The Pledge of Allegiance was led by Councilman Williams. -000- The Mayor issued two proclamations: "National Action for Foster Children Week" April 8-14, 1973 and "Future Homemakers of America Week" - April 1-7 , 1973 . -°000- The Minutes of the regular meeting held on March 27, 1973, were approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, The City of Beaumont, Texas, on September 15, 1970 , duly passed a Resolution authorizing and directing the then City Manager to make applica- i.on and sign the necessary documents to apply for federal grants under the ederal Water Pollution Control Act, Public Law 660, as amended, in order to have sufficient funds to complete certain sewage transmission and treatment facilities; and, WHEREAS, Howard McDaniel has assumed the position of Acting City Manager of Beaumont and it is, therefore, necessary to amend the Resolution of Septem- ber 17, 1970, to correctly reflect the name of the present City Manager of Beaumont; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the Resolution of the City of Beaumont, Texas, passed September 17, 1970, relating to the application for a federal grant under the Federal Water Pollu- tion Control Act, Public Law 660, as amended, is hereby amended to read as follows: That Howard McDaniel, Acting City Manager, be, and he is hereby, autho- rized and directed to make application and sign the necessary documents re- quired to complete the project on behalf of the City, for a federal grant under Public Law 660, as amended, to be applied to the cost of the construction of said sewage facilities. Question: Ayes: All Nayes : None -000- The following three resolutions were introduced and read: A RES9 -LUTTON WHEREAS, Mary Addie Mitchell, E. W. McCown and Bernice Dyson, Individual and as Independent Executrix of the Estate of Jack Dyson, Deceased, have ten- dered an easement to The City of Beaumont for street and utility purposes over and across property owned by them in The City of Beaumont, Jefferson County, Texas, said easement being -dated March 9, 1973; and, WHEREAS, the City Council has considered the purposes of said easement and is of the opinion that the acceptance of said easement for street and util- ity purposes is necessary and desirable and that same should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That said easement tendered by the above named to The City of Beaumont be, and the same is hereby, in all things accepted. PASSED by the City Council this the 3rd day of April, 1973 . /s/ KEN RITTER - MAYOR - A RESOLU'T'ION WHEREAS, Students Homes, Inc. of Jefferson County, Texas, has tendered an easement to the City of Beaumont for street and utility pruposes over and across property owned by it in the City of Beaumont, Jefferson County, Texas, said easement being dated March 1, 1973; and, WHEREAS, the City Council has considered the purposes of said easement and is of the opinion that the acceptance of said easement for street and utility purposes is necessary and desirable and that same should be accepted; NOW, THEREFORE, BE 11T RESOLVED BY THE CITY COUNCIL OF THE C-ITY OF SEA'.MONT: That said easement tendered by the above named to the City of Beaumont be, and the same is hereby, in all things accepted. Question: Ayes: All Nayes : None The Mayor instructed the City Manager to contact those people donating the pro- perty for City use and extend the City ® s gratitude. -000 The following ordinance giving the City Manager authority to set fees for var- ious recreation programs and activities for the Parks and Recreation Department was introduced and read: ORDINANCE NO. 73-27 ENTITLED AN ORDINANCE AUTHORIZING THE CITY MANAGER OF THE CITY OF BEAUMONT TO SET ALL FEES NECESSARY FOR THE OPERATION OF THE PARKS AND RECREATION PROGRAM OF THE CITY OF BEAUMONT; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. The ordinance was passed on a motion made by Councilman Dishman and seconded by Councilman Evans. Question: Ayes : Mayor Ritter Nayes : Councilman Councilman Cash Williams Councilman Dishman Councilman Evans -000- The following ordinance amending Chapter 12A of the Code of Ordinances by adding a new Article III concerning dangerous structures was introduced and read: ORDINANCE NO. 73-25 ENTITLED AN ORDINANCE AMENDING CHAPTER 12A OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS , BY ADDING A NEW ARTICLE III CONCERNING DANGEROUS STRUC'T'URES PROVIDING FOR THE REMOVAL, REPAIR OR DEMOLITION OF ANY BUILDING OR STRUC- TURE WHICH IS OR THREATENS TOE A PUBLIC NUI- SANCE, DANGEROUS TO THE HEALTH,TH, SAFETY OR GENERAL WELFARE OF THE PEOPLE OF THE CITY OF BEAUMONT: DEFINING DANGEROUS STRUCTURES - DECLARING SAID DANGEROUS STRUCTURES TO BE A PUBLIC NUISANCE; PROVIDING FOR NOTICE; PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. Question: Ayes : All Nayes: None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, the City Council of the City of Beaumont has previoouly adopted policies covering the operation of the Harvest Club, YMBL Building and Munici pal Auditorium, dated March 13 , 1973; and, WHEREAS, the City Council of the City of Beaumont now desires to adopt amended policies dated April 3 , 1973; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the policies covering the operation of the Harvest Club, YMBL Build- ieg and Municipal Auditorium, as amended, dated April 3, 1973, and on file in the City Clerk's office of the City of Beaumont are hereby adopted. Question: Ayes Mayor Ritter Nayes: Councilman Councilman Cash Evans Councilman Dishman Councilman Williams -o00- In response to questions previously asked Mr. Palmer if he had determined how Many employees he would need to handle the new workload to initiate the Hous- ing Ordinance as amended, he stated that 2 to 4 additional employees would be needed. Councilman Cash asked if employees could be transferred rather than hire new personnel for this Department. The City Manager responded that this worX, had been handled by Civil Service Fire Department personnel and Inspec- tion Department personnel in addition to their regular duties and that if these employees were transferred, then these vacancies would have to be filled. -000- Councilman Evans requested a study be made to determine the feasibility of the City operating an Ambulance Service. The Mayor stated that he felt that we had sufficient ambulance service and that he personally had heard no complaints from citizens. The Mayor also asked the City Manager to poll the Medical Pro- fession to determine if they had any complaints. Mr. Roy May, 5110 Twilight Drive, stated that our present ambulance service is used only to transfer peo- ple from one location to another and did not invo"Lve :actual medical aid.
