BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 26th day of September, 1995, with the following present: HONORABLE: David W. Riley City Manager Lane Nichols City Attorney Rosemarie Smith City Clerk -000- The Invocation was given by the Reverend Hollis Bass, pastor of Pine Burr Baptist Church. The Pledge of Allegiance was led by Mayor Moore. -000- Mayor Moore announced that an executive session will be held in accordance with Section 551.071 of the Government Code to discuss pending or contemplated litigation: Claim of Municipal Administrative Services and Claim of Christopher Mark Porter following the regular session of City Council. -000- Three Proclamations were issued: "Employee Recognition Week," September 25-29, 1995 and "Employee Recognition Day," September 24, 1995 (specifically for employees at the Remote Encoding Center located on Orleans Street); "Operation One-Vote Week," September 30 - October 10, 1995 (program instituted by Councilman Bobbie Patterson to encourage voter 257 September 26, 1995 registration and participation); and "Restaurant Month," October, 1995. Mayor Moore said he is going to take the privilege of reading the last proclamation, and said if statistics were researched, the individual for whom the proclamation is being issued would rank high; if looking at a completion fact, such as NFL quarterbacks, he would rank number one; looking at rushing yards with consecutive games, he'd be another Emmett Smith; if looking at how great a game he can call, he would be at the top with the top coaches; and explained that today Fire Chief Pete Shelton is being recognized and read a proclamation in his honor that he said comes from all of City Council: WHEREAS, we are recognizing a man who has been an outstanding member of the community and an extraordinary City of Beaumont employee for forty-five years; and, On September 30, 1950, C. A. "Pete" Shelton was hired by the City of Beaumont. He became Deputy Chief in 1962, Assistant Fire Chief in 1966, and Fire Chief on January 1, 1976. In 1983, Chief Shelton became the Emergency Management Coordinator for the City. In October of 1985, the City Council appointed Chief Shelton to serve as interim City Manager until June of 1986. In addition to working tirelessly for the safety of the citizens of Beaumont, Chief Shelton has also participated in numerous professional and volunteer organizations. He has been Chairman of the Lamar University Fire Training School since 1970, Commissioner for the Port of Beaumont since 1989, a member of the Board of Directors with the International Association of Fire Chiefs since 1983, and a member of the Board of Directors with Boys Haven Since 1989. He served as president of the Texas Fire Chiefs Association in 1981, Chairman of the Board of Directors of the American Red Cross in 1988, United Way Chairman in 1989, and President of Boys Haven in 1992. In 1986, the Beaumont Chamber of Commerce named Chief Shelton Man of the Hour; in 1988, he was named Man of the Year by the Neches River Festival; and in 1990, the Sales and Marketing Executive Club of Southeast Texas named Chief Shelton Outstanding Citizen of the Year. THEREFORE, it is with great pleasure that the City of Beaumont declares Saturday, September 30, 1995 as, "CHIEF C. A. 'PETE' SHELTON DAY" in Beaumont and calls upon everyone in the area to join in recognizing his outstanding accomplishments. ACCORDINGLY, the Mayor has hereunto set his hand and caused the Seal of the City of Beaumont to be affixed. (/s/ David W. Moore) MAYOR September 26, 1995 258 September 26, 1995 Before presenting the proclamation to Chief Shelton, Mayor Moore said, "Chief, before you come up I'd just like to say to you, it has been a pleasure watching you as long I've been around. Now, many of us weren't here when you started working for the Fire Department, but it certainly has been a pleasure over the years to work with you and around you and to know the respect that you command throughout this nation. One little footnote, last year I had a group of people from all over the country here for a meeting in our city, and one of the individual's name was Dee Woodard, and I'm sure you remember him. You sent the patch back to him. He had never been more impressed with a Fire Chief and his men and the hospitality that you all provided for us, and that goes on for many, many others, and with that, Sir, I'd asked you please come forward, and I'll tell you that don't mind wearing a larger coat size for awhile, but you certainly have had the biggest job, and we appreciate you." CHIEF SHELTON Thank you. Thank you Chief Shelton accepted the proclamation and shook hands with Councilmembers. CHIEF SHELTON It's truly an honor to accept this proclamation from you, Mayor, and the Council and my boss, City Manager Ray Riley. I want to thank you very much for it. I joined the Fire Department after graduating from a local high school, Saint Anthony High School, in 1950, and I guess the point I want to make is that the City's been good to me in a lot of ways. I started off making $206 a