WHEREAS, Beaumont Real Estate Holdings Company, through their agent
Ohmstede Ltd., has requested the City of Beaumont to allow Ohmstede Ltd. to encroach
on the City's rights-of-way on Pine, North Main and North Pearl Streets to install four (4)
groundwater monitoring wells, as shown below
1. PMW-20 and PMW-20D encroaching onto the City's right-of-way in the south central
portion of a triangular concrete median located at the intersection of Pine Street, North
Main Street and Harrison Avenue.
2. PMW-21 encroaching onto the City's right-of-way, two hundred eighty(280)feet north
of the intersection of Harrison Avenue and North Main Street and ten (10)feet east of
the edge of pavement of Pine Street, off of the railroad easement.
3. PMW-17 encroaching onto the City's right-of-way,two hundred twenty(220)feet south
of the intersection of Harrison Avenue and North Pearl Street and ten (10)feet west of
the back of curb of North Pearl Street;
and as described on Exhibit "A"attached hereto and made a part hereof for all purposes;
and,
WHEREAS City staff has expended considerable time and effort in investigating the
effect of such encroachment upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a License to Encroach to
Beaumont Real Estate Holdings Company, through their agent Ohmstede Ltd., as shown
above and on Exhibit "A" attached hereto, for a one-time fee of Five Hundred Dollars
($500.00).
