Kemendo, First Church of the Nazarene. The Pledge of Allegiance was led by Councilman Williams. -000- Mayor Ritter issued the following proclamations: "Crime Prevention Week in Beaumont" (Exchange Clubs) - February 6-12, 1977 ; "National Negro His- tory Month and N.A.A.C.P. Birthday Month in Beaumont" - February 13-19 , 1977 and "LULAC Week in Beaumont" - February 13-20, 1977 . -000- The minutes of the regular City Council session held February 1 , 1977 , were approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Ordinance No. 77-14 transferring $17 ,000 from Contingency Account 79-420 , $1,100 to Fire Department Account 34-501 to cover final settlement of Neicy Street Property acquisition (Sabine Pass Street Fire Station) and $15 ,900 to Police Department Account 31-204 , Wearing Apparel (Patches) was considered.: ORDINANCE NO. 77-14 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1, 1976 , AND ENDING SEPTEMBER 30, 1977 , BY TRANSFERRING $15, 900 FROM ACCOUNT NO. 79-420 , THE GENERAL FUND CONTINGENCY ACCOUNT TO THE POLICE DEPARTMENT ACCOUNT NO. 31-204 WEARING APPAREL; BY TRANSFERRING $1,100. 00 FROM ACCOUNT NO. 79-420, GENERAL FUND CONTINGENCY TO ACCOUNT NO. 34-501 IN THE FIRE DEPARTMENT; PROVIDING THAT SAID TRANSFERS ARE UNFORESEEN EXPENDITURES AND ESTABLISHED EMER- GENCIES OF THE CITY OF BEAUMONT; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- -20- February 8 , 1977 Resolution 77-35 authorizing payment to South East Texas Regional Plan- ning Commission in the amount of $9 ,218 . 03 for 1977 dues was approved on a. motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 77-36 authorizing payment to Donald K. Kersey in the amount of $1,109 for reimbursement for job analyses and expenses in connection with the Fireman' s case in 136th District Court was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Resolution 77-37 declaring Opal, Raven, Rena, and Lucille Streets an assessment paving project and authorizing the Public Works and Engineer- ing Department to prepare plans, specifications and cost estimates for said project was approved on a motion made by Councilman Evans and secon- ded by Councilwoman McGinnis. Question: Ayes : Councilwoman McGinnis Councilman Williams Councilman Evans Nayes : Mayor Ritter Councilman Cash -000- F resolution authorizing the City Manager to execute a labor agreement with the International Brotherhood of Police Officers was considered . Councilman Evans made a motion to approve the resolution; Councilwoman McGinnis seconded the motion. Councilman Cash asked that the item be veld one week so that Council could receive copies of the agreement for study. Councilman Evans withdrew his motion; Councilwoman McGinnis withdrew her second. The item was tabled one week. -000- Resolution 77-38 authorizing emergency repairs to Dozer 50-5010, a 1975 Fiat Allis Chalmers, at an approximate cost of $1,720. 00 by Fogle Equip- ment Company, was approved on a motion made by Councilman Cash and se- conded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Resolution 77-39 authorizing payment to Vinson, Elkins, Searles, Connally, and Smith for expenses and fees for legal services rendered in connection with the issuance of $245,000 City of Beaumoont, Texas Park System Certi- ficates of Obligation, Series 1976, in the total amount of $2,280.36 (Fair Park Arena) was approved on a motion Councilman Cash and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 77-40 authorizing execution of necessary documents to make application for a Texas Criminal Justice Division grant from the Governor' s Office for second-year funding for the Beaumont Regional Crime Lab was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. (approximate amount - $70,402 . 00) Question: Ayes : All Nayes : None -000- -21- February 8 , 1977 A resolution authorizing the City Manager to apply for $2 ,282 ,000 in FY 77 funds under the Housing and Community Development Block Grant Program was held because of the necessity of holding a public hearing. -000- Resolution 77-41 authorizing the replacement appointment of Mr. Marne Meynig, Jr. for Mr. J. F. Booker to the Community Development Block Grant Advisory Committee was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 77-42 authorizing the sale of a portion of Lot 1, Block 29 , Calder Highlands Addition (W. Lucas at Delaware) to Mr. Billy Purdom for $6 ,500. 00 was approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Evans. Question: Ayes : Mayor Ritter Nayes : Councilman Cash Councilwoman McGinnis Councilman Williams Councilman Evans -000- - dilapidated structures hearing (approximately 160 structures to be considered) was set for February 22, 1977 , on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- The third and final reading of Ordinance No. 77-15 granting the Atchison,. Topeka & Santa Fe Railway Company a renewal franchise for Track No. 90, crossing Blanchette and Neches Streets, was held: ORDINANCE NO. 77-15 AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, ITS SUCCESSORS, ASSIGNS AND LESSEES, THE RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE AN INDUSTRY SPUR TRACK NO. 90 ACROSS BLANCHETTE STREET AND NECHES STREET IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN ACCORD WITH EXHIBIT ATTACHED HERETO; PROVIDING THAT SAID TRACK SHALL BE USED ONLY FOR THE PURPOSE OF LOADING, UNLOADING AND SWITCHING TO INDUSTRIAL TRACK SERVING COMMERCIAL ENTERPRISE; PROVIDING REGULATIONS AND RESTRICTIONS FOR THE USE OF SAID TRACK; PRO- VIDING THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT CERTAIN MAINTENANCE WORK SHALL BE DONE AT THE DIRECTION OF THE CITY ENGINEER; PROVIDING FOR THE ACCEPTANCE AND FEE HEREUNDER; PRO- VIDING THAT THIS FRANCHISE IS SUBJECT TO THE CHARTER AND OR- DINANCES OF THE CITY OF BEAUMONT AND PROVIDING FOR TERMINATION FOR FAILURE TO USE THE TRACK FRANCHISED HEREUNDER; PROVIDING FOR TERMINATION OF THIS FRANCHISE ON JANUARY 1, 1978 AND THE RESTORATION OF SAID STREETS WITHIN NINETY (90) DAYS THEREAFTER; AND PROVIDING FOR INDEMNIFICATION OF THE CITY OF BEAUMONT. The ordinance was approved on a motion made by Councilman Evans and se- conded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Mr. L. J. Heilmann, 5645 Scenic Drive, addressed Council to request ad- ditional street lights be installed around the United States Post Office especially on Janes and Laurel Streets. Mr. Heilmann told Council the area is dark after the businesses close and late night shift changes pre- sent danger to Post Office workers going to and from their cars. -22- February 8 , 1977 Mr. Bart Berwick, 5670 Erie Street, criticized the hiring of Donald Kersey as an expert witness in the City' s recent court case with the firefighters ' union. Mr. L. P. Kinnear, 2395 Park Street, addressed Council to again complain of high rates for natural gas. -000- There being no further business , the meeting was recessed before continu- ing with the City Council Workshop Session. -000- I, Myrtle Corgey, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the regular City Council session held Febru- ary 8 , 1977 .
