BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 13th day of August, 1991, with the following present: HONORABLE: Evelyn M. Lord Mayor Andrew P. Alter Councilman At Large Ray A. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by Councilman Andrew P. Cokinos. The Pledge of Allegiance was led by Cindy Price, news reporter for Channel 6-KDFM-TV. -000- Citizen comment was invited on the Consent and Main Agendas. No one wished to address these items. -000- Councilman Goodson requested that Item C on the Consent Agenda authorizing the City Manager to notify the South East Texas Regional Planning Commission that the City of Beaumont does not wish to participate in an election for an Expanded Calling Scope (Orange, Jefferson and Hardin counties) for South East Texas be deferred to a later date for consideration on the Regular Agenda and allow an opportunity for proponents of the toll free calling expansion to present their views. Council concurred with Councilman Goodson's request. -000- The following Consent Agenda items were considered: -190- August 13 , 1991 Approval of the Minutes of the regular City Council session held August 6, 1991; and Resolution No. 91-190 authorizing pledge of securities in the amount of $3, 710, 122. 00 held at the Federal Reserve Bank-Dallas/Houston Branch effective August 13 , 1991; The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- City Manager Ray A. Riley presented to City Council the proposed annual operating budget for Fiscal Year 1992 . Expenditures from general, enterprise and designated revenue funds are budgeted at a total of $87, 128,000. With revenue anticipated in the amount of $86,465, 000 reserve balances in these funds are estimated to be $11, 363 , 000 at the end of the fiscal year. Appropriations in special and internal service funds total $16,286, 000 with year end reserves expected to be $4, 050, 000. 00. Resolution No. 91-191 scheduling a public hearing on the proposed Fiscal Year 1992 City Budget Document (with a tax increase of $. 04--$. 03 applied to general debt service and $. 01 for general operations--an increase from $. 54 to $.58 per $100 assessed valuation) and the proposed Capital Program for FY 1992 through FY 1996 to be held at 7: 00 p.m. on September 3 , 1991, in the City Council Chambers was approved on a motion made by Councilman Goodson and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution No. 91-192 authorizing purchase of a portable wood waste tub grinder for use by the Solid Waste Management Department to reduce tree trunks, limbs, brush, leaves, pallets, boards and other construction wood waste into shredded chips for mulch and reduce the volume of solid waste going into the landfill from Fuel Harvesters Equipment, Inc. in the amount of $139, 541. 00, with a unit engine warranty of twelve (12) months and a hammermill driveline and tub drive system warranty of thirty-six (36) months, was approved on a motion made by Mayor Pro Tem Smith and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 91-193 authorizing an intent to participate in the Texas Urban Main Street Project by: (1. ) endorsing the application of BUILD, Inc. for selection of Beaumont in the "Urban Main Street" program with -191- August 13, 1991 the specific goal of revitalizing a targeted business district within the context of the preservation and rehabilitation of its historic buildings, and, (2 . ) co-funding a full-time Main Street Project staff and committing financial support in the amount of $50, 000 (appropriation of $25, 000 in CDBG funds to augment the $25, 000 appropriation already proposed for BUILD, Inc. , in the general fund FY92 budget) for the first year of the project was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000 Ordinance No. 91-62 amending Ordinance No. 91-54 establishing a multi- family rate for the street use service fee by authorizing owners of rental multiple family dwellings to charge tenants any amount up to $3 . 00 per month for the fee was considered: ORDINANCE NO. 91-62 ENTITLED AN ORDINANCE AMENDING ORDINANCE 91-54 ESTABLISHING A MULTI-FAMILY FACILITY RATE FOR THE STREET USE SERVICE FEE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. Ordinance No. 91-62 was approved on a motion made by Councilman Goodson and seconded by Mayor Pro Tem Smith. Question: Ayes: All Nayes: None -000- Councilman Samuel requested a status report on the resurfacing of Cleveland Street. Mayor Pro Tem Smith reported a very enjoyable "Sunday in the Park" program last Sunday and announced the next one will be September 8th and invited everyone to enjoy an afternoon at Riverfront Park. Councilman Moore asked that a Workshop Session be conducted to review the ordinance regulating the number of pets allowed each household because he has received additional information to share with Council and inquired if the ditching program schedule will be impacted by weather conditions. Mayor Lord read a portion of a letter sent to Sheila Stewart at the Art Museum of Southeast Texas from a gentlemen who directs late-night programs for CBS. He said that while in Beaumont visiting family, a highlight of the trip was visiting the Art Museum and enjoying the current exhibitions and dining in the Tea Room. He congratulated the creation of an "oasis of culture that feeds both soul and body. " -192- August 13, 1991 Ms. Cynthia Hayes, president of Virginia Village Residents Council, read a letter to Council that requested: "1. Terminate the specific use permit which allowed a bar to operate at 4290 Pradice, within a residential neighborhood. 2. Continue to allow neighborhood commercial uses at this address, such as beauty shop, barber shop, offices and the like. Two murders, extreme danger and stress for residents of the neighborhood and huge amounts of police time related to patrons of this bar leads us to request your most serious attention to this petition. " The letter was signed by Ms. Hayes and attached to a petition with approximately 149 signatures that read, "We request that the City not allow the tavern on Booker and Pradice to reopen. The shooting, drug dealing, noise and traffic do not belong in residential neighborhood. " Mr. Mike Carpenter, representative of Carpenter Property Management, addressed Council and explained that the owners of the property have indicated to him they prefer the space be used for a purpose other than a bar and said other uses have been discussed. Discussion has included possible financial arrangements and applications for grants that might bring in community services such as a health clinic or a senior citizens facility. After a discussion of procedure, consensus of Council is to move forward with the process to revoke the specific use permit by conducting a joint public hearing and proceed with the appropriate action. Councilman Moore expressed his feeling that today marks a positive step forward by the residents of Virginia Village. He said that in forming an association and sending their president to represent them signals an effort on their part to help themselves, and they are showing concern for their neighborhood and children. Councilman Moore complimented them for their action. Ms. Delores Lawless, 495 Yorktown, addressed Council to extend an invitation to the Business and Professional Women's Club 46th Annual Civic Dinner on September 24, 1991, when Community Services Director Maurine Gray will be honored for outstanding civic and community service. -000- There being no further business, the Regular Session of City Council was adjourned to reconvene in Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held August 13, 1991.
