HomeMy WebLinkAboutORD 04-098 ORDINANCE NO. 04-098 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND/OR REPAIR; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1. 258 Bowie (Commercial) 15. 4492 Park 2. 1560 Brooklyn 16. 2204 Pecos (Rear Garage Apartment) 3. 2410 Clearview 17. 2425 Pecos 4. 773 Cuniff Avenue 18. 2016 Pope 5. 2170 Euclid 19. 2420 Ranier 6. 3226 W. Euclid and Garage 20. 4150 Steelton 7. 330 Fletcher 21. 2105 Victoria 8. 1495 W. Florida (Auxiliary Bldg.) 22. 3175 Washington Blvd. 9. 2595 Franklin 23. 3395 Washington Blvd. 10. 1130 Houston 24. 3635 West Lane (Garage Apt) 11. 2124 Magnolia 25. 1540 College (Residential/Commercial) 12. 1203-1205 North (Garage Apartment) 26. 3260 Gulf (Garage) 13. 3905 Ogden Avenue 127. 3960 Harding Drive & Garage 14. 2715 Park 128. 1203-1205 North (Duplex) to be public nuisances in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont,Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within ten (10) days of the effective date of this ordinance. 1. 258 Bowie (Commercial) 13. 3905 Ogden Avenue 2. 1560 Brooklyn 14. 2715 Park 4. 773 Cuniff Avenue 15. 4492 Park 5. 2170 Euclid 16. 2204 Pecos Rear Garage Apartment) 7. 330 Fletcher 19. 2420 Ranier 8. 1495 W. Florida (Auxiliary Bldg.) 20. 4150 Steelton 9. 2595 Franklin 21. 2105 Victoria 10. 1130 Houston 22. 3175 Washington Blvd. 11. 2124 Magnolia 124. 3635 West Lane (Garage Apt) If the property owners fail to comply within ten (10) days, Council orders that the property be demolished without further notification to the property owners or City Council action. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings execute a work program with the City within ten (10) days of the date of this ordinance and either demolish or repair the structures within ninety (90) days after the date of this ordinance: 18. 2016 Poe 123. 3395 Washington Blvd. If the property owner(s)fail(s)to comply within ninety (90) days, Council orders that the property be demolished without further notification to the property owner(s) or City Council action. Section 4. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings execute a work program with the City within ten (10) days of the date of this ordinance and either demolish or repair the structures within one-hundred twenty (120) days after the date of this ordinance: 3. 2410 Clearview 25. 1540 College (Residential/Commercial) 6. 3226 W. Euclid and Garage 26. 3260 Gulf (Garage) 12. 1203-1205 North (Garage Apartment) 7. 3960 Harding Drive & Garage 17. 2425 Pecos 28. 1203-1205 North Duplex If the property owner(s)fail(s)to comply within one-hundred twenty(120) days, Council orders that the property be demolished without further notification to the property owner(s) or City Council action. Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
