BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 3rd day of May, 1988, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman At Large Andrew P. Haines City Manager Lane Nichols City Attorney Barbara Liming Deputy City Clerk -000- The Invocation was given by Councilman David W. Moore. The Pledge of Allegiance was led by Mayor Maurice Meyers. -000- As one of the continuing sponsors of "Sunday in the Park" for 1988, Sister Fatima of St. Elizabeth Hospital was presented by Councilman Lee a framed copy of the winning poster depicting "Sunday in the Park" drawn by Shelly Steffek, a 10-year old student at St. Anne' s Catholic School, with a plaque inscribed "In appreciation for your contribution to the success of "Sunday in the Park" - St. Elizabeth Hospital, 1988. Sister Fatima expressed it was "a pleasure to be part of such a worthwhile event. " Councilman Lee read a memo relating the story of a "Sunday in the Park" that had been video taped by the Recreation Division in which a little boy from the community read the Three Little Pigs. The mother of the child obtained a copy of the tape for grandparents in England who had not seen the little boy since he was 18 months old and never seen his younger sister who was also featured on the video. England now shares our "Sunday in the Park" events! -000- Several Proclamations were issued: "Toastmaster International Month, " May, 1988; "Nursing Home Week, " (3) May 8-15, 1988; "Nurses Day, " Friday, May 6, 1988; "National Teacher's Day," Tuesday, May 3,. 1988; "Better Hearing and Speech Month, " May, 1988; and "National Day of Prayer, " Thursday, May 5, 1988; -120- May 3, 1988 Mr. Jerry Chandler, representing the Lindbergh Health Care Center and the College Street Nursing Center, introduced "Ms. Golden Triangle Nursing Home for 1987," Petra Suarez. Mr. Chandler presented the first annual Dove Award (representing peace and love) to Mayor Meyers for his interest and support of older citizens. Council was presented a plaque of appreciation to be hung at City Hall. The second Dove Award was presented to a community member who has promoted good public relations with nursing homes, informed the community of the services of nursing homes and helped dispell the myth that there is no quality life remaining for nursing home residents to Mr. Chris Bishop from Channel 12. -000- Citizen comment was invited on Agenda Items A, B, and C. No one wished to address Council on these items. -000- The following Consent Agenda item was considered: Approval of the Minutes of the Regular City Council Session held April 26, 1988. The Consent Agenda was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- MR. HAINES• Item B-1 preceding the recommendation for action that Council will require a public hearing concerning the Mass Transit Grant applications. The hearing has been scheduled for the meeting for consideration of the proposed Program of Projects for the Beaumont Transit System including applications for Capital and Operating Assistance Grants under the Mass Transportation Act of 1964 as amended. After the hearing, Council will be asked to approve a resolution approving the Program of Projects and authorizing the City Manager to file the applications with the Urban Mass Transportation Administration and execute the documents related to the applications. The program would include an application for Capital Grants in the amount of $192,000 to finance 80% of the cost of three (3) vans equipped with wheelchair lifts, replacement for service vehicles, and purchase of equipment for the office and repair shop. The Operating Assistance Grant application would be for $600,000 to finance 50% of the anticipated net cost of operating the Transit System during the fiscal year from next October 1st, 1988 through September 30, 1989. Net cost is the excess of expenses over operating revenues. We advise Council that the Transit Advisory Committee has recommended approval of the Program of Projects and those grant applications. At this time, Mayor, I would turn it to you to open a Public Hearing. -121- May 3, 1988 MAYOR MEYERS: Thank you very much. I would now declare a Public Hearing open for consideration of the City' s application for Transit Capital and Operating Assistance Grants and would offer the open microphone to anybody caring to comment during this Public Hearing portion. (No response from citizens or Councilmembers. ) Do you care to move through any of the other items while the Public Hearing is open? MR. HAINES• I wouldn' t plan on it, unless there are questions. MAYOR MEYERS• Very well, then, if there are no questions, we would close the Public Hearing portion, and let you pick it back up, Al. -000- Resolution No. 88-97 authorizing filing an application with the Department of Transportation and the Texas State Department of Highways and Public Transportation for a grant under the Urban Mass Transportation Act of 1964, as amended, for an operating assistance grant for the transit system and file an application of assurance as and other documents as required by the U. S. Department of Transportation effectuating the purposes of Title VI of the Civil Rights Act of 1964, and authorizing the City Manager to set forth and execute affirmative disadvantaged and women-owned business policies in connection with the project' s procurement needs was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Ordinance No. 88-41 abandoning a 61 . 11-foot-wide section of unimproved Trinity Street right-of-way extending in a southeasterly direction from Crockett Street, between Jefferson and Neches, to an intersection with a strip of unnamed, unimproved street right-of-way as requested by the Stedman Building Partnership was considered: ORDINANCE NO. 88-41 ENTITLED AN ORDINANCE VACATING AND ABANDONING TRINITY STREET RIGHT-OF-WAY LOCATED BETWEEN CROCKETT AND BOWIE STREETS, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 88-41 was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -122- May 3, 1988 Ordinance No. 88-42 abandoning a 20-foot-wide alley in Block 28, Van Wormer Addition, extending southwesterly from Neches Street between Crockett and Bowie as requested by the Stedman Building Partnership was considered: ORDINANCE NO. 88-42 ENTITLED AN ORDINANCE VACATING AND ABANDONING THE ALLEY LYING IN BLOCK 18, VAN WORMER ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 88-42 was approved on a motion made by Councilman Lee and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Ordinance No. 88-43 abandoning a 12. 