Cooper, City Attorney Kyle Hayes, City Manager Rose Ann Jones, City Clerk The City Council of the City of Beaumont,Texas, met in a regular session on November 16,2004, atthe City Hall Council Chambers,801 Main Street, Beaumont,Texas,at 1:30 p.m.to considerthe following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Lord called the council meeting to order at 1:30 p.m. Councilmember Samuel gave the invocation. CouncilmemberCokinos led the Pledge of Allegiance. Roll call was made by Rose Ann Jones, City Clerk. Present at the meeting were Mayor Lord, Mayor Pro Tern Ames,Councilmembers Smith,Beaulieu, Cokinos,Samuel and Patterson. Also present were Kyle Hayes,City Manager;Tyrone E. Jude Paredez 10620 Gage Road Beaumont TX Item #3: Felt that the City has already spent too much money on the Delaware Street Extension Project Minutes-November 16,2004 CONSENT AGENDA Approval of minutes - Minutes of November 9, 2004 Confirmation of committee appointments - None A) Authorize the execution of a License to Encroach Agreement with Beaumont Real Estate Holdings Company, through their agent Ohmstede Ltd., on the City's right-of-way on Pine, North Main and North Pearl Streets forthe installation of four(4)groundwater monitoring wells - Resolution 04-268 B) Authorize paymentto contractors and/orvendors forcosts associated with the development of ten new homes on the former Dick Dowling school site - Resolution 04-269 Council member Cokinos moved to approve the Consent Agenda. Council member Beaulieu seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider approving the purchase of an electronic handheld ticket writer system for use by the Police Department - Resolution 04-270 Administration recommends the purchase of an electronic handheld ticket writer system from Enforcement Technology of Irvine, California in the amount of$71,234. A computerized handheld ticket writer system reduces the time necessary to write a traffic citation,eliminates the manual data entry process,and minimizes errors. Data captured in the handheld computers is uploaded periodically into the Municipal Court's computer system. Issuing and processing traffic citations and parking tickets in this manner reduces the time it takes to issue citations,eliminates manual data entry and minimizes the error rate. Funds are available in the Municipal Court Technology Fund. Councilmember Cokinos made a motion to APPROVE RESOLUTION 04-270 TO ACCEPT THE BID SUBMITTED BY ENFORCEMENT TECHNOLOGY, IRVINE, CALIFORNIA, FOR THE PURCHASE OF AN ELECTRONIC HANDHELD TICKET WRITER SYSTEM FOR THE BEAUMONT POLICE TRAFFIC DIVISION IN THE AMOUNT OF $71,234. Councilmember Beaulieu seconded the motion. Consider approving the purchase of propertyforthe construction of anew Convention & Visitors Bureau Office Building - Resolution 04-271 Administration has recommended that Council approve the acceptance of Tract 2, Block 4 in the Fuller Keith Addition,being conveyed to the City of Beaumont by Fidelity National Title Insurance Companyforthe construction of a new Convention&Visitors Bureau Office Building. The cost of this parcel of land is$5,000,funded underthe General Improvement Fund. Mayor Pro Tern Ames made a motion to APPROVE RESOLUTION 04-271 TO AUTHORIZE THE PURCHASE OF PROPERTY,BEING TRACT 2, BLOCK 4 IN THE FULLER KEITH ADDITION, LOCATED AT 825 MC FADDIN STREET FROM FIDELITY NATIONAL TITLE INSURANCE COMPANY FOR THE CONSTRUCTION OF A NEW CONVENTION &VISITORS BUREAU OFFICE BUILDING FOR THE NEGOTIATED VALUE OF$5,000. Councilmember Smith secondedthe motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS,SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED 3. Consider approving a resolution authorizing the City Manager to execute Change Order No.2 forthe Delaware Street Extension projectto provide sand bedding forthe new water transmission line - Resolution No. 04-272 Administration recommended approval of increasing the Delaware Street Extension project amount by$42,406 to provide the sand bedding needed to install the 36-inch water transmission line. Change Order No. 2 funds are necessary for the extra cost of the sand bedding material needed to install the 36-inch transmission line. The bedding material is required by the transmission line manufacturer but was not included in the original contract. Funds are available in the Capital Improvement Program. Councilmember Smith made a motion to APPROVE RESOLUTION 04-272 AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 2 FOR THE DELAWARE STREET EXTENSION PROJECT FOR THE EXTRA COST OF THE SAND BEDDING MATERIAL NEEDED TO Page 3 of 6 Minutes-November 16,2004 INSTALL THE 36-INCH TRANSMISSION LINE IN THE AMOUNT OF$42,406 INCREASING THE CONTACT AMOUNT TO$4,274,962.30. CouncilmemberCokinos seconded the motion. Jim RIGGS, WHO WAS ALSO A POLICE OFFICER COUNCILMEMBER SMITH - NONE CITY ATTORNEY COOPER- NONE CITY MANAGER HAYES - NONE MAYOR LORD - ON SUNDAY, ATTENDED A CEREMONY IN SILSBEE WHILE THEY HONORED THEIR VETERANS AND PREPARED FOR CHRISTMAS FOR THE TROOPS IN IRAQ; ATTENDED A DEDICATION AT ST. JUDE'S FOR THE BOY SCOUT TROOP HUT WHICH WAS IN HONOR OF OFFICER CONRAD GERNALE, A FORMER BEAUMONT POLICE OFFICER. THIS DEDICATION WAS ALSO ATTENDED BY MANY OF OUR POLICE OFFICERS IN HIS MEMORY.
