Patterson July 20,2004 Audwin Samuel Lane Nichols, City Attorney Kyle Hayes, City Manager Rose Ann Jones, City Clerk The City Council of the City of Beaumont,Texas, met in a regular session on July 20,2004, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Lord called the council meeting to order at 1:30 p.m. Pastor Mark Viatorof Friendship Baptist Church gave the invocation. Mayor Pro Tem Ames led the Pledge of Allegiance. Roll call was made by Rose Ann Jones, City Clerk. Present at the meeting were Mayor Lord,Mayor Pro Tem Ames,Councilmembers Smith,Beaulieu, Cokinos and Samuel. Absent: Councilmember Patterson. Also present were Kyle Hayes, City Manager; Joe Sanders, Assistant City Attorney; Rose Ann Jones, City Clerk. Proclamations, Presentations, Recognitions None Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda. None CONSENT AGENDA Approval of minutes- Minutes of July 13, 2004 Confirmation of committee appointments - Leonie Bodin was reappointed to the Historical Landmark Commission. Her term of office will expire March 23, 2006. (Councilmember Bobbie J. Patterson) - Resolution 04-157 Minutes-July 20,2004 A) Approve a resolution acknowledging the"Matricula Consular,"an identification card issued bythe Mexican Consulate to Mexican nationals residing in the United States-Resolution 04- 158 B) Approve a resolution authorizing the City Managerto enter into an agreementwith the Texas Department of Transportation (TxDOT) for reimbursement of costs associated with the operation and maintenance of traffic signals on controlled access highways within the City limits of Beaumont - Resolution 04-159 Councilmember Cokinos moved to approve the Consent Agenda. Councilmember Beaulieu seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider approving an agreement between the City of Beaumont and the Texas Engineering Extension Service (TEEX) to utilize a State Homeland Security sub-grant - Resolution 04-160 Administration recommended approval and authorizing the City Managerto sign an agreement initiating a contract to utilize the State Homeland Security sub-grant. TEEX,who is responsible for allocating the LETPP grants,notified Mayor Lord that the City of Beaumont will receive a base equipment grant in the amount of$75,126. TEEX also provided a regional allocation of $575,622.57. Of this regional amount, approximately $367,000 will go to agencies in Jefferson County to provide communications interoperability. The proposed agreement provides the process and time line that will be followed during the administration of the LETPP Law Enforcement Terrorism Prevention Program Grant. It outlines certain project tasks, involving the procurement and management of the equipment. These funds may be used for planning,organization, training, exercises and equipment. Councilmember Cokinos moved to APPROVE RESOLUTION NO. 04-160 AUTHORIZING THE CITY MANGER TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF BEAUMONT AND THE TEXAS ENGINEERING EXTENSION SERVICE(TEEX)TO UTILIZE A STATE HOMELAND SECURITY SUB-GRANT. Councilmember Smith seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS AND SAMUEL Page 2 of 5 Minutes-July 20,2004 NAYS: NONE MOTION PASSED 2. Consider approving a contract for preventative maintenance of city-owned vehicles and equipment - Resolution 04-161 Administration recommended the award of a one (1) year contract to JMPKL, Inc. d.b.a. The Lube Shop for automotive preventative maintenance at the unit costs reflected in the original bid with an estimated total annual expenditure of$70,152.36. An option foran additional yearatthe same pricing is available atthe City's discretion. Sixteen vendors were notified with two submitting bids. The Lube Shop has satisfactorily held the contract to service City vehicles for the past five years. The company has locations at 5030 College Street and 5340 Eastex Freeway. The multiple locations ensure a sufficient number of service bays to timely handle the volume of work required. It is estimated that the vendor will provide approximately 2,725 maintenance service orders for the 460 City vehicles during the annual contract. Funds are available forthis expenditure in the Fleet Management Division's operating budget. COuncilmember Smith moved to APPROVE RESOLUTION 04-161 TO APPROVE A CONTRACT FOR PREVENTATIVE MAINTENANCE OF CITY-OWNED VEHICLES AND EQUIPMENT. Mayor Pro Tern Ames seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS AND SAMUEL NAYS: NONE MOTION PASSED WORKSESSION Review and discuss a proposed thirty(30)year lease agreement of the Beaumont Fire Training Grounds A workshop was conducted by City Manager Kyle Hayes. Three proposals were received and reviewed by a committee consisting of representatives from the Fire Department, City Attorney's Office, Finance Office and the Central Services Department. Proposals were received from Lamar/LIT of Beaumont, Texas Engineering Extension Services(TEEX)and Industrial Safety Training Council(ISTC). The best proposal was received from Industrial Safety Training Council(ISTC). The ISTC proposal provided fora thirty(30)year lease relieving the City of all responsibility for maintenance, capital costs and the operation of the property. ISTC's proposal included funding all major capital improvement projects at no additional cost to the City. They will also be responsible for all utility costs including water and sewer. Lynwood Beaumont TX Upset with the way the police handled her recent disturbance Allen Lee 5095 Maddox Street Beaumont TX Addressed his ongoing concerns with the Police Department and feels that some changes need to be done in that department; requested further police investigations Roberto C. Flores, Sr. 2425 Buchanan Beaumont TX With the help of PastorTorres,they are trying to make improvements in the neighborhood to help the children as well as the adults to become more active citizens and to better themselves. City Manager Kyle Hayes addressed the comments concerning the LaFleur incident. This investigation has been turned overto the FBI and until their investigation is complete,no comments can be made concerning this issue on behalf of the City, Mayor or Councilmembers. He further stated that if citizens have issues with the Police,they need to address them to Internal Affairs orto the FBI.
