BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 5th day of November, 1991, with the following present: HONORABLE: Evelyn M. Lord Mayor Lulu L. The Pledge of Allegiance was led by Mayor Pro Tem Smith. -000- Four Proclamations were issued: "Chemistry Week, " November 3-9, 1991; "Jump Rope for Heart Week, " November 4-8, 1991; "Veteran's Day Weekend, " November 9-11, 1991; and "Beaumont Friendly Week, " November 4-10, 1991. -000 City Manager Riley asked John Labrie, Solid Waste Director, to make presentations to City employees of the Solid Waste Department who are recent winners in a competition conducted by the Lone Star Chapter of Solid Waste Association of North America. Mr. Labrie introduced Reed Roberts, a worker at the Landfill, who finished fourth in the bulldozer competition by proving proper maintenance of his equipment in a pre- trip inspection and participating in a heavy equipment obstacle course; Ulysses Cormier, who finished third in the compactor operation obstacle course competition with a compactor weighing approximately 75,000 pounds; Ronald Polar, a mechanic at the Fleet Department, who won the honor of State Champion Mechanic of Texas; and Robert Limbrick, first place winner in the compactor competition, as well as the Texas Grand Champion, having the highest score of any competitor in any event. As first place finishers, Mr. Polar and Mr. Limbrick will compete in the -280- November 5, 1991 North American championships in June, 1992 , in Dallas. Mr. Labrie belatedly recognized Ben Alexander, who was the Grand Champion of the truck driving competition and the first place finisher in the side loader refuse truck competition last year. Mr. Alexander proceeded to the North American championships in Vancouver, where he finished in fourth place. Mr. Labrie presented certificates to each of the winners and Mayor Lord presented them with Cross pen and pencil sets from the City of Beaumont. -000- Citizen comment was invited on the Consent Agenda and Main Agenda Items 1 through 5. No one wished to address these subjects. -000- (Councilman Alter left the Council Chambers and did not vote on the Consent Agenda items. ) The following Consent Agenda Items were considered: Approval of the Minutes of the regular City Council session held October 29, 1991; Resolution No. 91-276 appointing Jerry Hinson to the Airport Advisory Commission for a term expiring May 31, 1993 ; and Resolution No. 91-277 authorizing settlement of a property damage claim in the amount of $12,500. 00 ($12,240 for vehicle replacement value and $260 rental reimbursement) brought against the City by Susan Edd as the result of a collision involving Ms. Edd's van and a City sanitation truck driven by Betty Briggs on October 17, 1991, at Stacewood and Madrid. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- (Councilman Alter returned to the Council Chambers. ) Resolution No. 91-278 accepting the work performed by Australian Courtworks, Inc. for resurfacing tennis courts at the Athletic Complex and authorizing final payment in the amount of $15,225.00 was approved on a motion made by Councilman Cokinos and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- -281- November 5, 1991 Resolution No. 91-279 authorizing Change Order No. 1 to the contract for the 1991 Street Rehabilitation Program - Reconstruction and Overlay Project with Bo-Mac Contractors, Inc. for an estimated $25, 000. 00 to compensate for sales taxes on items exempted at time of bidding, but made subject to taxes by Texas legislation prior to award of the contract, was approved on a motion made by Councilman Alter and seconded by Mayor Pro Tem Smith. Question: Ayes: All Nayes: None -000- Resolution No. 91-280 authorizing purchase of fourteen (14) Washington Pedestrian light poles and Sentry Electric Company globes for the Crockett Street Plaza Project in the amount of $15, 302 . 00 from Graybar Electric Co. , Inc. was approved on a motion made by Councilman Moore and seconded by Mayor Pro Tem Smith. Question: Ayes: All Nayes: None -000- Resolution No. 91-281 authorizing a contract for maintaining non- utilized City Property (by mowing an average of once per month) with Trax Enterprises in the amount of $. 00248 per square foot for developed property and $. 00179 per square foot for vacant property and a minimum charge of $15.00 for lots with an area of less than 7,500 square feet was approved on a motion made by Mayor Pro Tem Smith and seconded by Councilman Goodson. These parcels of property have been inspected, are vacant, and found to be in violation of Article III, Section 14-50 of the Code of Ordinances. Notices have been sent to owners by Certified Mail and published in the Beaumont Enterprise. -283- The twenty-five (25) structures listed below have been condemned by City Council and the owners ordered to either raze or repair them within specified time frames. Reinspection of these structures have revealed non-compliance with the Council 's order. The Building Codes Division of the Public Safety Department is requesting authorization from City Council to demolish these structures in accordance with the Dangerous Structure Ordinance and charge the property owners with the cost of demolition. 