BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 29th day of June, 1993, with the following present: HONORABLE: Evelyn M. Lord Mayor Guy N. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend James Franklin, Pleasant Green Baptist Church. The Pledge of Allegiance of led by Councilman Davis. -000- Solid Waste Director John Labrie recognized three employees who competed in the International Truck and Equipment Rodeo sponsored by the Solid Waste Association of North America held in Tampa, Florida on June 5 and 6, 1993 . Mr. Labrie said 18 states were represented, and all participants are State Champions. In the international competition, Edison Govea, Fleet Division, was Third Place winner in the Equipment Mechanic competition; Ricky Wilridge, Solid Waste Department, was Fourth Place winner in the Front-End Loader competition; and Carl Guillory, Solid Waste Department, won First Place in the Rear Loader Truck competition. Of all competitors, Carl Guillory achieved the third highest score in the nation. Mayor Lord and Council expressed appreciation to the winners and said they rarely receive complaints, but often receive compliments about the Solid Waste Department. Mayor Lord presented each man with a pen as a token of appreciation for their achievement and service to the City. -142- June 29, 1993 Dr. Jim Jordon from Lamar University reviewed Lamar's programs and participation in space science in recent years and announced that a new project that will involve Texas in becoming the space state. To do that, many think an initiative unique to Texas is needed. The initiative is called the Texas Satellite Initiative or TexSat Program. He said the idea is to build a satellite completely with Texas universities, Texas industry, Texas business, manage and possibly launch a shuttle. Mr. Jordan said "the program is designed to stimulate Texas universities in science and technology, to promote the commercial utilization of space by Texas companies, to elevate the perception of Texas as a space state and a place where to do business in space and provide the opportunity for smaller minority Texas universities to develop their space technology capacity by teaming with space flight experience universities. " Mr. Jordan said he is here to inform Council and citizens of Lamar's participation in this program, and asked that upon Council 's review of the goals of the Texas Satellite Initiative, that a resolution of support for the TexSat Program be issued. He also announced that Astronaut John Young will be at the Texas Energy Museum tonight in commemoration of Space Week, and Bill Nash from Space Industries will be here on June 30 when a formal announcement of the TexSat Program will be made. -000- Mayor Pro Tem Goodson announced that another special presentation will be made today. Coundilman Goodson introduced Shirleen Cook and Shirley Bartos of the Chamber of Commerce and asked Shirleen Cook to make this surprise presentation. Shirleen Cook . . .In 1971, Beaumont Chamber of Commerce and the Junior League formed a program called "Leadership Beaumont. " Leadership Beaumont, for those of you who might not be familiar with it, is an education program designed to identify and motivate emerging leaders in the community and to develop their potentials for leadership. On May 8th, May 4th, 1993, Leadership Beaumont held its annual alumni meeting. There are some 800 graduates throughout Beaumont, Southeast Texas, the State of Texas and probably the United States who are graduates of Leadership Beaumont. On this evening of May 4th, for the first time, Leadership Beaumont chose to honor some of its outstanding leaders, but the person who received the Outstanding Leadership Award for 1993 is our mayor, Evelyn Lord, and this afternoon, Mayor, I 'd like to present you with the real thing on behalf of Leadership Beaumont. (Ms. Cook presented Mayor Lord with a lapel pin. ) Applause by the audience. Mayor Lord Thank you very much. Thank you very, very much. I am surprised, and I must tell you that, I said it before and I 'll say it very quickly now, that of all the things I 've been associated with, the six years I spent -143- June 29, 1993 as Chairman of Leadership Beaumont was one of the best investments I've ever made because I look around me everywhere, in this room, there are many, many graduates of Leadership Beaumont, and I know that the program has just trained super people and turned out really nice folk, haven't they David? (Councilman Moore) Yes, and thank you very much. -000- Citizen comment was invited on the Consent Agenda and Main Agenda Items 1 through 12. Councilman Smith pointed out that some items have already had public hearings. Mayor Lord reviewed the agenda and invited comments on the Consent Agenda and Main Agenda Items 1 through 4, Item 7, and Items 10 through 12. No one wished to address these subjects. Mayor Lord suggested that in preparing the Agenda, all items that have had public hearings be listed together. