Cit y of Beaumont ~ Council Agenda Item TO: City Council FROM: Kyle Hayes, City Manager PREPARED: Tom Scofield, Chief of Police MEETING DATE: October 26, 2004 AGENDA MEMO DATE: October 13, 2004 REQUESTED ACTION: Consider a resolution authorizing the City Manager to execute all documents necessary to accept the project titled "FY2005 S. T. E. P. Waves". RECOMMENDATION Administration recommends authorizing the City Manager to execute all documents necessary to accept the project titled"FY2005 S.T. E. P. Waves". BACKGROUND In January, 1999, the City Council passed a resolution authorizing the city to apply for matching funds for a traffic safety "Safe and Sober S. T. E. P." grant project. The Police Department has successfully applied for and the City Council approved several traffic safety grants over the past four years. This grant application will provide funding for a"FY2005 S. T.E. P. Waves"grant program for the overtime enforcement and education efforts on traffic safety areas of occupant protection and speed. The grant would be in the amount of$13,165 from the Texas Department of Transportation with a required match from the city of$1,822. BUDGETARY IMPACT A match of$1,822 will be required from the City. Funds are available in the Police Department's Budget. PREVIOUS ACTION The City has participated in"S. T. E. P."traffic enforcement grants in prior years. SUBSEQUENT ACTION None. RECOMMENDED BY City Manager and Chief of Police. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: WHEREAS,the City of Beaumont has been notified by the Texas Department of Transportation that it is eligible to receive funding to assist in highway safety enforcement; and, WHEREAS, the City of Beaumont recognizes that the safety and security of the motoring public is of paramount concern to the City; and WHEREAS,the City of Beaumont strives to enhance the safety of the motoring public; and, WHEREAS, , grant funding through the Texas Department of Transportation would assist in enhancing the safety of the motoring public and reducing motor vehicle crashes which often result in loss of life or personal injury; and WHEREAS,traffic safety enforcement and encouragement of safe driving habits is a significant goal of the Beaumont Police Department; and WHEREAS, the City of Beaumont has been notified by the Texas Department of Transportation that it is eligible for federal reimbursement funding in an amount not to exceed Thirteen Thousand One Hundred and Sixty-Five($ 13,165)Dollars pursuant to the projects titled "FY05 S.T.E.P. Waves"for occupant protection enforcement, education of the public and speeding enforcement. WHEREAS, the City of Beaumont has agreed to contribute One Thousand Eight Hundred.and Twenty-Two($ 1,822)Dollars as their portion of the costs for the projects titles "FY05 S.T.E.P. Waves"which are Thanksgiving 2004 holiday, Child Passenger Safety Week 2005, Memorial Day 2005 holiday, and Labor Day 2005 holiday. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager of the City of Beaumont, be, and is hereby, authorized to execute all documents necessary to accept the project"FY05 S.T.E.P. RECOMMENDATION The Administration recommends approval of agreements with the Southeast Texas Family Resource Center to assist with administrative and operating expenses for Kids in Motion Safe Haven in the amount of$19,016, Six Production Studios to shoot a short documentary on the Charlton-Pollard Neighborhood for the amount of$6,500 and the Charlton-Pollard Neighborhood Association for Project Clean in the amount of$2,073. Programs sponsored by the Charlton-Pollard Weed and Seed Initiative are designed to enhance the quality of life of and promote educational opportunities for persons and families living in and around the Charlton-Pollard neighborhood. BACKGROUND The U. S. Department of Justice,Executive Office for Weed and Seed under Title I of the Omnibus Crime Control and Safe Streets Act of 1968 approved the budget for Grant Award#2001-WS-QX- 002 1. The Weed and Seed Steering Committee approved funding for the Kids In Motion Safe Haven on the 17'day of August,2004. The Weed and Seed Steering Committee approved funding for Six Productions Studios and the Charlton-Pollard Neighborhood Association on September 21, 2004. BUDGETARY IMPACT Funds are available from the U. S. Department of Justice Grant#2001-WS-QX-0021. PREVIOUS ACTION None. SUBSEQUENT ACTION None. Also recommended for approval are the water and sanitary improvements for Lots 1-18, Block 9. RECOMMENDATION The Administration requests approval of a resolution to select an underwriter to provide underwriting services for approximately $12,365,000 