A. Woytek, Bethlehem Lutheran Church. The Pledge of Allegiance was led by Councilman Evans. -000- Mayor Ritter issued the following proclamations : "Bible Week in the City of Beaumont" - November 23-30, 1975 and "Navy Junior R.O.T.C. Day in Beaumont" November 22, 1975 . -000- The Minute's of the regular City Council session held November 11, 1975, were approved on a motion made by Councilman Evans and seconded by Councilman Wil- liams Question: Ayes: All Nayes: None -000- Resolution 75-411 establishing a permanent Transit Advisory Committee was con- sidered: RESOLUTION 75-411 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the members of the Transit Advisory Committee heretofore appointed by this City Council are appointed for the term set out herein beside their names : Elaine Niskala------------one year Mrs. Alida Terrell--------two years Otto St. John------------- three years J. Weatherly-----------two years Mrs. Norma Schwartz Hall--three years and, -190- November 18 , 1975 BE IT FURTHER RESOLVED that one non• voting ex-officio member of this committee shall be appointed by the Mayor from the members of the City Council; and, BE IT FURTHER RESOLVED that the Chairman and Vice Chairman will be elected by the committee to serve a one year term; and, BE IT FURTHER RESOLVED that upon the expiration of the term of service of each of the above members of the Transit Advisory Committee, new members will be appointed by the City Council to serve for a term of two years and existing members can be reappointed; and, BE IT FURTHER RESOLVED that the Director of Traffic and Transportation, or an authorized representative from the Traffic Engineering staff, shall serve as Secretary of the committee, and the duties of the Secretary of the committee shall be as follows: 1. Serve as a non-voting member of the committee; 2. Attend all meetings of the committee and its appointed committees; 3 . Provide the committee with all information necessary for the per- formance of its duties; 1 4 . Submit a proposed Agenda to the committee chairman and members; 5 . Invite the participation of interested parties concerned with topics on the Agenda; 6. Coordinate the attendance of staff personnel of the City; 7. Introduce items on the Agenda and present applicable information as shall be necessary to aid in resolving transit problems in its proceedings; and 8 . Provide such clerical/administrative support as required by the committee in its proceedings. and, BE IT FURTHER RESOLVED that the Transit Advisory Committee shall have the following duties and responsibilities: 1. To be an advisory board to the City Council and the City Manager; 2 . To recommend transit objectives to the City of Beaumont Transit System; 3. To assist the City Council and the City Manager ' s staff in plan- ning for a continuing program of transit development; 4 . To meet as required by the Chairman of the committee, or the Secretary; and 5. To keep the City Council and the City Manager' s staff informed of current transit trends, and to recommend changes and improvements which will update the transit system services. The resolution was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Williams. Question: Ayes : All Nayes: None -000- Resolution 75-401 authorizing the award of bids for furnishing a postage ma- chine for the Building Maintenance Department to Singer Mailing Equipment, in the amount of $1, 695 . 00, this being the lowest and best bid received, was ap- proved on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 75-402 authorizing the award of informal bids for furnishing 20, 000 General Offense Report forms for the Police Department to Data Graphic, in the amount of $1, 075. 40, this being the lowest and best bid received, was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes: None -191- November 18, 1975 Resolution 75-403 authorizing the award of bids for furnishing electrical mat- erials for the Fair Park trailer area to Port Electrical Dist® Co. , in the amount of $386083; Consolidated Electrical Dist. , in the amount of $578 .52; Westinghouse Electric Company, in the amount of $2,115. 61; G. E. Supply, in --.he amount of $3,447 . 46; and Marine & Industrial Electric Supply, in the amoun­_ of $72. 36, these being the best bids received (CAP 45-P-01, Phase I - total $6, 600. 78) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes .