BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 30th day of October, 1990, with the following present: HONORABLE: Evelyn M. Lord Mayor Andrew P. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend Edward Simon, East Mount Olive Baptist Church. The Pledge of Allegiance was led by City Attorney Lane Nichols. -000- Mayor Lord bid farewell to Mr. Nick Toparcean, Building Codes Supervisor, and extended best wishes for success and happiness in his recent decision to accept a position with the City of Houston as Housing Code Administrator. -000- Citizen comment was invited on the Consent Agenda and Main Agenda Items one (1) through five (5) . No one wished to address these items. -000- At the request of Mayor Pro Tem Cokinos, Item D accepting a right-of- way easement for Homer Drive was removed from the Consent Agenda for further discussion. The following Consent Agenda items were considered: Approval of the Minutes of the Regular Session of City Council conducted October 23, 1990: -373- October ,30, 1990 Resolution No. 90-244 authorizing Parkdale Bank - Beaumont to pledge $100, 000. 00 in securities (U. S. Treasury Note, due 12/31/91, Receipt No. CUSIP 912827YH9) to Federal Reserve Bank - Dallas/Houston Branch effective October 30, 1990 and release $100, 000. 00 in securities (U. S. Treasury Note, due 11/30/90, Receipt No. CUSIP 912827WX6) with Federal Reserve Bank - Dallas/Houston Branch effective October 30, 1990; and Resolution No. 90-245 accepting the dedication of a 20-foot wide drainage and utility easement, situated about 1150 feet west of Avenue Bellechase and extending northward from Delaware for a distance of about 1, 560 feet, from the Phoenix Company, developers of Bellechase Addition. The Consent Agenda was approved on a motion made by Councilman Moore and seconded by Mayor Pro Tem Cokinos. Question: Ayes: All Nayes: None -000- October 30, 1990 After a short discussion, Resolution No. 90-246 accepting a 30-foot-wide by 633 . 38-foot-wide easement for the Homer Drive right-of-way out of the J. S. Marble Survey and the William Dyches Survey from the Beaumont Independent School District was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Resolution No. 90-247 authorizing purchase of an education network personal computer system (one IBM 16 Mhz 80386SX PS/2 Model 65SX file server and four IBM 8 Mhz 8086 PS/2 Model 25 workstations; one IBM Classroom LAN Administration System 1.2, one Novell Netware 2 . 15, one each of IBM Reading for Meaning Level 1, Level 2, Level 3, and Level 4, one IBM Primary Editor Plus, one IBM Touch Typing for Beginners and one IBM Reading for Information Level 2 software packages) from International Business Machines, Inc. , of Beaumont, in the amount of $16,837 . 00 (from the resources of the Community Foundation Fund established by former City Councilman Michael Brumley with money he would have received as Councilman and upon his resignation requested the fund finance the adult literacy training program) was approved on a motion made by Councilman Moore and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Ordinance No. 90-66 adopting an updated service credit for employees' retirement benefits offered by the Texas Municipal Retirement System by advancing the base by one year to the period from January 1, 1987 through December 31, 1989, effective January 1, 1990, was considered: -374- October 30, 1990 ORDINANCE NO. 90-66 AN ORDINANCE AUTHORIZING AND ALLOWING, UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL RETIREMENT SYSTEM, "UPDATED SERVICE CREDITS" IN SAID SYSTEM FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM WHO PRESENTLY ARE IN THE EMPLOYMENT OF THE CITY OF BEAUMONT; AND ESTABLISHING AN EFFECTIVE DATE FOR SUCH ACTIONS. Ordinance No. 90-66 was approved on a motion made by Councilman Smith and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 90-248 awarding a contract for furnishing and installing an automated fuel dispensing system at the fueling sites located at the Fleet Center and the Streets and Drainage Facility on Concord Road to Sumney Pump Service of Beaumont, in the amount of $37,562 . 00 was approved on a motion made by Councilman Alter and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 90-249 authorizing purchase of equipment (22 Discriminator Modules, 34 Detectors, 19 Card Racks, and 5, 000 feet of Cable) necessary to expand the Opticom traffic signal control system which gives the green light to emergency vehicles approaching an intersection for 17 more intersections (College and Twenty-Third, College and Lindberg, College and Langham, Eleventh and Blanchette, Eleventh and Stagg, North and Eleventh, Eleventh and Interstate 10, Delaware and Eleventh, North and Seventh, College and Orleans, Phelan and Major, Washington and Houston, Washington and Park, Washington and Avenue Al Washington and Irving, College and Avenue C, and College and Eighth) from Consolidate Traffic Controls of Arlington, Texas, in the amount of $51, 290. 