City of Beaumont, General Obligation Refunding Bonds. BACKGROUND A request for proposals for underwriting services on the above mentioned bonds was sent out by the City's Financial Advisor,Frank Ildebrando of RBC Dain Rauscher on October S,2004. Six proposals were received and are in the process of being reviewed. A recommendation by RBC Dain Rauscher will be made at the City Council meeting on October 26, 2004 to select the underwriter or team of underwriters. The selection will be based on the demonstrated competence, experience,knowledge and qualifications of the underwriters submitting responses, and on the reasonableness of the proposed fee for underwriting services. The bonds are expected to be issued on November 1,2004 with delivery and receipt of proceeds by the City on December 2, 2004. Proceeds will be used to refund certain outstanding obligations of the City including portions of the 1995 Certificates of Obligation,the 1996 Refunding Bonds and the 1996 Certificates of Obligation. The refunding is expected to produce a net cost savings to the City of approximately$550,000. BUDGETARY IWACT All debt shall be incurred in the Debt Service Fund which is supported by property taxes. PREVIOUS ACTION None. SUBSEQUENT ACTION An ordinance authorizing the issuance of City of Beaumont, Texas General Obligation Refunding Bonds will be presented for City Council consideration on November 2, 2444. BACKGROUND Robert Clark,representing the developers of the property,has requested a zone change from A-R to PUD for 139.84 acres of land located on the north side of Walden Road,east ofDishman Elementary School. The Crescent on Walden development will consist of home lots varying in size from approximately one acre to zero lot line. This mixed density development will also contain three separate lakes,the largest being approximately fifteen acres in size. The purpose of the PUD District is to encourage the unified design of a variety of uses in accordance with an approved comprehensive development plan. This district provides for greater flexibility in the design of buildings, yards, courts and circulation than provided by other districts. Prior to the issuance of any building permit for property located in a PUD District,a general land use and density plan must submitted to the Planning Commission. The plan shall include schematic land use plan identifying proposed general uses,densities,major open spaces and circulation and access features. A general land use plan has been submitted as part of this application. BUDGETARYIMPACT None. PREVIOUS ACTION At a Joint Public Hearing held October 18,2004,the Planning Commission voted 9:0 to approve a zone change from A-R(Agricultural-Residential)to PUD(Planned Unit Development)District for property located on the north side of Walden Road, east of Dishman Elementary School. Parkway,between Florida and Veatch. BACKGROUND Campus Village Housing, LP, is requesting a zone change for property located on the west side of MLK Parkway, between Florida and Veatch. The zone change involves the rear portions of a 2.6 acre tract and 3.36 acre tract which are zoned LI. The front 190'of these two tracts are already zoned GC-MD. The 2.6 acre tract is vacant while the 3.36 acre tract is improved with a former night club building and related parking. In the development of the property,the night club will be demolished. The purpose for the zone change is to rezone the subject property so that the entire 5.86 acres can be developed into a luxury student housing development. Campus Village Housing has identified a demand for off-campus, luxury housing near Lamar University. The company states that it has a great deal of experience in the development of off-campus,luxury student housing and believes that Lamar University provides a growing market for such housing. BUDGETARY IMPACT None. PREVIOUS ACTION At a Joint Public Hearing held October 18, 2004,the Planning Commission voted 8:0:1 to approve a zone change from LI (Light Industrial) to GC-MD (General Commercial-Multiple Family Dwelling) District for property located on the west side of M.L.K. D. of the Zoning Ordinance states the following: Protest: The City Council shall not amend, supplement, change, modify or repeal any regulation,restriction or boundary or approve a Specific Use Permit where a protest against such change, signed by the owners of twenty(20) percent or more either of the area of the lots included in such proposed change or of the lots or land immediately adjoining the same and extending two hundred (200) feet therefrom, except by the favorable vote of three-fourths (3/4) of all the members of the