BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 10th day of January, 1989, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman-At-Large Andrew P. Cokinos Councilman-At-Large Lulu L. Smith Councilman, Ward I Mike Brumley Councilman, Ward II Audwin Samuel Mayor Pro-Tem Councilman, Ward III David W. Moore Councilman, Ward IV Albert E. Haines City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend R. D. Carrington, Chairman of the Martin Luther King, Jr. Parkway Commission and pastor of Emmanuel Baptist Church. The Pledge of Allegiance was led by Councilman Lee. -000- Mayor Meyers recognized and introduced Mr. Butch Hoffer, his wife 2-2, his son Lewis and daughter-in-law Marcia who, along with other family members, attended the Rose Bowl in California where they displayed a computer printed banner announcing that "Everything' s Coming Up Roses in Beaumont, Texas. " Mayor Meyers thanked the Hoffers for remembering and being proud of their hometown. -000- A Proclamation was issued recognizing that the Martin Luther King, Jr. Parkway, Phase III , be dedicated toward the completion of the construction, aesthetic appearance and development of the parkway as a tribute to Dr. Martin Luther King, Jr. The Reverend R. D. Carrington, Chairman of the Martin Luther King, Jr. Parkway Commission accepted the Proclamation and introduced Commission Members Irene Ropas, Nancy Neild, Debra Burke, Claudia Deshotel, Beverly Hatcher and Dr. Bettye Smith (arrived late) who were also present. Reverend Carrington extended an invitation to the groundbreaking ceremonies and celebration on Sunday, January 15, 1989 at the Montagne Center at Lamar -5- January 10, 1988 University where Dr. John Q. Taylor King, chancellor and president emeritus of Houston-Tillotson College in Austin will be the guest speaker. Mayor Meyers announced that among other activities, there will be also be a parade honoring Dr. King on Saturday at 10: 00 a.m. starting at the Beaumont Civic Center. A Proclamation designating January 15, 1989 as "Dr. Martin Luther King, Jr. Day" in Beaumont was received by the Reverend Rayfield Walker who invited everyone to the 8th annual memorial service for Dr. King at the West Tabernacle Baptist Church at 4: 00 p.m. Sunday, January 15th, with State Representative Al Price as speaker. -000- Mayor Meyers announced that following the Council meeting there would be an Executive Session pursuant to Section 2(e) of the Texas Open Meetings Act, to discuss pending or contemplated litigation and Section 2(g) to consider the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee. -000- Citizen comment was invited on Agenda Items A through D. Mrs. Delia Harrington, 815 Willow Street, addressed Council opposing a general garbage discount for all senior citizens. -000 The following Consent Agenda item was considered: Approval of the Minutes of the Regular City Council session held January 3, 1989. The Consent Agenda was approved on a motion made by Councilman Samuel and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 89-6 endorsing an application Economic Development Administration Technical Assistance Program funds for a Regional Resource Recovery Feasibility Study, authorize City participation and appoint the City Manager or his designee as our representative on the Deep East Texas Resource and Recovery Advisory Committee was approved on a motion made by Councilman Lee and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- -6- January 10, 1989 Ordinances amending the regulations concerning garbage and trash rates for Senior Citizens were considered: The first ordinance for consideration was to amend Section 28-24. 1( 2) (c) to read: The "senior citizen discount rate" shall apply to customers residing in single-family residences who are sixty-five ( 65) years of age or older. To obtain the senior citizen discount rate, eligible persons must file a sworn application on a form provided therefor with the Central Collection Division. The senior citizen rate shall remain in effect so long as the customer residing in the single-family residence is sixty-five ( 65) years of age or older. The second ordinance considered for amending Section 28-24. 1( 2) (c) regarding the Senior Citizen discount with an annual income ceiling read: The "senior citizen discount rate" shall apply to customers residing in single-family residences who are over the age of sixty-five ( 65) years whose total annual income, when combined with the total annual income of all persons residing in the residence, does not exceed To obtain the senior citizen discount rate, eligible persons must file a sworn application on a form provided therefor with the Central Collections Division. The senior citizen discount rate will remain in effect until the income exceeds the amount stated above. After a lengthy discussion concerning the low income and moderate income median levels for a family of two, the impact of a senior discount discount on the sanitation fund, and various other questions, Ordinance No. 89-1 eliminating an income ceiling and providing a discount for all citizens sixty-five ( 65) years of age or older was considered: ORDINANCE NO. 89-1 ENTITLED AN ORDINANCE AMENDING THE REGULATIONS CONCERNING GARBAGE AND TRASH RATES FOR SENIOR CITIZENS; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. Ordinance No. 89-1 was approved on a motion made by Councilman Brumley and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 89-7 authorizing filing of an application for funds in the amount of $95,000. 00 with the Department of Housing and Urban Development for the Rental Rehabilitation Program was approved on a motion made by Councilman Moore and seconded by Councilman Smith. Question: Ayes: All Nayes: None -7- January 10, 1989 Cancellation of the Work Session to tour City facilities was announced. -000- Councilman Cokinos asked for the amount of salary increases for the Assistant City Manager positions and any other positions created by the reorganization. Councilman Moore also requested the amount of increases and the basis for the increases for the Assistant City Managers. -000- Mrs. Delia Harrington, 815 Willow Street, addressed Council to express her disappointment in the possibility of the resignation of Mr. Haines as City Manager and expressed her appreciation for his leadership as City Manager. Mr. Henry Dannenbaum, 1567 Wall Street, made a presentation to City Manager Albert E. Haines and expressed his appreciation to him. Mr. Tony Sacker, 4635 Elmherst Drive, addressed Council in support of selecting a new City Manager from among local residents. Mr. Robert E. Price, 965 Goodhue, addressed Council to complain about elimination of twice-a-week garbage pickup for weeks that involve holidays and suggested that the day after a holiday be substituted for pickup. -000- There being no further business, the regular City Council meeting was adjourned. -000- 2, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular City Council session held January 10, 1989.