- All Nayes : None -000- Resolution 75-404 authorizing ITT Terryphone Corporation to construct an over- head communications across the 900 black of Dixie Street-, approximately 1001 south of College Street (for Nance Industries) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Williams. Question: Ayes : All Nayes: None -000- Resolution 75-405 authorizing the City Manager to apply for a grant from the Governor' s Office of Traffic Safety for the development of an Automated Acci- dent Analysis System (100% funded) was approved on a motion made by Council- man Williams and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes : None -000- Resolution 75-406 authorizing the City Manager to apply for a grant from the Governor ' s Office of Traffic Safety to provide for the attendance of personnel from the Community Development Department, Traffic & Transportation Department, and Public Works Department at the Bicycle./Pedestrian Facility Planning, De- sign and Implementation Seminar, December 4-6 , 1975 (100% funded) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans© Question: Ayes : All Nayes: None -000- Resolution 75-407 authorizing the City Manager to apply for a grant from the Governor' s Office of Traffic for the development of a School Trip Safety Pro- gram (100% funded in approximate amount of $11,,000 to $12 , 000) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans, Question: Ayes : All Nayes : None -000- Resolution 75-408 authorizing the City Manager to make application to the Texas Criminal Justice Division, Governor' s Office for a grant, 100% funded by State and Federal funds, "Implementation Police Records Analysis - Phases I & II" was approved on a motion made by Councilman Evans and seconded by Council%,-oman McGinnis® Question: Ayes : All Nayes : None -000- Resolution 75-409 authorizing the City Manager to make application to the Texas Criminal Justice Division, Governor' s Office for a grant, funded entirely by Federal and State monies, project titled "Beaumont Regional Crime Laboratory" was approved on a mot-Ion made by Councilman Evans and seconded by Councilman Williams. (Approximate amount of grant - $115 ,000. 00) Question: Ayes: All Nayes: None -000- Resolution 75-410 authorizing the City Manager to execute a contract between the City of Beaumont and the State Department of Highways and Public Transpor- tation for the installation of a Grade Crossing Protection Device at the in- tersection of Railroad Avenue and Franklin, cost of installation to be borne -192- November 18 , 1975 by the State of Texas and the Railroad Company; the cost of the power for the railroad preemption device to be borne by the City of Beaumont was approved on a motion made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes: None -00o- Resolution 75-412 establishing a permanent Transit Advisory Committee setting three year tezms and allowing for reappointment of Pat Phelan, Gilbert Adams, Sr. , Larry Parks, George Ingram, Dr. James Massey, W, C. Ross, Jr. , and Leo Lemell; designating Gilbert Adams, Sr. as Chairman; and stating duties and responsibilities of the Committee was approved on a motion made by Councilman Evans and seconded by Councilman Williams. Question: Ayes : All Nayes : None -000- Resolution 75-413 authorizing the City Manager to execute an express purchas- ing agency contract with the South East Texas Regional Planning Commission for the purchase of 37 Walkie-Talkie type radios and AC & DC Battery Chargers (City' s match of 25% - approximately $8 , 200. 00) was approved on a motion made by Councilman Williams and seconded by Councilman Evans,, Question: Ayes : All Nayes: None -000- Resolution 75-414 authorizing the City Manager to execute a letter agreement with Milton Bell and Rex Goode for services performed in connection with the Municipal Auditorium, not to exceed $15,000 (CAP 45-B-01) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Williams. Question: Ayes : All Nayes: None -000- Resolution 75-415 authorizing the City Attorney, or his assistant, to settle the following three suits: The City of Beaumont vs. Carlo J. Malley, Cause No. 30, 907 (CIP 11-ST-02) ; The City of Beaumont vs. William G. Childs , Cause No. 31, 806 (CIP 11-ST-07) ; and the City of Beaumont vs. William G. Childs, Cause No. 31,795 (CIP 11-ST-07) was approved on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 75-416 supporting Taylors Bayou project was considered: RESOLUTION 75-416 WHEREAS, the United States Government, operating through the Department of the Army, proposes to do dredging work on Taylor ' s Bayou as set out in Pub- lic Notice SN-NW-1, which dredging work is a portion of the total Taylor' s Bayou Project; and, WHEREAS, the City of Beaumont has supported improvements in Taylor' s Bayou over the last thirty (30) years and expressed such support by the pas- sage of major drainage bond issues; and, WHEREAS, the City Council of the City of Beaumont desires at this time to make public its support of the existing Taylor ' s Bayou Project and the total Taylor ' s Bayou Improvement projects; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City of Beaumont does hereby support and approve the proposed im- provements for Taylor ' s Bayou as set out in Public Notice SN-NW-1, and the entire Taylor' s Bayou improvement projects. Stokes, Chairman of the Beaumont Chamber of Commerce Drainage Commit- tee (5740 Regina Lane) , addressed Council to urge support of the Taylor ' s Bayou Project. Mr. James C. Leggett, 1849 Washington Boulevard, addressed Council in support of the Taylor ' s Bayou Project. Mr. L. V. Norris, 2402 Gladys, addressed Council in favor of the Taylor' s Bayou Project. Mr. W. J. Balmer, Public Works Coordinator, 4045 Redwood, addressed Council in support of Taylor' s Bayou Project. The resolution was approved on a motion made by Councilman Williams and secon- ded by Councilman Evans, Question: Ayes: All Nayes: None -000- Resolution 75-417 authorizing the release of weed liens against Mrs. Sue Levin ($75. 