First United Metho- dist Church. The Pledge of Allegiance was led by Councilman Cash. -000- Mayor Pro Tem McGinnis .issued the following proclamations : "Pony Baseball Week in Beaumont" - August 7-13 , 1977; "Arthritis Week in Beaumont" - Au- gust 15-21, 1977; and "Navy Mothers Week in Beaumont" August 12-20, 1977. -000- The Minutes .of the regular City Council held August 2, 1977, were approved on a motion made by Councilman Cash and seconded by Councilman Evans . Question : Ayes; All Nayes : None -000- Resolution 77-224 authorizing the advertising for bids for the purchase of a radio communications system for the Beaumont Municipal Transit System (UMTA Grant - 90/100 was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question: Ayes : All Nayes : None -000- Resolution 77-225 authorizing the City Manager to submit an application to the Office of Traffic Safety and State Department of Highways and Public Transportation for third-year funding of the Selective Traffic Enforcement Program (STEP) for the period October 1 , 1977 through September 30, 1978 (100To grant ) was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question: Ayes : All Nayes : None -000-- Resolution 77-226 accepting the dedication of a 16-foot wide underground utility and drainage easement out of the A. Williams Survey (Sixteenth (16th) Street extension south from Dowlen to Eastex) was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes : All Nayes : None -122- August 9, 1977 Resolution 77-227 authorizing the acceptance , for City maintenance, the water , sanitary sewer, storm sewer, and concrete pavement improvements in Woodlands Addition, Unit III , Lots 1-12 , Block 4 ; Lots 13-21 , Block 3; and Lots 7-9, Block 8 (Tupelo Lane, Mayhaw and Youpon) was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question : Ayes: All Nayes : None -000 Resolution 77-228 authorizing the acceptance, for City maintenance, the water, sanitary sewer, storm sewer, and concrete pavement improvements in Comstock Place Subdivision, Lots 1-24, Block 3 (Larry Lane) was approved on a motion made by Councilman Cash and seconded by Councilman Evans . Question : Ayes: All Nayes None -000- Resolution 77-229 authorizing the City Manager to apply with the State Of- fice of Traffic Safety for funding of the Construction Barricade and Sian Replacement Program (grant - $14, 963,00 to run from November 1, 1977 to September 30, 19781 was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question : Ayes : All Nayes: None -000- Resolution 77-230 authorizing the City Manager to execute an amendment to the .contract between the City of Beaumont and the International Brotherhood of Police Officers, Local No. 491 (2nd year of contract allows for 6o pay increase with college course incentive pay for fiscal year October 1 , 1977 through September 30, 1978) was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question : Ayes: All Nayes : None -000-- Resolution 77--231 authorizing the City Manager to execute a letter of agreement with the Beaumont Heritage Society for provision of certain ser- vices, including the acquisition and publication (100 bound copies) of a historical survey in the amount of $11 , 000 to be funded by HUD 701 Planning Grant was approved on a motion made by Councilman Evans and seconded by Councilman Cash.. Question: Ayes : All Nayes : None Mrs. Carol. Nelson, Beaumont Heritage -Society, , spoke concerning the completed survey. -000- Ordinance No. 77-83 authorizing the retention of Haskins and Sells to per- form a, comprehensive review of financial procedures and appropriating the sum of $15, 000 to cover the cost thereof was considered : ORDINANCE NO. 77-83 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD BEGINNING OCTOBER 1 , 1976, AND ENDING SEPTEM- BER 30, 1977 , BY APPROPRIATING $15, 000 FROM UNAPPROPRIATED FUNDS TO ACCOUNT NO. 79-415; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH HASKINS & SELLS TO REVIEW THE FINANCIAL PROCEDURES OF THE CITY OF BEAUMONT; AUTHORIZING PAYMENT FOR SUCH REVIEW NOT TO EXCEED $15, 000. The ordinance was approved on a motion made by Councilman Cash and seconded by Councilman. Evans. Question : Ayes: All Nayes : None -123- August 9, 1977 Citizens were invited to address Council concerning an ordinance authorizing a zoning change from R-lA (Single Family Residential) to R-2M (Medium Den- sity Multiple Dwelling) of a 2. 9 acre tract of land out of the H. Williams Survey, located in the 7300-7400 Block of Prutzman Road. Mr . Ed Royer, Developer, explained that he plans to build a 34-unit Town- house Complex for single family purchase and occupancy., if zoning change is granted. Mrs. Corrie Love, 7550 Chelsea Place, addressed Council in opposition to the proposed change. Mr. Floyd Crow, 7560 Chelsea Place, addressed Council in opposition to the proposed change. Mr . James Crain , 7520 Chelsea Place, addressed Council in opposition to the proposed change. Mrs. Doris Brumfield, 7510 Chelsea Place, addressed Council in opposition to the proposed change. Mr. Royer and Mr. E. J. Richard, owner of the property, addressed Council in favor of the proposed change. The item is to be placed on the Agenda for action Tuesday, August 16, 1977. -000- Mrs. Delia Harrington, 815 Willow Street , asked that a traffic sign be placed in the 800 block of Willow Street . -000- PUBLIC HEARING DILAPIDATED STRUCTURES THOSE PRESENT for the Dilapidated Structures Hearing were : Don Cash Councilman, Ward I Vi McGinnis Mayor Pro Tem, Councilwoman Ward II *Calvin Williams Councilman, Ward III Leroy Evans Councilman, Ward IV Absent : Ken Ritter Mayor (* arrived during discussion) The following affidavit was submitted : "THE STATE OF TEXAS 0 COUNTY OF JEFFERSON AFFIDAVIT BEFORE ME, the undersigned authority, on this day personally appeared LEONARD C. HARDY, Director of Housing & Environmental Control Division of the City of .Beaumont , Texas, who, being by me duly sworn , states the fol- lowing: THAT I have personally inspected each of the following listed structures and find each of the same to be "dangerous structures" as defined by Sec- tion 12A-19 of the Code of Ordinances : 1035 ALABAMA STREET, Lot 22, Block 4 , Lamar Addition (40-077-00) ,2505 BLANCHETTE STREET, N/i of the S/z of Lots 1 & 2, Block 7, Cartwright Addi- tion (16-060-00) , 1495 CARTWRIGHT STREET (-GARAGE ONLY) , Lot 6, Block 63 , -124- August 9, 1977 Cartwright Addition (17-141-00) , 1792 LIBERTY STREET, Lot 6, Block 10, McFaddin Second Addition (46-221-00) and 3532 ST. JAMES BLVD. , Lot 22 , Block 7 , West Oakland Addition (67-156-00) . Bassett Notary Public in and for Jefferson County, Texas" 1792 LIBERTY STREET - Mr, R.eN Toodard, attorney representing owner Bill Sanders, requested that the structure not be condemned because the owner wishes to sell the property. In answer to questions by Mr. Nichols, Asst . City Attorney, Mr. Hardy stated that the structure is sound and could be brought up to standards for habitation. After a lengthy discussion, Councilman Evans made a motion to condemn the structure and allow six months for repairs; the motion was seconded by Councilwoman McGinnis. Question : Ayes : Councilwoman McGinnis Nayes : Council- Councilman Evans man Cash 2505 BLANCHETTE STREET - In answer to questions by Councilman Cash, Mr. Hardy stated that this building is structurally sound and the owner is making an apparent effort to repair the structure . Councilman Cash made a motion to condemn the other three structures listed in the above affi- davit and order them. demolished but to hold the structure at 2505 Blanchette for additional information; the motion was seconded by Councilwoman Mc- Ginnis .
