BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 18th day of January, 1994, with the following present: HONORABLE: Evelyn M. Lord Mayor Guy N. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk * (Councilman Moore arrived at 1: 37 p.m. ) -000- The Invocation was given by Erin Hardy, a member of Girl Scout Troop 6381, sponsored by Trinity Methodist Church. The Pledge of Allegiance was led by Girl Scout Troop 6381. Council was presented with samples of cookies that will be sold during the Girl Scout' s annual cookie sale. -000- Citizen comment was invited on the Consent and Main Agendas. No one wished to address these items. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held January 4, 1994 ; Resolution No. 94-6 appointing Bruce Irvine, Elray Wilson, Bob Harris, and Chuck Mason to the Zoning Board of Adjustment with terms expiring September 30, 1995 and Bessie Chisum to the Planning and Zoning Commission for a term expiring July 31, 1994 ; and reappointing Bill -6- January 18, 1994 Faucett to the Library Commission for a term expiring October 31, 1995; Resolution No. 94-7 authorizing Change Order No. 1 for Contract 1, Water Service Line Replacement with A-1 Guarantee Plumbing for installation of additional house service lines in the Pine Crest area and final payment in the amount of $7, 136.94 increasing the contract price to $33 , 982.29 from $27,204 . 03 ; Resolution No. 94-8 authorizing execution of a Pipeline License Agreement with Citgo Pipeline Company for installation of 196 feet of 10- inch liquefied petroleum gas pipeline across Old Voth Road, Lawrence Drive and Helbig Road to allow Citgo to transport gas between Lake Charles, Louisiana, and Mont Belvieu, Texas; Resolution No. 94-9 authorizing execution of a License to Encroach to Exxon Company, U.S.A. for a groundwater monitoring well which is encroaching into the Avenue A right-of-way adjacent to Lot 26, Block 14 of the Arlington Addition for an area of nine square feet, 96 feet from the north right-of-way line of Euclid Avenue and 8 feet from the east right-of-way line of Avenue A, for a one-time fee of $500. 00; and Resolution No. 94-10 authorizing settlement of the lawsuit of Angela Jacobs vs. City of Beaumont, et al in the amount of $3 ,400.00. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 94-11 authorizing a contract with Habitat for Humanity in the amount of $30, 000. 00 to provide funding assistance for construction materials for three homes for low income families in the Charlton- Pollard neighborhood from Community Development Block Grant funds was approved on a motion made by Councilman Smith and seconded by Councilman Davis. Question: Ayes: All Nayes: None -000- Resolution No. 94-12 authorizing purchase of an excavator for the Landfill Division of the Solid Waste Management Department in the amount of $196, 349. 00, with a guaranteed three-year repurchase price of $150, 000.00 or a five-year repurchase price of $120,000. 00, from Mustang Tractor & Equipment Company was approved on a motion made by Councilman Smith and seconded by Mayor Pro Tem Goodson. Question: Ayes: All Nayes: None -7- January 18, 1994 Resolution No. 94-13 authorizing acceptance of the $41,483 .00 bid of Wheeled Coach Industries/Leadership Ford for furnishing a 1994 Ford cab and chassis and converting an existing ambulance body for the Emergency Medical Services Division (EMS) was approved on a motion made by Mayor Pro Tem Goodson and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution No. 94-14 authorizing Fiesta Mart, Inc. , located at 3295 College Street, to serve as a collection agent of Water Utility payments for the City of Beaumont, with no charge for this service, and to deposit payments received by them in the City of Beaumont's interest bearing account with Nations Bank, was approved on a motion made by Councilman Moore and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Councilman Smith queried Council regarding continuation of the "Sunday in the Park" program and agreed with a suggestion to reevaluate and discuss options at a Workshop. Mayor Pro Tem. Goodson reported that he, along with Councilmen Moore and Davis and others, attended the MLK program yesterday in Port Arthur and complimented the Steering Committee, Mrs. Savoy, her daughters and those involved in the program. He particularly complimented the Lincoln High School students who presented a skit entitled, "A Cry for Help. " He said it was excellent and very well-produced. Councilman Moore thanked all constituents, Council, and City Staff who