BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 22nd day of November, 1988, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman-At-Large Andrew P. Cokinos Councilman-At Large Mike Brumley Councilman, Ward II Audwin Samuel* Mayor Pro-Tem Councilman, Ward III David W. Moore Councilman, Ward IV Absent: Lulu L. Smith Councilman, Ward I Albert E. Haines City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk *arrived at 1: 23 p.m. -000- The Invocation was given by the Reverend Perry Busby, Borden Chapel Baptist Church. The Pledge of Allegiance was led by Councilman Moore. -000- Mayor Meyers announced and encouraged attendance at an Ecumenical Thanksgiving Service on Wednesday, November 23rd, 7: 00 p.m. at St. Andrew' s Presbyterian Church. -000- The Mayor and Council expressed best wishes to Dan Wallach, Beaumont Enterprise reporter covering City Hall, on his reassignment in another area of reporting and presented him a City of Beaumont lapel pin. -000- Anthony Holmes, liaison to Council from Lamar University, has been accepted to work in U. S. Congressman Leland' s office in Washington D.C. next summer. -000- -302- November 22, 1988 Citizen comment was invited on Agenda Items A and B-3 . No one wished to address these items. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held November 15, 1988; Resolution No. 88-253 releasing securities in the amount of $155,000 pledged as collateral for City deposits by Texas Commerce Bank of Beaumont ($75,000 in City of Houston bonds, $50,000 in Judson Independent School District bonds and $30, 000 in Livingston Independent School District) ; Resolution No. 88-254 appointing Rudy Minton, Becky Williams, and Dr. William Burke to the Clean Community Commission for terms expiring September 30, 1990; Resolution No. 88-255 accepting an eight-inch sanitary sewer line and easement on the west side of Interstate 10 south of College extending from a manhole at Blanchette Street southward for a distance of 1020 feet to the north side of the Cartwright Street ditch from the owners of the Jefferson Inn; and Resolution No. 88-256 authorizing release of a 20-foot wide easement located in the abandoned alley of Block 68 of the Van Wormer Addition within the right-of-way of the Martin Luther King, Jr. Parkway/Spur 380 project. The Consent Agenda was approved on a motion made by Councilman Moore and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Ordinance No. 88-95 amending a Specific Use Permit (requested by Scott and Pam Shelander) for immediate expansion of 2,700 square feet to the rear of a gymnastics training center at 7821 Gladys Avenue and future expansion to include an additional 5,000 feet in an area zoned (RM-H) Residential Multiple Family Dwelling-Highest Density was considered: ORDINANCE NO. 88-95 ENTITLED AN ORDINANCE ISSUING AN AMENDED SPECIFIC USE PERMIT TO ALLOW THE EXPANSION OF A GYMNASTICS TRAINING FACILITY ON PROPERTY LOCATED AT 7821 GLADYS AVENUE, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 88-95 was approved on a motion made by Councilman Lee and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -303- November 22, 1988 Ordinance No. 88-96 authorizing a Specific Use Permit (requested by Ohmstede, Inc. ) for an exemption from the building setback requirements at 690 Hazel Street, on the northeast corner of North Pearl and Hazel, in an area zoned H-I (Heavy Industrial) to construct a one-story office building (for the recently acquired C & D Machine and Engineering Co. , manufacturers of industrial robots) was considered: ORDINANCE NO. 88-96 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT ALLOWING THE REDUCTION OF THE REQUIRED YARD SETBACK FOR PROPERTY LOCATED AT 690 HAZEL AT NORTH PEARL, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 88-96 was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Ordinance No. 88-97 amending Chapter 28 of the Code of Ordinances including deletion of a provision requiring garbage collection on holidays, substituting a provision prohibiting City refuse collection service on official holidays, eliminating 4 ' x 4 ' x 4 ' bundling size requirements for tree limbs and branches, establishing a rate for automated containers used in providing commercial service, adding a provision requiring all refuse collected within the city limits to be disposed of at the City landfill, and revising and updating terminology and definitions to coincide with administrative staff reorganization was considered: ORDINANCE NO. 88-97 ENTITLED AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY ENACTING NEW REGULATIONS CONCERNING SOLID WASTE DISPOSAL AND FEES; PROVIDING FOR SEVERABILITY, PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No. 88-97 was approved on a motion made by Councilman Moore and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- Councilman Moore extended wishes for a safe trip to Mayor Meyers, Councilman Brumley and Councilman Smith to Beppu City, Japan and advised Chief Schuldt and Mrs. Dunkerley he was forwarding TEAMS information regarding grants packaging to them. Councilman Samuel related an opportunity to attend a Karate Championship and congratulated Mr. Conway for coordinating an excellent program. -304- November 22, 1988 Mayor Meyers gave an updated report on "Friendship 189, 1' the student exchange program with Russia. The student ambassadors will wear a patch with the symbols of the American and Russian flags. He reported the program presented in Washington D.C. was outstanding. Secretary of State Shultz invited the participants to the State Department where Soviet Ambassador Dubinin and sixteen ( 16) Russian mayors with ten ( 10) interpreters were present, and the importance of this meeting to the White House administration was emphasized. Beaumont was publicly commended at the Capital Hill Club for a letter previously sent reflecting community feelings regarding this opportunity for student exchange. Beaumont was cited as having the strongest expression and the preamble to the narrative was read at the luncheon. Next summer a minimum of ten ( 10) high school juniors from both public and private high schools in Beaumont will be selected to visit Russia for a student to student and student to family exchange. They will pay their own expenses or may be assisted by civic groups. Mayor Meyers had the opportunity to speak with the Ambassador regarding a potential exchange in the future. The Ambassador has requested Mayors Meyers correspond with him and submit information about Beaumont. -000- An Executive Session in accordance with Section 2(e) of the Texas Open Meetings Act to discuss pending or contemplated litigation following the Work Shop Session was announced. -000- Mrs. Beverly Hatcher, 890 Chatwood Drive, addressed Council to express delight in serving as Volunteer Chairman for the Ethnic Heritage Festival and thanked Council and City personnel for their support and assistance. Councilmembers individually thanked Mrs. Hatcher and all other volunteers for their labor of love in providing a great weekend of entertainment and better understanding of our ethnic culture. Mr. Henry Dannenbaum, 1567 Wall Street, announced the Singing Christmas Tree will be at First Baptist Church, December 16-18, 1988, at 7 :00 p.m. , thanked Chief Schuldt and Chief Shelton for allowing him to work with them, solicited donations for McBride Halfway House, and extended holiday greetings to Council. -000- There being no further business, the Regular City Council meeting was recessed to conduct the Workshop session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular City Council session held November 22, 1988 .
