BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 13th day of March, 1990, with the following present: HONORABLE: Maurice Meyers Mayor Andrew P. City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend Jim Duffy, Crestview Baptist Church. The Pledge of Allegiance was led by seven (7) Cub Scouts from Troop 222 . (The Scouts participated throughout the Council session by answering various questions pertaining to the business agenda posed by Councilman Samuel. ) -000- Mayor recognized the presence of the BUILD organization in the meeting and asked Mr. Bruce Irvine, past president, to introduce the new president. MR. BRUCE IRVINE: It' s a pleasure to introduce our new Executive Director Barry Long. As you may know, our former director was transferred back to Albuquerque with her husband, and so we searched and were able to entice Barry to become our leader. Barry has been in the area for almost sixteen (16) years. He's the former plant superintendent of the Bethlehem Steel Shipyard, has been active in the Goals for Beaumont program in the past, and in other community activities. We're very proud to have him on board, and it's a pleasure to be able to introduce you to him today. -61- March 13, 1990 MAYOR MEYERS• Thank you, Barry. Welcome, pleased to have you, and particularly pleased that you've accepted that position. MR. BARRY LONG: Thank you, and I 'm very, very pleased to have an opportunity to continue in Beaumont and to help you, all of you, make this city grow and prosper. Thank you, sir. MAYOR MEYERS• Would you, Bruce, introduce some of the other folks with you from the BUILD Board? BRUCE IRVINE• Other members. . .James Striedell, Arden Loughmiller, Paul Adams, Tom Bell, Barry's wife, Audrey, and down there is Kirt Anderson, and I think that's it. We had a Press Conference down at the Riverfront Park today to introduce Barry. . . MAYOR MEYERS• Thank you. Barry, we're pleased that you're back; pleased that you're heading up the organization. For the benefit of those in the audience, BUILD is an organization dedicated to the activities and continued growth and development of our Central Business District. They have an active group for volunteers that participate in many ways, and I think now with Barry's leadership, they can continue that act of participation, and we're pleased to have you here today, Barry. Thank you very much. -000- Five Proclamations were issued: "Mental Retardation Month, " March, 1990; "Beaumont Recreational Vehicle Week, " March 16-23, 1990; "Red Cross Month, " March, 1990; "Project Re-Start Employers Appreciation Week, " March 11-17, 1990; and "National Nutrition Month, " March, 1990. -000- Citizen comment was invited on the Consent and Main Agendas. No one wished to address these items. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held February 27, 1990; -62- March 13 , 1990 Resolution No. 90-37 authorizing acquisition of Parcel 155, consisting of 0. 080 of an acre of land on the southeast corner of Major Drive out of the Hezekiah Williams Survey, Abstract 56, from Mr. and Mrs. Rex Gene White for the appraised value of $4,468. 00 and Parcel 148, consisting of 0. 172 of an acre on the west side of Major Drive about 160 feet north of White Road out of the A. Huston Survey, Abstract 33,, from B. E. Sloane for the appraised value of $3 ,415. 00 for the widening and improvement of Major Drive; Resolution No. 90-38 authorizing a contract for furnishing and maintaining 125 street barricades for a one-year period to be used by the Streets and Drainage Division (75) and the Water Utilities Department (50) with D & S Sign and Supply, Inc. for $. 33 per barricade per day for a total of $15, 056.25; Resolution No. 90-39 authorizing purchase of a small, rubber-track hoe excavator for the Sewer Maintenance Division for use in repairing sewer lines in narrow spaces in backyards and alleys from Eastex Farm and Home of Beaumont for $24, 635. 00; and Resolution No. 90-40 authorizing Ray A. Riley, city manager, Walter Thomas, controller, and Kandy Daniel, treasurer, as authorized signatories for banking and investments effective March 13 , 1990, and requiring two signatures on every item. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution No. 90-41 authorizing an annual contract with APAC-Texas, Inc. for furnishing cement stabilized flexible base material at $14.50 per ton loaded on City trucks at the vendor's plant--an anticipated total expenditure of $43,500 for approximately 3 , 000 tons to be used this year--by the Streets and Drainage Division for subbase stabilization when replacing drainage pipes in driveways and pouring concrete slabs was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Ordinance No. 90-16 amending the Mechanical Code to reflect recommendations of the Plumbing and Mechanical Board of Review which include changes in permit timing and posting regulations, rewording sections for clarification, addressing flexible duct installation, electrical connections and disconnecting means for existing construction was