City Attorney -000- The Invocation was given by Councilman Cash. The Pledge of Allegiance was led by Councilwoman McGinnis. -000- The Mayor issued the following proclamation: "Beaumont Public Library Week" September 12-18 , 1976. Mayor Ritter recognized Mr. Ralph Romer who announced that the Knights of Columbus 951 would sponsor a golf tournament at Tyrrell Park on September 11 & 12 to help the area deaf program. -000- The Minutes of the regular City Council session held August 31, 1976, were ap- proved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes: None -000- Resolution 76-255 authorizing the award of a contract to E. R. Dupuis for im- provements to Booker and Fifth Streets - Assessment Paving Project No. 8 in the amount of $135, 917; and scheduling October 12 , 1976 , as the date for the Benefit Hearing was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes: Councilwoman Nayes : Mayor Ritter McGinnis Councilman Evans Abstained: Councilman Cash -000- Resolution 76-256 authorizing the award of bids for furnishing two (2) disk drives for the Data Processing Department to Transdata Corporation in the amount of $1, 300, this being the lowest and best bid received, was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes: None -000- Resolution 76-257 authorizing the award of bids for furnishing passenger and steel cord truck tires for City vehicles to Goodyear Tire Company for the an- nual period September 1, 1976 , through August 31, 1977, these being the lowest and best bids received, was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- -142- September 7 , 1976 Resolution 76-258 authorizing the retention, by separate contracts, of the ap- praisal services of Mr. Jack Albaugh and Mr. M. L. Lefler, Jr. , in conjunction with the Community Block Grant Program, Project No. B-76-MC-48-0003; and auth- orizing the retention of Garrod and Associates, Inc. for right-of-way surveys related to street and drainage construction in Census Tract 17 under the Com- munity Development Block Grant Program (second year property acquisition) was approved on a motion made by Councilman Evans and seconded by Councilwoman Mc- Ginnis. Question: Ayes : All Nayes : None -000- Resolution 76-259 authorizing payment of $108 , 957. 20 to Gulf States Utilities Company for high pressure lighting of Lavaca, University Drive and Florida Ave- nue ($98, 832 . 20) and costs for additional overhead facilities necessary to im- plement Phase I of the residential street light upgrade program ($10 ,125. 00) was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Mrs. Alma Haynes, 4240 South 5th Street, thanked Council for the favorable ac- tion concerning the bid award for Assessment Paving Project for Booker and South 5th Streets. Mr. A. B. Bernard, 4135 Pierre Drive, addressed Council in support of the As- sessment Paving Program and to complain about the soft shoulders along streets in the Fleetwood Addition. Mr. Prentice Boyd, 4255 Simpson, addressed Council in support of the Assessment Paving Program. Mr. Herman J. Davis, Jr. , 4115 South 4th, urged citizen input for the proposed budget. Mrs. Beatrice Shilo, 1880 Lucille, asked when the Assessment Paving Project for Odom and Bob Additions would be scheduled. She was told this project is next on the list if the Assessment Paving Program is continued. Mr. Vernon Durden, 1622 Roberts, spoke in support of the Assessment Paving Pro- gram. Mr. L. J. Hellmann, 5645 Scenic Drive, addressed Council concerning poor drain- age in Blue Lake Estates. He was told the County had acquired the necessary right-of-way and D.D. 6 would constructed needed outfall ditch. Father Eugene Farrell, Our Mother of Mercy Catholic Church, 3390 Sarah, ques- tioned the possibility of the City earning more money from the sale of alcoholic beverages. He was told the State regulates the amount the City can receive from these permits. Mr. L. P. Kinnear, 2395 Park Street, spoke in opposition to proposed Orleans Modification project. -000- There being no further business, the meeting recessed before continuing with the Dilapidated Structures Hearing. Leroy Evans Councilman, Ward IV Absent: Calvin Williams Councilman, Ward III Lane Nichols Asst. City Attorney Leonard Hardy Environmental Control Dir. Jim Thompson Admin. Asst. to City Mgr. Debbie English Urban Rehabilitation Coo-?- --, -000- In answer to questions by Mr. Nichols, Mr. Hardy stated that the structures located at 3430 & 3434 Edmonds do meet the definition of the dangerous struc- tures ordinance and that he recommended condemnation by the City Council. Mr. Jack Carson, representing Mrs. Gertrude Pena, owner, said that the owner is about 70 years of age and had suffered two heart attacks this year. He said that Mrs. Pena stores some of her furniture in these two houses and was not in sound enough health to have them demolished. He asked Council for a two-year extension. After much discussion, Councilwoman McGinnis made a motion to condemn these structures and to allow 90 days before demolition is ordered; Councilman Evans seconded the motion. It was approved as follows: Question: Ayes : All Nayes: None -000- In answer to questions by Mr. Nichols, Mr. Hardy stated that the structures located at 805, 811 and 825 Isla do meet the definition of the dangerous struc- ture ordinance and that he recommended condemnation by the City Council. Mr. Don Sanders, representing Mr. Bill Sanders, owner, requested a 60-day ex- tension before demolition of these structures. He said the owner is negotia- ting with the Delaware Church of Christ for a gift of the property to be made to the church. He said the owner will be not be back in the City for approx- imately six weeks and he is not sure of the status of the negotiations. After further discussion, Councilwoman McGinnis made a motion to condemn these structures but to allow 60 days before demolition is ordered; Councilman Cash seconded the motion. Coun- cilman Cash made a motion to condemn all of the above listed structures and' order all demolished except the Kyle Home, until the study is completed and the status of this old home known; the motion was seconded by Councilwoman McGinnis.
