The Pledge of Allegiance was led by Councilman Evans. -000- The Minutes of the regular meeting held on August 28 , 1973 , were approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, the City received bids on August 22, 1973, for furnishing one thousand feet (1, 000 ' ) of one inch (1") , one and one-half inch (1-1/2") , and two inch (2") , Galvanized Rigid Conduit for the Traffic and Transportation Department; and, WHEREAS, Marine & Industrial Supply Company submitted a bid for -furnish- ing said Galvanized Rigid Conduit for the Traffic and Transportation Depart- ment; and, WHEREAS, the City Council is of the opinion that the bid submitted by Marine & Industrial Supply Company is the lowest and best bid and should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the bid of Marine & Industrial Supply Company in the amount of One Thou- sand Two Hundred Seven and 20/100 ($1, 207 .20) Dollars be accepted by the City of Beaumont. PASSED by the City Council this the 4th day of September, 1973 . /s/ KEN RITTER - MAYOR - The resolution was passed on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, the City received bids for furnishing one TR-6 Radar Unit for the Police Department; and, WHEREAS, Kustom Signals, Inc. submitted a bid for furnishing said Radar Unit for the Police Department; and, WHEREAS, the City Council is of the opinion that the bid submitted by Kustom Signals, Inc. is the lowest and best bid and should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the bid of Kustom Signals, Inc. , in the amount of One Thousand Two Hun- dred Fifty-Five and 50/100 ($1,255. 50) Dollars be accepted by the City of Beaumont. Williams Survey from R-lA to R-2 and C-1) was introduced and read: ORDINANCE NO. 73-60 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND -2- IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF THREE (3) TRACTS OF LAND AS FOLLOWS : PARCEL NO. 1 CONTAINING 3. 0 ACRES OF LAND, MORE OR LESS, OUT OF THE C. Question: Ayes: All Nayes: None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, Anthony C. Parigi and wife, Opal L. Parigi, of Jefferson County, Texas, have tendered to the City of Beaumont an easement and right-of-way for street and highway purposes upon, over and across property owned by them in the City of Beaumont, Jefferson County, Texas, for the location, construction, extension and maintenance of a street extending generally from Shakespeare Drive eastward to at least Dowlen Road in the City of Beaumont, Jefferson County, Texas; and, WHEREAS, the City Council has considered the purposes of said easement and right-of-way and is of the opinion that the acceptance of said easement and right-of-way for street anO highway purposes is necessary and desirable and that same should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That said easement and right-of-way tendered by the above named to the City of Beaumont be, and the same is hereby, in all things accepted. Question: Ayes: All Nayes: None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, professional soils investigation work is necessary at the Water Utilities Service Center C.I .P. Project 11-WU-01; and, WHEREAS, the City Council of the City of Beaumont has determined that this work should be done by Southwestern Laboratories; -3- NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That Southwestern Laboratories is hereby authorized to do soils investigation work at the Water Utilities Service Center under CIP Project ll-WU-01 at an estimated cost of $1, 450. 00. PASSED by the City Council this 4th day of September, 1973 . /s/ KEN RITTER - MAYOR - The resolution was passed on a motion made by Councilman Evans and seconded by Councilman Dishman. Question: Ayes: All Nayes: None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, the Texas Criminal Justice Council has made available funds for continuation of the Beaumont Police Department Mobile On-Duty Electronic Learning Project; and, WHEREAS, the newly adopted provisions of the Texas Penal Code have made it necessary for a number of previously produced training messages under this program to be revised and updated; and, WHEREAS, the Beaumont Police Department desires to provide in-kind match in the amount of $1, 294 to be made up of salaries of Police Department personnel participating in the project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the City Council does hereby authorize the City Manager to execute an application for funds under the Mobil On-Duty Electronic Learning Project to the Texas Criminal Justice Council to be submitted to the Council for their approval and be it further resolved that the City Council of the City of Beaumont hereby ratifies any action taken by the City Manager previous to this resolution in signing any applications under this project. Question: Ayes: All Nayes : None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, the City of Beaumont and the American National Bank of Beau- mont, Texas, entered into a contract dated July 1, 1973 , whereby it was pro- vided that the said American National Bank of Beaumont would pledge with the City Council of the City of Beaumont certain securities in lieu of giving bond as City Depository; and, WHEREAS, the American National Bank of Beaumont wishes to withdraw the following securities from the Federal Reserve Bank of Dallas: Receipt # Description Value 8626 U.S. Treas. 7 . 