considered: -63- March 13, 1990 ORDINANCE NO. 90-16 ENTITLED AN ORDINANCE REPEALING CHAPTER 6, SECTION 6-171 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT AND ENACTING A NEW SECTION 6- 171 CONCERNING AMENDMENTS TO THE 1988 EDITION OF THE STANDARD MECHANICAL CODE. Ordinance No. 90-16 was approved on a motion made by Councilman Samuel and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 90-42 authorizing purchase of a 1,500-gallons-per-minute pump truck for the Fire Department from Kovatch Mobile Equipment Corporation of Nesquehoning, PA. , in the amount of $236,992 was approved on a motion made by Councilman Cokinos and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- The first reading of an ordinance granting an amended franchise to Browning Ferris Industries, Inc. (BFI) for a commercial garbage collection service was held: ORDINANCE No. ENTITLED AN ORDINANCE GRANTING A FRANCHISE TO BROWNING FERRIS INDUSTRIES TO OPERATE A SOLID WASTE COLLECTION AND TRANSPORTATION SERVICE IN THE CITY OF BEAUMONT; PROVIDING THE TERMS, CONDITIONS, OBLIGATIONS AND LIMITATION OF SUCH SERVICE; PROVIDING INDEMNITY TO THE CITY; RETAINING AUTHORITY TO REGULATE RATES; PROVIDING FOR FRANCHISE PAYMENTS AND PROVIDING FOR SEVERABILITY. An ordinance granting an amended franchise to Browning Ferris Industries, Inc. for a commercial garbage collection service was passed to its second reading on a motion made by Councilman Samuel and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- The first reading of an ordinance granting an amended franchise to REM Waste Control, Inc. for a commercial garbage collection service was held -64- March 13, 1990 ORDINANCE NO. ENTITLED AN ORDINANCE GRANTING A FRANCHISE TO REM WASTE CONTROL, INC. TO OPERATE A SOLID WASTE COLLECTION AND TRANSPORTATION SERVICE IN THE CITY OF BEAUMONT; PROVIDING THE TERMS, CONDITIONS, OBLIGATIONS AND LIMITATION OF SUCH SERVICE; PROVIDING INDEMNITY TO THE CITY; RETAINING AUTHORITY TO REGULATE RATES; PROVIDING FOR FRANCHISE PAYMENTS AND PROVIDING FOR SEVERABILITY. ENTITLED AN ORDINANCE GRANTING A FRANCHISE TO WASTE MANAGEMENT - GOLDEN TRIANGLE TO OPERATE A SOLID WASTE COLLECTION AND TRANSPORTATION SERVICE IN THE CITY OF BEAUMONT; PROVIDING THE TERMS, CONDITIONS, OBLIGATIONS, AND LIMITATION OF SUCH SERVICE; PROVIDING INDEMNITY TO THE CITY; RETAINING AUTHORITY TO REGULATE RATES; PROVIDING FOR FRANCHISE PAYMENTS AND PROVIDING FOR SEVERABILITY. An ordinance granting an amended franchise to Waste Management - Golden Triangle for a commercial container garbage collection service was passed to its second reading on a motion made by Councilman Smith and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- Councilman Brumley expressed disappointment in missing the first "Sunday in the Park" event by being out of town, encouraged everyone to vote today, and wished Mayor Meyers well in his race for nomination in the Congressional Primary. Councilman Moore complimented the "Sunday in the Park" activities and said everyone had a good time. -65- March 13, 1990 Councilman Samuel reported he has been contacted by Mr. Lewis Darjean, 2320 Overbrook, expressing concern about a bus stop at Overbrook and Arthur. Councilman Samuel also reported that residents on Bigner Road have contacted him regarding noise disturbance caused by dump trucks going to the sand pit and asked for help with the problem. Councilman Smith said everyone had a marvelous time at "Sunday in the Park, " and announced that with the new format, "Sunday in the Park" will be held the second Sunday of each month. She commended Mayor Meyers for the novel approach of telling the story with an animated dog. Mayor Meyers explained that "Hector the Dog" was played by a friend and gave opportunity for audience involvement. One little girl became totally enamored with Hector and became a non-planned participant who added to the success of the story by becoming so involved with Hector. Mayor Meyers said "Sunday in the Park" has found its place in the community and something to which many people look forward. -000- Mr. Bob Andrews, 7630 San Carlos, again addressed Council regarding wheelchair bound citizens needing public transportation to attend church on Sunday. Mr. Andrews was instructed to meet with the Transit Advisory Committee and procedurally approach the problem with them. As a group, then suggestions or solutions can be brought forward to Council. Mr. Thomas McDonald, Minneapolis, Minnesota, addressed Council about the legality of displaying a sign asking for work in return for food. Mr. McDonald was advised to meet with Assistant City Attorney Tyrone Cooper following the Council meeting. -000- Mayor Meyers announced that at the close of the Workshop Session an Executive Session will be conducted in accordance with Section 2 (e) of the Texas Open Meetings Act to discuss pending or contemplative litigation. -000- There being no further business, the meeting was recessed before continuing with the Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held March 13, 1990.
