The Pledge of Allegiance was led by Councilman Evans, -000- The Mayor issued one proclamation: "Shrine News Day in Beaumont" - March 29, 1975. -000- Mr. Vic Rogers, Chairman of the Bi-Centennial Commission, presented Share Cer- tificate -41 to Gladys City -Boom Town U.S.A. to be auctioned by Mayor Ritter : Mrs. J. A.. Raney, Tejas Chapter of the Daughters of the Republic of Texas, bid $25. 00; Downtown Lions bid $100-00; Sales & Marketing bid $200 .00. Beaumont Junior Forum was the successful bidder for $1 , 000. 00. -000- The Minutes of the regular session of the City Council held March 18 , 1975, was approved .on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes ; All Nayes : None -000- An ordinance amending the budget of the City of Beaumont by transferring $300, 000. 00 to Account No. 7.9-509 for the City "s matching share of the cost of buses for the Transit system, and transferring, $2 , 500 .00 from unappropriated reserves. to Account No. 11-201 to pay the cost of printing the annuai activi- ties report was considered: AN ORDINANCE iLl-1-111--ul ENTITLED AN ORDINANCE Al ENDING THE BUDGET OF THE CITY OF BEAUMONT ADOPTED SEPTEMBER 24 , 1974, FOR THE FISCAL PERIOD BEGINNING OCTOBER 1, 1974, AND ENDING SEPTEMBER 30, 1975, BY TRANSFERRING THE SUM OF $300, 000 FROM UNAPPRO- PRIATED RESERVES TO ACCOUNT NO. 79-509 , AND TRANSFERRING $2, 500 FROM UNAPPROPRIATED RE- SERVES TO ACCOUNT NO. 11-201. Councilwoman McGinnis made a motion to consider the two items separately; the motion was seconded by Councilman Evans. After a lengthy d1s.cussIon ,concerning obligations and expenses incurred, it was decided that more information was needed to clarify Council and staff 's position in this matter. Councilwoman McGinnis withdrew her motion; Councilman Evans withdrew his second. Gatlin Asphalt Company., -..Inc_, f.oT . _-... the Hot-Mix Asphaltic Concrete .Surfacing on Mariposa Street from South to Cedar--,- Streets, and authorizing the final payment to contractor in the amount of $12, 711. 60 was .he.ld for action because additional invoices have been received making final amount incorrect. -000- -44- Resolution 75-115 approving Supplemental Agreement No. 1 to the Florida -Street CIP Project (11-ST-08) contract in the amount of $5r164 . 00 concerning changes in the proposed drainage construction (changes requested by Lamar University to allow for future expansion of the university and to be reimbursed by them) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- Resolution 75-116 authorLzing .the City, Manager to enter into a contract forthe, removal o-f sand and soil from privately owned lands of M.J. Conner, K..J- Conner... and Geraldine Kozun was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question: Ayes : All Nayes: None -000- Resolution 75-117 authorizing payment to Beaumont Independent School-DistrLct- in the amount of $1,270. 00 for .use of Austin School gymnasium for City Basket- ball Leagues for 1.974-75 season was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 75-118 accepting the grant award from the Criminal Justice Division for the Crime Prevention grant's second year funding, and authorizing the City Manager to execute an acceptance agreement was approved on a motion made by Councilman Cash and seconded by Councilman Evans. ($64,314 . 00) Question: Ayes: All Nayes : None -000- Resolution 75-1-19 ,authoriz.ing the City Manager to execute and sign an applica-, tion and related documents for a TCJD grant related to Police Department dic- tating equipment purchase - funded by TCJD with LEAA funds - was approved an a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Resolution 75-120 authorizing the City Manager to execute an application for a grant to provide an infiltration-inflow study (grant - $945, 000,7 City - $315, 000) was approved on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 75-121 reducing the retainage on Contract. liIA with Holloway Sand and Gravel from 10% to. . 