "Spare Beaumont" - the historical survey jointly sponsored by a KUD comprehensive grant . Maurine Gray, City Librarian , was presented the first copy -- a total of 100 copies were given to the City. -000- The Minutes of the regular City Council session held August 23 , 1977 , were approved on a motion made by Councilman Evans and seconded by Coun- cilman McGinnis . Ouestion : Ayes : All Nayes : None -000- The Mayor issued the following proclamation : "Jerry Lewis Muscular Dystro- phy Weekend in Beaumont" - September 4th & 5th, 1977 . -000- Resolution 77-244 authorizing the advertising for bids for furnishing four (4) vehicles for the Police Department was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question : Ayes : All Nayes : None --000- Resolution 77-245 authorizing advertising for bids for furnishing reinforced concrete box culverts for the replacement of the damaged bridge on Langham Road crossing Janes Gulley (Drainage District 6 bridge - agreed that the City will furnish box culverts and D.D. 6 will install them) was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- Resolution 77-246 authorizing the award of bids to Dixie Truck Center for furnishing one ( l) cab chassis truck ($7, 199. 00) ; two (2) dual wheel cab chassis trucks (with three cubic yard body - $23 , 846 . 00) ; three (3) six cubic ,yard dump trucks ($43 ,677 . 00) ; and one (1) standard one-half ton pickup truck ($4 , 575. 00) was approved on a motion made by Councilman Cash and seconded by Councilman Evans . Question : Ayes : All Nayes : None -135- August 30, 1977 Resolution 77-247 authorizing the award of bids to Veped Traffic Controls , Inc . and Westinghouse Electric Company for furnishing traffic signal poles , arms and luminaries for use in the Traffic and Transportation Department (Orleans Street Mall - CAP 45-ST-06) was approved on a motion made by Coun- cilwoman McGinnis and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- Resolution 77-248 authorizing the award of bid to Environmental Sales and Service for furnishing one (1) water pressure cleaner for use by the Sewer Maintenance Division at a cost of $14 ,800. 00 was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question : Ayes: All Nayes : None -000- Resolution 77-249 authorizing the award of bid to Tidelands International , Inc . for furnishing two (2) 1500-gallon water tank trucks for use in the Street Division at a cost of $30, 870. 00 was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question : Ayes : All Nayes: None -000- Ordinance No. 77-91 authorizing a zoning change from R-1 (Single Family Dwelling) to R-2M (Medium Density Multiple Dwelling) of a 13. 70 acre tract out of the F. Bigner Survey, located on the north side of Folsom Drive , approximately 960 feet west of Cecil Drive (5400 Block of Folsom) was considered : ORDINANCE NO. 77-91 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , BY CHANGING A 13. 70 ACRE TRACT OF LAND OUT OF THE F. BIGNER SURVEY, ABSTRACT 1 , LOCATED ON THE NORTH SIDE OF FOLSOM DRIVE IN THE 5400 BLOCK APPROXIMATELY 960 FEET ;PEST OF CECIL DRIVE, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREIN- AFTER DESCRIBED, PRESENTLY ZONED "R-111 , TO "R-2M" ; PROVIDING FOR SEVERABILITY AND PROVID- ING A PENALTY. Councilman Cash made a motion to approve the zoning change. A lengthy discussion was held concerning the 6. 2 acre tract presently zoned R-1 proposed as a buffer for the residential addition adjacent to the pro- perty . Mr . Pat Peyton , attorney representing the applicant for the change, Mr. E.D. Brady, addressed Council saying it is the intention of his client to develop the 6. 2 acre tract single family residential as required by the R-1 classi- fication and that a contractural agreement could be made for the buffer zone to remain R-1 . Councilwoman McGinnis seconded the motion made by Councilman Cash with an amendment providing that a contractural agreement be made with respect to the buffer zone remaining R-1 . Question : Ayes : All Nayes : None -000- -136- August 30, 1977 Ordinance No . 77-92 authorizing the abandonment of a 20-foot alley, located in Block 1 , Wingfield Addition (Legion and Boyd Streets) was considered : ORDINANCE NO. 77-92 ENTITLED AN ORDINANCE VACATING ANT) ABANDONING A TWENTY FOOT (201 ) ALLEY LOCATED IN BLOCK 1 , WINGFIELD ADDITION, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS , AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000 Resolution 77-250 authorizing the issuance of a purchase order to Kinsel Ford, Inc . for repairs to 1977 Ford Police Car #10-1103 ($1 , 105. 