BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 8th day of August, 1989, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Mayor Pro Tem Councilman At Large Andrew P. Cokinos Councilman At Large Lulu L. Smith Councilman, Ward I Audwin Samuel Councilman, Ward III Absent: Michael Brumley Councilman, Ward II David W. Moore Councilman, Ward IV Ray A. Riley City Manager Rosemarie Chiappetta City Clerk Tyrone Cooper Asst. City Attorney -000- The Invocation was given by the Reverend Albert Tibbs, pastor at Starlight Baptist Church. The Pledge of Allegiance was led by Mayor Meyers. -000- Mayor Meyers welcomed Mr. Riley Juneau, president of Juneau' s Fine Furniture, Inc. , as a new businessman in Beaumont. They have recently expanded their business of sixty years in Mid-County to include opening Juneau' s Pennsylvania House at Parkdale Plaza on Dowlen Road. Mr. Juneau introduced his son, Robert Juneau, and Scott Smith, manager of the new business, stated they couldn' t resist the opportunity Beaumont offered, and expressed appreciation for the cooperation they've received. Mr. Robert Juneau said they look forward to serving the community and helping people with their furniture needs. Mr. Scott Smith stated he is "very proud to be a part of the Juneau organization and a part of the Beaumont community. " Councilman Smith expressed wishes for success at the new facility, thanked Mr. Juneau for a marvelous tour of the store and the privilege of officiating at the ribbon-cutting ceremony, and voiced admiration for his enthusiasm in this venture. -210- August 8, 1989 Citizen comment was invited on the Consent and Main Agenda. No one wished to address Council on these items. -000- The following Consent Agenda item was considered: Approval of the Minutes of the regular City Council session held August 1, 1989. The Consent Agenda was approved on a motion made by Councilman Lee and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Ordinance No. 89-56 amending Section 26-23 of the Code of Ordinance by extending the 35-mile-per-hour speed limit on the south frontage road of Interstate 10 East from Pine to Miller Street, extending the 40- mile-per-hour speed limit on the north frontage road to a point 150 feet west of the centerline of 11th Street to fill a gap in current speed limits, and correcting the description for the 40-mile-per-hour speed limit on the east frontage road from a point 697 feet east to read west of the center line of 11th Street to a point 564 feet southeast of the center line of Washington Boulevard was considered: ORDINANCE NO. 89-56 ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ESTABLISH MAXIMUM AND MINIMUM SPEEDS IN CERTAIN ZONES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No. 89-56 was approved on a motion made by Councilman Lee and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Ordinance No. 89-57 amending Section 26-23 of the Code of Ordinances reducing the speed limit from 45-miles-per-hour to 40-miles-per-hour on Washington Boulevard from a point 600 feet west of the center line of Burbank Street to a point 90 feet east of the center line of Major Drive in the vicinity of Glendale Street to conform to traffic changes resulting from recent residential development was considered: ORDINANCE NO. 89-57 ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ESTABLISH MAXIMUM AND MINIMUM SPEEDS IN CERTAIN ZONES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. -211- August 8, 1989 Ordinance No. 89-57 was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 89-159 authorizing purchase of two Vactor Model 810 C dual-engine, fan type truck mounted vacuum machines for cleaning catch basins, storm sewers and sanitary sewers, as part of the overall effort to improve drainage, from Industrial Disposal Supply Co. , at $124,202 each was approved on a motion made by Councilman Lee and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Mr. Riley announced that the proposed budget for Fiscal Year 1989-90 is complete and distributed to Council and will be scheduled for a formal presentation next Tuesday, August 15, 1989 and copies will be on file in the City Clerk' s office for review by interested parties. -000- Councilman Cokinos requested a status report of the Major Drive project from Highway 124 to Highway 105 . Staff responded that the original commitment to widen Major Drive was the section between College to Dishman, but expansion of the limits has been considered. New appraisals are being drawn to proceed with acquisition for right-of- way. Councilman Samuel asked Tom Warner, Public Works Director, to have someone prepare a report of progress on Spear Road which has been in disrepair for several weeks. He requested a time table for expected repairs so that he can report back to constituents. Councilman Smith announced that a very good program for "Sunday in the Park, " will be sponsored by American Darling Valve and the Melody Maids next Sunday. Mayor Meyers made a statement that if the Public Utility Commission sees fit to roll back their rate, that perhaps Council on behalf of rate payers, accept that roll back. Mayor Meyers proposed that Council consider regulation that sets out guidelines for newly constructed homes to be built above the elevation of drainage ditches and flood levels to insure these homes will not flood. Also, he cited seeing private contractors disposing of grass clippings and yard trash down the sewers, thus creating clogged basins restricting rain intake and creating an atmosphere for flooding when heavy rains occur. Mayor Meyers suggested formation and enforcement of a fine for this offense. Staff will research these two issues and report their findings and recommendation. -212- August 8, 1989 Mrs. Delia Harrington, 815 Willow, addressed Council in support of Mayor Meyers plan to initiate biennial elections and to complain of a water system leak on railroad property creating a constant puddle of water at Long and Grand. Dr. Bettye R. Smith, 3380 Worcester, addressed Council to again complain of high grass and litter (unwanted sofas and refrigerators, etc. ) on Warren Street near Worcester causing a breeding place for rats, roaches, spiders and snakes and creating an unsafe and unhealthy environment. Mr. Henry Dannenbaum, 1567 Wall, addressed Council on various subjects including adding his support of litter law enforcement. Mr. C. L. Sherman, 585 Belvedere Drive, addressed Council to point out that we have an ordinance in affect that regulates houses being built at a 23 foot level, but there are different flooding levels throughout the city, therefore, the same regulation cannot serve the entire city. -000- There being no further business, the regular City Council meeting was recessed for the City Council Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular City Council session held August 8, 1989.
