City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend A. D. Bracken, Westfield Church of the Nazarene. The Pledge of Allegiance was led by Councilman Cash. -000- Mayor Ritter issued the following proclamations: Garland Shepherd Day in Beaumont" March 29, 1977; "Doctors ' Day in Beaumont" - March 30 , 1977 ; "Cancer Control Month in Beaumont" - April, 1977 ; "Southeast Texas Genealogical & Historical Society Day in Beaumont" - April 2 , 1977 ; and "Lions ' White Cane Days in Beaumont" - April 1 & 2 , 1977. -000- Ordinance No. 77-25 transferring funds in the amount of $3 ,264 .00 from the General Contingency Fund Account to the Fleet Fund 98-503 Account; and authorizing the award of bid for furnishing two (2) bobtail trash dump trucks for use in the Street Department to Dixie Truck Center was considered: ORDINANCE NO. 77-25 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1, 1976 , AND ENDING SEPTEMBER 30 , 1977 , BY TRANSFERRING FUNDS IN THE AMOUNT OF $3,264 . 00 FROM THE GENERAL FUND CONTINGENCY ACCOUNT TO THE FLEET FUND ACCOUNT NO. 98-503 FOR THE PURCHASE OF TWO BOBTAIL TRASH DUMP TRUCKS AND PROVIDING FOR THE AWARD OF BIDS FOR SAID BOBTAIL TRASH DUMP TRUCKS. The ordinance was approved on a motion made by Councilman Evans and secon- ded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Ordinance No. 77-26 transferring funds in the amount of $3,946 from the General Contingency Fund Account to the Fleet Fund 98-503 Account; and authorizing the award of bids for furnishing one (1) front loader packer body .to Pak-Mor Manufacturing Co. ; and for furnishing cab and chassis to Tidelands International, Inc. for use in the Solid Waste Division was considered: -52- March 29 , 1977 ORDINANCE NO. 77-26 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1, 1976, AND ENDING SEPTEMBER 30, 1977 , BY TRANSFERRING FUNDS IN THE AMOUNT OF $3,946. 00 FROM THE GENERAL FUND CONTINGENCY ACCOUNT TO THE FLEET ACCOUNT NO. 98-503 TO PURCHASE A TANDEM FRONT LOADER TRUCK AND PROVIDING FOR THE AWARD OF BIDS FOR A FRONT LOADER PACKER BODY WITH CAB AND CHASSIS . (Front loader packer body at a cost of $11,800.00 and cab and chassis at a cost of $24 , 944 . 00) The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 77-101 authorizing the award of bid for furnishing approximately 1100 feet of 6-inch and 400 feet of 12-inch cast iron pipe to Mabry Foundry and Supply Company ($6 ,984 . 00) was approved on a motion made by Councilwo- man McGinnis and seconded by Councilman Cash. Question: Ayes : All Nayes : None -000- Resolution 77-102 authorizing the award of bid for furnishing a pad-mounted transformer at the Fair Park Arena to H. K. Porter Company, Inc. ($7 ,280 . ) was considered. The City Manager explained that this bid was for $52. 00 more than the lowest bid but delivery time will be five weeks earlier than the low bid and, for that reason, recommended the H.K. Porter Company bid. The resolution was approved on a motion made by Councilman Cash and secon- ded by Councilwoman McGinnis. Question: Ayes : All Nayes ; None -000- Resolution 77-103 authorizing the American National Bank to release secur- ities in the amount of $200, 000 was approved on a motion made by Councilman Evans and seconded by Councilman Williams. Question: Ayes : All Nayes : None -000- Resolution 77-104 authorizing payment to Maida Insurance Company on general liability and fleet policy endorsements to Policy No. GA 593 17 30 at a cost of $15 , 818 . 00 was approved on a motion made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes : None -000- Resolution 77-105 conveying one (1) tract of land procured from the Stein-- hagan Oil Company to Missouri Pacific Railway Company, in accordance with the Railroad Primary Agreement (1964 Railroad Relocation Program) was ap- proved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. (property at Cedar at Avenue C) Question: Ayes : All Nayes : None -000- Ordinance No. 77-27 transferring funds in the amount of $28 ,438 . 54 from un- appropriated Water Systems Fund Balance to Account 83-310 to cover the cost of emergency repairs to Water Wells 1 & 2 at Loeb and to the main pumping plant was considered: -53- March 29 , 1977 ORDINANCE NO. 77-27 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1, 1976, AND ENDING SEPTEMBER 30, 1977 , BY APPROPRIATING $28 ,438.54 IN UNAPPROPRIATED WATER SYSTEMS FUND BALANCE FUNDS INTO ACCOUNT NO. 83-310 TO PAY THE COSTS OF EMERGENCY REPAIRS TO ELECTRIC MOTORS AND RELATED EQUIPMENT AT THE MAIN PUMPING PLANT. The ordinance was approved on a motion made by Councilman Evans and secon- ded by Councilwoman McGinnis. Question: Ayes : All Nayes: None -000- Resolution 77-106 authorizing final payment of $3 ,610. 00 to John Boegner Demolition and Excavation Company for work on the Civic Center site (total contract $33, 840. 00) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Williams. Question: Ayes: All Nayes : None -000- A resolution setting the ad valorem tax assessment ratio at 90% and the tax rate at $1. 30 was considered. The Manager and Finance Director Bill Avery responded to questions from the Council saying that it is necessary to change the ratio at this time because notices had to be sent out to property owners prior to the con- vening of the Tax Equalization Board. Councilman Williams expressed concern over the fact that south end residents are presently under a reassessment program and to raise the ratio from 60% to 90% in such a short period would double their rate. The Manager stated that the south end residents had not had a reevaluation assessment since 1963. Councilman Cash asked if anyone other than the Finance Director had recom- mended this change and the Manager responded that City Tax personnel had. Mayor Ritter called for a motion on the resolution. No motion was made and the resolution died. -000- Resolution 77-107 authorizing the release of 26 weed liens was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- Three retiring City employees received Service Award Plaques : Henry Austin, Police Department, 35 years of service (not present) ; Oscar Visor, Public Works Department, Streets Division, 30 years of service (not present) ; and Millard Wilkinson, Administrative Services, Fleet Maintenance Division, 18 years of .service (present to receive plaque) . -000- There being no further business, the meeting was recessed before going into the Dilapidated Structures Hearing. -54- March 29, 1977 The meeting was reconvened for the purpose of holding a Dilapidated Structures hearing: DILAPIDATED STRUCTURES HEARING THOSE present for the hearing were: HONORABLE: Ken Ritter Mayor Don Cash Councilman, Ward I Vi McGinnis Councilwoman, Ward II Leroy Evans Councilman, Ward IV Absent: Calvin Williams Councilman, Ward III Lane Nichols Asst. City Attorney Leonard Hardy Dir. Environmental Control -000- REAR OF 1531 TEXAS ALLEY: In answer to questions by Mr. Nichols, Mr. Hardy stated that this structure does meet the definition of dangerous structure as provided in the ordinance. He said there are 21 violations against this building. Mr. Al Durso, owner, addressed Council to request a six-month extension to start rehabilitation of this building. In answer to questions by Mr. Nichols, Mr. Hardy recommended the structure be condemned and a six-month extension before demolition of the structure be granted A motion to condemn but allow the six-month extension was made by Council- woman McGinnis and seconded by Councilman Evans.
