HomeMy WebLinkAboutMIN APR 08 1976 SPECIAL SESSION CITY COUNCIL - CITY OF BEAUMONT HELD APRIL 8 , 1976 BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met JLn Special Session this the 8th day of April, 1976 , with the following present: HONORABLE: Ken Ritter Mayor Don Cash Councilman, Ward I Vi McGinnis Councilwoman, Ward II Calvin Williams Councilman, Ward III Leroy Evans Councilman, Ward IV Howard McDaniel Acting City Manager Kenneth Wall City Attorney -000- Resolution 76-121 authorizing the award of contract to Daniels Construction Company for the construction of Transit Maintenance/Administration Facilities in the amount of $972 ,090, was approved on a motion made by Councilwoman McGin- nis and seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- Resolution 76-122 authorizing payment of $9 ,520 to Wathen, DeShong & Henderson, Certified Public Accountants, for the balance due on the audit of the City for the fiscal year ended September 30, 1975, was approved on a motion made by Coun- cilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- After a lengthy discussion, Ordinance 76-47 authorizing the sale of a 1,116 . 93 square foot portion of street right-of-way (Rivers Circle) to American Darling Valve & Mfg. Co. for its appraised value of $300. 00 was considered: ORDINANCE NO. 76-47 ENTITLED AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A DEED, WITHOUT WARRANTY, CONVEY- ING IN BEHALF OF THE CITY OF BEAUMONT TO THE ABUTTING OWNER, AMERICAN-DARLING VALUE & MANU- FACTURING CO. , INC. , A 1 ,117 SQUARE FOOT POR- TION OF RIVERS CIRCLE, IN CONSIDERATION OF $300. 00 AND CERTAIN CONVENANTS DESCRIBED IN ENCLOSURE (1) HERETO; AND SUSPENDING SUBSEC- TION 42-5 (7) , TO THE EXTENT IT MAY BE IN CON- FLICE HEREWITH, UNTIL THE PASSAGE OF THIS OR- DINANCE BECOMES EFFECTIVE. The ordinance was approved on a motion made by Councilwoman McGinnis and secon- ded by Councilman Williams. Question: Ayes: All Nayes : None Councilman Williams asked that Don Pumphrey, City Public Information Officer, prepare a slide presentation of the area to include homes directly across from American Darling Valve & Mfg. Co. , and further down. -000® Resolution 76-123 ratifying Industrial District Agreement with Gulf States Util- ities Company was approved on a motionI.,,made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes: None -000- -57- April 8 , 1976 Resolution 76-124 requesting authorization to compromise and settle The City of Beaumont, Plaintiff, v. Trustees of the Westwood Bible Church, et al, Defendants, Cause No. 32,881, in the County Court of Jefferson County, At Law; the amount of the compromise would be $6,000. 00 (The City has already deposited $4,250. 00, which means that the City would pay an additional $1,750.00) was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes: Mayor Ritter Nayes: Councilman Cash Councilwoman McGinnis Councilman Williams Councilman Evans. -000- Resolution 76-125 authorizing the retention of Jefferson County Title Company to provide title opinions and title policies, at State regulated fees, for the extension of Crow Road from Eastex Freeway to Concord, and authorization to re- tain American Real Estate Company, at a fee not to exceed $1,500, to appraise 3 tracts of land for the acquisition of right-of-way for the extension of Crow Road, was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes: Councilman Cash Abstained: Mayor Ritter Councilwoman McGinnis Councilman Williams Councilman Evans -000- Resolution 76-126 authorizing an amendment to the contract between the City of Beaumont and Gruen and Associates to replace the firm Pitts, Phelps & White with George Ingram & Associates was approved on a motion made by Councilman Cash and seconded by Councilman Williams. Question: Ayes: All Nayes: None -000- Ordinance 76-48 amending Ordinance No. 76-40 to provide for demolition of dilap- idated structures within ten (10) days of the passage of the Ordinance was con- sidered: ORDINANCE NO. 76-48 ENTITLED AN ORDINANCE AMENDING ORDT1qANCE NO. 76-40 TO PROVIDE FOR A TEN (10) DAY PERIOD WITHIN WHICH OWNERS OF DILAPIDATED STRUCTURES MAY DEMOLISH OR TEAR DOWN SUCH STRUCTURES PRIOR TO DEMOLITION BY CITY FORCES. The ordinance was approved on a motion made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes : None -000- Ordinance No. 76-46 canvassing the votes cast for Council positions in the City election held April 3, 1976, was considered: ORDINANCE NO. 76-46 ENTITLED AN ORDINANCE CANVASSING THE RETURNS OF THE REGULAR CITY ELECTION WHICH WAS HELD ON THE 3RD DAY OF APRIL, 1976, AND ORDERING A RUN-OFF ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 17th DAY OF APRIL, 1976, TO DETERMINE WHO SHALL BE COUNCILMAN IN WARD II; NAMING THE PLACES WHERE SAID ELECTION SHALL BE HELD; APPOINTING OFFICERS TO PRE- SIDE OVER SAID ELECTION; PROVIDING FOR THE FORM OF NOTICE THEREOF; PROVIDING FOR THE FORM OF BALLOT FOR USE IN SAID ELECTION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. -58- April 8, 1976 The ordinance was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- Mr. Thomas E. Leggett, Jr. , 1952 Gilbert, called for unity of the Council. Mr. Jim Yarbrough, General Manager of American Darling Valve & Mfg. Company, addressed Council to give certain data about his company. Mr. George Coleman, 2375 Pierce Street, addressed Council to complain about the combined School Districts and City Municipal Election held April 3 , 1976 . Mr. Floyd G. Guillory, Judge for Election Precinct 39, addressed Council concern- ing reports of discrepancies with his voting precinct. He told Council his box had checked out accurately and that it was open and available to review to any- one with proper credentials. -000- There being no further business, the meetintq Vas recessed before continuing with the Council Workshop Session.
