The Pledge of Allegiance was led by Councilman Cash. -000- Minutes of the regular meeting held on January 2, 1973 approved on a motion made by Councilman Cash; seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- In response to published notice, bids were received for furnishing cleaning and lining equipment for the Water Distribution Department. Bids were as follows: Gulf Supply --------------------------------------- $6,194 . 02 Rose Oil Industry Supply Company ------------------ $6,483.38 Norvell-Wilder bid as read -------------- $3,234.30 bid as tabulated --------- $7, 001. 49 American Hose Specialty, Inc. --------------------- $7,104.16 Bids referred to the City Manager and staff for study and recommendation on a motion made by Councilman Cash; seconded by Councilman Evans. Question: Ayes : All Nayes: None -000- Permission to advertise for bids for purchasing and installing fencing and gates, relocating one gate and furnishing tie wire and bands for fence at 1848 Pine Street and adjacent property of the Health Department was granted on a motion by Councilman Dishman; seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, the City of Beaumont entered into a lease with the Beaumont Youth Council on the 5th day of May, 1970, leasing to the Beaumont Youth Council premises at 1899 Interstate 10 East for a period of five (5) years; and, WHEREAS, this lease provides that it may be terminated upon thirty (30) days notice in writing; and, WHEREAS, the City Council of the City of Beaumont considers its advisable that the City cancel said lease; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT; That the City Manager be and he is hereby authorized to give thirty (30) days notice of cancellation of the lease between the City of Beaumont and the Beaumont Youth Council for premises located at 1899 Interstate 10 East, and take any other steps necessary to effectuate the cancellation of this lease. Question: Ayes: All Nayes : None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, the acquisition of an easement across certain property known as Tract No. 5 of the Corley-Madison Project is necessary to the completion of said project; and, WHEREAS, there are located in said Tract No. 5 a signal relay box and a railroad signal for auto traffic, both of which will have to be relocated before completion of the Corley-Madison Project; and, WHEREAS, the Kansas City Southern Railway Company has tendered to the City of Beaumont an easement for Tract No. 5 in consideration of the City' s payment of the relocation of the said signal relay box and the railroad signal for auto traffic and the construction of the street crossing at an estimated .cost of nearly $10, 000; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS That the said easement for Tract No. 5 of the Corley-Madison Project, con- taining in area 3101 square feet, and more particularly described in said easement deed, which easement deed is hereby incorporated for all purposes as fully and ..completely as though copied verbatim herein, is in all respects accepted by the City of Beaumont; and, BE IT FURTHER RESOLVED: That the Director of Community Development of the City of Beaumont is hereby authorized to expend an amount not to exceed $10, 000 for the relocation of the said signal relay box and the railroad signal for auto traffic and the construction of the street crossing to City specifications_as consideration for the conveyance of the easement by Kansas City Southern Railway Company. Question: Ayes : All Nayes : None -000- The following resolution was introduced and read: A RESOLUTION WHEREAS, the acceptance of a quit claim deed from Kansas City Southern Railway Company, a Missouri corporation, to a portion of Block 11 of the Original Townsite of Beaumont, Texas, containing 2205 square feet in area, -2- is needed to clear title to the City of Beaumont to said Block 11, and the terms of said quit claim being in the best interest to the City of Beaumont and its citizenry; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That a certain quit claim deed to a portion of Block 11 of the Original Townsite of Beaumont, Beaumont, Jefferson County, Texas, containing in area 2205 square feet more particularly described in said quit claim deed which quit claim deed is incorporated herein as fully and completely as though copied verbatim, is in all respects accepted; and BE IT FURTHER RESOLVED: That the City of Beaumont hereby assumes the responsibility of removal of the trackage within said Block 11 and within Main Street and to repair the street in as good a condition as before removal, with the City of Beaumont to retain the trackage so removed. Question: Ayes: All Nayes: None -000- The following ordinance establishing a program on policy of residential street paving assessment was introduced and read: ORDINANCE NO. 73-1 ENTITLED AN ORDINANCE ESTABLISHING A PROGRAM AND POLICY OF RESIDENTIAL STREET PAVING ASSESSMENT BY THE CITY OF BEAUMONT, TEXAS; PROVIDING FOR AVAILA- BILITY OF ASSESSMENT PAVING; PROVIDING FOR APPLI- CATION BY THREE FOURTHS (3/4) OF THE PROPERTY OWNERS AND TWO THIRDS (2/3) OF TOTAL PROPERTY FRONTAGE OR THREE FOURTHS (3/4) OF TOTAL PROPERTY FRONTAGE AND TWO THIRDS (2/3) OF THE PROPERTY OWN- ERS; PROVIDING FOR ASSESSMENT RATES; PROVIDING FOR CITY PAYMENT FOR ALL COST OF STORM SEWERS AND AP- PURTENANCES; PROVIDING FOR FINANCING. OF STREET AS- SESSMENT CERTIFICATES BY THE CITY AND MONTHLY PAY- MENTS; REPEALING ALL ORDINANCES AND PARTS OF ORDI- NANCES IN CONFLICT HEREWITH. The ordinance passed on a motion made by Councilman Williams, seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- The following ordinance amending the Classification-Compensation Plan was introduced and read: ORDINANCE NO. 73-2 ENTITLED AN ORDINANCE AMENDING_ CHAPTER 12 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY REPEALING SECTION 12-34 OF SAID CODE OF ORDINANCES AND ENACTING A NEW SECTION 12-34 IN LIEU THEREOF; BY REPEAL- ING SECTION 12-35 OF SAID CODE OF ORDINANCES AND ENACTING A NEW SECTION 12-35 IN LIEU THEREOF; AMENDING. THE "MANUAL OF CLASS SPECIFICATIONS" AND THE "CLASSIFICATION AND PAY PLAN"; REPEALING ALL ORDINANCES IN CONFLICT. -3- The ordinance passed on a motion made by Councilman Dishman; seconded by Councilman Evans. Question: Ayes : All Nayes: None -000- The following ordinance amending Fire and Police Department pay grades was introduced and read: ORDINANCE NO. 73-3 ENTITLED AN ORDINANCE AMENDING SECTIONS 12-19 AND 12-20 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY INCREASING THE BASE PAY OF ALL GRADES OF THE POLICE DEPARTMENT AND THE FIRE DEPARTMENT OF THE CITY; REPEALING ALL CONFLICTING ORDINANCES; AND PROVIDING FOR SEVERABILITY. The ordinance passed on a motion made by Councilman Williams; seconded by Councilman Evans.
