III Howard McDaniel City Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend Dyson Nickle, St. James Episco- pal Church. The Pledge of Allegiance was led by Councilman Cash. -000- Mayor Ritter issued the following proclamations : "YMBL Week in Beaumont" May 15-21, 1977; "Bicycle Safety Week in Beaumont" - May 8-14, 1977 ; "National Transportation Week in Beaumont" - May 15-21; and "Goodwill Week in Beaumont" - May 8-14 , 1977. -000- Ordinance No. 77-50 abandoning a 2. 68 acre portion of Dowlen Road contin- gent upon completion of construction of a new portion of Dowlen Road to replace same was considered: ORDINANCE NO. 77-50 ENTITLED AN ORDINANCE VACATING AND ABANDONING A PORTION OF DOWLEN ROAD BETWEEN FOLSOM ROAD AND THE PROPOSED DOWLEN ROAD CUT-OFF IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN; PROVIDING THAT SAID ABANDON- MENT SHALL BE EFFECTIVE UPON THE COMPLETION OF NEW DOWLEN ROAD TO BE SUBSTITUTED THEREFORE; AND SUSPENDING SUBSECTION 42-5 (7) , TO THE EX- TENT IT MAY BE IN CONFLICT HEREWITH, UNTIL THE PASSAGE OF THIS ORDINANCE BECOMES EFFECTIVE. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 77-136 authorizing the acceptance, for City maintenance, the water, sanitary sewer, storm sewer, and street improvements in Longmeadow Addition, Block 1, Lots 1-14; Block 2, Lots 1-27; and Block 3, Lots 1-15; Shenandoah Drive and Shiloh Drive; was approved on a motion made by Coun- cilwoman McGinnis and seconded by Councilman Cash. Question: Ayes : All Nayes : None -000- -78- May 10, 1977 Resolution 77-137 authorizing the acceptance, for City maintenance, the water, sanitary sewer, storm sewer, and street improvements in Park North Addition, Block 8 , Lots 1-32 and Block 9, Lots 1-26 (Roadrunner Lane, Springdale Lane, and Park North Drive) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- Resolution 77-138 authorizing the City Manager to enter into an agreement with Streety Enterprises to participate in oversize street paving of Shakespeare and Westgate Drives and oversize water lines; and enter into an agreement with Schaumburg & Polk, Consulting Engineers for engineering services for these projects (Revenue Sharing funds will be used) was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Ordinance No. 77-51 regulating the operation of massage parlors was con- sidered: ORDINANCE NO. 77-51 ENTITLED AN ORDINANCE ADOPTING A NEW CHAPTER 19A OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS, TO BE ENTITLED "MASSAGE PAR- LORS : " PROVIDING DEFINITIONS; PROVIDING FOR A REQUIREMENT FOR A BUSINESS LICENSE; PROVIDING FOR MASSAGISTS ' PERMITS; PROVIDING FOR CERTAIN EXEMPTIONS; PROVIDING FOR A MASSAGE ESTABLISH- MENT LICENSE FEE; ESTABLISHING APPLICATION RE- QUIREMENTS FOR MASSAGE ESTABLISHMENT LICENSES; PROVIDING FOR MASSAGISTS PERMIT FEES; ESTAB- LISHING APPLICATION REQUIREMENTS FOR MASSAGISTS' PERMITS; PROVIDING CERTAIN EXEMPTIONS; PROVIDING FOR ISSUANCE OF LICENSES AND PERMITS; PROVIDING FOR APPROVAL OR DENIAL OF PERMIT AND LICENSE AP- PLICATIONS; PROVIDING FOR APPEAL TO THE CITY COUNCIL; PROVIDING FOR WAIVERS OF APPLICATION REQUIREMENTS; PROVIDING FOR REGULATION OF MULTI- PLE MASSAGE ESTABLISHMENTS AND FEES; REQUIRING THE POSTING OF LICENSES; PROVIDING FOR EMPLOYEE REGISTERS; PROVIDING FOR REVOCATION OF PERMITS; PROVIDING FOR APPEAL TO THE CITY COUNCIL; PRO- VIDING FOR MINIMUM REQUIREMENTS FOR PHYSICAL FACILITIES; PROVIDING FOR OPERATING REQUIREMENTS; PROHIBITING PERSONS UNDER EIGHTEEN YEARS OF AGE ON LICENSED PREMISES; PROHIBITING ALCOHOLIC BEV- ERAGES ON LICENSED PREMISES; PROHIBITING OPERATION BETWEEN CERTAIN HOURS; PROHIBITING EMPLOYMENT OF CERTAIN PERSONS; PROVIDING FOR INSPECTION OF LICENSED PREMISES; ENUMERATING CERTAIN UNLAWFUL ACTS; PROVIDING FOR THE SALE, TRANSFER OR CHANGE OF LOCATION OF MASSAGE ESTABLISHMENTS; LIMITING OPERATION UNDER NAME SPECIFIED IN LICENSE; PRO- VIDING FOR TRANSFER OF LICENSE; PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORD- INANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. The ordinance was approved on a motion made by Councilman Cash and secon- ded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- -79- May 10, 1977 Resolution 77-139 authorizing the City Manager to execute an amendment to the freeway lighting agreement with the State of Texas was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans.
