BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 3rd day of April, 1990, with the following present: HONORABLE: Bob Lee, Jr. Mayor Pro Tem Councilman At Large Andrew P. Cokinos Councilman At Large Lulu L. Smith Councilman, Ward I Michael Brumley Councilman, Ward II Audwin Samuel Councilman, Ward III David W. Moore Councilman, Ward IV Absent: Maurice Meyers Mayor Ray A. Riley City Manager Tyrone Cooper Asst. City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend Dan Dark, Westwood Bible Church. The Pledge of Allegiance was led by Councilman Brumley -000- Four Proclamations were issued: "Love Lamar Week, " April 2-7,1990; "Academic Bowl Day, " April 4, 1990; "National Gardening Week, " April 8- 14, 1990; and "Fair Housing Month, " April, 1990. -000- Citizen comment was invited on the Consent and Main Agenda. No one wished to address these items. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held March 27, 1990; Resolution No. 90-56 appointing Lillie M. Scourton to the Library Commission for a term expiring October 31, 1991; and -85- April 3 , 1990 Resolution No. 90-57 accepting the donation of a 13-foot-wide storm sewer easement and a temporary 20-foot working easement from Dr. Jerry D. Clark to provide for relocation of a 24-inch line approximately 15 feet north of the present location which crosses under a corner of the residence at 1495 Futura, described at Lot 11, Block 18, Tangledahl Addition, and abandon the original easements. The Consent Agenda was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 90-58 authorizing execution of an agreement to the terms and conditions of a $2, 367, 000 Financial Assistance Award from the Economic Development Administration, sought originally as part of the financing for the proposed Spindletop Waterpark on Cardinal Drive, to a more general designation to be known as the Spindletop Regional Development Project to consider a wider variety of proposals for development of the 44.764-acre tract due to the failure of developer John Bartolomei of Niagara Falls, New York, to meet time limits which called for the waterpark opening in April, 1988, was approved on a motion made by Councilman Brumley and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution No. 90-59 authorizing an Interlocal Agreement with Drainage District 6 to equally share costs for construction of the Cartwright Relief Project (in vicinity of Cartwright and Eighth Streets) , consisting of a box culvert and ditch system to relieve the existing Cartwright box system and divert some of the storm water overload to the Terrell Street outfall, at an estimated cost of $200, 000, and the North Circuit Drive Bridge Project (in vicinity of North Circuit Drive and Sallie Curtis School) , which would raise the elevation of an existing bridge to allow the unrestricted flow of some waters down Hillebrandt Bayou, at an estimated cost of $190, 000, was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Ordinance No. 90-23 amending Ordinance No. 90-8 calling the May 5, 1990, General Election to add five (5) more precincts due to a vacancy created by the resignation of the District II Trustee for a total of eighteen (18) to be used jointly for the election of three (3) Trustees for the Beaumont Independent School District election was considered: -86- April 3, 1990 ORDINANCE NO. 90-23 ENTITLED AN ORDINANCE AMENDING ORDINANCE NO. 90-8 WHICH CALLED A GENERAL ELECTION TO BE HELD IN THE CITY OF BEAUMONT ON THE 5TH DAY OF MAY, 1990, TO AMEND TERMS OF THE JOINT ELECTION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. Ordinance No. 90-23 was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Councilman Smith extended an invitation to attend the second "Sunday in the Park" on April 8, beginning at 2 : 00 p.m. and enjoy all the fun and activities planned around a Cajun crawfish theme. Councilman Moore related that he recently witnessed one of the public buses stopped for an extended period of time, and upon investigation discovered that the driver, Elmo Braxton, had alertly stopped the bus when he observed a passenger suffering a mild stroke and called the Emergency Medical Service who arrived in minutes. Captain Ellery B. Bowers, Dan Marberry, Stephen Ayers, and Jose Gonzales administered aid to the passenger and quickly transported him to the hospital. Councilman Moore complimented the keen observation of the bus driver and efficiency of the Fire Department and EMS crew. -000- Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council on various festivals in the area and expressed gratitude for drug education and recent drug raids. Mrs. Phyllis Finch, 2060 Edson Drive, addressed Council about a problem regarding citizens sweeping leaves and grass clippings into storm sewer drains and encouraged enactment and enforcement of an ordinance to eliminate this occurrence.