month, and I was working 84 hours a week, which was$.59 an hour. So, we've come a long way. I've had the privilege of working under three fire chiefs that...I was very close to all of them, and they served as my mentor, and I think I learned some management skills from all of these three individuals. A little history on the Fire Department in Beaumont--we've only had five fire chiefs in 97 years in this city, and I think that speaks very well of the Fire Department, as well as from a political standpoint, that we've all had an opportunity to do our job, previous chiefs and myself, without political interference. I've always prided myself and my department in trying to help the people in the community. I think it's important because the citizens are the people we serve and should be trying to do a good job for this City. And, again, I want to thank you for the opportunity to serve this City, and the City's been good to me, and I hope that I've done my best. Thank you so much. Chief Shelton received applause and a standing ovation. Mayor Moore extended Council the opportunity to make personal comments to Chief Shelton. COUNCILMAN SMITH I just can't tell you how we're going to miss you because you've always been around and been so 259 September 26, 1995 helpful, but I hope you'll enjoy your retirement and that you'll come back and see us and you'll still be involved in the community because we need you. And, thank you so much for all the years you've served the City. COUNCILMAN GOODSON Chief, I don't know about big suits, but I know about big shoes, and we got some big shoes to fill. If you don't appreciate the Fire Chief, it's because he does his job so well that he's one of those many City employees who makes us look a lot better at what we do than we often deserve, and think that about a lot of people up here, but none more so than you, Pete. You have been an inspiration to me and a mentor to a lot of us up here that were appointed or elected or whatever else on this Council, and we've often sought your advice because of the time you've been on Council, and I know that you'll still be there for us even though you may not be Chief. And, I'm not concerned about you being active around here. I don't only expect it--I think we all demand it-- you're too important. COUNCILMAN COKINOS Chief, you're a giant. A giant of a man, and we're all going to miss you. You came to, to the City's assistance during the $20 million loss, and you were the interim City Manager and you really pulled us through some tough times, and I certainly do appreciate you, and I'm still going to call you Pontiotis--that's Greek for Pete. MAYOR PRO TEM AMES Chief, thank you, and we're going to miss you. I hope you'll continue to stay involved in the community because you've been such a big asset. Even before I was on Council, of all the people in the community, everyone knew who Chief Shelton was, and we appreciate it and we're going to miss you. Come back and see us. COUNCILMAN DAVIS Chief, you mentioned something about some of the political leaders during your tenure of being a Chief as really leaving you alone and letting you do your job, and I've learned in my short experience here when you do a great job, people leave you alone and let you do your job. You know, one of the things that my dad has mentioned about you in discussions of a lot of City leaders here, when I was about to come on City Council, and he said one word that really epitomizes you-- fairness. And, Sir, I think that's a great compliment to the type of person you are. Thank you very, very much for your service. 260 September 26, 1995 COUNCILMAN PATTERSON Chief, I haven't known you very long personally, but I, as well as many of us, have known of you and the things that you've done with the Fire Department, and we are going to miss you, and we really do appreciate what you have done. MAYOR MOORE Well, we're not sending you off today or anything! But, one thing I would like to say, you've been an individual that I could joke with and kid about, as I did early on about the suit coat size and that was a joke between the merchants downtown and where ever, but there are three words that I think about. Your leadership is one, and it has never been questioned--your respect, which is throughout the entire Country, and I think when other Fire Chiefs speak of you so highly, that's absolutely fantastic, and the caring attitude that you display toward so many people in so many different neighborhoods, it's just good to have had a chief like you, and I hope that we'll be fortunate to have someone to step in to continue the legacy that you have started here. And, of course, if you want to continue a little longer, I don't think anybody's going to complain. But, Chief, we're proud to recognize you today, and we wish you the absolute very best for you in weeks to come. -000- Citizen comment was invited on the Consent Agenda and Main Agenda Items 5 through 11. No one wished to address these items. Councilman Cokinos requested that Item C on the Consent Agenda, an ordinance renaming