25% Notes, due 5-15-74 $1,779, 000 TOTAL-----$1, 779, 000 -4- WHEREAS, the American National Bank of Beaumont wishes to pledge the following securities with the Federal Reserve Bank of Dallas : Description Par Value San Carlos, Arizona Project Notes 5. 16°x, due 2-8-74 (Guaranteed by U.S. Govt. as to Principal & Interest) $1, 600, 000. 00 The total above securities being pledged being in the sum of $1, 600, 000. 00; and, WHEREAS, after this withdrawal, the American National Bank of Beaumont will have sufficient securities pledged to protect the deposits of the said City of Beaumont, Texas; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the American National Bank of Beaumont, Texas, be permitted to withdraw the above described securities from the Federal Reserve Bank of Dallas, and a certified copy of this Resolution shall constitute evidence of the autho- rity of the American National Bank of Beaumont, Texas, to make said withdrawal. Question: Ayes : All Nayes: None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, California Western States Life Insurance Company has raised the rates on the City Group Health Insurance Policy, effective September 1, 1973; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the appropriate City Officials are hereby authorized to pay the increase in rate in the City Group Health Insurance Policy to the California Western States Life Insurance Company. PASSED by the City Council this 4th day of September, 1973. /s/ KEN RITTER - MAYOR - The resolution was passed on a motion made by Councilman Dishman and seconded by Councilman Evans. Question: Ayes : All Nayes: None -000- The resolution was introduced and read: A RESOLUTION WHEREAS, the Municipal Code Corporation has submitted its invoice for supplements to the Code of Ordinances in the amount of $1,240. 48; and, WHEREAS, the City Council of the City of Beaumont has determined that this invoice should be paid, -5- NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the appropriate City Official is hereby authorized to pay the invoice of the Municipal Code Corporation in the amount of $1,240.48 . PASSED by the City Council this 4th day of September, 1973 . /s/ KEN RITTER - MAYOR - The resolution was passed on a motion made by Councilman Evans and seconded by Councilman Cash. Question: Ayes: All Nayes: None -000- DILAPIDATED STRUCTURE HEARING 2470 Space Street - Mr. Milton Palmer, Director of Environmental Control, described this structure as open, fairly sound, but in a dilapidated condi- tion due to roof leaking. Ifi- answer to Assistant City Attorney Lane Nichols ' question, Mr. Palmer recommended that the house either be repaired or torn down immediately. Mr. Franks, representing owner, requested time to repair the structure. Councilman Evans made a motion to condemn the structure and grant Mr. Franks 30 days to repair or demolish this structure. The motion was seconded by Councilman Dishman. Question: Ayes: All Nayes: None -000- 4360 Highland Avejiue - Mr. Palmer described this structure as having burned 57n'din a deter-latirrT-condition. Mrs. Doris Angelo, representative of her mother' s estate, requested unlimited time to either repair or demolish this structure. Councilman Cash made a motion to condemn the structure and grant Mrs. Angelo 30 days to repair or demolish this structure. Councilman Evans seconded this motion. Question: Ayes: All Nayes: None -000- 2175 Rockwell Street, 2175 Rockwell Street (Rear Right) , and 2175 Rockwell Street (Rear Left) - Mr. Palmer described these three structures as open, vacant, and in a deteriated condition. Mrs. Ruby Perkins requested that these structures be torn down by the City. Councilman Dishman made a motion to condemn these structures. The motion was seconded by Councilman Cash. Question: Ayes: All Nayes: None -000- 2414 Space Street and 2420 Space Street - Mr. Palmer described these structures as being 80% demolished and recommended that they be condemned. Councilman Dishman made a motion to condemn these structures. Councilman Evans seconded this motion. Question: Ayes: All Nayes: None -000- 800 Bonham Street - Mr. Palmer described this structure as partially demol- ished and recommended it be condemned so that the work would be completed. A motion to condemn this structure was made by Councilman Cash and seconded by Councilman Dishman. Question: Ayes: All Nayes: None -000- -6- 1417 Carroll Alley, 1425 Carroll Alley, and 1435 Carroll Alley - Mr. Palmer described these structures as being open, vacant, and in a Tir—lapidated condi- tion. He recommended they be demolished immediately. A motion to condemn these structures was made by Councilman Dishman and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- 1675 Chamberlain Drive - The attorney representing this property requests that Tt—be torn down by the city. Mr. Palmer described the structure as in a dilapi- dated condition and recommended it be condemned and torn down immediately. A motion to condemn this structure was made by Councilman Evans and seconded by Councilman Cash. Question: Ayes: All Nayes: None -000- 2945 Concord Road and 2977 Concord Road - Mr. Palmer described these structures as open, vacant, and in a dilapidated condition. He recommended they be con- demned and torn down immediately. Councilman Evans made a motion to condemn these structures and the motion was seconded by Councilman Dishman. Question: Ayes: All Nayes: None -000- 2825 Crockett Street - Mr. Palmer described this structure as partially demol- ished