26) and Mr. Jack Straughter ($17. 49) was approved on a motion made by Coun- cilman Evans and seconded by Councilwoman McGinnis. Nayes : None -000- Chief Bauer announced the selection of Mr. Bill McClain, Laboratory Director for the City of Beaumont to attend a special course providing instruction and laboratory practice in ABO grouping techniques as applied to stains produced by body fluid offered by the Federal Bureau of Investigation' s National Aca- demy at Quantico, Virginia beginning December. -000- Chief Bauer announced the selection of Lieutenant E. C. Woodsmall of the Crime Prevention Unit of the Beaumont Police Department to attend the January Ses- sion of the Federal Bureau of Investigation' s National Academy in Quantico, Virginia. Chief Bauer said Lt. Woodsmall is the thirteenth officer selected from the B.P.D. and expenses are being paid by the F.B. I. -000- Chief Bauer presented a brochure published by the Crime Prevention Unit of the Beaumont Police Department offering services of this Unit to citizens who have experienced burglaries to aid them in security provisions for their homes and businesses. -000- Mr. McDaniel announced the retirement of Mr. C. A. "Red" Chriswell, Chief of the Fire Department, effective December 31, 1975. He said he would like to announce the appointment of Assistant Chief C. A. "Pete" Shelton as Chief of the Fire Department effective January 1, 1976 and asked for Council confir- mation of this appointment. Councilman Evans made a motion to confirm the appointment; it was seconded by Councilwoman McGinnis. Question: Ayes: All Nayes: None -000- Mr. J. C. Burkett Sr. , 5290 Pineburr, presented what he described as a letter and bill to Mayor Ritter. Mr. Jim McCuistin, 934 Calder Avenue (Y.M.C.A. ) , addressed Council to say he had not been issued a library card as a permanent resident of the City and asked Council help in obtaining a resident card. He was told Staff would investigate the problem. -194- November 18 , 1975 A brief recess was called prior to going into the Dilapidated Structure Hearing. DILAPIDATED STRUCTURES HEARING Those attending the Dilapidated Structures Hearing were as follows: Ken Ritter Mayor Vi McGinnis Councilwoman, Ward II Calvin Williams Councilman, Ward III Leroy Evans Councilman, Ward IV Absent: Don Cash Councilman, Ward I Lane Nichols Asst® City Attorney Leonard Hardy Dir. Environmental Cont. -000- Mrs. Ethel Dickson, owner of the structures at 1469 & 1471 Andrus Alley (Du- plex) and 1494 Andrus Alley, addressed Council to request she be given addi- tional time to have the structures demolished. She told Council she had re- ceived contracts on these and other structures for their demolition but that additional time would be required. In answer to questions by Mr. Nichols, Mr. Hardy stated that the above listed structures did meet the definition of the dangerous structures ordinance and recommended they be condemned and ordered demolished. After a lengthy discussion, Councilman Williams made a motion to condemn the structures and allow Mrs. Dickson six months to demolish the structures; the motion was seconded by Councilman Evans. Question: Ayes: All. Nayes: None -000- 5935 Greenmoor Lane - In answer to questions by Mr. Nichols, Mr. Hardy said the structure is more than 50% burned and recommended it be condemned and ordered demolished. Mr. Leland Henry, 1720 Rikisha, told Council his wife owns this property. He said they have been unable to settle with their insurance company for the loss of this structure because of the Fire Department' s report of arson as the cause of the fire. He said he Is not willing to demolish the structure until the in- surance claim is se-ttled. After a lengthy discussion, Councilman Evans made a motion to condemn the structure and allow sixty days for the demolition by owners; the motion was seconded by Councilman Williams, Question: Ayes: All Nayes: None -000- Mr. Nichols asked Mr. Hardy if he had personally examined the structures listed in the following affidavit and executed the affidavit stating that each meets the definition of dangerous structure as defined in the City ordinance. Mr. Hardy stated he had examined the structures and had executed the affidavit and recommended all structures be condemned and ordered demolished by the City Council.
