BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 4th day of April, 1989, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman-At-Large Andrew P. Cokinos Councilman-At-Large Lulu L. Smith Councilman, Ward I Michael Brumley Councilman, Ward II Audwin Samuel* Mayor Pro-Tem Councilman, Ward III David W. Moore Councilman, Ward IV Ray A. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend Kenneth Weatherford, Associate Pastor at Southside Assembly of God. The Pledge of Allegiance was led by Councilman Smith. -000- Mayor Meyers announced an Executive Session in accordance with Section 2(e) of the Open Meetings Act of the State of Texas to discuss pending or contemplative litigation following the regular session of City Council. -000- Colonel Thomas Long of the Texas State Guard' s 208th Military Police Battalion in Houston was introduced. Colonel Long solicited support in activating a Texas State Guard unit in Beaumont to train men for readiness in time of emergency and to volunteer as protection for special events involving large numbers of people. -000- As a result of the efforts of the Southend Community Uplift Program (S.C.U.P. ) , an Adopt-A-Lot program has evolved whereby citizens volunteer to keep property clean by cutting and edging grass and clearing litter and trash from the premises. Councilman Moore and Mayor Meyers signed an Adopt-A-Lot contract with Mr. Terry Jordan and Mr. C. J. Eisen of the Port of Beaumont to maintain the Port frontage area from Sabine Pass through Carroll Street and with Mr. Charlie Schmucker, representing Modern, Inc. , for the area at Divelleneuve and Irving Street. -80- April 4, 1989 *(Councilman Samuel arrived at Council at 1: 30 p.m. ) Lamar liaison to Council, Anthony Holmes, was congratulated for winning the seat as president of the Lamar Student Government Association, April 3, 1989. Anthony is a volunteer protege of Councilman Samuel and has been recognized as the first "Mayor for a Day" in Beaumont. -000- Three Proclamations were issued: "United States Coast Guard Chief Petty Officers Day, " April 7, 1989; "Love Lamar Week," April 3 through April 8, 1989; and "Academic Bowl Day, " April 5, 1989. Lamar University students presented Council with pencils, tee-shirts, bumper stickers, and pins with the "I Love Lamar -- Keeping the Spirit Alive" logo. Mayor Meyers stated that Lamar University and the student body is one of the greatest assets to Southeast Texas. -000- Citizen comment was invited on the Consent Agenda and the Main Agenda Items 2 through 4 . No one wished to address these items. -000- The following Consent Agenda Items were considered: Approval of the Minutes of the regular City Council session held March 28, 1989; Resolution No. 89-70 appointing Anita Wallace to the Library Commission to fill the unexpired term of Terry Charlton until October 31, 1989. Resolution No. 89-71 exempting unmarked Police Department vehicles from State law requirements for identification of vehicles and equipment owned by municipalities and county governments and authorizing the Finance Officer, Police Chief and Purchasing Manager to apply for special license plates for such vehicles; and Resolution No. 89-72 authorizing a License to Encroach on a 15-foot utility easement across the rear of property at 6085 Gladys to R. F. DuBois, Jr. to build a home workshop for a one-time fee of $500. 00. The Consent Agenda was approved on a motion made by Councilman Moore and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- A Public Hearing was called to consider an application for a specific use permit at 2206 West Cardinal Drive by Triangle Metallurgical, Inc. , of Granite City, Illinois, for establishment of a plant to be used for warehousing, processing and baling of non-ferrous scrap metal for off- site recycling (essentially a receiving plant for weekly shipment of materials to its recycling plant in Houston) . -81- April 4, 1989 Mr. Riley reported this item was scheduled to be heard on March 21, 1989 by the Planning Commission, but because there was not a quorum present no consideration was given this permit, but will be considered at the April 17th Planning Commission meeting with a subsequent recommendation to Council. Because of business commitments by the company, it is necessary for some determination for issuance of the specific use permit by Council. All property owners within 200 feet of the proposed business have been notified. Mr. Kirt Anderson, Planning Director, presented a Staff report explaining the location of the proposed plant is in a tract of land known as part of Tract 4, Block 12 of the Annie T. Warren Addition zoned General Commercial-Multiple Dwelling, owners of the property are Edson Realty Co. , the operation of the plant, hours of operation and number of employees, types of equipment, showed a slide presentation of the surrounding land uses, and stated the Planning Staff recommends approval of the request on the basis that the application is in compliance with the eight conditions necessary for a specific use permit. Mr. Ed Edson, 5615 Clinton, and Mr. Rick Suarez, Fairmont City, Illinois, manager of the proposed facility, addressed Council in support of issuance of the specific use permit. There being no one else to address Council, the Public Hearing was closed. Ordinance No. 89-18 authorizing a specific use permit for establishment of a plant for the warehousing, processing and baling of non-ferrous scrap metal for off-site recycling at 2206 West Cardinal Drive was considered: ORDINANCE NO. 89-18 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR ESTABLISHMENT OF PLANT FOR THE WAREHOUSING PROCESSING, AND BALING OF NON- FERROUS SCRAP METAL FOR OFF-SITE RECYCLING ON PROPERTY LOCATED AT 2206 WEST CARDINAL DRIVE, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 89-18 was approved on a motion made by Councilman Cokinos and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Resolution No. 89-73 authorizing a contract with H. B. Neild and Son, Inc. in the amount of $1, 694,000 for construction of the Tyrrell Historical Library Restoration Project (adjustments to be made to pare down the contract by about $50,000 in materials and deducting $30,000 from the $180,000 furnishings allowance to bring the cost within range of the original estimate) was approved on a motion made by Councilman Moore and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -82- April 4, 1989 Resolution No. 89-74 authorizing renewal of a lease contract with Allright Beaumont Co. for parking lot operation for a period of two years beginning April 1, 1989, with the City receiving 600 of the receipts from event parking on three lots in the downtown Municipal Complex (South City Hall parking lot, Library lot, and Art Museum lot) and 60% of receipts in excess of $1,600 from parking on the North Civic Center Parking Lot, an increase of 50, plus a base rental of $800 per month ( for the North lot) and requiring that any charge for parking in excess of $1. 50 be confirmed by the City was approved on a motion made by Councilman Lee and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 89-75 authorizing an annual contract from APAC-Texas for an estimated quantity of 2,500 tons of hot-mix asphaltic concrete for street maintenance at $22.00 per ton for an approximate total annual expenditure of $55, 000 was approved on a motion made by Councilman Brumley and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- Council commented on the success of the first "Sunday in the Park" for the 1989 season and the Mayor' s jokes. Councilman Lee announced that the next "Sunday in the Park" will have two hosts, Saint Elizabeth Hospital, a continuing sponsor of the event, and Friends of Sunday in the Park. An added attraction will be the presence of the tall ship Elissa. Councilman Cokinos congratulated Staff for an effective ceremony for the opening of the Emergency Shelter for the Homeless. Councilman Moore complimented Staff for the fishing rodeo at Alice Keith Park with Boys Haven and KAYD-97 participating and stated there was a great spirit of fun and acknowledged an excellent symphony presented by Cecelia Chaison, Keith Albright, and Jay Wadenpfuhl last week. Councilman Samuel congratulated Councilman Moore for receiving the Public Citizen of the Year Award by the Association of Social Workers. -000- Mr. Henry Dannenbaum, 1567 Wall, addressed Council on various subjects including his expression of appreciation to Councilman Moore for his leadership with S.C.U.P. and the improvement in the cleanliness of the Southend of Beaumont. -000- There being no further business, the regular City Council meeting was recessed to conduct an Executive Session. -83- April 4, 1989 I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular City Council session held April 4, 1989.