1540 Bean Court, 1560 Bean Court, 1575 Bean Court, 1594 Bean Court, 1650 Bean Court, 1670 Bean Court, 1680 Bean Court, 1695 Bean Court, 2284 Brooklyn, 1405 Carroll Alley, 6031 Chandler, 1735 Church, 1248 Evalon, 6795 Fannett, 2435 Neches (garage apt. ) , 802-50 Orleans (commercial), 2245 Pear, 1580 Port, 2295 Potts, 1462 Sabine Pass, 2545 Wall (apt.), 2549 Wall (apt. ), 2555 Wall (apt. ), 2557 Wall (apt. ), and 2561 Wall (apt. ) . Mrs. Zohreh Shahrodi, 1225 Wilchester Circle, addressed Council to request additional time for renovation of the structures located at 1560, 1575, 1594, 1650, 1670, 1680, and 1695 Bean Court. She said they had been purchased at a Sheriff's Sale for delinquent taxes and can be redeemed by the previous owner until April, 1992 . Staff reports indicated that an additional 60 days, expiring in August, was granted to raze these structures as a result of the June 4, 1991, dilapidated structure hearing. Mr. Don Unruh addressed Council regarding the structure at 2398 Avenue A. Mr. Unruh said he is in the process of selling the property. Mr. Unruh was instructed by Mayor Lord to inform the prospective buyer to contact the Building Codes Division to establish a work plan to bring the structure up to Code. On behalf of her mother, Josephine Chavis addressed Council regarding the property at 429 San Jacinto (Oliver Dixon listed as owner on tax roll) to explain that rehabilitation of the structure has begun with installation of 15 aluminum windows and new sills and the house has been raised and leveled. Instruction was given to acquire a permit for the work and formulate a work plan with the Building Codes Division. Councilman Moore suggested that promotion highlighting the opportunities provided by the Rental Rehabilitation Program with loan assistance be developed in an effort to encourage an increase in low to moderate income level rental property. There being no one else to address Council, the public hearing was closed. Ordinance No. 91-91 declaring certain dilapidated structures to be public nuisances and ordering their repair or removal by their owners was considered: -284- November 5, 1991 ORDINANCE NO. 91-91 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. By removing the structure located at 429 San Jacinto from Section 3 of the ordinance, ordering demolition within thirty (30) days, and placing it in Section 2, to allow demolition or repair within thirty (30) days, Ordinance No. 91-91 was amended and approved on a motion made by Councilman Alter and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- Councilman Moore congratulated Housing Services staff for a well-planned block party to celebrate the six new affordable homes in the Charlton- Pollard Neighborhood for low to moderate income families and the dedication of property (at Madison and Poplar Streets) where Beaumont Habitat for Humanity will construct approximately 18 homes to be sold to needy families with no interest charge. Councilman Alter congratulated the employees of the Solid Waste Department for representing the City of Beaumont well in their recent competition and announced there are five meetings to be conducted throughout the city at 7:00 p.m. on designated evenings to discuss the recycling program and encouraged public attendance. Mayor Lord urged participation at the Community Thanksgiving Celebration at the Julie Rogers Theater on November 25th and attendance at one of the first four recycling meetings. Councilman Alter suggested that possibly the recycling program on November 25th should be rescheduled, since there is a conflict. Councilman Goodson thanked Councilman Moore for his hard work with the Youth Challenge Task Force and formulating the meeting, where several enjoyed a great learning experience, and reminded everyone that "Sunday in the Park" activities will be hosted Sunday, November 10, from 2 : 00 to 4: 00 p.m. Mayor Lord reported that a tremendous Moccasin Program meeting was held last night with over one hundred in attendance at a multi-ethnic dinner at 6: 00 p.m. and then a panel discussion featuring Middle School students focusing on their heritage and present day problems. -285- November 5, 1991 Mrs. Delia Harrington, 815 Willow Street, addressed Council to extend an invitation to attend the recital of the Interfaith Choral Society Sunday afternoon at the First Methodist Church at 3 : 00 p.m. Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council to encourage obtaining tickets for the Beaumont Bowl to be held this weekend. -000- Mayor Lord announced that following the Workshop Session an Executive Session will be conducted in accordance with Section 2 (e) of the Texas Open Meetings Act to discuss pending or contemplated litigation: Darnell Pinnell vs. The City of Beaumont. -000- There being no other business, the meeting was adjourned to reconvene in Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held November 5, 1991.