72 to be reimbursed by State Farm Insurance Company) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Resolution 77-251 authorizing the execution of a quitclaim deed to Joseph and Dorothy Jane Guillory (Neches River Park Addition) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- Resolution 77-252 reappointing Dewey Gonsoulin to the Civil Service Commis- sion for a three year term ending August 1 , 1980 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- Resolution 77-253 authorizing the release of weed liens (E. E. Wetherington, $10. 00; Mrs . Beatrice Butler , $13 . 32; Herbert Oldham, $29. 00; Robert Brous- sard, $10. 19; Tortoris Rentals, 455, 00, %55. 00 & $55. 00; Amanda Johnson Estate, $55. 00; Charles Ferguson, $25. 00,• Gulf Building & Loan, $55. 00; Glenn Justice Mortgage Co. , Inc . , $55. 00; and Arteal Fontenot , $10. 92) was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- Ordinance No. 77-93 granting Atchison , Topeka and Santa Fe Railway Company a renewal franchise for Industry Track No . 65 which crosses Jirou Street between Ashley and Evalon Streets was given its third and final reading: ORDINANCE NO. 77-93 AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMnANY, ITS SUCCESSORS , ASSIGNS AND LESSEES , THE RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE AN INDUSTRIAL SPUR TRACT FROM A POINT IN JIROU STREET IN MCFADDIN ' S FIRST ADDITION TURNING OUT OF TRACK NO. 65 OF THE ATCHISON, TOPEKA AND SANTA FE RAILWAY C0111PANY NOW CONSTRUCTED IN SAID STREET AND RUNNING NORTHEASTERLY ACROSS THE EAST ONE-HALF OF SAID STREET, AND ENTERING RAILWAY COMPANY' S PROPERTY IN LOT6, BLOCK 3 OF SAID ADDITION, IN THE CI'T'Y OF BEAUMONT, JEFFER- SON COUNTY, TEXAS, IN ACCORD WITH EXHIBIT ATTACHED HERETO; -137- August 30, 1977 PROVIDING THAT SAID TRACK SHALL BE USED ONLY FOR THE PUR- POSE OF LOADING, UNLOADING AND SWITCHING TO INDUSTRIAL TRACK SERVING COMMERCIAL ENTERPRISE; PROVIDING REGULATIONS AND RESTRICTIONS FOR THE USE OF SAID TRACK; PROVIDING THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT CERTAIN MAIN- TENANCE WORK SHALL BE DONE AT THE DIRECTION OF THE CITY ENGINEER; PROVIDING FOR THE ACCEPTANCE AND FEE HEREUNDER; PROVIDING THAT THIS FRANCHISE IS SUBJECT TO THE CHARTER AND ORDINANCES OF Tf:E CITY OF BEAUMONT AND PROVIDING FOR TERMINATION FOR FAILURE TO USE TEE TRACK FRANCHISED HERE- UNDER; PROVIDING FOR TERMINATION OF THIS FRANCHISE ON JULY 22, 1982 AND THE RESTORATION OF SAID STREET WITHIN NINETY (90) DAYS THEREAFTER; AND PROVIDING FOR INDEMNI- FICATION OF THE CITY OF BEAUMONT. Question : Ayes : All Nayes : None -000- Ordinance No . 77-94 granting Atchison , Topeka and Santa Fe Railway Company a renewal franchise for Industry Track No. 91 in Blanchette Street between Neches and Park Streets had its third and final reading: ORDINANCE NO. 77-94 AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, ITS SUCCESSORS , ASSIGNS AND LESSEES, THE RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE AN INDUSTRY TRACK FROM A POINT IN BLANCHETTE STREET SOUTHEASTERLY OF BLOCK 69, OF THE OLD TOWN OF BEAUMONT CONNECTING WITH AND PARALLEL TO THE MAIN TRACK OF THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY NOW CONSTRUCTED IN SAID STREET AND RUNNING DOWN SAID BLANCHETTE STREET TO A POINT OPPOSITE LOT NO. 357 IN SAID BLOCK IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN ACCORD WITH EXHIBIT ATTACHED HERETO; PROVIDING THAT SAID TRACK SHALL BE USED ONLY FOR THE PURPOSE OF LOADING, UNLOADING AND SNITCHING TO INDUSTRIAL TRACKS SERVING COMMERCIAL ENTERPRISES; PROVIDING REGULATIONS AND RESTRICTIONS FOR THE USE OF SAID TRACK; PROVID- ING THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT CERTAIN MAIN- TENANCE WORK SHALL BE DONE AT THE DIRECTION OF THE CITY ENGI- NEER; PROVIDING FOR THE ACCEPTANCE AND FEE HEREUNDER; PROVID- ING THAT THIS FRANCHISE IS SUBJECT TO THE CHARTER AND ORDI- NANCES OF THE CITY OF BEAUMONT AND PROVIDING FOR TERMINATION FOR FAILURE TO USE THE TRACK FRANCHISED HEREUNDER; PROVIDDING FOR TERMINATION OF THIS FRANCHISE ON JUNE 14, 1978 AND THE RESTORATION OF SAID STREETS WITHIN NINETY (90) DAYS THEREAFTER; AND PROVIDING FOR INDEMNIFICATION OF THE CITY OF BEAUMONT.
