BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 2nd day of October, 1990, with the following present: HONORABLE: Evelyn M. Lord Mayor Andrew P. City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by Mayor Pro Tem Cokinos. The Pledge of Allegiance was led by Councilman Alter. -000- Three Proclamations were issued: "Physical Therapy Week, " September 30, 1990 - October 6, 1990; "National Quality Month, " October, 1990; and "First City, Texas School Savings Day, " October 4, 1990. -000- Public comment was invited on the Consent and Main Agenda. No one wished to address these items. -000- The following Consent Agenda items were considered: Approval of the Minutes of the Regular Session of City Council conducted September 25, 1990; Resolution No. 90-216 appointing Clifford Levias to the Clean Community Commission for a term expiring September 30, 1991; Gaylyn Cooper, Chairman, and William F. Jones, Vice Chairman, of the Housing Rehabilitation Loan Board with terms expiring May 31, 1991; and Bonnie -249- October 2, 1990 Cokinos and Martha Reed to the Convention and Tourism Advisory Board for terms expiring July 31, 1993 ; and Resolution No. 90-217 authorizing purchase of an annual supply of 440, 000 mailing envelopes for bills imprinted with carrier route designations at a cost of $4,963.20, 60,000 mailing envelopes without carrier route designations at a cost of $676. 80, and 500,000 return envelopes to be sent with the bills at a cost of $5, 540 for a total of $11, 180. 00 from Westvaco of Houston to be used in the Water Utilities Department/Customer Service Division for monthly billings of water service statements. The Consent Agenda was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 90-218 accepting the work performed under contract by H. B. Neild and Sons, Inc. for restoration of the Tyrrell Historical Library for a completed cost of $1, 614,757.25, authorizing Change Order No. 3 for a deduction of $55,467. 16 (elimination of some library furnishings and equipment, landscaping, a plaque and room identification signage) , and authorizing final payment in the amount of $83,504 . 10 was approved on a motion made by Councilman Alter and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Ordinance No. 90-59 defining the term "Police Department" as sworn and certified police personnel to resolve a problem for the Texas Municipal Retirement System involving contributions to the employees retirement fund as provided in Ordinance No. 69-89 (Civilian employees contribute 5% of their salary for retirement and Police personnel contribute 7% because they are not covered by Social Security) was considered: ORDINANCE NO. 90-59 ENTITLED AN ORDINANCE DEFINING THE TERM "POLICE DEPARTMENT" FOR PURPOSES OF THE MUNICIPAL RETIREMENT SYSTEM; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. Ordinance No. 90-59 was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- -250- October 2, 1990 Resolution No. 90-219 awarding an annual contract for mowing privately- owned developed property to Perricone Specialties Lawn Care at $3 . 19 per 1, 000 square feet and $1. 50 per 1, 000 square feet for removal and disposal of grass clippings and to Ace Clark Construction Company for mowing undeveloped property at $2. 00 per 1, 000 square feet and $2 . 50 per 1, 000 square feet for removal and disposal of grass clippings, as may be required by the Environmental Health Division, for a combined total of both contracts based on estimates of the year' s requirements at $23,756.40, was approved on a motion made by Councilman Alter and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution No. 90-220 authorizing purchase of stop-loss coverage for the employee health care insurance plan at a reinsurance rate of $3 . 33 per month, per employee, and $4. 11 per dependent, per month, with $150, 000 deductible, basic life insurance at $.23 per $1, 000 of coverage, and accidental death and dismemberment at $. 06 per $1, 000 of coverage from John Alden Risk Management Services was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Resolution No. 90-221 authorizing purchase of date processing equipment consisting of one 850-megabyte direct-access disk storage facility ($13, 657) , one 16 MB main storage facility ($18, 000) , one 8 MB main storage facility ($9, 000) and one two-line communication subsystem ($4, 650) from International Business Machines, Inc. for a total of $45, 307. 00, in order to increase memory capacity, operating speed, and to connect the Police Department' s AS/400 to the AS/400 in City Hall, was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 90-222 authorizing Change Order No. 1 in the amount of $239, 026. 00 (for 2, 040 SY Flexible Base, $57. 00 per unit, $116,280-- 1,400 SY Concrete Base, $75.59 per unit, $105,826.00--940 LF Curb & Gutter, $18. 00 unit price, $16,920. 00) , increasing the total amount to $1, 465, 212 .85 to the contract with Cutler Repaving, Inc. to provide for the additional work found to be necessary to replace larger areas of streets than originally anticipated because of underlying conditions and for satisfactory performance of the contract for the recycling and repaving of asphalt streets under the 1990 Major Street Rehabilitation Program was approved on a motion made by Councilman Smith and seconded by Councilman Moore. Question: Ayes: All Nayes: None -251- October 2, 1990 Resolution No. 90-223 authorizing Change Order No. 1 in the amount of $190,418. 