called, sent cards or visited during his family's loss of his father last week. He said this support was sustaining for them. Also, Councilman Moore questioned progress of the bus stop issue located near the Fiesta Store, congratulated City Staff, the Sheriff's Department, the Beaumont Police Department, the YMCA, the Probation Department, and Entergy Corp. for an excellent POWER program (to promote pride, opportunity, work, education and respect) directed at students, ages 10- 16, in progress at Lamar University's Montagne Center and encouraged parents to attend a program from 6: 00 p.m. to 8: 00 p.m. tonight. Mayor Lord added that Councilman Moore is doing a fine job of emceeing the POWER program at Lamar and emphasized the communication skills and appeal of Drew Brown, the morning speaker at the program. She said he caught the imagination of even the youngest and kept everyone attentive. Mayor Lord said she and her husband attended an MLK service last night at Saint Anthony's that was beautiful and exceptional. In addition, she said that last week provided an opportunity to welcome 200 new families moving to Beaumont as a result of the GSU-Entergy Corporation merger, who are anxious to become a part of our community and be of service. -8- January 18, 1994 Mayor Lord formally congratulated Councilman Moore for his recent election as Chairman of the National League of Cities Transportation Committee and as President of the National Black Caucus of Local Elected Officials. -000- Mayor Lord announced that an Executive session will be held in accordance with Section 551. 071 of the Government Code following the Workshop Session to discuss pending or contemplated litigation: Richard Bolin vs. City of Beaumont and Jerone Williams vs. City of Beaumont. -000- Barbara Scott, Northridge Manor; Gwendolyn Davis, Grand Pine; Marva Eaglin, Neches Park; Alma Wilson, Tracewood, II; and Johnetta Colone, Northridge Manor; addressed Council to request that Mayor Lord rescind her nomination to the Beaumont Housing Authority Board and to reconsider their requested nomination of Loretta Dotson, even though Ms. Dotson has filed a lawsuit against the Housing Authority resulting in a conflict of interest that would inhibit her voting ability. Ms. Schieketa Eaglin, 3220 Christopher, addressed Council to complain of seismographic testing in her neighborhood with inadequate notice and damages caused to property and asked for assistance. Mrs. Betty Madison, 3990 Baldwin Drive, addressed Council to complain of loud noise in her neighborhood (Concord and Baldwin) from boom-boxes throughout the night and 18-wheelers parking at the Village Shopping Center, leaving their refrigeration units in operation, blowing horns and making excessive noise. Council suggested that the Madisons contact Captain Woodsmall with the noise problems and work with him through the Community-Oriented Police program. Councilman Davis said he has also received a complaint from Mrs. White at 3225 Christopher regarding seismographic testing activities, and Mr. Riley said Staff would check into their permitting and activities. Mr. Bubba Metz, Wales Drive, addressed Council to complain about receipt of parking tickets of his commercial vehicle (employee of Neff Brothers) in a residential area. Mr. Metz said he cannot meet the required 30- minute response time, if his vehicle is not parked near his home. The City Attorney told Mr. Metz he would meet with him after Council to explain ordinances regulating commercial vehicles in residential zones. Mr. Henry Dannenbaum, 2880 Grand, informed Council that he is celebrating his 60th birthday today. -9- January 18, 1994 In response to an inquiry regarding an answer to the request for Mayor Lord to rescind her nomination to the Beaumont Housing Authority and consider the request to appoint Loretta Dotson, City Attorney Nichols said, "these comments were directed at a City Council meeting, but not a subject that the City is responsible for. . .and I think the Council has been very understanding in allowing the comments to go on. It really is sort of out of order and not appropriate in this setting to deal with an individual responsibility that you hold. " Mayor Lord said she would address the subject of her appointment to the Beaumont Housing Authority after the official Council meeting. -000- There being no further business, the Regular Session of City Council was recessed to conduct the Workshop Session to be followed by an Executive Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held January 18, 1994.