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held June 15, 1993; Resolution No. 93-147 authorizing two (2) , two-feet wide, Licenses to Encroach with Kinsel Ford, Lincoln, Mercury, Inc. , one at the intersection of Hollywood and Eleventh Streets and 305 feet east of Eleventh Street and crossing Hollywood Street 970 feet west of Eleventh Street, for installation of aerial fiber and copper telecommunication cable to link their operations for a one-time fee of Five Hundred Dollars ($500.00) for each License to Encroach; Resolution No. 93-148 authorizing Change Order No. 5 for the Cartwright Drainage Project with Russ Miller Construction Company, Inc. for a contract price increase in the amount of $11,506.88 to revise Change Order No. 4, executed January 11, 1993 with no change in contract price, and to replace sidewalks and driveway pipes necessary due to field changes; and Resolution No. 93-149 authorizing acceptance and conveyance of Lot 4, Block 2, Home to Bowenville Addition; Lots 6 through 11, Block 2, Home to Bowenville Addition; the west 30 feet to Lot 3 and the east 20 feet of Lot 4, Block 121, Pinecrest Addition; and Lot 9, Block 91, Cartwright Addition; (purchased with Community Development Block Grant funds in the amount of $24,400.00) to the Innovative Housing Development Corporation (IHDC) to be used for the purpose of constructing new affordable housing. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem Goodson. Question: Ayes: All Nayes: None -144- June 29, 1993 The second reading of an ordinance granting a solid waste collection and transportation service franchise to American Sani-Can Company, Inc. of Nederland, Texas, for a monthly franchise fee equivalent to 7% of their gross revenues generated from collections within the corporate limits and with an expiration date of June 27, 1996 coinciding with the other five existing agreements was held: ORDINANCE NO. ENTITLED AN ORDINANCE GRANTING A FRANCHISE TO AMERICAN SANI-CAN COMPANY, INC. TO OPERATE A SOLID WASTE COLLECTION AND TRANSPORTATION SERVICE IN THE CITY OF BEAUMONT; PROVIDING THE TERMS, CONDITIONS, OBLIGATIONS AND LIMITATION OF SUCH SERVICE; PROVIDING INDEMNITY TO THE CITY; RETAINING; AUTHORITY TO REGULATE RATES; PROVIDING FOR FRANCHISE PAYMENTS AND PROVIDING FOR SEVERABILITY. An ordinance granting a solid waste collection and transportation service franchise to American Sani-Can Company, Inc. was passed to its third and final reading on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- An Ordinance amending the name of the South East Texas Regional Electrical Examining Board (SETREEB) to the Southeast Texas Regional Electrical Certification Board (STRECB) and to approve the agreement/by- laws for the board (utilizing testing provided by the Southern Building Code Congress International accessed through STRECB) was considered: ORDINANCE NO. ENTITLED AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES TO PROVIDE REGULATIONS FOR THE TESTING AND CERTIFICATION OF VARIOUS CLASSES OF ELECTRICIANS; AUTHORIZING THE CITY MANAGER TO APPROVE AND ACCEPT ON BEHALF OF THE CITY THE SOUTHEAST TEXAS REGIONAL ELECTRICAL CERTIFICATION BOARD AGREEMENT AND BYLAWS; PROVIDING FOR SEVERABILITY; PROVIDING REPEAL AND PROVIDING A PENALTY. Councilman Moore questioned the testing process and said there have been past misunderstandings regarding testing. Mr. Riley said that under the present system, to receive qualifications as a master or journeyman -145- June 29, 1993 electrician, one must have actual experience in the field to take the test. Now, those with the electrical knowledge who are actually doing the work, but not under certification of a City code, will be able to take the test. Also, Councilman Moore questioned the vote of the (Electrical Review) Board indicating four Ayes and one Abstention. He asked why the one Abstention. Staff was not privy to this information, and Councilman Moore asked to delay action on this item for one week for clarification of the vote and to receive answers to other questions. A consensus of Council was to defer action on this Ordinance for one week. -000- Resolution No. 93-150 authorizing application and acceptance for a grant in the amount of $200, 000. 00 from the U. S. Justice Department, Bureau of Justice Assistance, to be used by the Beaumont Police Department for a Community-Oriented Policing (COP) program was approved on a motion made by Councilman Moore and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 93-151 authorizing a lease agreement with BUILD, Inc. to allow the City use of the remaining 617 acres of Collier's Ferry property (donation from Betsy Mecom Mullins) for park purposes available in its natural state until funding is available for park development was approved on a motion made by Councilman Smith and seconded by Mayor Pro Tem Goodson. Question: Ayes: All Nayes: None -000- Ordinance No. 93-28 amending Sections 30-21 and 30-39 of the Code of Ordinances to permit the definition and designation of Beaumont Historic- Cultural Preservation Landmarks and Districts was considered: ORDINANCE NO. 93-28 ENTITLED AN ORDINANCE REPEALING SECTIONS 30- 21 OF THE CODE OF ORDINANCES AND AMENDING ARTICLES II AND IV OF THE ZONING ORDINANCE BY ADDING NEW SECTIONS 30-21. 