Beaumont, Texas, met in regular session this the lst day of February, 1977, with the following present: HONORABLE: Ken Ritter Mayor Vi McGinnis Councilwoman, Ward II Calvin Williams Councilman, Ward III Leroy Evans Councilman, Ward IV Absent: Don Cash Councilman, Ward I Howard McDaniel City Manager Myrtle Corgey City Clerk Lavon Jones Asst. City Attorney -000- The Invocation was given by the Reverend Gale A. Mallette, South Park Baptist Church. The Pledge of Allegiance was led by Councilwoman McGinnis. -000- Mayor Ritter issued one proclamation: "Vocational Education Week in Beaumont" - February 2-12 , 1977 . Mrs. Collier and her third grade students from Fletcher Elementary School attended today' s meeting. -000- The Minutes of the regular City Council session held January 25, 1977 , were approved on a motion made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Resolution 77-25 authorizing the advertising for bids for demolition of 29 condemned structures in Census Tract 17 was approved on a motion made by Councilman Evans and seconded by Councilman Williams. Question: Ayes : All Nayes : None -000- Resolution 77-26 authorizing the award of bid for furnishing one (1) slope mower and tractor ($16 ,809. 83) for the Street Division to Oil City Tractors, Inc. was approved on a motion made by Councilwoman Mc- Ginnis and seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- Resolution 77-27 authorizing the award of bid for furnishing various pieces of fleet equipment to Pak-Mor Manufacturing Co. (5 rear loader packer bodies - $17,270.00) , R. B. Everett and Company (asphalt distri- butor - $11,239. 00) and Beaumont Motor Company (Cab & Chassis for the asphalt distributor - $12 ,509.40) was approved on a motion made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes : None -17- February 1, 1977 Resolution 77-28 authorizing the award of contract to F. Gatlin Asphalt Company in the amount of $759 ,991. 03 for the Community Development Block Grant Projects, Nos. 071-75-311, 071-75-321, 071-75-331 and 071-76-371, Census Tract 17, was. approved on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- Resolution 77-29 authorizing the award of contract to Gold Crest Elec- tric Company for furnishing airfield lighting at Beaumont Municipal Airport for an amount of $86 ,978 . 80 (grant - 90% federal and 10% local) was approved on a motion made by Councilman Evans and seconded by Coun- cilman Williams. Question: Ayes: All Nayes: None -000- Resolution 77-30 authorizing the rejection of bids received for one (1) 40-foot aerial tower truck was approved on a motion made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes : None -000- Ordinance No. 77-11 authorizing a zoning change from R-1 (Single Family Dwelling) and R-3 (Modified Two Family and Multiple Dwelling) to R-2 . (Two Family and Multiple Dwelling) of one tract totaling 2. 32 acres, and described generally as a portion of the Fredrick Bigner Survey, located between 5620 and 5690 Concord Road was considered: ORDINANCE NO. 77-11 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING A 2. 3263 ACRE TRACT OF LAND OUT OF THE FREDRICK BIGNER SUR- VEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREIN- AFTER DESCRIBED, PRESENTLY ZONED "R-1" AND "R-3 1 , TO "R-2" ; PROVIDING FOR SEVERABILITY; AND PROVID- ING A PENALTY. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Ordinance No. 77-12 authorizing the abandonment of the easternmost ten feet of a 20-foot utility easement in Lot 26, Block 7 , Fleetwood Addi- tion, was considered: ORDINANCE NO. 77-12 ENTITLED AN ORDINANCE VACATING AND ABANDONING THE EASTERNMOST TEN (10 ' ) FEET OF A TWENTY (201 ) FOOT UTILITY EASEMENT IN LOT 26, BLOCK 7, FLEETWOOD ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman Evans and se- conded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- -18- February 1, 1977 Ordinance No. 77-13 authorizing zoning changes in the area generally des- cribed as Beaumont Census Tract 17 and bounded by Buford Street, the eastern City limits line, Kansas City Southern Railroad, and Irving Street was considered: ORDINANCE NO. 77-13 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, IN CONFOR- MITY WITH THAT CERTAIN MAP ENTITLED "REZONING STUDY CENSUS TRACT 17" , DATED DECEMBER 13 , 1976 , INSOFAR AS BOUNDARIES MAY BE WITHIN THE PERIMETERS OF SAID "REZONING STUDY CENSUS TRACT 17" MAP; IN- CORPORATING BY REFERENCE SAID MAP IN THIS ORDINANCE; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes: None -000- Resolution 77-31 authorizing the payment of expenses in the Police ar- bitration case was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- Resolution 77-32 authorizing the acceptance, for City maintenance, the water, sanitary sewer, storm sewer, and concrete pavement improvements in Tangledahl Addition, Lots 1-29, Block 25 and Lots 1-6 , Block 240 was approved on a motion made by Councilman Evans and seconded by Coun- cilwoman McGinnis. Question: Ayes: All Nayes : None -000- Resolution 77-33 approving Change Order No. 3 to the Transit Maintenance Facility contract (change deletes $1,080. 00 from contract -- total con- tract $973 ,006. 00) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Williams. Question: Ayes: All Nayes: None -000- Resolution 77-34 accepting two easements from First Security National Bank providing for locations of traffic signal device foundations (Pearl and Bowie Streets and Pearl and Fannin Streets) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans.