5-foot-wide alley in Block 9, McMillan Addition, extending northeasterly from Jefferson between Crockett and Bowie as requested by the Stedman Building Partnership was considered: ORDINANCE NO. 88-43 ENTITLED AN ORDINANCE VACATING AND ABANDONING A 12. 5-FOOT WIDE, IRREGULAR SHAPED ALLEY RIGHT-OF-WAY LOCATED NORTH OF AND ADJACENT TO LOTS 5, 6, 7 AND 8, BLOCK 9, MCMILLAN ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 88-43 was approved on a motion made by Councilman Lee and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Ordinance No. 88-44 abandoning a 61. 11-foot-wide section of unnamed, unimproved street right of way extending northwesterly from Jefferson Street to Bowie Street west of Neches as requested by the Stedman Building Partnership was considered: ORDINANCE NO. 88-44 ENTITLED AN ORDINANCE VACATING AND ABANDONING THE UNNAMED STREET RIGHT-OF-WAY WHICH EXTENDS IN A NORTH-EASTERLY DIRECTION FROM JEFFERSON STREET, BEING BOUND ON THE NORTH BY BLOCKS 18 AND 19, VAN WORMER ADDITION AND BOUNDED ON THE SOUTH BY BLOCK 9, MCMILLAN ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 88-44 was approved on a motion made by Councilman Lee and seconded by Councilman Smith. Question: Ayes: All Nayes: None -123- May 3 , 1988 Ordinance No. 88-45 abandoning a 20-foot-wide utility easement in Block 17, Van Wormer Addition extending southwesterly from Park between Crockett and Bowie Streets was considered: ORDINANCE NO. 88-45 ENTITLED AN ORDINANCE VACATING AND ABANDONING THE 20 ' X 300 ' GENERAL UTILITY EASEMENT LOCATED IN THE ABANDONED ALLEY OF BLOCK 17, VAN WORMER ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 88-45 was approved on a motion made by Councilman Lee and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 88-98 authorizing an addendum to the License Agreement with A T & T for use of city right-of-way for installation of an additional 4,746 linear feet of cable as Route Two of a fiber optic communication system at a fee of $500 plus $ .60 per linear foot per year through 1991 with expected payments of $10,000 for inspection, engineering, and other costs was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 88-99 authorizing an annual contract to furnish ready mix concrete to be used chiefly for street repair with American Builder' s Concrete of Beaumont for 5 sack ready mix at $50. 30 per cubic yard, add or deduct per sack $2.20, and Type III High Early at $52. 90 per cubic yard was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 88-100 authorizing an annual contract for purchase of hot mix cold laid asphaltic concrete to be used chiefly for pothole patching from Apac-Texas at $26. 00 per ton loaded on City trucks at the vendor' s plant was approved on a motion made by Councilman Brumley and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Councilman Smith commented about the Open House for Central High and the Career Center and is impressed with the upgrading of the physical plant and neighborhood and asked Public Works Director Tom Warner to check the potholes on Plant Road for possible patching. -124- May 3 , 1988 r Councilman Moore congratulated City Staff for their presentation of the Fair Housing Seminar, admonished everyone to vote in the election this weekend, announced that the Social Civic Club will be working on a cleanup project at Hebert Cemetery, thanked Wayne Sherman for his participation and promotion of the "Adopt-A-Cop" program and stated that he will be a participant in a fund raiser sponsored by Baptist Hospital for the program by being in the dunking booth. Councilman Cokinos congratulated Councilman Moore for retaining his title in consuming the most hot tamales at last Sunday' s Cinco de Mayo celebration and the Sherman brothers for their "Adopt-A-Cop" promotion, and announced that $84,560. 08 has been received to date for the Hulsey children trust fund. Councilman Lee announced that the next "Sunday in the Park" will be hosted by Lamar' s Early Childhood Development Center. Councilman Brumley announced that through the efforts of Mr. Pete Plotts and Lamar University, there will be a Summer Youth Employment Program that will employ 68 young people. Mr. Plotts engineered a grant through Regional Planning to be administered by Lamar University to provide summer jobs for youth between the ages of 14 and 20 and especially targeted for those living in Federal Housing Projects. -000- Mr. C. L. Sherman, 585 Belvedere Drive, addressed Council to announce that he received a check in the amount of $1,200 from the Kiwanis Club for the "Adopt-A-Cop" project who is challenging all other civic clubs to respond to the cause. Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council on various subjects and made a contribution to Councilman Cokinos for the Hulsey children and to Wayne Sherman for the "Adopt-A-Cop" project. Mrs. Maree Calcote, 5615 Duff Street, addressed Council as a member of the Clean Community Commission to announce they had made their official 22- page entry into the Governor' s Community Achievement Award for 1988. The estimated number of volunteer hours dedicated to cleanup in Beaumont is over 21,000 hours this past year. Ms. Carla Kirk, 5680 Concord, a student at Lamar University addressed Council regarding a study completed by a class at Lamar that suggests a need from their research that a day center for the homeless is needed and asked that the $250,000 to be received from a grant for the renovation of one of the fire stations be used for this need. Mayor Meyers asked Ms. Kirk to make an appointment with Mr. Haines or Miss Sherrell Cockrell to discuss the class findings and the City' s program. Mr. Forrest "Ted" Posey, 3695 Edmonds, addressed Council regarding nursing home visitation, Summit 1 and 1 progress, and invited Council to a tree- planting memorial service for Mrs. Alzie Swearingen on May 12, 1988. -125- May 3, 1988 There being no further business, the meeting was recessed for ten minutes before continuing the Work Session. -000- 2, Barbara Liming, Deputy City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the minutes of the regular City Council session held May 3, 1988.