1 AND 30-21. 2 AND AMENDING SECTIONS 30-39 TO PERMIT THE DEFINITION AND DESIGNATION OF BEAUMONT HISTORIC - CULTURAL PRESERVATION LANDMARKS AND DISTRICTS AND THEIR REGULATIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING FOR A PENALTY. Question: Ayes: All Nayes: None -000- Ordinance No. 93-30 authorizing abandonment of Fifteen Street extending from the south right-of-way of Harrison Avenue south a distance of 709.77 feet to the north right-of-way line of North Street, lying within Block 29, J. B. Langham Estate Subdivision, in the T. H. Lewis and the Noah Tevis Surveys, containing approximately 0.9776 acres (requested by Mark Whitely for St. Elizabeth Hospital) subject to retention of a general utility easement was considered: ORDINANCE NO. 93-30 ENTITLED AND ORDINANCE ABANDONING THE FIFTEEN STREET RIGHT-OF-WAY LOCATED BETWEEN HARRISON AVENUE AND NORTH STREET, BEAUMONT, JEFFERSON COUNTY, TEXAS. -147- June 29, 1993 Ordinance No. 93-30 was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem Goodson. Question: Ayes: All Nayes: None -000- Ordinance No. 93-31 authorizing abandonment of a 20.7-foot-wide right-of- way known as Isla Street, extending 1, 010 feet east from Pine Street to Brakes Bayou, located along the north 20.7 ' of Blocks 1 and 2, Sheffield Addition, containing 0.479 acres, and a 10-foot-wide alley abutting the west side of lot line of Lot 8, Block 1, Sheffield Addition, extending from the north right-of-way line of Elm Street (aka Bayou Avenue) north to the south right-of-way line of a 20.7 ' alley known as Isla Avenue or Sheffield Street, containing 0. 036 acres in the Sheffield Addition which includes all property in Block 1 of the Sheffield Addition was considered: ORDINANCE NO. 93-31 ENTITLED AN ORDINANCE ABANDONING A 20.7 ' WIDE RIGHT-OF-WAY KNOWN AS ISLA STREET AND A 10 ' WIDE ALLEY IN THE SHEFFIELD ADDITION, CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 93-31 was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Ordinance No. 93-32 authorizing a Specific Use Permit to allow expansion of Magnolia Cemetery in Block 1, Sheffield Addition, approximately 2. 14 acres, was considered: ORDINANCE NO. 93-32 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO MAGNOLIA CEMETERY TO ALLOW EXPANSION OF AN EXISTING CEMETERY LOCATED EAST OF PINE STREET ON 2 . 14 ACRES OF LAND, MORE OR LESS, BEING ALL OF BLOCK 1, SHEFFIELD ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 93-32 was approved on a motion made by Councilman Smith and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -148- June 29, 1993 Ordinance No. 93-33 granting a variance to Section 3-10 of the Code of Ordinances at the request of Fertitta's Finer Foods, Inc. , located at 2695 Park Street for approximately 40 years, to allow sale of the business to Andy Dung Thien Le, a potential buyer, was considered: ORDINANCE NO. 93-33 ENTITLED AN ORDINANCE GRANTING A VARIANCE TO SECTION 3-10 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ALLOW THE OFF-PREMISE SALE OF WINE AND BEER AT 2695 PARK STREET IN BEAUMONT, TEXAS. Ordinance No. 93-33 was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 93-152 authorizing purchase of 1,500 chairs at $46.75 each; 15 chair racks at $295.00 each; and 4 starter blocks at $240.00 per set; from Virco Manufacturing Corporation for a total of $74,790.00 to be used for the Convention Facilities, Civic Center Complex was approved on a motion made by Councilman Moore and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- A Public Hearing was called to amend the condemnation order of May 25, 1993 to demolish the structure located at 580 North Circuit to make it effective July 21, 1993 instead of May 25, 1993, and to consider the twenty-two (22) below listed dilapidated structures found to be in violation of the City of Beaumont's Dangerous Structure Ordinance, Article III, Section 14-50: 1114 Forrest (20 violations) , 1126 Forrest (25 violations) , 1146 Forrest (24 violations) , 1156 Forrest (23 violations) , 1073 Miller (17 violations) , 1075 Miller (19 violations) , 1081 Miller (19 violations) , 1083 Miller (19 violations) , 1085 Miller (19 violations) , 1095 Miller (19 violations) , 1115 Stephenson (20 violations) , 1125 Stephenson, (19 violations) 1137 Stephenson (19 violations) , 1153 Stephenson (18 -149- June 29, 1993 violations) , 1054 Ashley (18 violations) , 1064 Ashley (18 violations) , 1078 Ashley (19 violations) , 1086 Ashley (19 violations) , 1088 Ashley (19 violations) , 1098 Ashley (19 violations) - Blanche Hebert, owner of all twenty (20) structures, Staff recommendation for City to Raze these structures, authorized by owner in signing a Demolition Consent form, 2700 Smart (Utility Shed - Southern Pacific Transportation c/o Kenneth Porier, owner (5 violations) , Staff recommendation