5% (project, 98% complete) was approved on a motion made by Councilman Evans and seconded byCouncilman Williams. Question: Ayes: All Nayes : None -000- Resolution 75-122 authorizing the American National Bank to release $50,000 in securities was .approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Evans. Question: Ayes: All Nayes: None -000- An ordinance establishing closing hours (from 9 : 00 p.m. to 8 : 00 p.m. ) and hol..i- days (New Year 's, July 4th, Labor Day & Thanksgiving) for package stores was considered: -45- March 25, 1975 Councilman Williams made a motion to table this for one week and invited group present at the Meeting to the Workshop Session Thursday to hear opposition to this change. Councilman Cash seconded the motion. Mayor Ritter .recognized citizens in attendance who wanted to address Council concerning this change. Mr. J. L. Albritton - Big Fat Rabbit Liquor Store, 695 Forsythe - addressed the Council in opposition to the change. Mr. William Hickman, Gem Cut Rate Liquor Stores, addressed the Council in favor of the change. Mr. Freeman Royer, Amuny' s Liquor Store, addressed Council in opposition to the change. Councilman Williams called. for vote on previous question to table this discussion until. Thursday's workshop session. Question: Ayes : Councilman Williams Nayes: Mayor Ritter Councilman Cash Councilwoman McGinnis Councilman Evans The motion failed so citizens were allowed to address Council at this time con- cerning this matter. Mrs. Mary, Ann Fiorenza, A.J. 's Liquor Stores, addressed Council in favor of the change. Mr. Charles L. Williams, Butch's Package Store, addressed Council in opposition to the change. Vote called for original motion to table consideration of the Ordinance for one week and for discussion at Thursday's workshop session. Question: Ayes: All Nayes: None -000- Mayor Ritter recognized citizens who wished to address Council on any matter pertinent to City business. Mr. Leantha J. Redd, Executive Secretary of the Beaumont Chapter of N.A.A.C.P. , addressed Council to ask what progress had been made in establishing a Human Relations Commission Study Committee. Mayor Ritter responded that the Council was still considering such a Study Committee and that appointments would be made soon. -000- Mayor Ritter called for a recess. After the recess, the meeting was reconvened with all members of Council in at- tendance. Environmental Control -000- 2289 Broadway - rear - In answer to questions by Mr. Nichols, Mr. Hardy said that this structure was not now in violation of the Dilapidated Structure Ordi- nance because some work had been done by the owner. Mr. Lavinghousez addressed Council to say he planned to rehabilitate the struc- ture and would get the necessary building permits. 3017 W. Brenham Street - In answer to questions by Mr. Nichols, Mr. Hardy said this structure had 22 violations of the Dangerous Structure Ordinance and he recommended it be condemned and ordered demolished. Councilman Evans made the motion to condemn. and order demolished;. Councilman Williams seconded the motion. Question: Ayes: All Nayes: None -000- 3019 W. Brenham Street - Mr.. Hardy stated there are 25 violations of the Dan- . gerous Structure Ordinanr-e .and 45% deterioration. He recommended it be con- demned and ..ordered ,demolished. Councilwoman McGinnis made the motion; it was seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- 3021 W. Brenham Street ,- Mr. Hardy said there are 21 violations of the Danger- ous Structure Ordinance. and recommended it be condemned and ordered demolished. Councilman Cash made such a motion and Councilwoman McGinnis seconded it.. Question: Ayes : All Nayes : None -000- 820 Buford - In answer to questions by Mr. Nichols, Mr. Hardy said this struc- ture has 31 violations of the Dangerous Structure Ordinance. 822 Buford -.Mr. Hardy said this structure has 32 violations of the Dangerous Structure Ord.i- nance. 836 Buford - 39 violations of the Dangerous Structure Ordinance. He. recommended that all three (same owner for all) be condemned and ordered de- molished. Councilman .Cash made a motion to condemn and order demolished all three structures and it was seconded by Councilman Evans . Question: Ayes : All Nayes : None -000- Two structures next to 836 Buford - 1. Mr. Hardy said there are 37 violations to the Dangerous Structure Ordinance. 2. Mr. Hardy said there are 39 viola- tions to the Dangerous Structure Ordinance. He recommended both be condemned , .. and ordered demolished. Councilman Cash made such a motion; it was seconded by Councilman Evans. Question: Ayes : All Nayes : None -47- March 25, 1975 860 Buford - Mr. Hardy said there are 30 violations to the Dangerous Structure ordinance—in the occupied portion of this structure. He recommended that por- tion be co.ndemned .and demoi.ished. Councilman Evans made a motion to table this and allow resident to demolish the dilapidated portion of the structure; the motion was seconded by Councilwoman McGinnis. After a discussion concerning this decision being tabled approximately 4 years.: : ago, Councilman Evans withdrew his motion and Councilwoman McGinnis withdrew her second. A motion to condemn .and order demolished the dilapidated portion of this struc- ture was made by Councilman Cash and seconded by Councilwoman McGinnis, Question: Ayes: All Nayes; None 924 Buford - In answer to questions by Mr. Nichols, Mr. Hardy said- this struc tune has 33 violatio.ns .t0 the Dangerous Structure Ordinance. 