00 was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 90-250 accepting bids for fourteen (14) laser printers and personal computers with a one year on-site maintenance agreement (HP Laser Jet III or equivalent, $1,599; 286/40 12 Mhz with monochrome monitor, $1, 025; 286/40 12 Mhz with color monitor, $1,400; 386/40 16 Mhz with monochrome monitor, $1, 475; 386/40 16 Mhz with color monitor, $1, 850; 386/100 33 Mhz with color monitor, $4,200; and 486/100 25 Mhz -375- October 30, 1990 with color monitor at $5,450) from Seabrook Computer of Nederland, a C1607A font cartridge, $144.41 and a C1608A two meg buffer cartridge at $635. 18 from ABM, Inc. of Doraville, Georgia, and a HP Paint-jet XL color printer at $1,589, including manufacturer's warranty, from GA Computer of Webster, New York, was approved on a motion made by Councilman Goodson and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Mayor Lord announced an Executive Session to be conducted at the close of the Workshop Session in accordance with Section 2 (e) of the Texas Open Meetings Act to discuss pending or contemplated litigation: Baytown Construction Co. , et al vs the City of Beaumont, et al. -000- A public hearing was called to consider the eight (8) below listed structures found to be in violation of the City of Beaumont's Dangerous Structure Ordinance, Article III, Section 14-50: 775 Avenue A - Victoria Mortgage Company, owner (21 violations) , Staff recommendation to raze or repair within 30 days; 1771 Herring Alley - Joe Rocio, owner (21 violations) , Staff recommendation to raze within 30 days; 992 M. L. King Parkway North and 972 M. L. King Parkway North - James Weaver, owner (21 violations each structure) , Staff recommendation to raze each structure within 30 days; 185 Fletcher - Faye R. Richardson, owner (26 violations, Staff recommendation to raze within 30 days; 2131 Pope - First National Security Corporations, owner (10 violations) , Staff recommendation to raze or repair within 30 days; 1875 Forsythe - Martin Medina Padilla, Jr. , owner (21 violations) , Staff recommendation to raze or repair within 30 days; and 3160 Highland - Dan Sims, Sr. , owner (20 violations) , Staff recommendation to raze within 30 days. These parcels of property have been inspected, are vacant, and found to be in violation of Article III, Section 14-50 of the Code of Ordinances. Notices have been sent to owners by Certified Mail and published in the Beaumont Enterprise. The twenty-two (22) structures listed below have been condemned by City Council and the owners ordered to either raze or repair them within specified time frames. Reinspection of these structures have revealed non-compliance with the Council 's order. The Public Safety Department is requesting authorization from City Council to demolish these structures in accordance with the Dangerous Structure Ordinance and charge the property owners with the cost of demolition. 1975 Ashley, 745 Avenue D, 745 Avenue D (garage apt. ), 2289 Broadway, 1748 Delaware, 4190 Harding, 1270 Harriot, 2125 Hebert, 2405 Hegele, 2695 Houston, 2695 Houston (rear), 3955 Inez, 890 Jackson, 235 Manning, -376- October 30, 1990 1364 Orange, 2805 Orange, 1990 Pine, 2307 Pope, 4155 Pradice, 3755 Preston, 5375 Sunset (garage), and 1513 Victoria. There being no one desiring to address Council, the public hearing was closed. Mr. Nick Toparcean, Building Codes Supervisor, asked that two structures be removed from Section 1: 2131 Pope, the owner has established a work program and 3160 Highland, the structure has been demolished. Mr. Toparcean asked that one structure be removed from Section 4: 1270 Harriott, the property owner has established a work program for renovation. ORDINANCE NO. 90-67 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. Ordinance No. 90-67 was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Councilman Alter said he enjoyed attending the very educational Texas Municipal League Convention in Corpus Christi and everywhere he went people who recognized Beaumont knew Fire Chief Pete Shelton and had good things to say about him. Councilman Alter congratulated Joe Bob Kinsel as outgoing leader for the Chamber of Commerce and Jim Yarbrough for assuming the leadership role, congratulated Richard LeBlanc and Ed Moore in working with the Chamber and the Federal government in bringing the 2, 