to raze within 30 days; and 2395 Avenue A - Bernice H. Mott, ET UX, owner (21 violations) , Staff recommendation to raze within 30 days. These parcels of property have been inspected, are vacant, and found to be in violation of Article III, Section 14-50 of the Code of Ordinances. Notices have sent to owners by Certified Mail and published in the Beaumont Enterprise. The nineteen (19) structures listed below have been condemned by City Council and the owners ordered to either raze or repair them within specified time frames. Reinspection of these structures have revealed non-compliance with the Council 's order. The Community Development Division of the Administrative Services Department is requesting authorization from the City Council to demolish these structures in accordance with the Dangerous Structure Ordinance and charge the property owners with the cost of demolition. 820 Bonham (shed), 2055 College (commercial), 3080 Concord, 3106 A. Crockett, 2440 Forrest, 2545 S. 4th, 3675 Glenwood, 2055 Hayes Lane, 1111 Hazel, 1390 Liberty, 1290 Lyle, 2350 S. 9th, 2045 Pecos, 3595 Scranton, 880 Sherman, 1470 Stewart, 3414 St. James, 3540 Usan and 3570 Usan. Mr. H. J. McCormick, 550 North Circuit, addressed Council in opposition to granting an extension until September 1, 1993 for demoliton of the structure at 580 North Circuit. Mr. McCormick reviewed past and present ownership of the property, the condition of the property, length of time granted for rehabilitation and recent spray painting of the exterior of the structure that he said did not improve the strength or integrity of the building. He said that medical reasons have been given by the owner in a request for additional time and suggested that proof of medical problems be required. Mr. David Royer, 325 West Caldwood, owner of the structure at 580 North Circuit, addressed Council to state that he had surgery that prevented his rehabilitation plans for the structure, said the original time granted him should have been until June 2nd, but demolition orders were brought back to Council on May 25, 1993, and Mr. Royer requested all the original time granted for rehabilitation. Mrs. Betty O'Quinn, 296 Manor, addressed Council to say that the neighborhood has been tolerant for over two years regarding the condemnation process for the property at 580 North Circuit and neighbors -150- June 29, 1993 feel they are entitled to an explanation for any additional demolition delays. Mr. Bob Johnson, 640 North Circuit, addressed Council to express concern that not only is the structure at 580 North Circuit an eyesore, but a danger to the safety and well-being of children in the neighborhood. Council asked Staff for a review of the process regarding this structure and change of ownership, questioned development and progress of any work plan, scope of structural damage and estimated time to make structural repairs required by Code. After discussion, Council agreed that the structure is in a dilapidated state and a public nuisance, but felt that early action on the demolition order should be considered and Mr. Royer is entitled to the full time originally allotted. They concurred that perhaps the sixty (60) days allowed in the proposed ordinance exceeds fairness and less time should be considered. Mr. David Royer, 325 West Caldwood, again addressed Council to state that he would probable demolish the garage, said he has already made improvements to the foundation, plumbing and electricity and can bring the structure up to Code within two weeks. Mr. H. J. McCormick, 550 North Circuit, again addressed Council to reiterate that Mr. Royer has owned the property since June, 1992, and no rehabilitation progress of substance has been made. Additional Council discussion included condition of the structure and a reasonable time frame for achieving necessary repairs to meet minimum Code requirements. There being no one else to address Council, the Public Hearing was closed. Ordinance No. 93-34 amending a condemnation order of May 25, 1993 to demolish the structure located at 580 North Circuit and declaring certain dilapidated structures to be public nuisances and ordering their repair or removal by their owners was considered: ORDINANCE NO. 93-34 ENTITLED AN ORDINANCE AMENDING A CONDEMNATION ORDER OF MAY 25, 1993 TO DEMOLISH THE STRUCTURE LOCATED AT 580 N. CIRCUIT; FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. Councilman Cokinos made a motion, seconded by Councilman Davis, to amend Section 1 of the ordinance setting the date for a demolition order on -151- June 29, 1993 the structure located at 580 N. Circuit effective July 27, 1993. Question: Ayes: Councilman Nayes: Mayor Lord Cokinos Mayor ProTem Councilman Goodson Davis Councilman Councilman Moore Smith The motion failed to pass on a tie vote. Section 1 of Ordinance No. 93-34 was amended to set the demolition order date on the structure located at 580 N. Circuit in Section I to become effective July 21, 1993 and approved on a motion by Mayor Lord and