and recommended that it be condemned so that work could be completed. Councilman Cash made a motion to condemn this structure and the motion was seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- 3020 Edmonds Street, 3020 Edmonds Street (Rear) , 3020 Edmonds Street (Rear) Mr. Palmer described these structures as open, vacant, and in a deteriated condition. He recommended they be condemned and torn down immediately. A motion was made by Councilman Evans to condemn these structures. Councilman Dishman seconded the motion. Question: Ayes: All Nayes: None Later in the hearing a Mrs. Kelly representing the family for these structures appeared and requested they be given time to demolish these houses themselves. An amendatory motion was made by Councilman Cash to grant the family 30 days to begin this work. The motion was seconded by Councilman. Evans. Question: Ayes: All Nayes: None -000- 3418 W. Euclid Street - Mr. Palmer described this structure as in a deteriated condition and recommended it be torn down immediately. Councilman Dishman made a motion to condemn this structure. The motion was seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- 3621 Glenwood Street. - Mr. Palmer recommended that this structure be torn down Councilman Evans made a motion to condemn this property and the motion was seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- 2975 Goliad Street - Mr. Palmer stated that this structure had been burned and was open and vacant. He recommended that this structure be condemned and torn down immediately. Councilman Evans made a motion to condemn this structure. The motion was seconded by Councilman Cash. Question: Ayes: All Nayes : None -7-- 2540 Hegel. Street - Mr. Palmer stated that this structure was in a dilapidated condition and recommended it be torn down immediately. A motion was made by Councilman Cash and seconded by Councilman Evans to condemn this structure. Question: Ayes: All Nayes : None -000- 690 Irma Street - Mr. Palmer described this two-story structure as in a dilapi- dated condition and recommended it be torn down immediately. A motion was made by Councilman Cash and seconded by Councilman Evans to condemn this structure. Question: Ayes : All Nayes: None -000- 715 -Mad-ison Avenue - Mr. Palmer described this structure as open, vacant and in a dilapidated condition. He recommended it be torn down immediately. A motion was made by Councilman Cash and seconded by Councilman Evans to con- demn this structure. Question: Ayes: All Nayes : None -000- 2657 Magnolia Street - Mr. Palmer described this as a burned structure, torn down but thed-e—bree remains. He recommended that this structure be torn down immediately. Councilman Cash made a motion to condemn this structure and the motion was seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- 1445 Maple Street - Mr. Palmer stated that a permit had been issued on this structure after receipt of notice. Mr. Palmer recommended that this structure be condemned and torn down immediately. A motion was made by Councilman Cash and seconded by Councilman Dishman to condemn this structure. Question: Ayes: All Nayes : None -000- 3745 Preston Street - Mr. Palmer described this structure as open, vacant, and in a deteriating condition. He recommended it be torn down immediately. A motion was made by Councilman Evans and seconded by Councilman Dishman to con- demn this structure. Question: Ayes: All Nayes : None -000- 3130 Roland Road - Mr. Palmer recommended this structure be condemned and torn down =E`ediately�. A motion was made to condemn this structure by Councilman Dishman and seconded by Councilman Cash. Question: Ayes: All Nayes: None -000- 3240 Roland Road and 4130 Roland Road -- These structures are down but not cleared away. Mr. Palmer recommended they be condemned. A motion was made to condemn these structures by Councilman Cash and seconded by Councilman Dishman. Question: Ayes: All Nayes: None -000- 1383 Schwarner Street - Mr. Palmer described this property as burned, vine covered and'definitely unsafe. He recommended the structure be condemned. Councilman Dishman made a motion to condemn this structure be condemned. Councilman Cash seconded the motion. Question: Ayes: All Nayes : None -000- -8- 1405 Schwarner Street - Mr. Palmer described `-Jiis structure as open, vacant and in-a-deter-1-ating condition. He reco�=,ended it be condemned and torn down immediately. A motion was made by Councilman Evans to condemn this structure. Councilman Fishman seconded the motion. Question: Ayes : All Nayes: None -000- 275 South 13th Street - Mr. Palmer described this structure as open, vacant, and recommended it be demolished as soon as poss4ble. Councilman Evans made a motion to condemn this structure. Councilman Dishman seconded this motion. He recommended it be condemned, A motion was made by Councilman Cash and seconded by Councilman Disiurian t_o oondei.rnn this property. He -stated he could not contact the cw,�,-)ers in Houston and recommended this structure be condemned and the owners g4ven 30 days to remove it. A motion was made by Councilman Evans and sec-onded by Councilman Fishman to condemn this structure. Question: Ayes: All Nayes: None -000- 3335 Waverly Street - Mr. Palmer stated this house is open, vacant, and deteri- ating. He recommended it be condemned and 'torn down immediately. Councilman Cash made a motion to condemn this structure, Councilman Evans seconded the motion.