750 bed prison, "an absolute recession-proof industry, " to Beaumont. Councilman Moore told Mr. Nick Toparcean that it has been a pleasure working with him and feels that he has been very instrumental in the efforts in the Southend of Beaumont with SCUP as well as in the Northend. He said that Mr. Toparcean demonstrated a great deal of dedication and expressed a desire that his replacement would take the job as seriously as Mr. Toparcean and have an equal impact throughout the city. Councilman Smith and Mayor Pro Tem Cokinos added their expressions of appreciation and wishes for success to Mr. Toparcean. MAYOR LORD: (in response to Council comments) Isn't it nice to quit while you're ahead? MR. TOPARCEAN• If I may, Mayor and Council, I 'd like to express. . .the ten years that -377- October 30, 1990 I 've been with the City of Beaumont, it's been a major learning experience for me, and I can remember from my first days until now. And, it's been a pleasure working with all of you. It's been a pleasure to call Beaumont my home and to choose this location to raise my family. I intend to stay in Beaumont as long as I can, but inevitably I will have to probably relocate, but I will be coming back because I have family here and I ' ll take account of all these dilapidated buildings! I 'm not going to let my work go undone, okay. But, thank you again. Mayor Lord again reminded everyone of the covered dish dinner and meeting of the Moccasin Exchange Program at 7:00 p.m. this evening in the Employee Lounge at City Hall. -000- Mrs. Delia Harrington, 815 Willow Street, addressed Council regarding fireants in the "Welcome to Beaumont Park" and reported the remainder of a post from a newspaper receptacle no longer in use is creating a safety hazard near the corner of Calder and Willow. (Mrs. Harrington was informed that the Parks Department would be notified of the fireants and the situation at Calder and Willow would be investigated. ) Mr. Forrest F. "Ted" Posey, 3695 Edmonds, again addressed Council to discuss the need for additional bus transportation in Beaumont. Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council to add his support for cleanup efforts in Beaumont. Mr. Samuel Wicks, a homeless gentleman, addressed Council to discuss the possibility of formulating a plan to hire the homeless to work for the various agencies and non-profit organizations that assist the homeless. Mr. Wicks suggested a percentage of their salary could be returned to the agencies for continuation of the program with the individual receiving the remainder to establish a home and become self-sufficient. Mayor Lord told Mr. Wicks that he presented food for thought, commended him for his desire to work, and thanked him for addressing Council. -000- There being no other business, the meeting was recessed before continuing with the Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held October 30, 1990. Rosemarie Chiappetta City Clerk -378- October 30, 1990 EXCERPT FROM BEAUMONT, TEXAS, CITY COUNCIL WORKSHOP SESSION HELD OCTOBER 30, 1990 (Workshop discussion in progress when tape started) COUNCILMAN GUY GOODSON, WARD II: . . . numbers about the breakout of minority population and everything, so because it did satisfy a lot of concerns, but I would prefer to have everybody here if possible before we move. MAYOR PRO TEM ANDREW COKINOS: I like the idea too as a matter of fair play because Audwin's (Audwin Samuel, Councilman, Ward III) not here for his input and his . . . . . . COUNCILMAN GOODSON: Well, one of the alternatives does result in a change of a precinct between these two that we are looking at right now in his . . . and. I would hate not to get his thoughts about what effect that has on him. COUNCILMAN DAVID MOORE. WARD IV: And, Ray, really truly Guy's already stated about I 's (Ward I) as well and I appreciate the response in packaging this and it kind of makes the I guess you might say the negotiations we put forward a little bit more amicable for everyone, simply because it doesn't really effect the balance that we are trying to keep in the two districts. The fact that it's well over . . . well, it's over 60% and that's a major concern and it's also a concern in our communities but in an effort to completely digest this as well as those persons here for discussions I ask that we defer this one week MAYOR EVELYN LORD: Lu, do you have any problem with that? MAYOR PRO TEM COKINOS: We don't need a motion on that . . .? MAYOR LORD: No, we don't need any motion and we all feel . . because we are concerned with the minority representation, we certainly would like-a lot of leadership coming from our minority members of Council.
