BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 6th day of July, 1993, with the following present: HONORABLE: Evelyn M. Lord Mayor Guy N. The Pledge of Allegiance was led by Mayor Pro Tem Goodson. -000- One Proclamation was issued: "Beaumont Day in the Astrodome, " July 24, 1993 . -000- Parks and Recreation Director Luke Jackson announced that members of one of the fastest track clubs accompanied him to City Council today and asked Lou Cappi, coordinator of the program, to make an announcement. Mr. Lou Cappi It's been awhile since I've addressed Council, but something's changed. I can either look at you or read the paper, one or the other! (Mr. Cappi put on glasses. ) I can't do both anymore. Beaumont Track Club was formed in 1988 when a couple of high school coaches came to us and said there was a demand and a real big need for a summer track program for the Beaumont area. After meeting with some parents and coaches, we formed the team, and the first year we went to the Hershey Meet in District Meet in LaPorte we took 18 runners, and 9 of them placed. We thought--we were feeling pretty good about that. Well, I made the -155- July 6, 1993 mistake of telling Roy Washington, who was our coach at the time, it'd really be nice to come back with 75-100 kids. Well, this past Spring, we did it. We ended up with 65, and it was a little confusing, but we made it through. We are part of the Texas Amateur Athletic Federation, the Hershey and Jesse Owens youth programs, and also the TAC Program which is, encompasses most of the older kids. At this point and time, I 'd like Coach Pat Milton, our coach--head coach, to stand and be recognized. She didn't quite believe me when I gave her my sales pitch about how much fun she was gonna have this summer. She's never seen so much paperwork and so many birth certificates in her entire life. (Applause) . . .This year we're, we have married the Beaumont School District's track team, and we're running two program simultaneously, so at this time our two older girls who represent the team, if you'll stand up, (Candace Dixon and Yolanda Nelson) they're going to Odessa this weekend in an attempt to qualify for a National Meet in Baton Rouge, Louisiana in three weeks along with nine other girls. (Applause) We have a roster this year of 130 boys and girls between the ages of 7 and 18. And right behind me, if you ladies and gentlemen would stand up, this represents a small portion of the 33 boys and girls that are going to Hershey this coming week for the Hershey State Meet and an opportunity to possibly participate in the National Hershey Track Meet in August. Thank you. The local athletes who placed either first or second in the Hershey District Track and Field Meet June 25 are Boys 9-10: Ben Booker, second, 50 meter dash; Daniel Darjean, first, 100 meter dash; Brandon Chappell, second, 200 meter dash; Jamaal Landry, first, 400 meter dash; 400 relay team of Brandon Chappell, Jamaal Landry, Ben Booker, and Daniel Darjean, first. Girls 9-10: Dorothy Joubert, second, 100 meter dash. Boys 11-12 : Chris Bell, first, 100 meter dash; Travis Milton, first, 200 meter dash; 400 meter relay team of Terrell Parker, Chris Bell, Arthur Colvert, and Travis Milton, second. Girls 11-12: Sharonda Renfro, first, Demetria Smith, second, 100 meter dash; Mia Labove, first, Ahli Hanson, second, 200 meter dash; Cammie Randle, first, 400 meter dash; Auriel Guidry, first, 800 meter dash; 400 relay team of Ahli Hanson, Sharonda Renfro, Demetria Smith, Mia Labove, Amber Ford, and Mikn Hanson, first; and Ahli Hanson, second, long jump. Boys 13-14: Jamie Perrault, first, Harold Smith, second, 100 meter dash; 400 meter relay team of Stephen Cotton, Clayton Guillory, Harold Smith, Jamie Perrault, first. Girls 13-14: Jhantel Ball, first, Brandy Murphy, second, 100 meter dash; Christie Colbert, first, 200 meter dash; 400 meter relay team of Christie Colbert, Brandy Murphy, Tanique Balque, Jhantel Ball, and Kesha Lee, first; Kendra Chatman, second, softball throw. Council congratulated the winners and expressed best wishes for continued success. Director Luke Jackson said that in an effort to solve an identity problem for the Parks and Recreation Department, a distinctive logo has -156- July 6, 1993 been designed with their department name and silhouette of a little boy and girl playing on a see-saw. Tee shirts imprinted with the new logo were presented to Council by Mr. Jackson. -000- Citizen comment was invited on the Consent and Main Agendas. Candace Dixon, as a member of the Beaumont Track Club, thanked Council for the opportunity to attend Council and for the recognition given them today. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held June 29, 1993; Resolution No. 93-154 reappointing Marie Hubbard and Ricardo Ramirez, Jr. to the Community Development Advisory Committee for terms expiring May 31, 1995 and appointing Lonnie Hood to the Airport Advisory Committee for a term expiring May 31, 1995; Resolution No. 93-155 authorizing purchase of two (2) 250 CFM Ingersol Rand air compressors in the amount of $25,998. 00 from Heatley Equipment Co. for the Building Services Division and the Water Distribution Division for general maintenance use; and Resolution No. 93-156 authorizing settlement in the amount of Three Thousand and 00/100 ($3, 000. 00) Dollars in the claim of C. W. Veazie vs. City of Beaumont. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem. Goodson. Question: Ayes: All Nayes: None -000- Ordinance No. 93-35 amending the name of the South East Texas Regional Electrical Examining Board (SETREEB) to the Southeast Texas Regional Electrical Certification Board (STRECB) , approving the agreement/bylaws for the board, utilizing certification of competency provided by the Southern Building Code Congress International (SBCCI) accessed through STRECB and permit applicants with residential and commercial experience to apply for licensing was considered: -157- July 6, 1993 I ORDINANCE NO. 93-35 ENTITLED AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES TO PROVIDE REGULATIONS FOR THE TESTING AND CERTIFICATION OF VARIOUS CLASSES OF ELECTRICIANS; AUTHORIZING THE CITY MANAGER TO APPROVE AND ACCEPT ON BEHALF OF THE CITY THE SOUTHEAST TEXAS REGIONAL ELECTRICAL CERTIFICATION BOARD AGREEMENT AND BYLAWS; PROVIDING FOR SEVERABILITY; PROVIDING REPEAL AND PROVIDING A PENALTY. Mr. Riley explained that three features of this ordinance are approval of the name change, agreement and bylaws of the Southeast Texas Regional Electrical Certification Board, provision for anyone to test for a certificate of competency, and inclusion of the Limited Master Electrician class. In answer to the question asked at last Council meeting relating to abstention of a member of the Electrical Review Board, Mr. Riley reported it appears there was some question and a matter of concern about municipal inspection in the bylaws, but rather than vote no, the member abstained in the vote because he did not prefer to vote yes, but neither did he want to give a negative vote toward the total change. Councilman Moore thanked Council for the additional week for consideration of this ordinance, thanked Staff for clarification of some concerns, said he still has concerns he hopes to see improved upon, but sees this as an improvement he can support. Ordinance No. 93-35 was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Ordinance No. 93-36 repealing Ordinance No. 93-30 abandoning all of Fifteenth (15th) Street sixty feet (601 ) wide right-of-way extending front the south right-of-way of Harrison Avenue south a distance of 709.77 feet to the north right-of-way line of North Street, said 15th Street right-of-way lying within Block 29, J. B. Langham Estate Subdivision, in the T. H. Lewis and the Noah Tevis Surveys containing 0.9776 acres, subject to retention of a utility easement, was considered: ORDINANCE NO. 93-36 ENTITLED AN ORDINANCE REPEALING ORDINANCE 93-30 AND ABANDONING THE FIFTEENTH STREET RIGHT-OF-WAY LOCATED BETWEEN HARRISON AVENUE AND NORTH STREET, BEAUMONT, JEFFERSON COUNTY, TEXAS AND RETAINING A UTILITY EASEMENT. -158- July 6, 1993 Ordinance No. 93-36 was approved on a motion made by Councilman Davis and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 93-157 authorizing Change Order No. 4 decreasing the contract by $6,815. 02 with APAC-TEXAS, Inc. as a result of actual quantities used in construction of the roadway at the Landfill for a total contract amount of $371, 026.98 and authorizing final payment in the amount of $79,547. 06 was considered. Mr. Riley informed Council that due to decreases to the contract resulting from Change Orders, the MBE requirement was not met by the contractor. Councilman Moore expressed dissatisfaction that this was not taken into account before completion of the contract. Mayor Pro Tem Goodson asked that Council be notified of any affect on MBE percentages at the time a Change Order is presented for approval. Resolution No. 93-157 was approved on a motion made by Mayor Pro Tem Goodson and seconded by Councilman Alter. Question: Ayes: Mayor Lord Nayes: Councilman Mayor Pro Tem Moore Goodson Councilman Cokinos Councilman Alter Councilman Smith Councilman Davis -000- Resolution No. 93-158 encouraging the Texas Air Control Board (TACB) and the Environmental Protection Agency (EPA) to re-evaluate, and where appropriate, change the proposed regulatory mandates set for Jefferson County (relating to air pollution) to insure the least disruption to the industry and citizens of Beaumont was approved on a motion made by Councilman Moore and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 93-159 authorizing allocation of an additional $7, 500. 00 from the Community Development Block Grant funds to the Volunteer Services Council of the Beaumont State Center for completion of construction of First Steps Lab School was approved on a motion made by Councilman Moore and seconded by Councilman Alter. -159- July 6, 1993 Question: Ayes: Mayor Pro Tem Nayes: None Goodson Councilman Cokinos Councilman Alter Councilman Smith Councilman Davis Councilman Moore Abstained: Mayor Lord -000- Mayor Lord announced that an Executive Session will be conducted in accordance with Section 2 (e) of the Texas Open Meetings Act following the Workshop Session to discuss pending or contemplated litigation: Woodford D. Bouillion et al vs City of Beaumont et al. -000- Mayor Lord welcomed Dr. John P. Idoux of Lamar University and four students from Russia. Dr. Idoux said the students are from Moscow who are studying at the Higher College of Chemistry, a new institution in Russia, where the brightest and best students from all over Russia are invited to attend. Dr. Idoux said these four students are visiting