City Council. The Traffic Manager has conditioned approval of this request upon the removal of the north driveway. In addition, he has stated that no new median cut on Dowlen will be allowed. Land Manor is now requesting a modification to its Texas Department of Criminal Justice contract that will allow it to provide treatment to adult female parolees who have already participated in a 9 month in-prison Therapeutic Community for treatment of addiction. This facility will provide these females with additional chemical dependency treatment and assistance through the Department of Assistive and Rehabilitative Services. Franklin House South is licensed by the Department of State Health Services as a residential and outpatient substance abuse treatment facility. In addition to the existing 45 beds for male and female substance abusers, Franklin House South would offer residential services to 10 females and outpatient services to 16 females. Residential services would be for periods of from one to three months, dependent on the client's needs. Outpatient services may continue for one year. BUDGETARY IMPACT None. BACKGROUND The State of Texas Cooperative Purchasing Program provides contracted pricing on various commodities to all state, county, school district and municipal agencies within Texas. The Program is coordinated by the Texas Building and Procurement Commission (TBPC) in accordance with state bidding statutes. The City has approximately 33,000 of the 90-gallon containers currently in service, which are used in conjunction with automated refuse trucks. The majority of the cans in service were purchased in 1989 with an anticipated useful life of seven(7) years. Due to aging and wear, the existing containers are in varying stages of deterioration. The Clean Community Division anticipates the eventual replacement of the entire container inventory over a period of years. The City purchased 1,260 containers from Toter during fiscal year 2004, with that being the first significant acquisition of cans since the inception of the automated trash system. RECOMMENDATION Administration recommends a sixty-month(60) lease for forty (40) Imagistics brand photocopiers from Better Business Machines of Beaumont, Texas for use by various City Departments in the amount of$64,524 per year. BACKGROUND The City of Beaumont currently has eighty-two(82)photocopiers located throughout the City. Forty (40)copiers were identified for replacement based on copier age,maintenance costs,and rental fees. Copiers selected for replacement include seven (7) older copiers with higher than average maintenance costs, twelve (12) rented copiers, and twenty-one (21) copiers on the Teleserve maintenance insurance plan. Leasing these forty (40) copiers will alleviate the need to purchase replacement copiers for the older equipment in the near future as well as eliminate the risk of rising maintenance costs. Newer copiers less than six (6) years old, copiers on fixed term leases, and copiers currently in minimal use environments were not considered for replacement at this time. Proposals were solicited from eight (8) vendors for a sixty-month (60) supplies and maintenance inclusive lease. Specifications included precise details about the capabilities and features required on each copier. Copy speeds ranging from twenty-five (25) to fifty-five (55) copies per minute (CPM)were requested in various quantities based on users' needs. Industry standard features such as bypass trays, automatic duplexing, enlargement and reduction capabilities, and finisher/staplers were required on all copiers. The proposal specifications also included provisions to allow the City to add copiers to the lease during the initial term should the City desire to do so. While the City would realize an estimated annual cost savings of $1,806 over current costs by selecting the lowest proposal, Administration recommends the second lowest proposal in the amount of$64,524 per year. This selection would cost the City approximately$2,586 extra per year over current costs but will provide the best value. The second proposal includes twenty-five (25) copiers that exceed the minimum required copy speeds. The vendor will provide 35 copy per minute (CPM) copiers and 55 CPM copiers as indicated below. Offering only two(2)copier models in addition to the color copier will make a supplies inventory simple to order and maintain. While the potential cost savings and additional costs resulting from either proposal can only be estimated because of supply and maintenance variables, the second proposal from Better Business Machines offers the City the greatest overall value.
