BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 12th day of July, 1988 with the following present: HONORABLE: Maurice Meyers Mayor* Bob Lee, Jr. , Councilman At Large Andrew P. Cokinos Councilman At Large Lulu L. Smith Councilman, Ward I Mike Brumley Councilman, Ward II Audwin Samuel Mayor Pro-Tem Councilman, Ward III David W. Moore Councilman, Ward IV Albert E. Haines City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk *Mayor Meyers arrived at 1: 45 p.m. during discussion of Agenda Item C-2. -000- The Invocation was given by the Reverend A. L. Tibbs, Starlight Missionary Baptist Church. The Pledge of Allegiance was led by Councilman Cokinos. -000- Mayor Pro-Tem Samuel announced that the next Town Meeting for the City of Beaumont will be hosted by Reverend Tibbs at Starlight Missionary Baptist Church on August 30, 1988. -000- Mayor Pro-Tern Samuel called an Executive Session in accordance with Section 2(g) of the Open Meetings Act of the State of Texas to discuss appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public office or employee following the Workshop Session. -000- MAYOR PRO-TEM SAMUEL: It is with extreme pleasure that we take this opportunity to recognize some of those individuals that serve our community, sometime behind the scene, but they truly serve it with - all their heart. On June the 18th of 1988, Downtown Beaumont marked the revitalization of a traditional holiday for the residents of Beaumont and particularly the Black residents in Beaumont. -184- July 12, 1988 This was the Juneteenth Kickoff, and they had many of the activities Downtown. It was a collective effort of many volunteers and with the conjunction of our Recreational Department. And at this time I would like to present a plaque to two of Co-Sponsors of this activity, and I would ask that Mr. Jesse Samuels and Mr. Richard Carroll please come forward, and the plaque reads, "In recognition of your service to the community the Mayor and the City Council of Beaumont, Texas. KISS-98 Juneteenth, 1988. " We thank you very much, Doc, (Richard Carroll) you've done a great deal of work in the community, not only in this project, but in many others. This is a small way we say thank-you, but we truly mean it from our heart. Thank you Mr. Samuels, I appreciate it. Mr. Carroll presented a "Fitness Official Juneteenth Tee-shirt" to each member of Council, the City Attorney and City Manager from KISS-98fm for their support and on-going cooperation. Mr. Jesse Samuels, host of the Sunrise Morning Gospel Caravan from 6: 00 a.m. to 10:00 p.m. on KALO-1250 am also presented tee-shirts to Council, the City Attorney and City Manager bearing the KALO logo. Even though a representative from Gideon Distributing Company was unable to attend Council, Mayor Pro-Tem Samuel presented a plaque in recognition of their support during the Juneteenth celebration. Mayor Pro-Tem Samuel expressed special appreciation to Gerald Ulmer of the Convention Facilities Department who worked tireless hours in assisting with the Juneteenth activities. -000- Public comment was invited on Agenda Items A through C. Mr. Gerald Buckley, 5755 Mel Sha Lane, addressed Council in support and appreciation of Councils' opposing a proposed landfill by Browning-Ferris, Inc. as indicated on Agenda Item B-1, and announced that '"NIBTD" (NOT IN BETWEEN TWO DUMPS) Coalition will appear in a large number before Council at a later date to show appreciation for this action. -000- The following Consent Agenda items were considered: Approval of the Minutes of the Regular City Council Session held July 5, 1988; and Resolution No. 88-145 authorizing approval of a waiver of penalty and interest for taxes on Accounts 048600-024820 and 035650-00750 which became delinquent through errors which were not the fault of the property owners, as provided by Section 33.011 of the State Property Tax Code. The Consent Agenda was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -185- July 12, 1988 Resolution No. 88-146 acknowledging a contact by Browning Ferris Industries indicating intent to submit an application to the Texas Department of Health for a Type I municipal landfill permit for a proposed location approximately one-half ( 1/2) mile - south of the southern city limits on LaBelle Road which is near Tyrrell Park and within the extra-territorial jurisdiction of Beaumont, and realizing LaBelle Road and Frint Road are not presently constructed to handle the additional heavy truck traffic, this resolution formally opposing a Type I municipal landfill as proposed by Browning Ferris Industries was approved on a motion made by Councilman Lee and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution No. 88-147 approving purchase of 10 automated refuse collection trucks for the new automated garbage system from Smart' s Truck and Trailer Equipment, Inc. at the low bid of $96,443 .88 per truck for a total cost of $964,438. 