Lamar University for the summer and participating in a research program and getting an opportunity to sample America and its culture by living on the University campus. Dr. Idoux introduced Eugeniya Semernia, Yuri Torubaev, Maxim Khrapov and Yan Zubavichus and Mayor Lord and Council presented them with honorary citizenship cards from Beaumont. -000- Mr. Lafayette Spivey, Jr. , 6010 Chandler Drive, addressed Council to complain about destruction of Downs Road caused by heavy trucks involved with the construction of Tyrrell Park Road, asked that while the repairs are being made to Tyrrell Park Road that trucks use Frint Road to Labelle Road to Highway 124, and reported personal damage to the spoiler of his vehicle caused as a result of the construction in the Tyrrell Park area. He said he was advised by the Legal Department to contact the contractor to report the damages. The contractor informed Mr. Spivey they were not responsible for the damage and asked for assistance. Mr. Spivey was instructed to speak with Mr. Nichols after the meeting. Mayor Lord told Mr. Spivey she has witnessed the condition of Downs Road and has brought a complaint to the Public Works Director. Councilman Moore also reported the poor condition of the street. Mr. Warner said Downs road is under construction, but plans for the final coat of asphalt and other work will not be completed until the construction is complete at the Wetlands. Mayor Lord and Councilman Moore concurred -160- July 6, 1993 that the streets in that area are unsatisfactory and should be given attention. Mrs. Ruth Naumczik, 370 Giles, addressed Council to report that the South Park Neighborhood Association designed a logo and that Jim Cline of the Transportation Division was instrumental in making twelve signs using that logo for the neighborhood. She said they viewed the signs this morning, and they are beautiful. Mrs. Naumczik thanked Mr. Cline and the City for making the signs and said everyone in South Park will enjoy seeing the signs. Mrs. Naumczik told Councilman Moore that "one is gonna go up right at the intersection of East Virginia and Avenue A. As you come home at night you will see the sign, and I hope you will feel that it is our members' thanking you for inspiring us, helping us get started and giving the pride back to South Park that we have now. " Mr. John Naumczik, 370 Giles, addressed Council to discuss previous difficulty in obtaining an electrical license and to express appreciation for passage of Agenda Item No. 1 changing procedures to allow applicants with residential and commercial experience to apply for a license and displayed a cap with the imprint of the South Park Neighborhood Association logo. Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council to compliment Independence Day celebration activities. Mr. Roberto Flores, 2425 Buchanan, addressed Council in appreciation for passage of Agenda Item No. 5 authorizing additional funding for completion of the First Steps Lab School, reported receipt of a letter from the Sister Cities Commission relative to raising funds for Sister City projects. Mr. Flores added that when visitors from Beppu City arrive, it would be inappropriate to take them to an area where a street is purported to have been named in honor of their ancestors (Jap Lane) . Mayor Lord said that street in reference is not inside the City limits of Beaumont. Mrs. Gisela Houseman, Chairman of the Volunteer Services Council for the Beaumont State Center, addressed Council to express gratitude to Council for approving the additional funding necessary for completion of the First Steps Lab School, said the expected completion date is within four to five weeks, invited Council to the grand opening and reviewed some of school 's program. -000- Councilman Moore said he had opportunity to represent the City at a State Bar meeting at the Holidome and to welcome a group of Operation Desert Storm participants. He said he learned more about some of the consequences and hardships they and their families suffered. Councilman Moore told Chief Scofield that he was approached this morning by a citizen with a complaint about the activities at the Rolls Royce Club -161- July 6, 1993 off Mary Street and asked for assistance for that neighborhood. Also, Councilman Moore reported to the Planning Department that a sensitive issue is developing regarding property descriptions and a $300 charge for a name change. He asked that Council consider waiving the fee for the name change of the Colored Addition and suggested that Council might automatically take action for the change. Councilman Alter said he thought the Fourth of July festivities were terrific in spite of the dampened fireworks and said Archie Beaumont of 4478 Dallas called and requested his ditches be reviewed for digging and reported that the lid of his trash can was broken off by the trash truck and asked that his trash can be replaced and possibly receive an additional can. Mayor Pro Tem Goodson commented to Mr. Warner that he has received several calls from residents in Mr. Spivey's neighborhood about the streets and requested that any information about the construction period be relayed to them. -000- There being no further business, the Regular Session of City Council was recessed to reconvene in Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held July 6, 1993 .
