BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 30th day of July, 1991, with the following present: HONORABLE: Evelyn M. Lord Mayor Andrew P. City Attorney Rosemarie Chiappetta City Clerk (*Councilmen Samuel and Moore arrived late. ) -000- The Invocation was given by the Reverend Troy E. Key, Associate Pastor of Education/Administration at First Baptist Church. The Pledge of Allegiance was led by Rosemarie Chiappetta, City Clerk. -000- Citizen comment was invited on the Consent Agenda and Main Agenda Items 1 through 5. No one wished to address these items. -000- At the request of Councilman Cokinos, Item C of the Consent Agenda authorizing purchase of 214 90-gallon automated collection garbage containers was removed for further clarification and consideration separately. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held July 23, 1991; -178- July 30, 1991 Resolution No. 91-177 appointing R. Edward Dix and Ted Blanton, Jr. to the Planning Commission for terms expiring July 31, 1994 and appointing Iris Booker and Eddie Senigaur to the Community Development Advisory Committee for terms expiring May 31, 1993 ; and Resolution No. 91-178 granting a Temporary Construction Access Easement on 1.762 acres and a Perpetual Drainage Easement covering 10. 892 acres in Tyrrell Park to Jefferson County Drainage District No. 6 and Tytex Properties, Ltd. for the widening of Hillebrandt Bayou by the U. S. Corps of Engineers in the Taylor's Bayou Flood Control Project. The Consent Agenda was approved on a motion made by Mayor Pro Tem Smith and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- (Councilmen Samuel and Moore arrived during discussion of Resolution No. 91-179. ) Resolution No. 91-179 authorizing purchase of 214 90-gallon automated collection garbage containers from Toter, Inc. , at a cost of $53.95 each, for a total of $11,545. 30 to replenish the Landfill inventory to fill requests for additional or replacement containers was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 91-180 authorizing a contract with W. B. Construction, Inc. in the amount of $364,554. 00 for construction of the East Caldwood Project of the Comprehensive Drainage Improvement Program, designed to increase the capacity of the East Caldwood drainage system to improve drainage in areas on both sides of the street between the Lindbergh Drive Overpass and the outfall south of Laurel Avenue, a distance of 1,750 feet, was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 91-181 authorizing a contract with Jleeco Builders in the amount of $24, 042 . 00 for installation of a new metal canopy roof over the existing restrooms and concession stand at Riverfront Park (T 1-11 decking to be installed on framing furnished by City, roofing materials by contractor) was approved on a motion made by Mayor Pro Tem Smith and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- -179- July 30, 1991 Ordinance No. 91-59 amending Section 6-21 of the Code of Ordinances to add a new section to regulate and establish minimum standards for residential foundation repairs to include requirement that work be done by a licensed and bonded contractor, a permit obtained, drawings of proposed work, a detailed description of the work and a copy of the contractor's proposal to the property owner be submitted to the City Building Official was considered: ORDINANCE NO. 91-59 ENTITLED AN ORDINANCE AMENDING CHAPTER 6, SECTION 21, OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No. 91-59 was approved on a motion made by Councilman Goodson and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 91-182 authorizing support of an application to be submitted by BUILD, Inc. , for consideration as one of the cities to participate in the 1991 Urban Main Street Program of the Texas Historical Commission which provides assistance to cities in revitalization of historic commercial districts through development of public/private partnerships was approved on a motion made by Councilman Alter and seconded by Mayor Pro Tem Smith. Question: Ayes: All Nayes: None -000- Resolution No. 91-183 authorizing emergency repairs (exhaust system and engine) to the Police Department's surveillance airplane by Gafford Aero of San Marcos, Texas in the amount of $26,518. 20 (to be paid from the confiscated goods account) was approved on a motion made by Councilman Moore and seconded by Councilman Samuel. These parcels of property have been inspected, are vacant, and found to be in violation of Article III, Section 14-50 of the Code of Ordinances. Notices have been sent to owners by Certified Mail and published in the Beaumont Enterprise. The thirteen (13) structures listed below have been condemned by City Council and the owners ordered to either raze or repair them within specified time frames. Reinspection of these structures have revealed non-compliance with the Council 's order. The Public Safety Department is requesting authorization from City Council to demolish these structures in accordance with the Dangerous Structure Ordinance and charge the property owners with the cost of demolition. 3910 Avenue A, 2395 Avenue B, 2930 S. 11th (Commerciall, 957 Ewing, 1338 Hale, 1345 Hale, 1085 Harrison, 630 Jackson, 422 Jeanette, 2295 Leight, 1450 Lyle (Apartments) , 4815 Sunbury, and 2250 Toledo. Mr. Charles Freeman, 3430 St. Helena, owner of the structure at 2295 Leight addressed Council to request additional time for repairs. Mr. -181- July 30, 1991 Freeman said he has been unable to complete the repairs due to his work schedule and rain, and his work permit has expired. There being no one else to address Council, the public hearing was closed. Ordinance No. 91-60 declaring certain dilapidated structures to be public nuisances and ordering their repair or removal by their owners was considered: ORDINANCE NO. 91-60 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. The structure at 2295 Leight was removed from Section 4 of the Ordinance ordering raze to allow the owner to obtain another work permit and restablish a work schedule. If the owner is unable to comply, Staff may bring the structure back for consideration again next month Ordinance No. 91-60 was approved on a motion made by Councilman Goodson and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Mayor Pro Tem Smith reported cutting the ribbon for the National Big Bass Star 1 Championship on the Neches River and said they were a very enthusiastic group. Councilman Alter said that he attended a fun-filled street party on the parking lot of Cellular One, a mobile telephone service, for their grand opening and ribbon cutting ceremony with about 300 people. Mayor Lord said she received suggestions this weekend prompting her to request research be conducted for possible installation of a marquee on the Civic Center to display events there and at the Julie Rogers Theatre. She said she also participated in the Big Bass Tournament by handing out the awards, and that an exciting feature of the tournament was that all bass were weighed in and later released alive back into the Neches River. In addition, Mayor Lord rode in a boat on the Neches River with Mark Chesnutt, Country and Western performer, who appeared as part of the entertainment on Saturday. -000- Mayor Lord announced than an Executive Session will be conducted in -182- July 30, 1991 accordance with Section 2 (e) of the Texas Open Meetings Act to discuss pending or contemplated litigation: J. G. Coward, Jr. , et al v. Spencer Francoise, et al and Excavators & Constructors, Inc. v. The City of Beaumont and Section 2 (g) to discuss the Department of Labor concerning overtime provisions for civilian employees before conducting the Workshop Session to be held in the Council Chambers. -000- There being no further business, the Regular Session of City Council was adjourned to reconvene in Executive Session and then in Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held July 30, 1991.