a portion of Fannin Street to George Jones Place, be removed to allow the caption to be read and formal action taken. The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held September 19, 1995; Resolution No. 95-246 authorizing Texas Commerce Bank National Association to pledge $8,131,392.66 (current value) in securities held at Bank One - Dallas, effective September 26, 1995; Resolution No. 95-247 authorizing 3% base salary increases for the City Manager and the City Attorney and a 4% base salary increase for the City Clerk, effective October 1, 1995; Resolution No. 95-248 authorizing submission of a grant request to the Texas Historical Commission for a 1996 Certified Local Government (CLG) grant in the amount of$16,227.00 261 September 26, 1995 to aid some of the basic programs of the Historical Landmark Commission and for travel to the annual CLG conference; Resolution No. 95-249 authorizing purchase of three (3) grade display systems (a leveling device that can be attached to earth moving equipment)for the Streets and Drainage Division from Spectra-Physics Laserplane, Inc. at a cost of$6,348.00 each, less trade-in of two (2) used levels in the amount of$1,500.00 each, for a total cost of$16,044.00; Resolution No. 95-250 designating Ray A. Riley, City Manager, Beverly Hodges, Finance Officer, and Kandy Daniel, Treasurer, as investment officials of the City of Beaumont and authorized as signatories for any institution designated as a depository; authorizing Ray A. Riley, City Manager, Beverly Hodges, Finance Officer, Kandy Daniel, Treasurer, and Michaele Lfferty, Deputy Treasurer, to request electronic fund (wire) or ACH transfers of all City funds on deposit with Texas Commerce Bank National Association; authorizing Dawn Gaudet, Deborah Johnson, Geneva Gordon, Doris McCauley and Debora Guillory as signatories on the Cash Bond Account Number 05007019292 at Texas Commerce Bank National Association; authorizing Ray A. Taft, Manager of Mercy Funeral Home, who expressed interest in purchasing this parcel of land; and Resolution No. 95-252 authorizing acquisition of Parcel 54: 0.118 of an acre out of Lot 11, Block 1, Wescalder Fig Acres Addition from Mr. and Mrs. Edward C. Burks for the appraised value of $66,000.00 for improvements to FM 364/Major Drive from Highway 105 to State Highway 124. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem Ames. Question: Ayes: All Nayes: None -000- Mayor Moore told Council that shortly before commencement of the meeting, he received an informational petition for Council with approximately 600 signatures in opposition to Agenda Item No. 1 rezoning a portion of Tract 6 out of Tract 55, Tax Roll Plat SPA, H. Williams Survey, Abstract 262 September 26, 1995 No. 56 from RM-H to NC, and since there could be no comment on the item, he wanted Council to be aware of the information. -000- Ordinance No. 95-61 renaming the portion of Fannin Street between Orleans and Pearl to "George Jones Place"was considered: ORDINANCE NO. 95-61 ENTITLED AN ORDINANCE CHANGING THE NAME OF THAT PORTION OF FANNIN STREET BETWEEN ORLEANS AND PEARL TO "GEORGE JONES pLACE" IN BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilman Cokinos thanked the City Attorney for preparing the ordinance and requested that the signatures of all of Council be included on the document. Ordinance No. 95-61 was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem Ames. Question: Ayes: All Nayes: None -000- An ordinance to rezone a 3.76 acre tract located in the 2300 block of Dowlen Road from RM-H (Residential Multiple Family Dwelling-Highest Density) District to NC (Neighborhood Commercial) District at the request of Dowlen Joint Ventures on behalf of a prospective purchaser who desires to build a funeral home on the north half of the tract with a recommendation from the Planning Commission for denial was considered: ORDINANCE NO. ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED RM- H (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST DENSITY) DISTRICT TO NC (NEIGHBORHOOD COMMERCIAL) DISTRICT FOR PROPERTY LOCATED BETWEEN DOWLEN ROAD AND WELLINGTON PLACE, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. 263 September 26, 1995 Councilman Goodson stated that when the property was originally considered for a zone change in 1993, he encouraged a one-time, inclusive zone change that would allow for proper development and would remain firm to that commitment, said he strongly supports proper one-time zone changes and did not feel the change was adequate in 1993. Councilman Goodson added that he is never in favor of stopping development, said he is not opposed to a funeral home being constructed, they are a necessary part of our society and is disappointed that this issue has potentially become an attack on funeral homes and discussed future flow of traffic in the area.. Councilman Davis stated that he would like information as soon as possible about subjects such as this rezoning request so that he will be able to informatively answer citizen inquiries. The ordinance was denied on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- An ordinance authorizing a Specific Use Permit of a 3.76 acre tract located in the 2300 block of Dowlen Road where Service Corp. International (SCI) plans to build a funeral home was introduced: ORDINANCE NO. ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW THE CONSTRUCTION OF A FUNERAL HOME IN AN AREA ZONED NC (NEIGHBORHOOD COMMERCIAL) DISTRICT, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Since Agenda Item Number 1 was denied, the zoning classification remains RM-H, not NC, and Councilman Goodson pointed out this is not an appropriate zoning classification change in RM-H and questioned further discussion or action. The City Attorney confirmed that a Specific Use Permit is not allowed in an RM-H zone and presented options of action. The ordinance was denied on a motion made by Councilman Cokinos and seconded by Councilman Davis. Question: Ayes: All Nayes: None -000- Ordinance No. 95-62 amending a Specific Use Permit to allow the Beaumont Heritage Center (BHC) to make a number of improvements at the John J. French Museum and the David French House was considered: 264 September 26, 1995 ORDINANCE NO. 95-62 ENTITLED AN ORDINANCE ISSUING AN AMENDED SPECIFIC USE PERMIT TO THE BEAUMONT HERITAGE CENTER TO ALLOW RENOVATIONS AND ADDITIONS TO THE JOHN J. FRENCH MUSEUM AT 2985 FRENCH ROAD ZONED HC (HISTORICAL CULTURAL DESIGNATION) DISTRICT, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 95-62 was approved on a motion made by Councilman Cokinos and seconded by Councilman Davis. Question: Ayes: All Nayes: None -000- Ordinance No. 95-63 authorizing a zone change from RS (Residential Single Family Dwelling) District to GC-MD (General Commercial-Multiple Family Dwelling) District for the east 43.6 feet of Lots 18 and 23, Block 6, Lucky Five Addition, requested by Mr. and Mrs. Alsaiah Lemons for the purpose of having all their property in one zone district, was considered: ORDINANCE NO. 95-63 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT TO GC-MD (GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING) DISTRICT FOR THE EAST 43.6 FEET OF LOTS 18 AND 23, BLOCK 6, LUCKY FIVE ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No. 95-63 was approved on a motion made by Councilman Patterson and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 95-253 authorizing a one-month agreement, effective October 1 through October 265 September 26, 1995 31, 1995, with Browning-Ferris Industries (BFI) for curbside recycling collection for the sum of $27,200.00, with the City receiving all revenue from sale of the recyclable materials was approved on a motion made by Councilman Goodson and seconded by Councilman Davis. Question: Ayes: All Nayes: None -000- Resolution No. 95-254 authorizing a one (1) year contract with the Innovative Housing Development Corporation in the amount of $300,000 to continue the Homebuyer Assistance Program for homes to be constructed in the Charlton-Pollard Neighborhood was approved on a motion made by Councilman Davis and seconded by Mayor Pro Tem Ames. Question: Ayes: All Nayes: None -000- Resolution No. 95-255 authorizing adoption of the City of Beaumont Investment Policy as amended to primarily reflect changes mandated by state law was approved on a motion made by Councilman Smith and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 95-256 authorizing a two (2) year contract with Commercial Life Insurance Company, Larry Windham agent, for basic life and accidental death dismemberment and supplemental life and accidental death and dismemberment benefits effective January 1, 1996 for an estimated annual premium of$80,712.00 was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. (Gulf Coast Insurance Agency, agent) to provide stop loss insurance for the City's medical insurance program 266 September 26, 1995 for an estimated annual premium of$80,287.00 was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: Mayor Moore Nayes: None Mayor Pro Tem Ames Councilman Cokinos Councilman Smith Councilman Goodson Councilman Patterson Abstained: Councilman Davis -000- Resolution No. 95-258 authorizing a one (1) year contract with American Home Assurance Insurance Company (Jeff Munro Agency, agent) for excess workers' compensation insurance for the City's self-insured workers' compensation program effective October 1, 1995 with the option to renew for two (2) additional years for an estimated annual premium of $26,162.00 was approved on a motion made by Councilman Goodson and seconded by Councilman Cokinos. Question: Ayes: Mayor Moore Nayes: None Mayor Pro Tem Ames Councilman Cokinos Councilman Smith Councilman Goodson Councilman Patterson Abstained: Councilman Davis -000- Resolution No. 95-259 authorizing a contract with John Alden Life Insurance Company (Michael Wolf--MONY, agent) to provide long term disability benefits to City employees at no cost to the City effective January 1, 1996 was approved on a motion made by Mayor Pro Tem Ames and seconded by Councilman Smith. Question: Ayes: Mayor Moore Nayes: None Mayor