BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 29th day of October, 1991, with the following present: HONORABLE: Evelyn M. Lord Mayor Lulu L. Smith Mayor Pro Tem Councilman, Ward I Andrew P. Cokinos Councilman At Large Brian R. Alter Councilman At Large Guy N. Goodson Councilman, Ward II David W. Moore Councilman, Ward IV Absent: Audwin Samuel Councilman, Ward III Ray A. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend James Blackwell, South Park Baptist Church. The Pledge of Allegiance was led by Councilman Cokinos, who asked Dr. Mary Gagne, principal of Kelly High School and Bryan Weaver, President of the Kelly High School Student Council to join him. -000- Mayor Lord announced that prior to Council, "Hunger Heroes" (six people working in two separate programs to feed the hungry) were recognized, and that today is Student Government Discovery Day, a program initiated to allow high school seniors an opportunity to spend a day with City officials and staff to learn first-hand about City government. Mayor Lord welcomed Dr. Gagne and Kelly High School students. -000- Proclamations were issued for "Garden Center Days, " November 2-3, 1991; and "Hunger Heroes Day, " October 29, 1991 (Recipients were Ruth White, founder of the Blessed Sacrament Brown Bag volunteer program, and Shawn and Eric Smith, teen-aged brothers, Jay and Jolis Ewing and Sandy Simmons, volunteers at Some Other Place soup kitchen) . Before presenting the next proclamation, Mayor Lord introduced former -274- October 29, 1991 Mayor Ken Ritter, a partner with the firm managing Tracy Byrd, a Country Music singer, Don Jacobs, publicist for Tracy, Tracy's parents, Jerry and Brenda Byrd, and Tracy's wife, Michelle. Mayor Lord read the following proclamation: WHEREAS, Country Music is experiencing a tremendous upsurge in popularity and is now recognized as an outstanding integral part of American culture; and, WHEREAS, the newest rising star in County Music is Beaumont native Tracy Byrd; and, WHEREAS, Tracy Byrd has burst upon the scene as an artist of such virtuosity and versatility that he can serve up a country song well-done or provide a rare treat in performance with the Beaumont Symphony; and, WHEREAS, Tracy Byrd is now on the verge of worldwide fame and popularity with the signing of a long-term contract with the international recording giant, MCA Records; and, WHEREAS, this event took place with MCA-Nashville President Bruce Hinton in Beaumont on October 25, 1991, with hundreds of fans and well wishers looking on; and, WHEREAS, Beaumont, Texas, is unique in that no other city can boast of concurrently having three area natives--George Jones, Mark Chesnutt and Tracy Byrd--on the same record label; and, WHEREAS, despite the time pressures of the hectic schedule of rising recording artists, Tracy Byrd and his band, Heartbroke, always manage to squeeze in performances for charities and benefits; and, WHEREAS, Tracy Byrd, himself still finds time for charitable and community service work, including, and most recently, the role of honorary chairman of the 1992 "Walk America" fund drive for the March of Dimes Birth Defects Foundation. NOW, THEREFORE, I, Evelyn M. Lord, Mayor of the City of Beaumont do hereby proclaim Tuesday, October 29, 1991, as "TRACY BYRD DAY" in Beaumont and call upon all citizens to join me in expressing pride in his musical accomplishments and in the wholesome, clean-cut image he brings to the world of music. IN WITNESS WHEREOF, I have hereunto set my hand and have caused the Seal of the City of Beaumont to be affixed. /s/ Evelyn M. Lord, Mayor Tracy presented Council with MCA Record label caps, thanked Council for the proclamation and their support, expressed appreciation to all the news media and KD-97 for their help during the past three years, his fans and fan club representative, Marcelle Hollenbeck, and said he hopes he will always make Beaumont proud. Tracy introduced Heartbroke Band members Carlo Stanley (bass guitarist and harmony singer) of Port Arthur, Johnny Lee Carpenter (fiddler) , Lake Charles, Louisiana, Lane -275- October 29, 1991 Thibodeaux (steel guitarist) , Groves, Billy Carpenter (drummer) , Lake Charles, Louisiana, Big John Campbell (guitarist) , Orange, and Cary Stone, who also sings at Cutters Lounge. Mayor Lord said that a day like today makes everyone proud, and that she's encouraging production of a bumper sticker that reads, "I wasn't born in Beaumont, but I got here as fast as I could! " Council suggested that might me good lyrics or a title for a Country-Western song! -000- Mayor Lord announced there will be no Executive Session held today following City Council. -000- Citizen comment was invited on the Consent Agenda and Main Agenda Items 3, 4, and 5. No one wished to address these items. -000- The following Consent Agenda item was considered: Approval of the Minutes of the regular City Council session held October 22, 1991. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Ordinance No. 91-89 authorizing a specific use permit to allow First Baptist Church of Voth to construct a 4, 160-square-foot sanctuary at 8205 Broussard Road at Church Road on a 1.26 acre tract of land in the D. Easley Survey, zoned RS (Residential Single Family Dwelling) , was considered: ORDINANCE NO. 91-89 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW THE FIRST BAPTIST CHURCH OF VOTH TO ESTABLISH A NEW CHURCH AT 8205 BROUSSARD ROAD AND CHURCH ROAD ON A 1.26 ACRE TRACT OF LAND IN THE D. EASLEY SURVEY, ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING) , BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 91-89 was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -276- October 29, 1991 Ordinance No. 91-90 authorizing a specific use permit to South Park Church of Christ to construct a 7, 176-square-foot sanctuary in the 800 Block of West Cardinal Drive on a 2 .98 tract of land in the J. A. Veatch Survey, zoned RS (Residential Single Family Dwelling) , was considered: ORDINANCE NO. 91-90 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW THE SOUTH PARK CHURCH OF CHRIST TO ESTABLISH A NEW CHURCH IN THE 800 BLOCK OF W. CARDINAL DRIVE ON A 2 .98 ACRE TRACT OF LAND IN THE J. A. VEATCH SURVEY, ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING) , BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 91-90 was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- After discussion concerning disposition of residences on property acquisitions and the possibility of removal and use of the houses for low-income rental property or rehabilitation by the City or groups such as Habitat for Humanity rather than demolition, Resolution No. 91-273 authorizing purchase of Parcel 165, a 0.772 acre homesite situated about 700 feet south of Bluebonnet on the east side of Major Drive for required right-of-way (appraised value--$61, 395. 00) and a 0. 1876 acre 20- foot wide underground utility easement, (appraised value--$1,875. 00) , out of the Hezekiah Williams Survey, Abstract 56, from Ms. Louise Millner McCormack at a total appraised value of $63, 270. 00 for the FM 364 (Major Drive) Project (north of Dishman Road) was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem Smith. Question: Ayes: All Nayes: None -000- Resolution No. 91-274 casting 212.5 of the City of Beaumont' s 425 votes for Eugene Landry and 212.5 votes for Ed Moore in an election to name the Jefferson County Tax Appraisal District Board of Directors for two- year terms beginning January 1, 1992 and ending December 31, 1993 , was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 91-275 pledging advice and technical information support by the Parks Department in a program sponsored by the Beaumont Chapter of the Humana Seniors Association and the Deep East Texas Region of the -277- October 29, 1991 Texas Forest Service for planting trees on school grounds, was approved on a motion made by Councilman Alter and seconded by Mayor Pro Tem Smith. Question: Ayes: All Nayes: None -000- Councilman Moore said the TML meeting in Fort Worth last week was most interesting with an exchange of a lot of good ideas and extended an invitation to Council to attend a luncheon tomorrow at 12 : 30 p.m. followed by a youth task force meeting at 1: 30 p.m. at the Central High School Ninth Grade Campus to discuss some sensitive teen issues. Mayor Lord congratulated City Manager Ray Riley for receiving the Administrator of the Year Award by the Library Association of Texas at the TML meeting based on the superior support and cooperation he gives to library services. Councilman Alter said he notes there is stronger and stronger emphasis on agendas for training municipal leaders to become more involved in the drug, crime and education problems. He added that since the Parks Department now has a tree spade they are trying to create an initiative to work with home and commercial builders to flag trees on property under development for removal and placement in the parks. In addition, Councilman Alter thanked Mayor Lord for the opportunity to present a key to the City to Bruce Hinton of MCA Records at Cutters last Friday in her absence. He stated it was an evening of fun, and that Mr. Hinton said this is the first time that MCA has ever signed two Country-Western performers from the same city in the same year outside of Nashville (Mark Chesnutt and Tracy Byrd) . Councilman Cokinos thanked Dr. Gagne for bringing Kelly High School students to Council today and invited them to return. Councilman Goodson reminded everyone to attend the Environmental Expo at the Civic Center and encouraged Kelly High School students to attend the Moccasin Exchange Program next Monday at 6: 00 p.m. in the City Hall Employee Lounge to observe a gathering of ethnic and cultural backgrounds coming together to better understand each other. Mayor Lord explained that about a dozen Middle School students of different ethnic backgrounds will be on the program to tell the good things about their heritage and talk about any problems they encounter. She welcomed attendance and asked each one to bring a covered dish for the meal. Mayor Pro Tem Smith added that Council would truly like to have the students attend the Moccasin Exchange Program because it will be exciting to see how Middle School students feel, announced on November 9, from 9: 00 a.m. until 5: 00 p.m. , there will be a Health Fair in the -278- October 29, 1991 Civic Center with a lot of information, and that the next to the last "Sunday in the Park" for this season will be Sunday, November 10th, with Councilman Goodson reading to the children. -000- Bryan Weaver, 2040 Chevy Chase, on behalf of the students at Kelly High School and Dr. Gagne, addressed Council to thank them for the opportunity of being a part of Student Government Discovery Day, for answering their questions, providing the tour of City facilities and for lunch. Dr. Mary Gagne, 5940 Tangledahl, addressed Council to say that today was very enjoyable and that Kelly High School is trying to impress students with the importance of becoming active in the community, and Council has reinforced that today through this opportunity. Mr. Henry Dannenbaum, 1567 Wall, addressed Council to announce that First Baptist Church is hosting a Noah's Ark Halloween Party for neighborhood children Thursday and invited everyone to hear the Continental Singers on "Bring a Friend Day" next Sunday. -000- There being no other business, the meeting was adjourned to reconvene in Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held October 29, 1991.
