The Pledge of Allegiance was led by Councilman Evans. -000- The Mayor issued two proclamations : "Lurline Bean Day`® - March 19, 1973 and "Girl Scout Week in Beaumont" - March 1117, 1973 . _000- Minutes of the regular meeting held on March 6, 1973, were approved on a motion made by Councilman Cash and seconded by Councilman Evans . Question: Ayes : All Nayes : None -000- A recommendation rejecting the bid of Allied Supplier & Erector, Inc. for furnishing necessary materials, equipment, superintendence, and labor for erecting fencing and gates on city property east of Pine Street and author- izing re-advertising for bids was approved on a motion made by Councilman Evans and seconded by Councilman Dishman. Question: Ayes : All Nayes : None _000- The following resolution was introduced and read: A RESOLUTION WHEREAS , emergency repairs are necessary to the Allis-Chalmers HD-12G crawler, tractor for the Solid Waste Department; and, WHEREAS , the hazard created to the public health requires immediate repair of said tractor; and, WHEREAS, the emergency situation does not allow time for a formal bidding procedure for such repairs and informal bids have been received; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That "t-he bid of Fogle Equipment Company in the sum of $5 ,089. 58 for the repair of said Allis-Chalmers IID-12G crawler tractor be, and the same is hereby, accepted and Clarence Cowart, Director of Solid Waste Department, is authorized to order the emergency repairs to said tractor for the sum hereinabove stated. Question: Ayes : All, Nayes : None Authorization to advertise for bids for furnishing one crawler type tractor with 1z yd. loading bucket for the Street Department was granted on a motion made by Councilman Cash and seconded by Councilman Evans, Question: Ayes : All Nayes : None -000- The following ordinance regarding Planning Division File 489-Z to change the zoning of three contiguous parcels of land in the F. Bigner Survey from R-1 to R-2 and C-1, the property being situated on the west side of Treadway Road lying north of Folsom Drive and southwest of the Eastex Free- way, total area being 6.135 acres. was introduced and read: ORDINANCE NO. 73-20 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , BY CHANGING THE CLASSIFICATION OF TWO (2) TRACTS OF LAND AS FOLLOWS : PARCEL NO. 1 CONTAINING 3 . 038 ACRES OF LAND, MORE OR LESS, OUT OF THE F. BIGNER SURVEY, IN BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED "R-1" TO "C-11" PARCEL NO. 2 CONTAINING 1. 879 ACRES OF LAND, MORE OR LESS , OUT OF THE F. BIGNER SURVEY, IN BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED "R-1" TO "R-211 ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. The ordinance was passed on a motion made by Councilman Cash and seconded by Councilman Williams. Question: Ayes : All Nayes: None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, the City Council has approved the acquisition of an under- ground utilities easement across property belonging to the First United Meth- odist Church, and the appraised value of said easement plus damages to the remainder of said property is $4 , 302 less than the award of the Special Com- missioners duly appointed to hear the Proceedings in Eminent Domain for the street right-of-way; and, WHEREAS, the City Council has authorized the additional acquisition of an easement for street right-of-way purposes; and, WHEREAS, it is the opinion of the City Council that $4 ,302 should be appropriated from the General Fund, Contingency Account to pay the award of Commissioners in excess of the fair market value of the underground util- ities easement and damages to the remainder; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the Director of Finance be, and he is hereby, authorized to pay from the General. Fund, Contingency Account the sum of $4 , 302 towards the payment of the award of Commissioners in that certain Proceedings in Eminent Domain styled "The City of Beaumont, Plaintiff vs. Trustees for the First United Methodist Church of Beaumont, Texas, et al, Defendants. Dowlen, Tom H. Dowlen, and Robert O. Dowlen, Sr. have tendered an easement to the City of Beaumont for street and/or utility purposes in, on and over property owned by them in The City of Beaumont, Jefferson County, Texas, said easement being dated February 28 , 1973; and, WHEREAS, the City Council has considered the purposes of said easement and is of the opinion that the acceptance of said easement for street and/or utility purposes is necessary and desirable and that same should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That said easement tendered by the above-named persons to the City of Beaumont be, and the same is hereby, in all things accepted. Question: Ayes : All Nayes : None -000- The following ordinance vacating and abandoning a portion of Levert Street between the south line of Calder and north line of realigned Missouri Paci- fic right-of-way was introduced and read: ORDINANCE NO. 73-21 ENTITLED AN ORDINANCE VACATING AND ABANDONING A PORTION OF LEVERT STREET BETWEEN THE SOUTH LINE OF CALDER AVENUE AND THE NORTH LINE OF THE REALIGNED MISSOURI-PACIFIC RIGHT-OF-WAY, AS MORE PARTICULARLY DESCRIBED HEREIN. The ordinance was passed on a motion made by Councilman Cash and seconded by Councilman Dishman. Question: Ayes : All Nayes : None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, the City Council of the City of Beaumont desires to estab- lish a rate schedule for the Harvest- Club, YMBL Hall , and Municipal Audi- torium: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the appropriate City departments are hereby authorized to charge the following fees for the use of the Harvest Club, YMBL Hall and Municipal Auditorium: -4- HARVEST CLUB Dances and style shows up to 4 hours $140 and $35 for each additional hour. Meetings up to 2 hours $70 and $35 for each addi- tional hour. Rehearsal or decorating $25 an hour. At least one Fireman and one Policeman shall be re- quired for commercial and public functions. Fee: $5 per hour each. YMBL HALL Dances and style shows up to 4 hours $60 and $15 for each additional hour. Meetings up to 2 hours $30 and $15 for each additional hour. Rehearsal or decorating $5 an hour, At least one Fireman and one Policeman shall be required for commercial and public functions. Fee : $5 per hour each. MUNICIPAL AUDITORIUM Up to 4 hours - 1 Performance $220 and $55 for each additional hour. 2 Performances - Afternoon and/or Night $330. Rehearsal or decorating $45 an hour, At least one Fireman and one Policeman shall be re- quired for commercial and public functions. Fee: $5 per hour each. BE IT FURTHER RESOLVED: That the policies covering the operation of the Harvest Club, YMBL Building and Municipal Auditorium, dated March 13, 1973 , and on file in the City Clerk' s office of the City of Beaumont are hereby adopted.