Pro Tem Ames Councilman Smith Councilman Goodson Councilman Patterson Abstained: Councilman Cokinos Councilman Davis Councilman Davis commented that he has received calls from employees during the year about 267 September 26, 1995 the length of time taken for payment to begin and asked Staff to closely survey the process so that employees do not experience unnecessary delays. -000- Councilman Patterson invited everyone to attend a special planned Operation One Vote Festival to be held at the L. L. Melton YMCA on Saturday from 11:00 a.m. to 5:00 p.m. and thanked Council for the proclamation in support of this program that is encouraging voter registration and the realization that an individual's one vote does count. Councilman Davis said we are moving forward with the Charlton Pollard Neighborhood Revitalization Program, encouraged vocal promotion of the project and apologized for not being able to attend the joint meeting with BISD because of a business appointment. Mayor Pro Tem Ames said the meeting with BISD was very good, said she is happy with the passage of items today that will benefit the revitalization of the Charlton Pollard neighborhood and is glad to be a part of that improvement. Councilman Goodson concurred that the meeting with BISD was productive, commented that Councilman Cokinos was not at this meeting because he was at an important meeting regarding the West Lucas Project, expressed appreciation for the attendance of the City Manager and Traffic Engineer Jim Cline and other Staff members to speak with citizens, announced an ACORN meeting for Monday night, commented about the upcoming report from State Comptroller John Sharp that may benefit the City, correspondence received from the Beaumont Housing Authority Council regarding units in the Charlton Pollard area, said all influence needs to be exercised to assure that HUD carries through with their obligation in the Charlton Pollard neighborhood and commended Habit for Humanity for accepting the project of building 18 building homes there and said they are now completing the seventh house. Councilman Cokinos complimented Traffic Engineer Jim Cline for his presentation at the West Lucas Drive Project meeting. Councilman Smith said the joint meeting with BISD Trustees was excellent with the primary topic being the Sharp report released September 15 that will have significant impacts on the District and possibly City efforts in the Charlton Pollard neighborhood. She said that about 500 students will be needed to keep the school open regardless of commitment, said our Community Development Staff needs to project a twenty-year forecast so that schools can be placed where truly needed and utilized and discussed future impact on the City regarding streets and services. Mayor Moore thanked Council for City representation at several meetings this week, complimented the level of discussion at the meeting with BISD last night for about two hours, said the task before the School Board is one for the entire city to consider, commented about good response of 268 September 26, 1995 Councilman Davis' presentation about the Charlton Pollard neighborhood at a meeting, discussion about Police resources in the School District, but said the Sharp report positioned issues for the community and there is definitely room for the City to help. Also, Mayor Moore reported that at the National League of Cities Transportation and Communication meeting, taxes, trust funds, a balanced budget and transit system adjustments and regulations were addressed. Mayor Moore further discussed funding of the transit system and ridership. In addition, he said old issues such as access right-of-way regarding communication, cable companies and telephones were discussed and said that upon his return to Beaumont a gentleman from one of the religious unions outside Beaumont visiting the community spoke very favorably about our city Sunday evening. Mayor Pro Tem Ames said she attended a ribbon cutting for the new Social Security office, and they expressed concern about the location of the bus stop for their patrons and asked that relocation be investigated to accommodate those conducting business at the Social Security office. -000- Mr. Gaylyn Cooper, on behalf of the Innovative Housing Development Corporation and the potential first-time home buyers that will be assisted with today's approved funding, addressed Council in appreciation for continued support and said they want to be part of the revitalization of the Charlton Pollard neighborhood and pledged support in a partnership with the City. Mr. Robert Lynn DeMary, 430 East Elgie, addressed Council to congratulate the City Manager and Council for state wide recognition as being the third-best managed city of our size, expressed approval for the curbside recyclable collection program, for passage of a contract with the Innovative Housing Development Corporation and the Charlton Pollard Revitalization Project and extended an invitation to attend the South Park Neighborhood Asso ciation meeting at 6:30 p.m. Thursday evening.