80 with an option to purchase one (1) additional truck within ninety ( 90) days was considered. After discussion regarding the amount of the Certificates of Obligation to cover payment of the containers and trucks for collection, the safe limits of indebtedness for the City to incur in Certificates of obligation ($2. 50 per $100 evaluation) , and number of Certificates of obligation issued this year, Councilman Cokinos stated he would abstain from voting on this item because of his standing opposition to the implementation of the automated garbage collection system. (Mayor Meyers arrived at the Council meeting at 1: 45 p.m. ) Resolution No. 88-147 was approved on a motion made by Councilman Moore and seconded by Councilman Lee. Question: Ayes: Mayor Meyers Nayes: None Mayor Pro-Tem Samuel Councilman Lee Councilman Brumley Councilman Smith Councilman Moore Abstention: Councilman Cokinos -000- Resolution No. 88-148 authorizing annual contracts with Beeco Sand Co. for furnishing cement stabilized sand, 1 1/2-sack cement mixture at $7.34 per ton and T-Mix Materials for furnishing 2-sack cement mixture at $10. 30 per ton for use by the Water Utilities Department and Public Works Department was approved on a motion made by Councilman Brumley and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- -186- July 12, 1988 Resolution No. 88-149 authorizing annual contracts for chemicals for the Water Treatment Plant from five suppliers at an estimated total expenditure of $158,830 for the twelve month period (copper sulfate from Thompson- Hayward Chemical Co. at $.57/lb. , -aluminum sulfate from Stauffer Chemical Company at $97.99/ton, fluosilic acid from Thompson-Hayward Chemical Co. at $134.00/ton, aqua ammonia from Van Waters & Rogers, Inc. at $140. 00/ton, zinc metaphosphate from Technical Products Corporation at $ . 65/lb. , and liquid chlorine from Jones Chemicals, Inc. at $390.00/ton) was approved on a motion made by Councilman Brumley and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Councilman Lee complimented the front-page news coverage of "Sunday in the Park" hosted by City employees using the theme "Texas Proud" with Councilman Samuel dressed in authentic cowboy attire reading Pecos Bill to the children and other activities including a shoot-out at Okay Corral, a water gun fight, and armadillo race. Next Sunday will be hosted by Parent Outreach and Councilman Moore will be the reader. Councilman Brumley announced that the next "Concert on the Move" will be on Thursday, July 21, 1988 at Klein Park with Rusty Wier performing. Councilman Smith announced there will be a workshop on Thursday, July 14, 1988 at the Career Center beginning at 6: 30 p.m. for Old Town merchants and invited Council to attend. Mayor Pro-Tem Samuel asked that City staff evaluate validation of health papers of horses going between the park and stable and the liability involved in the event of an injury caused by a horse. -000- Mr. Henry Dannenbaum, 1567 Wall, addressed Council regarding curfew, bicycles being operated without lights after dark, mandatory clothing or reflectors for bicycle riders to avoid accidents, and asked that a grant not be given to New Jerusalem Mission for development in any residential area. Mr. Jim Goodman, Route 2, Box 461, Silsbee, Texas, addressed Council regarding an accident between a City employee and the vehicle which his wife was driving in the 3800 block of Washington Boulevard on May 27, 1988 shortly before 1:00 p.m. A piece of equipment was dropped from the City vehicle striking Mrs. Goodman' s car causing $714. 00. The driver received a Police Citation for an insecure load. The Goodmans have received notification from the Risk Management Department stating the investigation is complete and the City of Beaumont cannot be held legally responsible for the accident. Mr. Goodman stated that he and his wife have reviewed the problem with Mayor Meyers and Mr. Tyrone Cooper and is addressing Council today as a matter of record and requesting assistance in expediting legal ramifications in paying for the damages to the car. -000- -187- July 12, 1988 There being no further business, the meeting was recessed before continuing with the City Council Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held July 12, 1988.