seconded by Councilman Smith. Question: Ayes: Mayor Lord Nayes: Mayor ProTem Councilman Goodson Cokinos Councilman Smith Councilman Davis Councilman Moore -000- Councilman Davis reported that he has experienced some very positive community feelings recently, mentioned that he has heard great things about Council 's ability to work together and commended fellow Councilmembers for their unity. Councilman Moore said he presented a Proclamation at a very nice event this past weekend to the Southeast Texas All Stars who are competing in Chattanooga, Tennessee this week. Also, Councilman Moore said that he has received many calls from residents in the Southend area near Mobil Oil on Buford, Sabine Pass and Washington Boulevard regarding the recent flooding that incapacitated entry and departure from their homes. He said he would like this problem looked at as an emergency situation and requested a report from the Public Works Department regarding a solution or aid to these residents toward better mobility during heavy rains and extreme flooding conditions. Mayor Lord announced that an Executive Session will be conducted following the Work Session in accordance with Section 2 (e) of the Texas Open Meetings Act to discuss contemplated or pending litigation: C. W. Veazie vs. City of Beaumont, Woodford D. Bouillion, et al, vs. City of Beaumont, et al, and Dave Shows vs. City of Beaumont. Mayor Pro Tem Goodson said that he received a call that in the area of 2660 Norris Street they were experiencing street flooding as a result of problems with the culverts, said that may be related to DD6 lateral, but asked Public Works Director Tom Warner to check into the situation for the City and said he attended a program in Houston sponsored by the United States Department of the Army when the Regional Recruiting Office -152- June 29, 1993 presented Mayor Lord with an award for outstanding service. In addition, he said BISD Superintendent Dr. Jerry Mallet was in attendance, two nurses were sworn into the U. S. Army Nursing Corp, and he said high praises and compliments were given to the City of Beaumont and the Port of Beaumont for continuing activities with the Armed Forces. Councilman Smith reported that the Woodland Acres, Woodland Estates, and McAnelly Additions in Northwest Beaumont met last night with Chief Tom Scofield and members of the Police Department. She said the new Community-Oriented Policing program they have established is very impressive, they had an excellent crowd in attendance and she is looking forward to the new policies that will be effective July 13th. She said another meeting will be held in the Griffing Park area Thursday. Councilman Moore told Councilman Smith that a number of South Park Neighborhood Association members are very supportive of these meetings and desire to attend some of them. Councilman Smith responded that some of their members did have the opportunity to attend and welcomed their presence. Mayor Lord said that she was in a meeting on Gulf Street yesterday with concerned neighbors along with Lt. Ray Beck explaining the new program. She said a lot more will be heard about the program and citizens are going to feel a lot better about security of neighborhoods. Also, she said the South Park Neighborhood Association may receive inquiries or invitations to attend other neighborhood meetings because of her acclaim of their success in organizing, promoting and conducting a unified effort and encouragement to others to start an association and get together to work out problems. Councilman Moore also announced that at 7:00 p.m. tonight, the Pear Orchard Neighborhood Association will meet at Our Mother of Mercy Church and a meeting will be conducted by the Northend Community Association at St. Pius Church at 7:15 p.m. Councilman Smith said that neighborhood associations have been established for over 30 years in Ward I, but meet only on an as-needed basis. She said the Police Department would be pleased if they met on a regular basis, and they plan to establish regular meeting dates. -000- Mr. Tom Sibley, 2150 Harrison, addressed Council in appreciation for passage of Agenda Item 6 designating a Historic-Cultural Landmark Preservation District Overlay for the area in Old Town located between McFaddin and Louisiana Avenues and First and Eleventh Streets. He said the residents hope to make Beaumont proud and invited Council to attend a victory party at his home Wednesday, June 30, beginning at 6:30 p.m. Mr. Dale Shearer, 909 West Drive, Port Neches, a representative of All -153- June 29, 1993 State Insurance Company, addressed Council on behalf of his client, Irvin Williams. Mr. Shearer related an accident that occurred on June 10, 1993 at a railroad crossing on Martin Luther King Boulevard that caused damage to Mr. Williams' automobile by a Southern Pacific Railroad crossing arm. Mr. Shearer asked for Council intervention in settlement of the claim and was advised that this is a civil dispute and Council has no legal recourse.