00 to the contract with Bo-Mac Contractors, Inc. to take advantage of a low price for more substantial and durable reconstruction by using asphalt stabilization at $5.86 per square yard instead of limestone (an increase of $3 .06 per square yard) on Helbig Road, Washington Boulevard, and Old Dowlen Road as part of the street reconstruction in the 1990 Major Street Rehabilitation Program was approved on a motion made by Councilman Moore and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Mayor Lord welcomed David Bauerlein, a reporter from the Beaumont Enterprise, who will be covering the news from City Hall. -000- Mayor Lord expressed delight in her recent trip to Buenos Aires, Argentina, and said she had a very interesting, hard-working, challenging, and fun ten days. She said she learned much about the Argentinians, including their lack of punctuality in arriving at functions. Most events start two hours late because of the custom that the more important one is, the later he arrives. Mayor Lord thanked Councilmembers who filled in for her during her absence. Councilman Smith thanked the Convention and Visitors Bureau, Claudie Hawkins, the manager of Convention Facilities, and her staff for their support of the Health Fair held last weekend and Chief Shelton for the loan of an old fire engine, which the children enjoyed immensely. Councilman Smith also said the party for the Desert Shield servicemen at Riverfront Park was very successful and contributed to a fun-filled weekend and reminded everyone of the debut performance of Lamar concerts at Julie Rogers Theatre tonight. Councilman Moore explained that he was out of town until Sunday evening, but immediately heard good reports of the party at Riverfront Park for the servicemen and reported that the play Diary of Black Men by Thomas Meloncon presented this past Sunday evening at the Julie Rogers Theatre was excellent and had over eight hundred in attendance. Mayor Pro Tem Cokinos congratulated Viet Nam Veterans of Southeast Texas, Chapter 292, for preparing barbecue for the Desert Shield servicemen, added thanks to the Parks and Recreation Division, especially Luke Jackson and Lou Cappy, for assistance in planning the party and said it was great and well attended and announced the "Taste of the Triangle" will begin at 6: 30 p.m. tonight at the Civic Center. Councilman Alter added the party was wonderful, was well attended by both citizens and the soldiers. He said there were many soldiers there in uniform, but many out of uniform because they are on reserve duty and could dress in civilian clothing. Councilman Alter expressed his -252- October 2, 1990 appreciation for the possibility of Cargill Steel and Wire Co. of Dallas acquiring the vacant NL Shaffer Tool property at Cedar Street and Avenue A with the prospect of providing hundreds of jobs, said the Beaumont State Center is holding their Volunteer Appreciation Dinner this evening and personally thanked the volunteers, reminded citizens that the voter registration deadline for the November election is near, announced that the first annual Babe Zaharias Award will be presented December 5th and tickets should be purchased early, and thanked the soldiers for participating in school activities with the students. He said Anthony Jauregui, pictured on the front page of the Beaumont Enterprise, October 1, is visiting a number of school in uniform and speaking with children. Councilman Goodson mentioned he recently attended a mentor orientation for the Julie and Ben Rogers' "I Have a Dream Program" through the Beaumont Independent School District and Lamar University. Because of the hard work of the Rogers family and BISD, this year there are more mentors than students that have signed up. He expressed excitement for the program and prospects of great success and an outstanding year. Mayor Lord added that she has enjoyed the learning experience for her while she has served this past year as mentor for a child with the "I Have a Dream Program, " said she rearranged flight plans to return home in time to attend a meeting unveiling another economic prospect for Beaumont, reported the feedback to her in the few hours she has been home about the Desert Shield party is tremendous and lauds the camaraderie of the community and the servicemen, and said to her surprise she spoke more French in Argentina than Spanish because several times she was in the company of guests from Guiana who spoke French only. -000- Mr. Ben Rogers, 2030 Thomas Road, expressed his delight in the reception and indoctrination of students for the "I Have A Dream Program" conducted last night with the original 75 students, their mentors, the new 75 students and mentors, parents and contributors, totaling over 500 people. He said it was a great evening and very exciting. Mr. Rogers commended Council for joining with business in redeveloping the downtown area and other parts of the city, especially with the Stedman Building and the Crockett Station and presented three challenges to Council: 1. become involved with the King Edward Hotel property; set a deadline and develop a viable use for the building; 2: address the parking meters--consider removal of meters except possibly in front of municipal buildings, establish no parking zones until after 10: 00 a.m. and thereafter limit two hours of free parking; and 3 : without an increase of personnel and budget, request the Police Chief to schedule two Police Officers to walk a downtown beat during the noon hour and from 4 :30 p.m. to 6:00 p.m. Mrs. Justine Tinkle, 7135 Concord, representing Larry's Antique Mall distributed an invitation to Council from dealers at the mall to attend -253- October 2, 1990 "Old Time Trade Day" next weekend and asked Council to consider their submission of a zone application for Larry's Antique Mall. Mr. Robert Preston, 1190 Iowa, presented a rock as an exhibit, approximately three inches in diameter, to the City Clerk and addressed Council to relay an incident he said happened on September 23, 1990, involving that rock and pieces of cinderblock being thrown at him while standing in his yard. In response to a telehone call to the Police Department about the incident, he said they dispatched an officer. Mr. Preston played for Council a portion of a cassette tape he claims to be from a scanner monitoring Beaumont Police Department traffic. He complained about the treatment of his call for assistance and conduct by the Police Department. Mr. Preston also discussed the Texas Open Meetings Act and the Civil Service Commission. Mr. Forrest F. "Ted" Posey, 3695 Edmonds, again addressed Council to ask that consideration be given to providing bus transportation on Sunday for those desiring to attend church and other civic activities because of the increase in gasoline prices that prohibit some people from driving their automobiles. Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council in support of the "I Have a Dream Program, " the Desert Shield party at Riverfront Park and the Health Fair. -000- There being no other business, the meeting was recessed before continuing with the Workshop session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council session held October 2, 1990.