934 Buford - Mr-. Hardy said this structure has 33 violations to the Dangerous Structure Ordi- nance. He recommended both be condemned and ordered demolished. A motion to condemn and demolish was made by Councilman Evans and seconded by Councilman Cash. Question: Ayes: All Nayes: None 838 Concord (Short) - In answer to-questions by Mr. Nichols, Mr. Hardy said _ this structure has 21 violations of the Dangerous Structure Ordinance and re- commended it be condemned and ordered demolished. A motion was made by Coun- cilman Cash and seconded by Councilman Evans, Question: Ayes: All Nayes: None 3114 West Crockett - Mr. Hardy said this structure has 16 violations to the Dangerous .Structure. Ordinance and recommended it be condemned and ordered de- molished. Such a motion was made by Councilman Cash and seconded by Council- man Evans. Question: Ayes: All Nayes : None -000- 3120 Elinor Street, (Rear) ..- In answer to questions by Mr. Nichols, Mr. Hardy. said this two story structure has 34 violations to the dangerous structure ordinance and recommended it be condemned and ordered demolished. Councilman Evans made such_ a motion and it was seconded by Coucilwoman McGinnis. Question: Ayes: All Nayes : None -000- 3495 West Euclid - Mr. Hardy said there were 21 violations to the Dangerous., Structure Ordinance and recommended it be condemned and ordered demolished. Such a motion was made by Councilman Cash and seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- 3640 West Euclid - In- answer to questions by Mr. Nichols, Mr. Hardy said this structure has 11 violations to Dangerous Structure Ordinance and recommended it be condemned and ordered demolished. Such a motion was made by Councilman Evans and seconded by Councilman Cash. _. Nichols, Mr. Hardy said this structure- has 25 violations to the Dangerous Structure Ordinance and recommended-it be condemned and ordered demolished. Such a motion was made by Councilman Cash and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes : None 17 Leicht Alley, 19 Leicht Alley, 26 Leicht Alley, & 27 Leicht Alley - In answer to questions by .Mr. Nichols, Mr.. Hardy said each of these structures had a least 33 violations to the Dangerous Structure Ordinance and recommended they be condemned and ordered demolished. Such a motion was made by Councilman Cash and seconded . by Councilwoman McGinnis. Question: Ayes: All Nayes: None 1980 Nora (Front ..& Rear) - In answer to questions by Mr. Nichols, Mr. Hardy_ the front structure- had 20 violations and the rear 23 violations to the, Dangerous Structure Ordinance. He recommended they be condemned and ordered demolished. Such a motion was made by Councilman Evans and seconded by Coun- cilman Cash. Question: Ayes : All Nayes : None 2435 Omaha Street (Front & Rear) - In answer to questions by Mr. Nichols, Mr. Hardy said the front structure has 17 violations to the Dangerous Structure Ordinance but is structurally sound; he said the rear structure has 8 viola- tions. A motion to table and bring-back. at the next hearing the structure at 24.3-5_._.._. _. ., Omaha (Front) after phone contact - has been made with the owner in California concerning the. soundness of this, struction was made by Councilman Evans; it was seconded by Councilwoman McGinnis. A motion to condemn- and order demolished the structure at 2435 Omaha (Rear) was made by Councilman Cash and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes: None 1238 Stewart Street - In answer to questions by Mr. Nichols, Mr. Hardy said this structure has7_46 violations to the Dangerous Structure Ordinance and recommended it be- condemned and ordered demolished. Such a motion was made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes ; None 4085 Usan Street - In-answer- to questions by Mr. Nichols, Mr. Hardy said this structure had Fu_rned. and has 16 violations to the Dangerous Structure Ordi- nance.
